that Smt. Supriya Khare, Scientific Officer (D), (formerly

SO/SD) Reactor Engineering Division, Bhabha Atomic

Research Centre (BARC), who was granted Extra Ordinary

Leave for 186 days from 24-11-94 to 28-5-1995 to visit her

husband in Sydney, Australia, has been overstaying her leave

with effect from 29-5-95;

2. And whereas it was also alleged that Smt. Khare while

in Sydney, on personal grounds, joined the course of Master

of Technology in Information Technology at University of

Technology,. Sydney without the permission of the

Department;

3. And whereas the said Smt. Khare by her aforesaid

conduct has shown lack of devotion to duty and had acted in

a manner unbecoming of a Government servant thereby

contravening the provisions of sub-rule (l)(ii) and (l)(iii) of

Rule 3 of the Central Civil Services (Conduct) Rules. 1964;

4. And whereas the said Smt. Khare was informed of the

charges and of the action proposed against her under Rule 14

of the Central Civil Services (Classification, Control and

Appeal) Rules, 1965 under Memorandum No. l/15(9)/96

(BARC)/Vig./713 dt. 2-9-1996;

5. And whereas the said Smt. Khare acknowledged receipt

of the chargesheet but did not submit any written statement

of defence;

6. And whereas an inquiry under Rule 14 of the Central

Civil Services (Classification, Control and Appeal) Rules,

1965 was ordered appointing an Inquiring Authority under

Order No. 1/15(9)/96(BARC)/Vig./271 dated 15-4-97;

7. And whereas the said Smt. Khare did not participate in

the inquiry proceedings and the said proceedings were,

therefore, held ex-parte;

8. And whereas the Inquiring Authority on conclusion of

the ex-parte proceedings submitted his report on 17-11 -1997,

concluding the charge against Smt. Khare as proved;

9. And whereas a copy of the inquiry report was sent to

Smt. Khare on 25-6-1998 and on 30-7-1998 for submitting

written representation, if any against the inquiry report;

10. And whereas Smt. Khare vide her representation dt.

22-8-1998 stated that she could not resume duties on expiry

of the leave due to family and financial constraints and

requested for acceptance of her resignation;

11. And whereas Smt. Khare was informed vide

Department's Memorandum No. 1 /15(9)/96(BARC)/Vig./705

dt. 21-9-1998 that her request for acceptance of resignation

cannot be agreed to;

12. And whereas after careful consideration of the inquiry

report and other records of the case and having rcgatd to its

own findings on the article of charge, the Disciplinary

Authority came to the conclusion that ends of justice would

be met in the case if the penalty of 'dismissal from service' is

imposed on the said Smt. Khare;

13. And whereas the Union Public Service Commission which

was consulted in the matter, has, on due consideration of all

the relevant records and other aspects of the case, advised

imposition of the penalty of 'dismissal from service' on Smt.

Khare under its letter No. F. 3/245/99-S.I dt. 30-3-2000 (copy

enclosed);

14. Now, therefore, the President, in exercise of the powers

conferred under Rule, 15(4) of the Central (Civil Services

Classification, Control and Appeal) Rules. 1965, hereby

imposes the penalty of 'dismissal from service' on Smt.

Supriya Khare. Scientific Off icer/D, Bhabha Atomic Research

Centre, Mumbai with immediate effect.

M. G. Balakrishnan, Scientific Officer/SD (now SO/D),

Bhabha Atomic Research Centre (BARC), has been absenting

from duty unauthorisedly with effect from 16^8-95;

2. Whereas it was also alleged that Shrl Bajiikrishnan while

in USA, on personal grounds, had joined a course in Systems

Programming and Computer Simulation in USA without

obtaining prior permissioin from his office.

3. And whereas the said Shri Balakrishnan by his aforesaid

conduct had shown lack of devotion to duty and had acted in

a manner unbecoming of a Government servant thereby

contravening the provisions of sub-rule (1) (ii) and (1) (iii) of

Rule 3 of the Central Civil Services (Conduct) Rules, 1964;

4. And whereas the said Shri Balakrishnan was informed

of the charges and of the action proposed against him under

Rule 14 of the Central Civil Services (Classification, Control

and Appeal) Rules, 1965 under Memorandum No. 1/15(6)/

97-Vig./41 dt. 12-1-1998;

5. And whereas the said Shri Balakrishnan acknowledged

receipt of the chargesheet and vide his letter dated nil

requested for acceptance of his resignation;

6. And whereas the said Shri Balakrishnan was informed

vide Memo. No. 7 (52)/96/Vjg/1743 dated 20-7-98 that his

request for acceptance of resignation cannot be agreed to and

receipt of the Memorandum was acknowledged by him;

7. And whereas Shri Balakrishnan did not submit any

written statement of defence;

8. And whereas an inquiry under Rule 14 of the Central

Civil Services (Classi'ication, Control and Appeal) Rules,

1965 was ordered appointing an Inquiring Authority under

Order No. l/15(6)/97-Vig/772 dl. 12-10-1998;

9. And whereas the said Shri Balakrishnan did not

participate in the inquiry proceedings and the said proceedings

were, therefore, held ex-parte;

10. And whereas the Inquiring Authority on conclusion of

the ex-partc proceedings submitted his report on 1-6-1999,

concluding the charges against Shri Balakrishnan as proved;

11. And whereas a copy of the inquiry report was sent to

Shri Balakrishnan in all available addresses vide Memo. No.

l/15(6)/97-Vig./561 dt. 4-8-1999 for submitting written

representation, if any, against the inquiry report;

12. And whereas while the copy of the Inquiry report sent

to his three addresses were received back undelivered, the

copy sent to his New York address was neither acknowledged

nor the undelivered cover received back from postal

authorities;

13. And whereas no representation against the inquiry

report was received from Shri Balakrishnan;

14. And whereas after careful consideration of the inquiry

report and other records pf jjie .case and having regard to its

own findings on the articles of ctigfg£, the Disciplinary

Authority came to the conclusion that ends of justice wojjld

be met in the case if the penalty of 'dismissal from service' is

imposed on the said Shri Balakrishnan;

15. And whereas the Union Public Service Commission

was consulted in the matter and the Commission, on due

consideration of all the relevant records and other aspects of

the ewe, has advised imposition of the penalty of 'dismissal

from service' on Shri Balakrishnan under its letter No.

F. 3/359/99-S.I. dt. 24-4^2000 (copy enclosed);

16. Now, therefore, the President, in exercise of the powers
