clause (ii) of sub-section (1) of section 35 of the Income-tax
Act, 1961 (said Act), read with Rules 5C and 5D of the
Income-tax Rules, 1962 (said Rules), from 1-4-2012 onwards
in the category of 'Scientific Research Association', subject
to the following conditions, namely:—
(i)
The sole objective of the approved 'scientific
research association' shall be to undertake
scientific research;
(ii)
The approved organization shall carry out
scientific research activity by itself;
(iii)
The approved organization shall maintain
separate books of accounts in respect of the sums
received by it for scientific research, reflect therein
the amounts used for carrying out research, get
such books audited by an accountant as defined
in the explanation to sub-section (2) of section
288 of the said Act and furnish the report of such
audit duly signed and verified by such accountant
to the Commissioner of Income-tax or the Director
of Income-tax having jurisdiction over the case,
by the due date of furnishing the return of income
under sub-section (1) of section 139 of the said
Act;
(iv)
The approved organization shall maintain a
separate statement of donations received and
amounts applied for scientific research in respect
of conerned Departments and a copy of such
statement duly certified by the auditor shall
accompany the report of audit referred to above.
2. The Central Government shall withdraw the approval
if the approved organization:—
(a)
fails to maintain separate books of accounts
referred to in sub-paragraph (iii) of paragraph 1;
or
(b)
fails to furnish its audit report referred to in sub-
paragraph (iii) of paragraph 1; or
(c)
fails to furnish its statement of the donations
received and sums applied for scientific research
referred to in sub-paragraph (iv) of paragraph 1;
or
(d)
ceases to carry on its research activities or its
research activities are not found to be genuine;
or
(e)
ceases to conform to and comply with the
provisions of clause (ii) of sub-section (1) of
section 35 of the said Act read with rules 5C and
5D of the said Rules.

MINISTRY OF LABOUR AND EMPLOYMENT
New Delhi, the 10th May, 2013
S.O. 1075.—In exercise of the power conferred by
Section 88 read with Section 91-A of the Employees' State
Insurance Act, 1948 (34 of 1948) the Central Government
hereby exempts the regular employees of factories/estab-
lishments of Chandigarh Industrial & Tourism Develop-
ment Corporation Ltd. from the operation of the said Act.
The exemption shall be effective from the date of issue of
notification for a period of one year.
2.
The above exemption is subject to the following con-
ditions namely:—
(1)
The aforesaid establishments wherein the em-
ployees are employed shall maintain a register
showing the name and designations of the ex-
empted employees';
(2)
Notwithstanding this exemption, the employ-
ees shall continue to receive such benefits
under the said Act to which they might have
become entitled to on the basis of the contri-
butions paid prior to the date from which ex-
emption granted by this notification operates;
(3)
The contributions for the exempted period, if
already paid, shall not be refundable;
(4)
The employer of the said factory/establishment
shall submit in respect of the period during
which that factory was subject to the opera-
tion of the said Act (hereinafter referred as the
said period), such returns in such forms and
containing such particulars as were due from
it in respect of the said period under the Em-
ployees' State Insurance (General) Regulations,
1950;
(5)
Any Social Security Officer appointed by the
Corporation under Sub-Section (1) of Section
45 of the said ESI Act or other official of the
Corporation authorized in this behalf by it, shall,
for the purpose of:—
(i)
Verifying the particulars contained in any
returned submitted under sub-section (1)
of section 44 for the said period; or
(ii)
Ascertaining whether registers and
records were maintained as required by
the Employees' State Insurance (General)
Regulations, 1950 for the said period; or
(iii)
Ascertaining whether the employees
continue to be entitled to benefits pro-
vided by the employer in cash and kind
being benefits in consideration of which
exemption is being granted under this
notification; or
(iv)
Ascertaining whether any of the provi-
sions of the Act had been complied with
during the period when such provisions
were in force in relation to the said fac-
tory to be empowered to:
(a)
require the principal or immediate
employer to him such information
as he may consider necessary for
the purpose of this Act; or
(b)
at any reasonable time enter any
factory, establishment, office or
other premises occupied by such
principal or immediate employer at
any reasonable time and require
any person found in charge
thereof to produce to such inspec-
tor or other official and allow him
to examine accounts, books and
other documents relating to the
employment of personal and pay-
ment of wages or to furnish to him
such information as he may con-
sider necessary; or
(c)
examine the principal or immedi-
ate employer, his agent or servant,
or any person found in such fac-
tory, establishment office or other
premises or any person whom the
said inspector or other official has
reasonable cause to believe to
have been an employee; or
(d)
make copies of or take extracts from
any register, account book or
other document maintained in

S.O. 1076.—In exercise of the power conferred by
Section 88 read with Section 91-A of the Employees' State
Insurance Act, 1948 (34 of 1948) the Central Government
hereby exempts M/s. Deiem (India) Private Limited, New
Delhi from the operation of the said Act on account of
stipend paid for work being done by inmates of Tihar Jail,
New Delhi under the training programme run by the estab-
lishment (manufacturing of shoes & shoe components) in
the jail premises. The exemption shall be effective from the
date of issue of notification for a period of one year.
2.
The above exemption is subject to the following con-
ditions namely:—
(1)
The aforesaid establishments wherein the em-
ployees are employed shall maintain a register
showing the name and designation of the
exempted employees';
(2)
Notwithstanding this exemption, the emp-
loyees shall continue to receive such benefits
under the said Act to which they might have
become entitled to on the basis of the
contributions paid prior to the date from which
exemption granted by this notification
operates;
(3)
The contributions for the exempted period, if
already paid, shall not be refundable;
(4)
The employer of the said factory/establishment
shall submit in respect of the period during
which that factory was subject to the opera-
tion of the said Act (hereinafter referred as the
said period), such returns in such forms and
containing such particulars as were due from
it in respect of the said period under the Em-
ployees' State Insurance (General) Regulations,
1950;
(5)
Any Social Security Officer appointed by the
Corporation under Sub-Section (1) of Section
45 of the said ESI Act or other official of the
Corporation authorized in this behalf by it, shall,
for the purpose of:—
(i)
Verifying the particulars contained in any
returned submitted under sub-section (1)
of section 44 for the said period; or
(ii)
Ascertaining whether registers and
records were maintained as required by
the Employees' State Insurance (General)
Regulations, 1950 for the said period; or
(iii)
Ascertaining whether the employees
continue to be entitled to benefits pro-
vided by the employer in cash and kind
being benefits in consideration of which
exemption is being granted under this
notification; or
(iv)
Ascertaining whether any of the provi-
sions of the Act had been complied with
during the period when such provisions
were in force in relation to the said fac-
tory to be empowered to:
(a)
require the principal or immediate
employer to him such information
as he may consider necessary for
the purpose of this Act; or
(b)
at any reasonable time enter any
factory, establishment, office or
other premises occupied by such
principal or immediate employer at
any reasonable time and require
any person found in charge
thereof to produce to such inspec-
tor or other official and allow him
to examine accounts, books and
other documents relating to the
employment of personal and pay-
ment of wages or to furnish to him
such information as he may con-
sider necessary; or
(c)
examine the principal or immedi-
ate employer, his agent or servant,
or any person found in such fac-
tory, establishment office or other
premises or any person whom the
said inspector or other official has
reasonable cause to believe to
have been an employee; or
(d)
make copies of or take extracts from
any register, account book or
other document maintained in
such factory, establishment, office
or other premises;
(e)
exercise such other powers as may
be prescribed.
(6)
In case of disinvestment/corporatization, the
exemption granted shall become automatically
cancelled and then the new entity will have to
approach the appropriate Government for
exemption.

S.O. 1078.—In exercise of the power conferred by
Section 88 read with Section 91-A of the Employees' State
Insurance Act, 1948 (34 of 1948) the Central Government
hereby exempts the regular employees of factories/estab-
lishments of BEML Ltd., Bangalaore (all offices) from the
operation of the said Act. The exemption shall be effective
w.e.f. 18-05-2013 for a period of one year.
2.
The above exemption is subject to the following
conditions namely:—
(1)
The aforesaid establishments wherein the
employees are employed shall maintain a
register showing the name and designations
of the exempted employees';
(2)
Not withstanding this exemption, the
employees shall continue to receive such
benefits under the said Act to which they
might have become entitled to on the basis of
the contributions paid prior to the date from
which exemption granted by this notification
operates;
(3)
The contributions for the exempted period, if
already paid, shall not be refundable;
(4)
The employer of the said factory/establishment
shall submit in respect of the period during
which that factory was subject to the operation

period), such returns in such forms and
containing such particulars as were due from
it in respect of the said period under the

Any Social Security Officer appointed by the
Corporation under Sub-Section (1) of Section
45 of the said ESI Act or other official of the
Corporation authorized in this behalf by it, shall,
for the purpose of:—
(i)
Verifying the particulars contained in
any returned submitted under
sub-section (1) of Section 44 for the said
period; or
(ii)
Ascertaining whether registers and
records were maintained as required by
the Employees' State Insurance (General)
Regulations, 1950 for the said period; or
(iii)
Ascertaining whether the employees
continue to be entitled to benefits pro-
vided by the employer in cash and kind
being benefits in consideration of which
exemption is being granted under this
notification; or
(iv)
Ascertaining whether any of the provi-
sions of the Act had been complied with
during the period when such provisions
were in force in relation to the said fac-
tory to be empowered to:
(a)
require the principal or immediate em-
ployer to him such information as he may
consider necessary for the purpose of
this Act; or
(b)
at any reasonable time enter any factory,
establishment, office or other premises
occupied by such principal or immedi-
ate employer at any reasonable time and
require any person found in charge
thereof to produce to such inspector or
other official and allow him to examine
accounts, books and other documents
relating to the employment of personal
and payment of wages or to furnish to
him such information as he may consider
necessary; or
(c)
examine the principal or immediate em-
ployer, his agent or servant, or any per-
son found in such factory, establishment
office or other premises or any person
whom the said inspector or other official
has reasonable cause to believe to have
been an employee; or
(d)
make copies of or take extracts from any
register, account book or other document
maintained in such factory, establish-
ment, office or other premises;
(e)
exercise such other powers as may be
prescribed.
(6)
In case of disinvestment/corporatization, the
exemption granted shall become automatically
cancelled and then the new entity will have to
approach the appropriate Government for ex-
emption.

S.O. 1081.—In exercise of the power conferred by
Section 88 read with Section 91-A of the Employees' State
Insurance Act, 1948 (34 of 1948) the Central Government
hereby exempts the regular employees of factories/
establishments of Rourkela Steel Plant, Rourkela from the
operation of the said Act. The exemption shall be effective
for a period of one year from the date of issue of notification.
2.
The above exemption is subject to the following
conditions namely:—
(1)
The aforesaid establishments wherein the
employees are employed shall maintain a
register showing the name and designations
of the exempted employees';
(2)
Not withstanding this exemption, the
employees shall continue to receive such
benefits under the said Act to which they might
have become entitled to on the basis of the
contributions paid prior to the date from which
exemption granted by this notification
operates;
(3)
The contributions for the exempted period, if
already paid, shall not be refundable;
(4)
The employer of the said factory/establishment
shall submit in respect of the period during
which that factory was subject to the operation
of the said Act (hereinafter referred as the said
period), such returns in such forms and
containing such particulars as were due from
it in respect of the said period under the
Employees' State Insurance (General)
Regulations, 1950;
(5)
Any Social Security Officer appointed by the
Corporation under Sub-Section (1) of Section
45 of the said ESI Act or other official of the
Corporation authorized in this behalf by it, shall,
for the purpose of:—
(i)
Verifying the particulars contained in
any returned submitted under sub-
section (1) of section 44 for the said
period; or
(ii)
Ascertaining whether registers and
records were maintained as required by
the Employees' State Insurance (General)
Regulations, 1950 for the said period; or
(iii)
Ascertaining whether the employees
continue to be entitled to benefits
provided by the employer in cash and
kind being benefits in consideration of
which exemption is being granted under
this notification; or
(iv)
Ascertaining whether any of the
provisions of the Act had been complied
with during the period when such
provisions were in force in relation to
the said factory to be empowered to:
(a)
require the principal or immediate
employer to him such information
as he may consider necessary for
the purpose of this Act; or
(b)
at any reasonable time enter any
factory, establishment, office or
other premises occupied by such
principal or immediate employer at
any reasonable time and require
any person found in charge
thereof to produce to such
inspector or other official and
allow him to examine accounts,
books and other documents
relating to the employment of
personal and payment of wages
or to furnish to him such
information as he may consider
necessary; or

(c)
examine the principal or immediate
employer, his agent or servant, or
any person found in such factory,
establishment, office or other
premises or any person whom the
said inspector or other official has
reasonable cause to believe to
have been an employee; or
(d)
make copies of or take extracts from
any register, account book or
other document maintained in
such factory, establishment, office
or other premises;
(e)
exercise such other powers as may
be prescribed.
(6)
In case of disinvestment/corporatization, the
exemption granted shall become automatically
cancelled and then the new entity will have to
approach the appropriate Government for
exemption.
