of the revenue districts of Gurgaon and Faridabad in the State of Haryana to exercise all the powers under

Section 4 and Section 6 of the aforesaid Act in their respective districts.

का. िन. आ. 38.—रा᳦पित, संिवधान के अनु᭒छेद 309 के पर᭠तुक ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए और रᭃा

मंᮢालय, ऑडᭅनᱶस तथा ऑडᭅनᱶस उप᭭कर कारखाना, समूह “ख” एवं समूह “ग” पद, राजभाषा काडर भतᱮ िनयम 2009 को,

जहाँ तक उनका संबंध िह᭠दी अिधकारी के पद से है, उन बातᲂ के िसवाय अिधᮓांत करते ᱟए िज᭠हᱶ ऐसे अिधᮓमण से पहले

ᳰकया गया है या करने का लोप ᳰकया गया है, ऑडᭅनᱶस तथा ऑडᭅनᱶस उप᭭कर कारखाना और इसके मु᭎यालय कᳱ िवरचनाᲐ

मᱶ सहायक िनदेशक (राजभाषा) के पद पर भतᱮ कᳱ प᳍ित का िविनयमन करने के िलए िन᳜िलिखत िनयम बनाते gSa:-

सिᭃ᳙ नाम और ᮧारंभ .– (1) इन िनयमᲂ का संिᭃ᳙ नाम “रᭃा मंᮢालय, आयुध और आयुध उप᭭कर िनमाᭅिणयाँ,

(वगᭅ ‘क’ पद), राजभाषा काडर, भतᱮ िनयम 2016” है।

(2) यह राजपᮢ मᱶ ᮧकाशन कᳱ तारीख से लागू हᲂगे।

पदᲂ कᳱ सं᭎या, वगᱮकरण, वे-बᱹड एवं ᮕेड-पे या वेतनमान .– उᲦ पदᲂ कᳱ सं᭎या, उनका वगᱮकरण, वे-बᱹड एवं

ᮕेड-वे या वेतनमान वे हᲂगे, जो इन िनयमᲂ के साथ उपाब᳍ सूची के ᭭त᭥भ (2) से (4) मᱶ िविन᳸द᳥ हᱹ।

भतᱮ कᳱ प᳍ित, आयु-सीमा, अहᭅताएं इ᭜याᳰद .– उᲦ पदᲂ पर भतᱮ कᳱ प᳍ित, आयु-सीमा, अहᭅताएं और उनसे

संबंिधत अ᭠य बातᱶ वे हᲂगी जो पूवᲃᲦ अनुसूची के ᭭त᭥भ (5) से ᭭त᭥भ (13) मᱶ िविन᳸द᳥ हᱹ।

अनहᭅता .– वह ᳞िᲦ –

(क)

िजसने ऐसे ᳞िᲦ से िजसका पित या िजसकᳱ प᳀ी जीिवत है, िववाह ᳰकया है; या

(ख)

िजसने अपने पित या अपनी प᳀ी के जीिवत रहते ᱟए ᳰकसी अ᭠य ᳞िᲦ से िववाह कर िलया है,

उᲦ पद पर िनयुिᲦ का पाᮢ नहᱭ होगा :

पर᭠तु यᳰद के᭠ᮤीय सरकार का समाधान हो जाता है ᳰक ऐसा िववाह ऐसे ᳞िᲦ और िववाह के अ᭠य पᭃकार के

िलए लागू वैयिᲦक कानून के अधीन अनु᭄ेय है एवं ऐसा करने के िलए अ᭠य आधार हᱹ तो वह ᳰकसी ᳞िᲦ को इस िनयम के

ᮧवतᭅन से छूट दे सकेगी और वह उᲦ पद पर भतᱮ के िलए पाᮢ होगा।

िशिथल करने कᳱ शिᲦ .– जहां के᭠ᮤीय सरकार कᳱ राय होगी ᳰक ऐसा करना आव᭫यक या समीचीन है तो वह

इसके कारणᲂ को लेखब᳍ करते ᱟए संघ लोक सेवा आयोग के परामशᭅ से इन िनयमᲂ के ᳰकसी भी उपबंध को ᳰकसी भी ᮰ेणी

या वगᭅ के ᳞िᲦयᲂ के िलए आदेश ᳇ारा िशिथल कर सकेगी।

᳞ावृिᱫ .– इन िनयमᲂ कᳱ कोई बात आरᭃण, आयु-सीमा मᱶ छूट और ऐसी अ᭠य ᳯरयायतᲂ पर ᮧभाव नहᱭ डाल

पाएगी िजनका उपबंध के᭠ᮤीय सरकार ᳇ारा इस संबंध मᱶ समय-समय पर िनकाले गए आदेश के अनुसार अनुसूिचत जाित,

अनुसूिचत जनजाित, अ᭠य िपछड़ा वगᭅ, भूतपूवᭅ सैिनक एवं अ᭠य िवशेष ᮧवगᭅ के ᳞िᲦयᲂ के िलए ᳰकया जाना अपेिᭃत है।

संगठनᲂ या सावᭅजिनक ᭃेᮢ के उपᮓमᲂ

या िव᳡िव᳒ालयᲂ या मा᭠यताᮧा᳙ शोध

चािहए और इसके तकनीकᳱ अथवा

वै᭄ािनक सािह᭜य से संबंिधत होने को

ᮧाथिमकता दी जाएगी।

᭭तर पर संिवधान के आठवᱶ अनु᭒छेद मᱶ

सि᭥मिलत िह᭠दी के अलावा अ᭠य ᳰकसी

भाषा का अ᭟ययन ᳰकया हो

फᳱडर ᮧवगᭅ के वे िवभागीय अिधकारी

जो पदो᳖ित कᳱ सीधी पंिᲦ मᱶ हᱹ,

ᮧितिनयुिᲦ या आमेलन के आधार पर

िनयुिᲦ के िलए पाᮢ नहᱭ हᲂगे।

इसी ᮧकार ᮧितिनयुᲦ अिधकारी ᮧो᳖ित

के ᳇ारा िनयुिᲦ के पाᮢ नहᱭ हᲂगे।

(ᮧितिनयुिᲦ कᳱ अविध (लघु अविध कᳱ

संिवदा सिहत), िजसके अंतगᭅत के᭠ᮤीय

सरकार के उसी या ᳰकसी अ᭠य

संगठन/िवभाग मᱶ इस िनयुिᲦ से ठीक

पहले धाᳯरत ᳰकसी अ᭠य काडर बा᳭ पद

साधारणतया तीन वषᭅ से अिधक नहᱭ

होगी। ᮧितिनयुिᲦ (लघु अविध कᳱ

संिवदा सिहत) पर िनयुिᲦ के िलए

अिधकतम आयु-सीमा आवेदन ᮧा᳙ करने

कᳱ अंितम ितिथ को 56 वषᭅ से अिधक

नहᱭ होगी।

ᳯट᭡पणः

ᮧितिनयुिᲦ के आधार पर िनयुिᲦ के

उ᳎े᭫य से, ᳰकसी अिधकारी ᳇ारा

01 जनवरी, 2006 या उस ितिथ िजस

ᳰदन

से छठवᱶ

वेतन आयोग

कᳱ

िसफाᳯरशᲂ पर आधाᳯरत संशोिधत

वेतनमान ᮧदान ᳰकया गया, से पहले कᳱ

गई िनयिमत सेवा को छठवᱶ वेतन आयोग

कᳱ िसफाᳯरशᲂ के आधार पर ᮧदान ᳰकए

गए ᮕेड-वे एवं वेतनमान मᱶ कᳱ गई सेवा

समझा जाएगा। परंतु यह उस ि᭭थित को

छोड़कर होगा जहाँ एक से अिधक पूवᭅ

संशोिधत वेतनमानᲂ को एक ᮕेड मᱶ एक

सामा᭠य ᮕेड-वे एवं वेतनमान के साथ

आमेिलत कर ᳰदया गया हो। यह फायदा

केवल उन पदᲂ के िलए ᳰदया जाएगा

िजनके िलए ᮕेड-वे या वेतनमान िबना

ᳰकसी ᮧकार के उ᳖यन के साधारण

ᮧित᭭थापन ᮕेड है।

Cadre, Recruitment Rules, 2009, in so far as they relates to the post of Hindi Officer, except as respect things done or

omitted to be done before such suppression, the President hereby makes the following rules regulating the method of

recruitment to the post of Assistant Director ( Official Language) in Ordnance and Ordnance Equipment Factories and

its Head Quarter formations namely :-

Short title and commencement - (1) These Rules may be called the “Ministry of Defence, Ordnance and

Ordnance Equipment Factories, (Group ‘A’ Post), Rajbhasha Cadre, Recruitment Rules, 2016.”

Number of posts, classification, pay band and Grade Pay or Pay Scale - The number of post, its

classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the

Schedule annexed to these rules.

Method of recruitment, age-limit, qualification etc. - The method of recruitment, age- limit, qualifications

and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

Disqualifications. – No person:

(a)

Who, has entered into or contracted a marriage with a person having a spouse living; or

(b) Who, having a spouse living, has entered into or contracted a marriage with any person, shall be

eligible for appointment to the said post:

provided that the Central Government may, if satisfied that such marriage is permissible under the personal

law applicable to such person and the other party to the marriage and that there are other grounds for so doing,

exempt any person from the operation of this rule shall be eligible for appointment to any of the said post:

Power to relax: - Where the Central Government is of the opinion that it is necessary or expedient to do so, it

may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission,

relax any of the provisions of these rules with respect to any class or category of persons.

Saving.:- Nothing in these rules shall affect reservations, relaxation of age - limit and other concessions

required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward classes, Ex-Servicemen, and

other special categories of persons in accordance with the order issued by the Central Government from time to time in

this regard.
