Present election petition questioning the election of

respondent no. 5, Mahabali Singh from 35-Karakat

Parliamentary Constituency, conducted during the general

election 2009 has been put up for orders as the same is

barred by limitation as it was filed after 45 days of the

declaration of the result of the election. By filing the limita-

tion petition kept at Flag-A, the election petitioner has

requested this Court to condone the delay of eight days in

filling the petition. The election petition has been filed in

terms of the provisions contianed in the Representaiton of

People Act, 1951 (hereinafter referred to as “the Act”), Sec-

tion 86 whereof gives a mandatory command to the High

Court to dismiss the election petition which does not

comply with the provisions of Sections 81, 82 or 117. Sec-

tion 81 require the election petition to be presented before

the High Court within 45 days of the declaration of the

result, failing which the petition has to be dismissed. The

mandatory scheme of the Act exclude the application of

Limitation Act, 1963 and such view has been taken by the

Hon'ble Supreme Court in the case of Hukumdev Narain

Yadav Versus Lalit Narain Mishra, reported in AIR 1974

Supreme Court 480.

3. The election petition having been filed beyond

the period of 45 days of the declaration of result of election

of respondent no. 5 is barred by limitation and is, accord-

ingly, dismissed.

New Delhi, the 7th July, 2011

O. N. 120.—Whereas, the Election Commission is satisfied that each of the contesting candidate(s), specified in

column (4) of the table below, at the General Election to the Lok Sabha in the State of Uttar Pradesh, as specified in column

(2), held from the Constituency, specified in column (3) against their name, have failed to lodge the account of his election

expenses as required by the Representation of the People Act, 1951 and the rules made thereunder as shown in column (5)

of the said table; and

Whereas, the said candidates have not furnished any reason or explanation for the said failure even after due

New Delhi, the 7th July, 2011

O.N. 124.—Whereas, the Election Commission of India is satisfied that each of the contesting candidates specified

in column 4 of the Table below at the General Election to the Legislative Assembly, 2009, in the Sikkim State held from the

constituency specified in column 3 against his/her name has failed to lodge the account of his/her election expenses as

shown in column 5 of the said Table as required by the Representation of the People Act, 1951 and the Rules made

thereunder;

And whereas, the said candidates have either not furnished any reason or explanation for the said failure even

after due notice by the Election Commission or after considering the representation made by them, if any, the Election

Commission is satisfied that they have no good reason or justification for the said failure;

Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission hereby declares the persons

specified in column 4 of the Table below to be disqualified for being chosen as and for being a member of either House of

Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from

the date of this order :
