का.जन.आ. 57(अ).— रक्षा संकमम अजधजनयम, 1903 (1903 का 7) की धारा 3 के अधीन संख्या का.जन.आ. - 49

तारीख 23 जसतंबर, 2010 द्वारा अजधसूचना िारी की गई थी, जिससे महाराष्ट्र राज्य के नागपुर जिले में रक्षा अनुसंधान एवं

जवकास संगठन, पररयोिना स्ट्थल बोरखेडी के आसपास जस्ट्थत अनुसूची में वर्णमत भूजम के उपयोग और उपभोग पर उक्त

अजधजनयम की धारा 7 के खंड (ग) में जवजनर्िमष्ट जनबंधनो^ोँ का अजधरोपण दकया िा सके;

और माननीय उच्च न्यायालय बंबई की नागपुर पीठ द्वारा डब्लल्यू.पी. संख्या 2324/2023 में तथा डब्लल्यू.पी. संख्या

2435/2023 में का.जन.आ. 49, तारीख 23 जसतंबर, 2010 को तारीख 30 माचम, 2026 के अपने आिेि द्वारा अजभखंजडत

कर दिया गया है;

और माननीय उच्च न्यायालय बंबई की नागपुर पीठ ने उपयुमक्त आिेि द्वारा केंद्रीय सरकार को रक्षा संकमम अजधजनयम,

1903 की धारा 3 के अधीन एक नई अजधसूचना प्रकाजित करने की स्ट्वतंत्रता प्रिान की है;

अतः, अब, केन्द्रीय सरकार, रक्षा संकमम अजधजनयम, 1903 की धारा 3 द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह

घोषणा करती है दक महाराष्ट्र राज्य के नागपुर जिले में रक्षा अनुसंधान एवं जवकास संगठन, पररयोिना स्ट्थल बोरखेडी के

आसपास जस्ट्थत अनुसूची में वर्णमत भूजम के उपयोग और उपभोग पर उक्त अजधजनयम की धारा 7 के खंड (ग) में यथा जवजनर्िमष्ट

जनबंधन िो पहले से जवद्यमान है, का अजधरोपण िारी रखना आव‍यक है, तादक उक्त भूजम को भवनों तथा अन्य बाधाओं से

मुक्त रखा िा सके।

2. उक्त जनबंधन रािपत्र में इस अजधसूचना के प्रकािन की तारीख से प्रवृत होंगे।

3. उक्त भूजम का मानजचत्र जिला कलेक्टर, नागपुर, महाराष्ट्र के कायामलय में जनरीक्षण के जलए उपलब्लध है।

रक्षा अनुसंधान एवं जवकास संगठन, पररयोिना स्ट्थल बोरखेडी, जिला नागपुर, महाराष्ट्र राज्य की चारिीवारी की

बाहरी पररजध की सबसे ऊपरी सीमा से एक सौ मीटर की िूरी के भीतर जस्ट्थत क्षेत्र में आने वाली समस्ट्त भूजम।

MINISTRY OF DEFENCE

NOTIFICATION

New Delhi, the 6th October, 2026

S.R.O. 57(E)— Whereas, the notification was issued under section 3 of the Works of Defence Act, 1903

(7 of 1903), vide number S. R.O. 49, dated 23^rd September, 2010 to impose restrictions specified in clause (c)of section

7 of the said Act, upon the use and enjoyment of the land described in the Schedule herein, being land lying in the

vicinity of Defence Research and Development Organisation, Project Site Borkhedi, District Nagpur, in State of

Maharashtra;

And whereas, the S.R.O. 49, dated 23^rd September, 2010 has been quashed by the Hon’ble High Court of

Bombay at Nagpur Bench in W.P. No. 2324 of 2023 and in W. P. No. 2435/2023 vide its Order dated 30^th March, 2026;

And whereas the Hon’ble High Court of Bombay at Nagpur Bench vide the aforesaid Order, given liberty to

the Central Government to publish a fresh notification under section 3 of the Works of Defence Act, 1903.

Now, therefore, in exercise of the powers conferred by section 3 of the Works of Defence Act, 1903, the Central

Government hereby declares that, it is necessary to continue to impose restrictions already in place, as specified in clause

(c) of Section 7 of the said Act, upon the use and enjoyment of the land descried in the Schedule herein, being land lying

in the vicinity of Defence Research and Development Organisation, Project Site Borkhedi, District Nagpur, in the State

of Maharashtra, in order that the said land may be kept free from buildings and other obstructions.

2. The said restrictions shall come into force with effect from the date of publication of this notification in the Official

Gazette.

3. A sketch plan of the said land may be inspected in the office of the District Collector, Nagpur, Maharashtra.

SCHEDULE

All the land comprised in the area lying within the distance of one hundred metres from the crest of the outer

parapet of the boundary wall of Defence Research and Development Organization, Project Site Borkhedi, District

Nagpur, in the State of Maharashtra.
