ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 7th August, 2015

O.N. 76 .—Whereas, the Election Commission of India is satisfied that the contesting candidates specified in

column (4) of the Table below at the General Election to the Legislative Assembly, 2012 in the Gujarat State specified in

column (2) and held from the Constituency specified in column (3) against his name has failed to lodge any account of his

election expenses as shown in coulmn (5) of the said Table as required by the Representation of the People Act, 1951 and

the rules made thereunder;

And whereas, the said candidate has not furnished any reason or explanation for the said failure even after due

notice by the Election Commission of India and the Election Commission of India is satisfied that he has no good reason or

justification for the said failure:

Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission of India hereby declares the

persons specified in column (4) of the Table below to be disqualified for being chosen as and for being a member of either

House of Parliament or of the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three

O.N. 79.—Whereas, the Election Commission of India is satisfied that the contesting candidates specified in

column (4) of the Table below at the General Election to the Legislative Assembly, 2013 in the Madhya Pradesh State

specified in column (2) and held from the Constituency specified in column (3) against his/her name has failed to lodge the

account of his/her election expenses in manner required by law as shown in coulmn (5) of the said Table as required by the

Representation of the People Act, 1951 and the Rules made thereunder;

And whereas, the said candidate has either not furnished any reason or explanation for the said failure even after

O. N. 80 .—Whereas, the Commission, vide its Order No. 76/BR-LA/2010, dated 7th August, 2014 had disqualified

under Section l0A of the Representation of People Act, 1951, Shri Suresh Paswan, Vill+Post - Rahikpur Thila Mohan, PS -

Simraha, Forbesganj, Bihar a contesting candidate for the General Election to the Bihar Legislative Assembly from 48-

Forbesganj Assembly Constituency, held in the year 2010, for being chosen as, and for being a member of either House of

the People or of the Legislative Assembly or Legislative Council of a State for a period of three years, for not lodging his

account of election expenses in the manner required by law.

And, whereas, the said Shri Suresh Paswan had preferred an appeal under Section 11 of the Representation of

People Act, 1951 against the said order and had requested for the removal of the disqualification for the reasons stated in

the said appeal dated 11the June, 2015.

And, whereas, the competent Authority decided to give a personal hearing to the aforesaid applicant for deciding

the apppeal under Section 11 of the Representation of People Act, 1951 and having heard him, has decided, vide order dated

24th August, 2015 that the disqualification imposed on said Shri Suresh Paswan, vide Order No. 76/BR-LA/2010, dated 7th

August, 2014, shall be revoked with immediate effect.

O.N. 82 .—Whereas, the Election Commission of India is satisfied that each of the contesting candidate specified

in column (4) of the Table below at the General Election to the Lok Sabha, 2014 from the State of Tamil Nadu specified in

column (2) and held from the Constituency specified in column (3) against his/her name has failed to lodge the account of

his/her election expenses as shown in coulmn (5) of the said Table as required by the Representation of the People Act,

1951 and the rules made thereunder;

And whereas, the said candidates have either not furnished any reason or explanation for the said failure even

after due notice by the Election Commission or after considering the representation made by them, if any, the Election

Commission is statisfed that they have no good reason or justification for the said failure:

Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission hereby declares the persons

specified in column (4) of the Table below to be disqualified for being chosen as and for being a member of either House of

Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from

Bihar, (3). Sh. Hari Mohan Singh, Vill-Gopalpur, Po-Natwapara, Ps-Bahadurganj, Distt-Kishanganj, Bihar a contesting

candidate for the General Election to the Bihar Legislative Assembly from 52-Bahadurganj Assembly Constituency, held in

the year 2010, for being chosen as, and for being a member of either House of the People or of the Legislative Assembly or

Legislative Council of a State for a period of three years, for not lodging his account of election expenses in the manner

required by law.

Now, therefore, the name of (1). Asif Rahman, (2). Shamim Alam (3). Sh. Hari Mohan Singh appearing at Serial no.

8,10 and 12 respectively of the Table appended with Commission’s Order no. 76/BR-LA/2010 dated 26th February, 2014,

O.N. 84 .—Whereas, the Commission, vide its Order No. 76/BR-LA/2010 dated 26th February 2014, had disqualified

under Section 10A of the Representation of the People Act, 1951, Shri Sakil Akhtar, Vill-Darnia, PO-Meharganj, PS-

Bahadurganj, Dist-Kishanganj, Bihar a contesting candidate for the General Election to the Bihar Legislative Assembly

from 52-Bahadurganj Assembly Constituency, held in the year 2010, for being chosen as, and for being a member of either

House of the People or of the Legislative Assembly or Legislative Council of a State for a period of three years, for not

lodging his account of election expenses in the manner required by law.

And, whereas, the said Shri Sakil Akhtar had preferred an appeal dated nil under Section 11 of the Representation

of the People Act, 1951 against the said order and had requested for the removal of the disqualification for the reasons

stated in the said appeal.

And, whereas, the competent authority having considered the aforesaid appeal, decided vide its order dated 27th

August, 2015 that the disqualification imposed on said Shri Sakil Akhtar, vide Order No.76/BR-LA/2010 dated 26th

February, 2014, shall be revoked with effect from 26th February, 2015.

Now, therefore, the name of Shri Sakil Akhtar, appearing at Serial no. 11 of the Table appended with Commission’s

Order no. 76/BR-LA/2010 dated 26th February, 2014, shall be omitted w.e.f. 26th February, 2014.

O. N. 85.—In exercise of the powers conferred by sub-section (1) of Section 13A of the Representation of the

People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the State Government concerned,

hereby nominates Shri Tenzing Gelek, IAS (SK : 1999) as the Chief Electoral Officer, Sikkim with effect from the date he takes

over charge and until further orders.

2. Shri Tenzing Gelek, IAS shall cease to hold and hand over forthwith the charge of all or any work under the

Government of Sikkim, which he may be holding before such assumption of office.

3. Shri Tenzing Gelek, IAS while functioning as the Chief Electoral Officer, Sikkim, shall not hold any additional

charge whatsoever under the Government of Sikkim, except that he should be designated Secretary to the Government in

charge of Election Department in the State Secretariat.
