ORDER
New Delhi, the 7th April, 2010
O.N. 21.—Whereas, Dr. Thankachan, a contesting candidate at the General Election to Lok Sabha, 2009 from
1-Andaman and Nicobar, Island Parliamentary Constituency was issued a notice under sub-rule (5) of the Rule 89 of the
Conduct of Election Rules, 1961 for failure to lodge any account of his election expenses in connection with the said
election;
And whereas, in reply to the Commission's said notice dated 22nd September, 2009, Dr. Thankachan in his
representation dated 13-11-2009 has submitted that he could not submit his account of election expenses since he had been
to mainland to settlement of his family dispute;
And whereas, the said representation of Dr. Thankachan was sent to the Sub-Divisional Magistrate (SA), South
Andaman-cum-Returning Officer, / -Andaman and Nicobar Islands Parliamentary Constituency for his comments on the
said representation;
Whereas, the Returning Officer, 1-Andaman and Nicobar Islands Parliamentary Constituency in the supplemen-
tary report dated 5th March, 2010 has stated that he has not yet filed his account of election expenses;
Whereas, the Election Commission of India is satisfied that Dr. J. Thankachan, M.G. Road, I ,ambal ine, Port Blair,
a contesting candidate at the General Election to Lok Sabha, 2009 from 1-Andaman and Nicobar Island Parliamentary
Constituency has failed to lodge his account of election expenses as required by the Representation of the People Act, 195 I
and the Rules made thereunder;
Now, therefore, in pursuance of Section I OA of the said Act, the Election Commission hereby declares Dr. J.
Thankachan to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative
Assembly or Legistative Council of a State or Union Territory for a period of three years from the date of this order.
