+चCक9 सा महाDवयालय क5 E थापना (अF ययन का नया अथवा उH चतर पाIयJम या 8KशLण 8ारंभ करना तथा +चCक9 सा

महाDवयालय वारा 8वेश Lमता मO वृDQ करना) Dव-नयम, 2011 मO आगे संशोधन करती है, अथा'त:

(1) इन Dव-नयम= का नाम नए +चCक9 सा महाDवयालय क5 E थापना (अF ययन का नया अथवा उH चतर पाIयJम या

8KशLण 8ारंभ करना तथा +चCक9 सा महाDवयालय वारा 8वेश Lमता मO वृDQ करना) संशोधन Dव-नयम, 2016 होगा ।

(2) ये भारत के राजपW मO 8काशन क5 -त+थ से 8वृ9 त ह=गे ।

2 नए +चCक9 सा महाDवयालय क5 E थापना (अF ययन का नया अथवा उH चतर पाIयJम या 8KशLण 8ारंभ करना तथा

+चCक9 सा महाDवयालय वारा 8वेश Lमता मO वृDQ करना) Dव-नयम, 2011 मO (यहॉ इसके पX चात् उ< त Dव-नयम के नाम

से संदKभ'त) मO, Dव-नयम 1 मO, उप Dव-नमय (1) मO, “नये आयुDव'[ान महाDवयालय” श] द= को “नये हो योपैथी

आयुDव'[ान महाDवयालय” श] द= से 8-तE थाDपत Cकया जाएगा ।

उ< त Dव-नयम= के Dव-नयम 6 मO, -

(क) ख_ ड (ख) के Kलए, -न न ख_ ड को 8-तE थाDपत Cकया जायेगा, अथा'त:-

“(ख) महाDवयालय के नाम मO अपना अथवा कम से कम तीस वषa के Kलए पbे पर :-

(i)

साठ सीट= क5 8वेश Lमता हेतु, कम से कम ढ+kई एकड+ का एक भूख_ ड e ामीण LेW= मO,

अथवा कम से कम दो एकड+ का भूख_ ड शहर तथा पव'तीय LेW= मO,

(ii)

साठ सीट= से अ+धक Cक तु एक सौ सीट= तक 8वेश Lमता हेतु कम से कम दो g लॉट

िजनक5 दूर दो Cकलोमीटर से अ+धक नहं ह= सहत भूख_ ड िजनका माप कम से कम चार

एकड+ का e ामीण LेW मO अथवा कम से कम तीन एकड+ शहर तथा पव'तीय LेW मO हो ।

h या या :- इस ख_ ड हेतु भूख_ ड यद सड+क अथवा नहर अथवा नाला वारा अलग Cकए गये

ह= Cक तु पुल से जुडे ह= तो उ हO एक माना जाएगा ।

(ii)

ख_ ड (ड.) के Kलए -न न ख_ ड को 8-तE थाDपत Cकया जायेगा, अथा'त:-

“(ड.) हो योपैथी के् य परष (हो योपै+थक महाDवयालयो तथा संलi न अE पताल= के Kलए

यूनतम मानक E तर) Dव-नयम, 2013 के 8ावधान= के आधार पर अपना हो योपै+थक

अE g ाताल का 8बंधन करता हो ।”

(iii)

ख_ ड (ड.) के पX चात्, -न न ख_ ड (ड. क) को जोडा जायेगा, अथा'त:-

“(ड.क) यह इस िEथ-त मO हो Cक वह हो योपैथी के् य परष (हो योपैथी महाDवयालय

तथा संलi न अE पताल= के Kलए यूनतम मानक E तर) Dव-नयम,2013 के उपबंध= के आधार

पर बु-नयाद ढॉचा त था kमशि<त को चरणबQ lप मO E थाDपत कर सके”,।

(iv)

ख_ ड (छ) के Kलए, -न न ख_ ड को 8-तE थाDपत Cकया जायेगा, अथा'त:-

“ (छ) यह इस िEथ-त मO हो Cक वह के य हो योपैथी परष, नई द ल के नाम से

पाIयJम क5 अव+ध के समय के Kलए एक मा य अनुसू+चत काय'अनुपालन बoक 89 याभू-त

-न न 8कार से उपल]ध कर सके :-

(i)

60 सीट= क5 8वेश Lमता के साथ महाDवयालय – lपये एक करोड,

(ii)

साठ सीट= क5 8वेश Lमता से अ+धक Cक तु एक सौ सीट= तक क5 8वेश Lमता के

साथ महाDवयालय – lपये एक करोड+ तथा पचास लाख;

पर तु यह उन महाDवयालय= िजनका संचालन राr य सरकार= अथवा के शाKसत

8शासन वारा Cकया जाता हो, पर लागू नहं होगा, यद वे अपनी योजना बजट मO -नयKम त

lप से स मयबQ काय'Jम के अनुसार पूण' lप से आवX यक सुDवधाओं क5 उपल] F ाता तक

Dव9 त पोषण करने के संबंध मO शपथ पW दO;”।

(ख)

उप Dव-नयम (2) मO –

(i) ख_ ड (घ) के Kलए, -न न को 8-तE थाDपत Cकया जाएगा, अथा'त :-

“(घ) यह के य परष वारा हो योपैथी मO E नातक अथवा E नातको9 तर uडeी पाIयJम

चलाने हेतु कम से कम चार वष' छ: माह एवं तीन वष' से Jमश: मा यता 8ाg त हो;” ।

(ii)

ख_ ड (छ) मO, “KशLक-छाW अनुपात” श] द= को “सुपरवाइजर (गाइड)-छाW अनुपात ” श] द=

से 8-तE थाDपत Cकया जाएगा ।

(iii)

ख_ ड (ज) के Kलए, -न न को 8-तE थाDपत Cकया जाएगा, अथा'त :-

“(ज) आयुDव'[ान महाDवयालय, के य हो योपैथी परष, नई द ल के नाम से पाIयJम

क5 अव+ध के समय के Kलए एक मा य अनुसू+चत बoक से काय'अनुपालन बoक 89 याभू-त

89 येक Dवधा मO अ-तर< त बु-नयाद सुDवधाओं के उपल] ध कराने के Kलए -न न 8कार से

उपल] F ा कर सके:-

तथा हो योपैथी के य परष (हो योपैथी महाDवयालय तथा संलi न अE पताल= के Kलए

यूनतम मानक E तर) Dव-नयम, 2013 के उपबंध= के आधार पर बु-नयाद ढॉचा त था

kमशि<त को E थाDपत कर सके”।

(ग) उप Dव-नयम (3) मO,-

(i)

ख_ ड (घ) मO, “साढे+ पांच वष'” श] द= को “साढे+ चार वष'” श] द= से 8-तE थाDपत Cकया

जाएगा ।

(ii)

ख_ ड (च) के Kलए -न न ख_ ड को 8-तE थाDपत Cकया जाएगा, अथा'त :-

(च) सुपरवाइजर(गाइड) तथा छाW= का अनुपात हो योपैथी (E नातको9 तर uडeी पाIयJम)

Dव-नमय, 1989 मO उ लेwखत 8ावधान= के अनुसार रखा जाएगा’’ ।

(iii) ख_ ड (ज) के Kलए, -न न को 8-तE थाDपत Cकया जाएगा, अथा'त :-

उ< त Dव-नयम= के Dव-नयम 8, को पुन: अंकन कर उप Dव-नयम (1) Cकया जायेगा इस 8कार पुन: अंकन हुए

उप Dव-नयम (1) के पX चात् -न न उप Dव-नयम को tksM+k जायेगा, अथा'त :-

“ (2) जहॉ के य सरकार वारा Cकसी भी कारण से आवेदन को नामंजूर Cकया जाता है, –

( क)

यद के य हो योपैथी परष को आवेदन अeेDषत Cकए zबना, उप- Dव-नयम (1) अंतग'त 8ाg त

शु क को लौटा दया जायेगा;

(ख) के य हो योपैथी परष क5 संE तु-त पर, उप -Dव-नयम (1) के अंतग'त 8ाg त शु क को लौटाया

नहं जाएगा, Cक तु आवेदक ऐसी नामंजूर क5 -त+थ से इस शत' के साथ Cक lपये पचास

हजार का अदेय 8CJया शु क का भुगतान कर तीन वष| के मF य 89 येक वष' मO एक बार पुन:

आवेदन कर सकता है;”।

5. उ< त Dव-नयम= मO, Dव-नयम 9 के Kलए -न न Dव-नयम को 8-तE थाDपत Cकया जाएगा अथा'त:-

“9.

अनुम-त आदेश – (1) के य हो योपैथी परष क5 संE तु-त पर के य सरकार एक नया

हो योपै+थक आयुDव'[ान महाDवयालय को खोलने के Kलए अथवा नये पाIयJम आरंभ करने

अथवा 8वेश Lमता मO वृDQ करने हेतु ऐसी शत| अथवा la’kksa/kuksa के साथ जो Cक आवX यक

समझे जाए, के साथ आशय का पW जार करेगी ।

(2) नये हो योपै+थक आयुDव'[ान महाDवयालय आरंभ करने हेतु आशय पW मO छाW= के

8थम दल के 8वेश करने से पूव', भवन, अवसंरचनात् मक सुDवधाओं, आयुDव'[ानी तथा संबQ

उपE कर, संकाय तथा कम'चारवृ द क5 आवX यकताओं िज हO पूरा Cकया जाना है, का Dववरण

सि मKलत होगा ।

(3) नये पाIयJम आरंभ करने अथवा 8वेश Lमता मO वृDQ हेतु आशय पW मO छाW= के 8थम

दल के 8वेश करने से पूव', भवन, अवसंरचना9 मक सुDवधाओं, आयुDव'[ानी तथा संबQ

उपE कर, संकाय कम'चारवृ द क5 आवX यकताओं िज हO पूरा Cकया जाना है तथा वत'मान

E नातक अथवा E नातको9 तर पाIयJम हेतु अनुम-त अथवा सशत' अनुम-त का Dववरण

सि मKलत होगा ।

(4) अनुम-त पW उप Dव-नयम (2) तथा (3) मO उ लेwखत शत| के अनुपालन क5 E वीकृ-त के

पX चात् तथा h यि<त वारा वॉ-छत राKश क5 काय'अनुपालन बoक 89 याभू-त देने के पX चात्

तथा के य हो योपैथी परष क5 संE तु-त 8ाg त होने के पX चात् ह जार Cकया जाएगा ।

(5) औपचारक अनु म-त मO हो योपै+थक आयुDव'[ान महाDवयालय तथा अE पताल क5

E थापना तथा DवE तार हेतु समयबQ काय'Jम सि मKलत होगा तथा इसमO के य हो योपैथी

परष वारा -नधा'रत वाDष'क ल• य= का वण'न होगा िज हO आवेदक वारा अगले वष| मO

छाW= के 8वेश के पूव' 8ाg त करना होगा, सि मKलत ह=गे ।

(6) एक हो योपै+थक आयुDव'[ान महाDवयालय आरंभ करने तथा छाW= के 8वेश देने हेतु

8ारंKभक अनुम-त एक वष' के Kलए द जाएगी तथा वा Dष'क ल• य= क5 8ािgत क5 जॉच के

पX चात् 8-त वष' नवीनीकरण Cकया जाएगा । यह आवेदक क5 िज मेदार होगी Cक वह

8ारंKभक अनुम-त क5 समािgत से छ: माह पूव' के य हो योपैथी परष को नवीकरण हेतु

आवेदन करे ।

(7) उप-Dव-नयम (6) मO उ लेwखत 8CJया तब तक जार रहेगी जब तक Cक हो योपै+थक

आयुDव'[ान महाDवयालय E थापना तथा अE पताल के DवE तार का काम पूरा कर ले तथा

हो योपै+थक आयुDव'[ान महाDवयालय को औपचारक मा यता द जाए ।

पर तु Cकसी भी E तर पर 8वेश तब तक नहं दए जाऐंगे जब तक Cक के य

हो योपैथी परष वारा -नधा'रत vko’drkvksa को पूरा न कर Kलया जाए ।

(8) के य सरकार Cकसी भी E तर पर आवेदक को कKमय= को सू+चत कर सकती है तथा

उन कKमय= को दूर करने हेतु एक अवसर एवं समय 8दान कर सकती है ।

(9) के य हो योपैथी परष 8E ताDवत आयुDव'[ान महाDवयालय से Cकसी भी 8कार क5

सूचना मंगा सकती है जैसी इसे जlर लगे या आवX यक ह= ’’।

उ< त Dव-नयम= मO, 8पW-1 मO, J सं 23 मO, उप Jम सं या (ख) के Kलए, -न न को 8-तE थाDपत

Cकया जाएगा :-

“(ख) शै€याओं का बंटवारा, श€याओं का अ+धभोग तथा < या हो योपैथी के य परष

(हो योपैथी महाDवयालय तथा संलi न अE पताल= के Kलए यूनतम मानक E तर) Dव-नयम,

2013 मO -नद'•ट मानक= का अनुपालन Cकया गया” ।

7. उ< त Dव-नयम= मO 8पW- 6 मO, -

(क) पैरा 2 के Kलए, -न न पैरा को 8-तE थाDपत Cकया जाएगा, अथा'त:-

“ 2. -नरLण 8-तवेदन तथा अ य संबं+धत कागजात= को परष क5 काय'कारणी सKम-त के

स मुख इसक5 बैठक मO दनॉक ................ को रखा गया था । 8E ताव पर F यान पूव'क

Dवचार करने के पX चात् काय'कारणी सKम-त ने योजना को E वीकार कर आशय का पW जार

करने हेतु अथवा अE वीकार करने क5 संE तु-त करने का fu.kZ; Kलया ”।

(ख) पैरा 3 मO, उप पैरा (iii) के Kलए, -न न उप पैरा को 8-तE थाDपत Cकया जाएगा, अथा'त :-

“(iii) Cक आवेदक के पास Dवयमान अE पताल के उ नयन हेतु अ-तर< त शै€या उपल] ध

कराने तथा अवसंरचना9 मक सुDवधाओं जैसा Cक के य परष वारा -नधा'रत Cकया गया

ह=, के संबंध मO चरणबQ DवE तार काय'Jम है जो Cक संयु< त lप से 8E ताDवत महाDवयालय

को अनुम-त दए जाने क5 दनॉक से चार वष| मO, हो योपैथी के य परष (हो योपैथी

महाDवयालय तथा संलi न अE पताल= के Kलए यूनतम मानक E तर) Dव-नयम, 2013 मO

-नद'• ट शै€याओं या अ य शत| को पूण' करेगा” ।

CENTRAL COUNCIL OF HOMOEOPATHY

New Delhi, the 2016

F.No 12-6/2001-C.C.H.(Pt. – II) — In exercise of the powers conferred by section 33 read with section 12A of the

Homoeopathy Central Council Act, 1973 (59 of 1973), the Central Council of Homoeopathy, with the previous sanction of

the Central Government, hereby makes the following regulations to amend the Establishment of New Medical College

(Opening of New or Higher Course of Study or Training and Increase of Admission Capacity by a Medical College)

Regulations, 2011, namely:-

(1) These regulations may be called the Establishment of New Medical College (Opening of New or Higher

Course of Study or Training and Increase of Admission Capacity by a Medical College) Amendments Regulations, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

In the Establishment of New Medical College (Opening of New or Higher Course of Study or Training and

Increase of Admission Capacity by a Medical College) Regulations, 2011. (hereinafter referred to as the said Regulations), in

regulation 1, in sub-regulation (1), for the words “New Medical College”, the words “New Homoeopathy Medical College”

shall be substituted.

In regulation 6 of the said Regulations,—]

(a)

in sub-regulation (1),—

(i)

for clause (b), the following clause shall be substituted, namely:-

“(b)

owns or possesses on lease, in the name of the college for a period of not less than thirty years,—

(i)

in the case of intake capacity upto sixty seats, a single plot of land measuring not less

than two and half acres in rural areas, or two acres in urban and hilly areas;

(ii)

in the case of intake capacity exceeding sixty seats but not exceeding one hundred seats,

the land measuring not less than four acres in rural areas, or not less than three acres in urban and

hilly areas, comprising of not more than two plots at a distance not exceeding two kilometres;

Explanation.— For the purposes of this clause, a plot, if separated by road or canal or rivulet but connected with a

bridge, shall be treated as one plot.”;

(ii)

for clause (e), the following clause shall be substituted, namely:-

“(e)

owns and manages a homoeopathic hospital in accordance with the provisions of the Homoeopathy Central

Council (Minimum Standards Requirement of Homoeopathic Colleges and attached Hospitals) Regulations, 2013;”;

(iii)

after clause (e), the following clause (ea) shall be inserted, namely:-

“(ea) is in a position to establish infrastructure and manpower in phased manner in accordance with the provisions of

the Homoeopathy Central Council (Minimum Standards Requirement of Homoeopathic Colleges and attached Hospitals)

Regulations, 2013;”;

(iv)

for clause (g), the following clause shall be substituted, namely:-

“(g)

is in a position to provide performance bank guarantee from a Scheduled Bank valid for a period equivalent

to the duration of the course in favour of the Central Council of Homoeopathy, New Delhi as follows:-

(i)

College with capacity upto 60 seats - rupees one crore;

(ii)

College with capacity exceeding sixty seats but not exceeding one hundred seats – rupees one crore

and fifty lakhs:

Provided that it shall not apply to the colleges governed by the State Government or Union Territory Administration,

if they give an undertaking to provide funds in their Plan Budget regularly till the requisite facilities are fully provided as per

the time bound programme indicated by them;”.

(b)

in sub-regulation (2),—

(i)

for clause (d), following clause shall be substituted, namely:-

“(d)

is recognised by the Central Council for running Undergraduate or Postgraduate degree course in

Homoeopathy for at least four years six months and three years respectively”.

(ii)

in clause (g), for the words “teacher-student ratio”, the words “Supervisor (Guide) - student ratio”

shall be substituted;

(iii)

for clause (h), following clause shall be substituted, namely:-

“(h)

the medical college provides an undertaking to furnish a bank guarantee in favour of the Central Council

of Homoeopathy, New Delhi, from a Scheduled Bank for a period equivalent to the duration of the course for providing

additional infrastructural facilities for each discipline as follows:-

(i)

Post Graduate course - rupees fifty lakhs;

(ii)

Any other recognized course - rupees thirty lakhs.

Provided that it shall not apply to the colleges governed by the State Government or Union Territory Administration,

if they give an undertaking to provide funds in their Plan Budget regularly till the requisite facilities are fully provided as per

the time bound programme indicated by them;” or ;

(iv)

after the clause (h), following clause (i) shall be inserted, namely:-

“(i)

it is in a position to establish infrastructure and manpower in accordance with the provisions of the

Homoeopathy (Post Graduate Degree Course) Regulations, 1989 and the Homoeopathy Central Council (Minimum

Standards Requirement of Homoeopathic Colleges and attached Hospitals) Regulations, 2013.”.

(c)

in sub-regulation (3),—

(i)

in clause (d), for the words “five and half year”, the words “four and half year” shall be

substituted;

(ii)

for clause (f), the following clause shall be substituted, namely:-

“(f)

the ratio of supervisor (Guide) and students is maintained as laid down in the Homoeopathy (Post Graduate

Degree Course) Regulations, 1989”.

(iii)

for clause (h), the following clause shall be substituted, namely:-

“(h)

provide an undertaking to furnish a bank guarantee in favour of the Central Council of Homoeopathy, New

Delhi, from a Scheduled Bank for a period equivalent to the duration of the course for providing additional infrastructural

facilities for each course or discipline as follows:-

(i)

Undergraduate course

College with the capacity upto

sixty seats

College with the capacity

Provided that it shall not apply to the colleges governed by the State Government or Union Territory Administration,

if they give an undertaking to provide funds in their Plan Budget regularly till the requisite facilities are fully provided as per

the time bound programme indicated by them.”.

4. Regulation 8 of the said Regulations, shall be renumbered as sub-regulation (1) thereof and after sub-regulation

(1) as so renumbered, the following sub-regulation shall be inserted, namely:-

“(2)

Where the application is rejected by the Central Government for any reason,—

(a)

without referring the application to the Central Council of Homoeopathy, the fees paid under sub-

regulation (1) shall be returned to the applicant;

(b)

on the recommendation of the Central Council of Homoeopathy, the fees paid under sub-

regulation (1) shall not be returned, but the applicant may re-submit the application once in each

year within a period of three years from the date of such rejection subject to the payment of a non-

refundable processing fee of rupees fifty thousand for each such application.”.

In the said Regulations, for regulation 9, the following regulation shall be substituted, namely:-

“9.

Permission Order.— (1) The Central Government on the recommendation of the Central Council of

Homoeopathy shall issue a letter of Intent to set up a new Homoeopathic medical college or open new

course or increase intake capacity with such conditions or modifications as may be considered necessary.

(2)

The Letter of Intent to set up a new Homoeopathic medical college shall include a statement of

requirements to be met in respect of buildings, infrastructural facilities, medical and allied equipment,

faculty and staff before admitting the first batch of students.

(3)

The Letter of Intent to open new course or increase intake capacity shall include a statement of

requirements to be met in respect of buildings, infrastructural facilities, medical and allied equipment,

faculty staff and obtaining the permission or conditional permission for existing undergraduate or

post graduate course.

(4) The Letter of permission shall be issued on compliance of the conditions referred to in sub-

regulations (2) and (3) are accepted and the performance bank guarantees for the required amount is

furnished by the person and after receiving the recommendations of the Central Council of

Homoeopathy.

(5)

The formal permission shall include a time bound programme for the establishment and expansion of

the homoeopathic medical college and the hospital facilities and it shall also define annual targets as

may be fixed by the Central Council of Homoeopathy to be achieved by the person commensurate

with the intake of students during the following years.

(6)

The permission to establish a homoeopathic medical college and admit students shall be granted

initially for a period of one year and shall be renewed on yearly basis subject to verification of the

achievements of annual targets and it shall be the responsibility of the person to apply to the Central

Council of Homoeopathy for the renewal six months prior to the expiry of the initial permission.

(7)

This process of renewal referred to in sub-regulation (6) shall continue till such time the

establishment of the homoeopathic medical college and expansion of the hospital facilities are

completed and a formal recognition of the homoeopathic medical college is granted:

Provided that the admissions shall not be made at any stage unless the requirements of the Central Council of

Homoeopathy are fulfilled.

(8)

The Central Government may at any stage convey the deficiencies to the applicant and provide him

an opportunity and time to rectify the deficiencies.

(9)

The Central Council of Homoeopathy may obtain any other information from the proposed medical

college as it deems fit and necessary.”.

In the said Regulations, in Form-1, in serial number 23, for sub-serial numbers (b), the following shall be

substituted, namely:-

“(b)

bed distribution, bed occupancy and whether the norms specified in Homoeopathy Central Council

(Minimum Standards Requirement of Homoeopathic Colleges and attached Hospitals) Regulations, 2013 would be

fulfilled.”.

In the said Regulations, in Form-6,—

(a)

for paragraph 2, the following paragraph shall be substituted, namely:-

“2.

The inspection report and all other related papers were placed before the Executive Committee of the

Council in its meeting held on ______________. On careful consideration of the proposal, the Executive Committee decided

to recommend for approval or disapproval of the Scheme for issue of Letter of Intent or permission.”;

(b)

in paragraph 3, for sub-paragraph (iii), following sub-paragraph shall be substituted, namely:-

“(iii)

that the applicant has a feasible and time bound expansion programme to provide additional beds and

infrastructure facilities as specified by the Central Council, by way of up-gradation of the existing Hospital so as to

collectively provide the specified bed complement within a period of four years from the date of grant of permission to set up

the proposed College and any other conditions as specified in the Homoeopathy Central Council (Minimum Standards

Requirement of Homoeopathic Colleges and attached Hospitals) Regulations, 2013.”.
