12/20-3-2009 Learned Sr. Counsel Mr. Anil Kumar Sinha submits that election petition filed on behalf of the

petitioner has now been rendered infructuous in view of the fact that the petitioner has challenged the bye election of

Parliament whereby the respondent Shri Babu Lal Marandi was elected. Admittedly, no corruption charge was levelled

against the respondent Babu Lal Marandi. As the Parliament has been dissolved in view of ensuing 15th Parliamentary

Election, this petition may be dismissed.

Learned Counsel Mr. Arvind Kumar Lall appearing for the petitioner fairly conceded that no charge of corrupt

parctice was alleged against the respondent Babu Lal Marandi in the Parliamentary bye election.

Having regard to the facts and changing circumstances as also in view of the submissions made above, this

Election Petition is dismissed as rendered infructuous. Inform the concerned as per statutory provisions.

O. N. 143 .—Whereas, the Election Commission is satisfied that each of the contesting candidates specified in

column (3) of the Table below at the General Election to the Odisha Legislative Assembly, 2009 held from the constituency

specified in column (2) against his/her name has failed to lodge any account of his/her election expenses at all as required

by the Representation of the People Act, 1951 and the Rules made thereunder as shown in column (4) of the said Table;

And whereas, the said candidates have either not furnished any reason or explanation for the said failure even

after due notice of the Election Commission, or after considering the representation if any, made by them the Election

Commission is satisfied that they have no good reason or justification for the said failure;

Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission hereby declares the persons

Tehsil Rajakheda, District Dholpur, Rajasthan, a contesting candidate at the General Election to the Lok Sabha held on May,

O. N. 148 .—In exercise of the powers conferred by sub-section (1) of Section 13A of the representation of the

People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the Government of Himachal Pradesh

hereby nominates Shri Narinder Chauhan, IAS (HP 84) as the Chief Electoral Officer for the State of Himachal Pradesh with

effect from the date he takes over charge and until further orders vice Shri Manoj Kumar, IAS.

Shri Narinder Chauhan, IAS shall cease to hold and hand over forthwith the charge of all or any charges of

work under the Government of Himachal Pradesh, which he may be holding before such assumption of office.

Shri Narinder Chauhan, IAS while functioning as the Chief Electoral Officer, Himachal Pradesh shall not hold

any additional charge whatsoever under the Government of Himachal Pradesh except that he should be designated

Secretary to the Government in charge of Election Department in the State Secretariat.
