O.N. 46.— Whereas, the Election Commission of India is satisfied that the contesting candidate specified in

column 4 of the Table below at the General Election to the Legislative Assembly 2013, in the Meghalaya State held

from the constituency specified in column 3 against his name, has failed to lodge the account of his election expenses as

shown in column 5 of the said Table as required by the Representation of the People Act, 1951 and the Rules made

thereunder;

And whereas, the said candidate has either not furnished any reason or explanation for the said failure even

after due notice by the Election Commission or the Election Commission is satisfied that he has no good reason or

justification for the said failure;

Now, therefore, in pursuance of section 10A of the said Act, the Election Commission hereby declares the

O.N. 50.—Whereas, the Election Commission is satisfied that Shri Anup Srivastava, C-4, Nehru Vihar

Kalyanpur, Lucknow.226022, Uttar Pradesh, a contesting candidate for the Bye Election to the Legislative Assembly,

2014 from 173-Lucknow East Assembly Constituency in the State of Uttar Pradesh has failed to lodge any account of

his election expenses as required by the Representation of the People Act, 1951 and Rules and Order made thereunder;

and

Whereas, Shri Anup Srivastava has not furnished any reason or explanation for the said failure even after due

notice and the Election Commission is thus satisfied that he has no good reason or justification for the said failure;

Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission hereby declares the said Shri Anup Srivastava to be disqualified for being chosen as, and for being, a

member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State for a period

of three years from the date of this order.

िव.स./2011 के !ारा वष 2011 म$ आयोिजत 54-गुवाहाटी पि/म िवधान सभा िनवाचन 2े3 से असम िवधान

सभा के साधारण िनवाचन म$ िनवाचन लड़ने वाले अ6यथ8, 9ी रंजीत कुमार डेका, मकान सं. 78, वाड-35,

चेनीकुठी, गुवाहाटी-3, असम को िविध !ारा अपेि2त रीित से िनवाचन <य का अपना लेखा दािखल नह> करने के

िलए, लोक ?ितिनिध@व अिधिनयम कA धारा 10क के अधीन संसद के कसी सदन या कसी राBय कA िवधान सभा

या िवधान पCरषद के िलए सदEय चुने जाने और होने के िलए तीन वष कA अविध के िलए िनरGहत घोिषत कर

दया था।

और यतः उL 9ी रंजीत कुमार डेका ने उL आदेश के िवMN लोक ?ितिनिध@व अिधिनयम, 1951 कA

धारा 11 के अधीन एक अपील दायर कA थी तथा दनांक 23 फरवरी, 2016 कA किथत अपील म$ दए गए कारणQ

के आधार पर िनरहता हटाने के िलए अनुरोध कया था।

यत:, स2म ?ािधकारी ने लोक ?ितिनिध@व अिधिनयम, 1951 कA धारा 11 के अधीन अपील पर िनणय

लेने के िलए उपयुL आवेदक को वैयिLक सुनवाई का अवसर देने का िनणय िलया तथा उसे सुनने के प/ात दनांक

16 मई, 2016 के अपने आदेश के !ारा यह िनणय िलया है क दनांक 31 दसबर, 2013 के आदेश सं.

76/असम-िव.स/2011 !ारा उL 9ी रंजीत कुमार डेका पर अिधरोिपत िनरहता त@काल ?भाव से हटा ली जाए।

अतः, अब, आयोग के दनांक 31 दसबर, 2013 के आदेश सं. 76/असम-िव.स/2011 से संलT सारणी के

Uम सं. 5 पर उिलिखत 9ी रंजीत कुमार डेका का नाम 16 मई, 2016 से हटा दया जाए।

O.N. 51.—Whereas, the Election Commission vide its Order No.76/AS-LA/2011 dated 31^st December, 2013

had disqualified under Section 10A of the Representation of the People Act, Shri Ranjeet Kr. Deka, House No. 78,

Ward –35,Chenikuthi, Guwahati-3, Assam, a contesting candidate in the General Election to the Assam Legislative

Assembly from 54-Guwahati West Legislative Assembly Constituency, held in the year 2011, for being chosen as, and

for being a member of either House of the People or of the Legislative Assembly or Legislative Council of a State for a

period of three years, for not lodging his account of election expenses in the manner required by law.

And Whereas, the said Shri Ranjeet Kr. Deka , had preferred an appeal under Section 11 of the Representation

of People Act, 1951 against the said Order and had requested for the removal of the disqualification for the reasons

stated in the said appeal dated 23^rd February, 2016.

Whereas, the Competent Authority decided to give a personal hearing to the aforesaid applicant for deciding

the appeal under section 11 of the Representation of the People Act, 1951 and having heard him, has decided vide its

order dated 16^th May, 2016 that the disqualification imposed on said Shri Ranjeet Kr. Deka vide Order No. 76/AS-

LA/2011 dated 31^st December, 2013 shall be revoked with immediate effect.

Now, Therefore, the name of Shri Ranjeet Kr. Deka appearing at Serial no.5 of the Table appended with

Commission’s Order no. . 76/AS-LA/2011 dated 31^st December, 2013 be omitted w.e.f. 16^th May, 2016.
