G.S.R. 54.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President

hereby makes the following rules further to amend the Indian Information Service (Group ‘A’) Rules, 1987, namely :—

1. (1) These rules may be called the Indian Information Service (Group ‘A’) Amendment Rules, 2012.

(2) They shall come into force with effect from 2nd February, 2008.

2. In the Indian Information Service (Group ‘A’) Rules, 1987 (referred to as the principal rules), in Schedule V, in

column 3 relating to the field of selection and minimum qualifying service for appointment to Junior Administrative Grade

(Non-Functional Selection Grade), the following Note shall be inserted at the end, namely :—

“Note : The Junior Administrative Grade officers who entered the Service by the method of promotion in the

Junior Time Scale of IIS Group ‘A’ shall also be considered eligible for appointment in the Junior Administrative

Grade (Non Functional Selection Grade), provided they have entered the fourteenth year of Service in Group’ A’

by following the Rules governing seniority along with officers who entered the fourteenth year of service

through the method of direct recruitment.”

Explanatory Memorandum

The Indian Information Service (IIS) (Group ‘A’) Rules, 1987 were further amended vide Indian Information

Service (Group’ A’) (Amendment) Rules, 2008, which were published in the Gazette of India, Part II, Section 3, Sub-section (i)

on 2nd February, 2008. The provision for grant of Non-Functional Selection Grade to the officers in the Junior Administrative

Grade, who entered into Group ‘A’ of the Service through direct recruitment as well as by methods other than direct

recruitment, was in existence prior to above amendment notified on 02-02-2008. The field of selection and minimum

qualifying service for appointment to Junior Administrative Grade (Non-Functional Selection Grade) mentioned in Column

(3) of Schedule V to the principal rules as amended vide (Amendment), Rules, 2008 is not applicable to the officers of

Junior Administrative Grade of IIS Group ‘A’ who have entered into the service other than by direct recruitment, i.e., by

promotion, to Junior Grade of IIS Group ‘A’ . There are some IIS officers who have entered the Indian Information Service

Group’ A’ by the method of promotion and have been promoted to the Junior Administrative Grade of IIS Group ‘A’ after

02-02-2008. They have been deprived of their legitimate right for placement in the Non-Functional Selection Grade (NFSG)

of JAG due to absence of an enabling provision for grant of NFSG to them in the principal rules amended vide (Amendment)

Rules, 2008. There are also a few officers who have been promoted to JAG of IIS Group’ A’ after 02-02-2008 and have since

retired or left the service without getting the benefit of NFSG. Hence, in order to ensure that the interest of such officers

is not jeopardized and in order to restore their legitimate right for grant of NFSG and to maintain continuity, it is considered

justified to give retrospective effect to these rules, with effect from 02-02-2008, the date on which the Indian Information

Service (Group’ A’) (Amendment) Rules, 2008 had come into force. The retrospective effect given to the amendment will

not affect any section or class of Government servants adversely.

G.S.R. 55.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession

of the Department of Statistics (Class IV posts), Recruitment Rules, 1972, except as respects things done or omitted to be

done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the

post of Multi-Tasking Staff in the Ministry of Statistics and Programme Implementation, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Statistics and Programme

Implementation, Multi-Tasking Staff, Group ‘C’ Posts, Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of the said post, its

classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the

Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications

and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law

applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any

person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do,

it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any

class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxations of age limit and other concessions

required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of

persons in accordance with the orders issued by the Central Government from time to time in this regard.

G.S.R. 56.—In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President

hereby makes the following rules regulating the method of recruitment to the post of Upper Division Clerk/Field Assistant

in the Ministry of Statistics and Programme Implementation, National Academy of Statistical Administration, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Statistics and Programme

Implementation, National Academy of Statistical Administration, Upper Division Clerk/Field Assistant, Group ‘C’ Post,

Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of the said post, its

classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the

Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications

and other matters relating thereto shall be as specified in column (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law

applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any

person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do,

it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any

class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required

to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in

accordance with the orders issued by the Central Government from time to time in this regard.

Bodies or Public Sector Undertakings,—

(i)

holding analogous post on regular basis; or

with eight years’ regular service in the grade of Lower Division

Clerk or equivalent;

Note 1 : The period of deputation (including short-term contract)

including period of deputation (including short-term contract) in

another ex-cadre post held immediately preceding this appointment in

the same or some other organisation or department of the Central

Government shall ordinarily not exceed three years.

Note 2 : The maximum age limit for appointment by deputation

(including short-term contract) shall be not exceeding 56 years as on

the closing date of receipt of applications.

Note 3 : For the purpose of appointment on deputation (including

short-term contract) basis, the service rendered on regular basis by an

officer prior to 1st January, 2006 or the date from which the revised pay

structure based on the recommendations of the Sixth Central Pay

Commission has been extended shall be deemed to be service rendered

in the corresponding grade pay or pay scale extended based on the

recommendations of the said Pay Commission except where there has

been merger of more than one pre-revised scale of pay into one grade

with a common grade pay or pay scale, and where this benefit will

extend only for the post(s) for which that grade pay or pay scale is the

normal replacement grade without any upgradation.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the National Institute of Animal Health, Laboratory Assistant (Group ‘C’) Recruitment Rules, 2010, in the

Schedule,—

Column (6) and the entries therein shall be omitted;

(b)

In Column (7), — after the entry “Between 18-27 years of age” the following entry shall be inserted,

namely :—

‘(relaxable up to forty years for departmental candidates in accordance with the instructions or orders
