िोसस, िडोदरा – 390007, भारत में वथित है, िे ट्ांसवमशि योजिा “खािडा, गुजरात में अपिे 3325 मेगािाट आरई पािस
िे विए मेससस गुजरात राज्य विद्युत विगम विवमटेड िो ििेवटटविटी प्रदाि िरिे िे विए ट्ांसवमशि प्रणािी” िे तहत
ओिरहेड ट्ांसवमशि िाइि वबछािे िे विए विद्युत अविवियम, 2003 िी िारा 164 िे अंतगसत प्रावििृत िरिे हेतु आिेदि
किया है।
और जबकि, विद्युत मंत्रािय, भारत सरिार िे अपिे पत्र सं. 25-17/15/2024-PG कदिांकित 04.03.2024 िे
द्वारा ट्ांसवमशि योजिा “खािडा, गुजरात में अपिे 3325 मेगािाट आरई पािस िे विए मेससस गुजरात राज्य विद्युत विगम
विवमटेड िो ििेवटटविटी प्रदाि िरिे िे विए ट्ांसवमशि प्रणािी” िे अंतगसत आिे िािी ओिरहेड ट्ांसवमशि िाइिों िे विए
विद्युत अविवियम िी िारा 68(1) िे अंतगसत पूिस अिुमोदि प्रदाि किया िा।

तारीख से 2 महीिे िे भीतर आम जिता िी टटप्पवणयों / अभ्यािेदि िी मांग िरते हुए िोटटस प्रिावशत किया िा। इसिे
पश्चात, मैससस गुजरात राज्य विद्युत विगम विवमटेड िे कदिांि 25.03.2026 िो एि हिफिामा प्रथतुत किया है, वजसमें
घोषणा िी गई है कि भारत सरिार िे आवििाटरि राजपत्र एिं थिािीय समाचार पत्रों में प्रिाशि िी तारीख से 2 महीिे
िे भीतर िोई टटप्पणी / अभ्यािेदि प्राप्त िहीं हुआ िा।
मैससस गुजरात राज्य विद्युत विगम विवमटेड िे कदिांि 25.03.2026 िो एि िचि पत्र प्रथतुत किया है, वजसमें यह
उल्िेख किया गया है कि प्रथतावित ओिरहेड ट्ांसवमशि िाइि(िो) िा मागस राजथिाि िे संशोवित ग्रेट इंवडयि बथटडस (GIB)
प्रािवमिता क्षेत्र िे बाहर वथित है, जैसा कि टरट यावचिा (वसविि) संख्या 838/2019 िे कदिांि 19.12.2025 िे आदेश
में संदर्भसत है। आिेदि िे यह भी िचि कदया है कि िह उक्त विणसय में विवहत माििीय सिोच्च न्यायािय िे सभी विदेशों तिा
उक्त आदेश िे अिुपािि में सक्षम प्रावििारी द्वारा भविष्य में जारी किए जािे िािे किसी भी विदेश िा पूणसतः पािि िरेगी।
साि ही, आिेदि िे यह भी बताया गया है कि ट्ांसवमशि िाइि िा संरेखण इस प्रिार बेहतर बिाया गया है कि जहााँ ति
संभि हो, िे अविितम साझा मागस िा उपयोग िरें।
और अब आिेदि िे विद्युत अविवियम, 2003 िी िारा 164 िे अंतगसत “खािडा, गुजरात में अपिे 3325 मेगािाट
आरई पािस िे विए मेससस गुजरात राज्य विद्युत विगम विवमटेड िो ििेवटटविटी प्रदाि िरिे िे विए ट्ांसवमशि प्रणािी” िे
तहत ट्ांसवमशि िाइि वबछािे िे विए उसे िे सभी शवक्तयां प्रदाि िरिे िा अिुरोि किया है, जो भारतीय टेिीग्राफ
अविवियम, 1885 िे तहत टेिीग्राफ िे प्रयोजि िे विए सरिार द्वारा थिावपत अििा अिुरवक्षत किये गए टेिीग्राफ िाइि
एिं खम्भे या इस प्रिार िी थिापिा और अिुरक्षण किये जािे िे विए, टेिीग्राफ प्रावििरण िो प्राप्त हैं। योजिा िे अंतगसत
विम्नविवखत ओिरहेड ट्ांसवमशि िाइि हैं:
1. जीएसईसीएि पीएस 2 (उत्तर) (खािडा आरई पािस, गुजरात में वथित)- खािडा-II पीएस (सेि-ll) 400 िेिी
एस/सी िाइि
उपरोक्त योजिा िे अंतगसत ओिरहेड ट्ांसवमशि िाइि गुजरात िे विम् िांकित गााँिों, िथबों और शहरों से होिर, उि पर से,
उििे आसपास से और बीच से होिर गुज़रेगी:

अब, साििािीपूिसि विचार िरिे िे पश्चात, विद्युत मंत्रािय, भारत सरिार, विद्युत अविवियम, 2003 िी िारा
164 िे तहत, मैससस गुजरात राज्य विद्युत विगम विवमटेड िो उपरोक्त ओिरहेड ट्ांसवमशि िाइि िो िगािे िे विए िे सभी
शवक्तयां विम्नविवखत विबंििों एिं शतों िे साि प्रदाि िरता है, जो भारतीय टेिीग्राफ अविवियम, 1885 िे तहत टेिीग्राफ
िे प्रयोजि िे विए सरिार द्वारा थिावपत अििा अिुरवक्षत किये गए टेिीग्राफ िाइि एिं खम्भे या इस प्रिार िी थिापिा
और अिुरक्षण किये जािे िे विए, टेिीग्राफ प्रावििरण िो प्राप्त हैं-
i.
यह अिुमोदि 25 िषों िे विए प्रदाि किया जाता है।
ii.
आिेदि िो प्रथतावित िाइि िी थिापिा से पूिस संबंवित प्रावििरणों अिासत् थिािीय वििायों, रेििे, राष्ट्रीय
राजमागस, राज्य राजमागस आकद िी सहमवत प्राप्त िरिी होगी।
iii.
आिेदि िो विद्युत अविवियम, 2003 िे तहत समुवचत आयोग िे द्वारा तैयार किए गए ट्ांसवमशि, ओ एंड एम,
ओपि एटसेस आकद िे विवियमों/संवहताओं िा पािि िरिा होगा।

iv.
आिेदि िेंद्र सरिार िे विद्युत विरीक्षि/मुख्य विद्युत विरीक्षि िे अिुमोदि िे पश्चात ही िाइि िा प्रचािि िरेगा।
v.
यह अिुमोदि आिेदि द्वारा विद्युत अविवियम, 2003 िे प्राििािों और उसिे तहत बिाए गए वियमों िी अपेक्षाओं
िा अिुपािि किए जािे िे अध्यिीि है।
vi.
मैससस गुजरात राज्य विद्युत विगम विवमटेड िो विद्युत विरीक्षण िे समय विमािि एिं रक्षा प्रावििरणों इत्याकद,
से अपेवक्षत अिुमवत िो प्राप्त िरिे िे बाद, इसे िेंद्रीय विद्युत प्रावििरण िो विद्युत विरीक्षण िे समय प्रथतुत िरिा
होगा।
vii.
यकद, उपरोक्त ओिरहेड िाइिों िा मागस (या उपरोक्त ओिरहेड िाइि िे मागस िा िुछ भाग) संशोवित ग्रेट इंवडयि
बथटडस (जीआईबी) क्षेत्र में आता है, तो आिेदि िो भारत िे माििीय सिोच्च न्यायािय िे टरट यावचिा (वसविि)
संख्या 838/2019 िे कदिांि 19.12.2025 िे आदेश और माििीय सिोच्च न्यायािय िे उपरोक्त आदेश िे अिुसरण
में सक्षम प्रावििाटरयों द्वारा कदए गए किसी भी अन्य विदेश िा पािि िरिा होगा।

ORDER
New Delhi, the 29th September, 2026
S.O. 5413(E).— Whereas M/s Gujarat State Electricity Corporation Limited having its registered address
Vidyut Bhavan, Race course, Vadodara – 390007, India, has applied for authorization under Section 164 of the
Electricity Act, 2003 for laying of overhead transmission line under the transmission scheme “Transmission system for
Providing connectivity to M/s Gujarat State Electricity Corporation Limited for its 3325 MW RE Park in Khavda,
Gujarat”.
And whereas, Ministry of Power, Government of India vide its letter No. 25-17/15/2024-PG dated 04.03.2024
had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under the
transmission scheme “Transmission system for Providing connectivity to M/s Gujarat State Electricity Corporation
Limited for its 3325 MW RE Park in Khavda, Gujarat”.
M/s Gujarat State Electricity Corporation Limited had published notice for transmission scheme in local
newspapers Times of India (in English) dated 17.05.2024, Rajasthan Patrika (in Hindi) dated 17.05.2024, Kutch Mitra
(in Gujarati) dated 17.05.2024 and in Weekly Gazette of India dated 17.08.2024 for the general public to make
observations/representations on the proposed transmission route within 2 Months from the date of publication.
Subsequently, M/s Gujarat State Electricity Corporation Limited has submitted an affidavit dated 25.03.2026 declaring
that no observation/representation was received within 2 Months from the date of Publication in the official gazette of
Government of India and newspaper publications.
M/s Gujarat State Electricity Corporation Limited had submitted an Undertaking dated 25.03.2026 stating that
the route of the proposed overhead transmission line(s) is located outside the Revised Great Indian Bustard (GIB)
Priority Area of Rajasthan and Gujarat, as referred to in the judgment of the Hon’ble Supreme Court of India dated
19.12.2025 in Writ Petition (Civil) No. 838 of 2019; the applicant has further undertaken to comply with all directions
of the Hon’ble Supreme Court as contained in the said judgment as well as with any subsequent directions issued by the
competent authorities in pursuance of the above order by the Hon’ble Supreme Court, and has also stated that the
transmission line alignment has been optimized, in such a way that they share maximum common stretch to the extent
possible.
And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity
Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of
telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established
or maintained for laying of electric lines under the transmission scheme “Transmission system for Providing
connectivity to M/s Gujarat State Electricity Corporation Limited for its 3325 MW RE Park in Khavda, Gujarat”. The
following overhead line is covered under this scheme:
1. GSECL PS2 (North) (located in Khavda RE Park, Gujarat) - Khavda-II PS (Sec-ll) 400 kV S/c line.

The transmission line covered under the above scheme will pass through, over, around and between the following
villages, towns and cities of Gujarat:

Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity
Act, 2003, confers all the powers to M/s Gujarat State Electricity Corporation Limited for laying above overhead line,
which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and
posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject
to following terms and conditions for installing the above mentioned line, namely:
i.
The approval is granted for 25 years.
ii.
The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National
Highways, State Highways etc. before erection of proposed line.
iii.
The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission,
O&M, open access, etc., framed under Electricity Act, 2003.
iv.
The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central
Government.
v.
The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the
rules made there under by the applicant.
vi.
M/s Gujarat State Electricity Corporation Limited shall have to submit the requisite clearances to Central
Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at
the time of Electrical Inspection.
vii.
In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the
Revised Great Indian Bustard (GIB) area, the applicant has to comply with the directions of Hon'ble Supreme
Court of India in its order dated 19.12.2025 in Writ Petition (Civil) No. 838 of 2019 and any other directions
given by competent authorities in pursuance of the above order by Hon’ble Supreme Court.
