No. 03 of 2015 F.No. No. A-27023/14/2015-Ad.VI(A)—Shri J.M.Hiremath, IRS (IT: 91084) was granted Study
Leave for two years from 02.08.1999 to 01.08.2001 for pursuing MBA course in USA. He was subsequently granted Extra
Ordinary Leave (EOL) on personal grounds from 02.08.2001 to 01.08.2003. Shri Hiremath did not report for duty after
expiry of EOL and remained unauthorized absence from duty since 02.08.2003. Shri Hiremath was issued a Charge
Memorandum dated 23.10.2006 for his unauthorized absence through CCIT (CCA), Bangaluru. However, the same could not
be served to the officer as there was nobody to receive the documents at the address indicated in Service Records.
2. Sh. Hiremath continued to remain on unauthorized absence during this period and did not make any contact with
the Authorities. A notice was published in the National daily and Regional language (Kannada) on 05.08.2015 directing Shri
Hiremath to appear before the authorities or submit his written representation by 07.08.2015 in this regard. Despite the
Public Notice neither Shri Hiremath had appeared in person before the authority nor sent any written representation received
so far.
3. Sh. Hiremath has been on unauthorized absence since 2.8.2003, now, therefore, in exercise of the power
conferred under DoPT G.S.R 261(E) dated 29.3.2012 read with Rule 12(2) of CCS (Leave) Rules, 1972 which states that a
Government servant who remains absent from duty for a continuous period exceeding five years other than on foreign
service, with or without leave, shall be deemed to have resigned from the Govt. service provided that a reasonable
opportunity to explain the reasons for such absence be given to that Govt. servant before provisions of sub-rule (2) are
invoked.
4. The President of India has given his consent to treat continuous absence of Shri Hiremath as deemed resignation
from Indian Revenue Service with immediate effect under Rule 12(2) of CCS(Leave) Rules, 1972.
5. The officer will not be entitled for any retirement benefits.
