इसके पश् चात् उक्त अजधजनयम कहा गया है।) की धारा 33व की उपधारा (1) अपेक्षानुसार, भारत के रािपत्र, असाधारण,

भाग II, खंड 3, उपखंड (1) में भारत सरकार के आयुष मंत्रालय की अजधसूचना संख्या सा.का.जन. 115(अ) तारीख

28 िनवरी, 2025 द्वारा प्रकाजित दकया गया था, जिसमें उससे प्रभाजवत होने की संभावना वाले ऐसे सभी व् यजक्तयों से, उस

तारीख से, जिसको उक् त अजधसूचना वाले रािपत्र की प्रजतयां िनता को उपलब् ध करा िी गई थी, तीस दिन की अवजध के

अवसान से पूवव आक्षेप और सुझाव मांगे गए थे।

और उक्त रािपत्र की प्रजतयां िनता को 04 फरवरी, 2025 को उपलब्ध करा िी गई थीं;

और उक्त प्ररूप जनयमों पर िनता से प्राप्त आपजियों और सुझावों पर केंद्रीय सरकार द्वारा जवचार दकया गया है;

अत:, केंद्रीय सरकार, ओषजध और प्रसाधन सामग्री अजधजनयम, 1940 (1940 का 23) की धारा 33ढ़ द्वारा प्रिि

िजक्तयों का प्रयोग करते हुए, उक्त अजधजनयम की धारा 33ग के अधीन गठित आयुवेदिक, जसद्ध और यूनानी ओषजध तकनीकी

सलाहकार बोडव के साथ परामिव के पश् चात्, ओषजध जनयम, 1945 में संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है,

अथावत्:-

1. संजक्षप् त नाम, और प्रारंभ. - (1) इन जनयमों का संजक्षप् त नाम औषजध (तेरहवां संिोधन) जनयम, 2026 है।

(2) ये, रािपत्र में उनके प्रकािन की तारीख को प्रवृत होंगे।

2. ओषजध जनयम 1945 में, अनुसूची ङ(झ) के स्ट् थान पर जनम्नजलजखत को रखा िाएगा, अथावत्:-

NOTIFICATION

New Delhi, the 15th September, 2026

G.S.R. 862(E).— Whereas the draft of certain rules further to amend the Drugs Rules, 1945 (hereinafter

referred to as the said rules) was published as required under sub-section (1) of section 33N of the Drugs and Cosmetics

Act, 1940 (23 of 1940) (hereinafter referred to as the said Act) vide notification of the Government of India in the

Ministry of Ayush, number G.S.R. 115(E), dated the 28th January, 2025 in the Gazette of India, Extraordinary, Part-II,

Section 3, sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the

expiry of a period of thirty days from the date on which the copies of the Official Gazette containing the said notification

were made available to the public;

And whereas, the copies of the said Gazette were made available to the public on the 04^th February 2025;

And whereas, objections and suggestions received from the public on the said draft rules have been considered by

the Central Government;

Now, therefore, in exercise of the powers conferred by section 33N of the Drugs and Cosmetics Act, 1940 (23

of 1940), the Central Government, after consultation with the Ayurvedic, Siddha and the Unani Drugs Technical

Advisory Board constituted under section 33 C of the said Act, hereby makes the following rules further to amend the

Drugs Rules, 1945, namely: -

1. Short title, and commencement. - (1) These rules may be called the Drugs (Thirteenth Amendment) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette

2. In the Drug Rules 1945, for SCHEDULE E (I), the following Schedule shall be substituted, namely: -
