New Delhi, the 11th May, 2015
In re :
Appeal under Section 11 of the Representation of the People Act, 1951 (43 of 1951) for removal of disqualification
imposed under Section 10A of the said Act on Shri Umesh Chand Senthia, a contesting candidate from 92-
Kheragarh Assembly Constituency at the General Election to Legislative Assembly held in 2012 .
O. N. 30.—Whereas, Shri Umesh Chand Senthia, a contesting candidate from 92-Kheragarh Assembly Constituency
in the State of Uttar Pradesh during Legislative Assembly General Election, 2012, had been disqualified under Section l0A
of the Representation of People Act, 1951, for failure to lodge the account of his election expenses in the manner required
by law, vide Commission's Order No.76/UP-LA/2012, dated 07.11.2014; and
Whereas, after receipt of the Commission's disqualification order dated 07.11.2014, Shri Umesh Chand Senthia, has
presented, an appeal dated 25.11.2014, under Section 11 of the aforesaid Act, along with relevant documents, for removal of
disqualification imposed on him vide Commission's aforesaid order and also requested for a personal hearing; and
Whereas, the Appellate Authority Shri Vinod Zutshi, Deputy Election Commissioner has heard Shri Umesh Chand
Senthia, in person on 17.04.2015 in the Commission's Secretariat; and
Whereas, after hearing Shri Umesh Chand Senthia, the Appellate Authority is satisfied that he has good reasons
for his failure to lodge account fully in the manner prescribed by law and has further noted that the aforesaid candidate
has now rectified the defects in his election account; and
Whereas, the Appellate Authority has decided to revoke disqualification imposed upon him vide aforesaid Order
dated 07.11.2014 and has further decided to revoke it with effect from 11.05.2015; and
Now, therefore, the disqualification imposed upon Shri Umesh Chand Senthia, a contesting candidate vide
Commission's Order 76/UP-LA/2012, dated 07.11.2014 is revoked with effect from 11.05.2015.
