MINISTRY OF DEFENCE

S.R.O. 98.—In exercise of powers conferred by section 184 of the Navy Act, 1957 (62 of 1957), the Central

Government hereby makes the following regulations further to amend the Navy Leave Regulations, 1970, namely:—

1. (1) These regulations may be called the Navy Leave (Amendment) Regulations, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Navy Leave Regulations, 1970:—

(i) delete all existing sub regulations under regulation 13 and substitute with new regulation 13, namely:—

"13. Annual Leave

(1) Annual Leave, for the year may at the discretion of the leave sanctioning authority, be extended to the next

calendar year without prejudice to the annual leave authorised for the year in which the extended leave expires;

(2) Annual leave may be taken in instalments within the same year;

(3) Annual leave year shall be the calendar year, namely 1st January to 31st December; and

(4) Annual leave shall be non-accumulative except as provided for in regulations 33 and 41."

S.R.O. 99 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President

hereby makes the following rules regulating the method of recruitment of Library Group 'B' posts of Ministry of Defence,

the Armed Forces Medical College, Pune under the Directorate General Armed Forces Medical Services, Ministry of

Defence, namely:-

1. Short title and commencement.—(1) These rules may be called Ministry of Defence, the Armed Forces

Medical College, Pune, Library Group 'B' posts, Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply for the recruitment to the post specified in Column 1 of the Schedule

annexed hereto.

3. Number of posts, classification, Pay band and grade pay and scale of pay.—The number of the said post, its

classification, Pay band and grade pay and the scale of pay attached thereto shall be as specified in column (2) to (4) of the

Schedule annexed to these rules.

4. Method of recruitment, age-limit and other qualifications etc.—The method of recruitment for the said post,

age-limit, qualifications and other matters connected therewith shall be as specified in column (5) to (13) of the said

Schedule.

5. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law

applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person

from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it

may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax

any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required

to be provided for the Schedule Castes, the Scheduled Tribes, the ex-servicemen and other special categories of persons

in accordance with the orders issued by the Central Government from time to time in this regard.

1. Officers of the Central Government :

(a) (i) holding analogous post on regular basis in the parent

cadre/department; Or

(ii) with five years' service in the grade rendered after

appointment thereto on regular basis in the scale of pay of

Rs.9300—34800 in PB-2 with Grade Pay of Rs.4200 or

equivalent in the parent cadre/department; and

(b) possessing the following educational qualification :

(i) degree of a recognized university;

(ii) bachelors' Degree or equivalent diploma in Library Science

of a recognized University/Institute.

(iii) two years' professional experience in a Library of

standing.

Certificate in Computer Applications from a recognized

Institute.

2. The Departmental Library and Information Assistant in the

scale of Rs.9300—34800 in PB-2 with Grade Pay of Rs.4200

with five years' regular service in the grade shall also be

considered alongwith outsiders and in case he is selected for

appointment to the post, the same shall be deemed to have

been filled by promotion.

(The departmental officers in the feeder category who are in

direct line of promotion will not be eligible for consideration

for appointment on deputation. Similarly, deputationists shall

not be eligible for consideration for appointment by

promotion).

(Period of deputation including period of deputation in

another Ex-Cadre post held immediately preceding this

appointment in the same or some other Organization/

Department of the Central Government shall ordinarily not to

exceed three years. The maximum age-limit for appointment

by deputation shall be not exceeding 56 years as on the

closing date of the receipt of applications).

Note : For the purpose of appointment on deputation basis,

the service rendered on a regular basis by an officer prior to

1.1.2006 (the date from which the revised pay structure based

on the 6th CPC recommendation has been extended) shall be

deemed to be service rendered in the corresponding grade

pay/pay scale extended based on the recommendations of

the Pay Commission except where there has been merger of

S.R.O. 100.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in

supersession of the Raksha Utpadan Vibhag, Directorate General Quality Assurance (Group 'C' and Group 'D') Recruitment

Rules, 1987 and the Department of Defence Production and Supplies, Director General Quality Assurance, Industrial

(Group 'C' and 'D') Recruitment Rules, 2001, except as respects things done or omitted to be done before such supersession,

the President hereby makes the following rules regulating the method of recruitment of Industrial (Group 'C') posts in the

Department of Defence Production (Directorate General of Quality Assurance), namely:—

1. Short Title and Commencement.— (1) These rules may be called the Ministry of Defence, Department of

Defence Production, Directorate General of Quality Assurance, Group 'C' Industrial Posts Recruitment Rules, 2012.

(2) They shall come into force on the date of publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column 1 of the Schedule annexed to these

rules.

3. Number of posts, classification and pay band and grade payor pay scale.—The number of the posts, their

classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns 2 to 4 of the said

Schedule.

4. Method of recruitment, age limit, qualifications etc.—The method of recruitment to the said posts, age limit,

qualifications and other matters relating thereto shall be as specified in columns 5 to 13 of the said Schedule.

Disqualification.—No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law

applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any

person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it

may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class

or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required

to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in

accordance with the orders issued by the Central Government from time to time in this regard.
