सा.का.िन. 180(अ).—रा᳦पित, संिवधान के अनु᭒छेद 309 के पर᭠तुक ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते

ᱟए और समाज क᭨याण िवभाग (िड᭭पैच राइडर, ᭭टाफ कार ᮟाइवर और ᭔ये᳧ गे᭭टेटनर ऑपरेटर) भतᱮ िनयम,

1969 को, उन बातᲂ के िसवाय अिधᮓांत करते ᱟए, जहां तक उनका संबंध ᭭टाफ कार ᮟाइवर से है, िज᭠हᱶ ऐसे

अिधᮓमण से पूवᭅ ᳰकया गया है या करने का लोप ᳰकया गया है, सामािजक ᭠याय और अिधकाᳯरता िवभाग,

सामािजक ᭠याय और अिधकाᳯरता मंᮢालय मᱶ ᭭टाफ कार ᮟाइवर (साधारण ᮕेड), ᭭टाफ कार ᮟाइवर ᮰ेणी-II तथा

᭭टाफ कार ᮟाइवर ᮕेड-I के पदᲂ पर भतᱮ करने कᳱ सामािजक ᭠याय और अिधकाᳯरता िवभाग प᳍ित को

िविनयिमत करने के िलए िन᳜िलिखत िनयम बनाते हᱹ, अथाᭅत् :-

संिᭃ᳙ नाम और ᮧारंभ :

(1) इन िनयमᲂ का संिᭃ᳙ नाम सामािजक ᭠याय और अिधकाᳯरता मंᮢालय, सामािजक ᭠याय और

अिधकाᳯरता िवभाग [᭭टाफ कार ᮟाइवर (साधारण ᮰ेणी), ᭭टाफ कार ᮟाइवर ᮕेड-II तथा ᭭टाफ कार

ᮟाइवर ᮕेड-I] समूह 'ग' पद भतᱮ िनयम, 2016 है।

(2) ये राजपᮢ मᱶ ᮧकाशन कᳱ तारीख को ᮧवृᱫ हᲂगे।

पद सं᭎या, वगᱮकरण और वेतन मैᳯᮝ᭍स का ᭭तर : उᲦ पदᲂ कᳱ सं᭎या, उनका वगᱮकरण और उनका वेतन

मैᳯᮝ᭍स का ᭭तर वही होगा जो इन िनयमᲂ से उपाब᳍ अनुसूची के ᭭तंभ 2 से ᭭तंभ 4 मᱶ िविन᳸द᳥ हᱹ।

भती कᳱ प᳍ित, आयु-सीमा, अहᭅताएं आᳰद :

उᲦ पद पर भतᱮ कᳱ प᳍ित, आयु-सीमा, अहᭅताएं और उᲦ पदᲂ से संबंिधत अ᭠य बातᱶ वे हᲂगी जो उᲦ

अनुसूची के ᭭तंभ (5) से ᭭तंभ (13) मᱶ िविन᳸द᳥ हᱹ।

िनरहᭅता : वह ᳞िᲦ, -

(क)

िजसने ऐसे ᳞िᲦ से िजसका पित या िजसकᳱ प᳀ी जीिवत है, िववाह ᳰकया है; या

(ख)

िजसने अपने पित या अपनी प᳀ी के जीिवत रहते ᱟए ᳰकसी ᳞िᲦ से िववाह ᳰकया है,

उᲦ पदᲂ पर िनयुिᲦ का पाᮢ नहᱭ होगा :

पर᭠तु यᳰद के᭠ᮤीय सरकार का यह समाधान हो जाता है ᳰक ऐसा िववाह ऐसे ᳞िᲦ और िववाह के अ᭠य

पᭃकार को लागू ᭭वीय िविध के अधीन अनु᭄ेय है और ऐसा करने के िलए अ᭠य आधार हᱹ तो वह ᳰकसी ᳞िᲦ को

इस िनयम के ᮧवतᭅन से छूट दे सकेगी।

िशिथल करने कᳱ शिᲦ :

जहां के᭠ᮤीय सरकार कᳱ यह राय है ᳰक ऐसा करना आव᭫यक या समीचीन है, वहां वह उसके िलए जो

कारण हᱹ, उ᭠हᱶ लेखब᳍ करके इन िनयमᲂ के ᳰकसी उपबंध को ᳰकसी वगᭅ या ᮧवगᭅ के ᳞िᲦयᲂ कᳱ बाबत, आदेश

᳇ारा िशिथल कर सकेगी।

᳞ावृिᱫ :

इन िनयमᲂ कᳱ कोई बात, ऐसे आरᭃण, आयु-सीमा मᱶ छूट और अ᭠य ᳯरयायतᲂ पर ᮧभाव नहᱭ डालेगी,

िजनका के᭠ᮤ सरकार ᳇ारा इस संबंध मᱶ समय-समय पर िनकाले गए आदेशᲂ के अनुसार अनुसूिचत जाितयᲂ,

अनुसूिचत जनजाितयᲂ, िपछड़े वगᲄ, भूतपूवᭅ सैिनकᲂ और अ᭠य िवशेष ᮧवगᭅ के ᳞िᲦयᲂ के िलए उपबंध करना

अथवा समूह 'ग' के िनयिमत कमᭅचारी का पद धाᳯरत

करने वाला काᳶमक।

सशᳫ बल के काᳶमकᲂ, जो एक वषᭅ के भीतर

सेवािनवृᱫ होने वाले हᱹ अथवा ᳯरजवᭅ मᱶ रखे जाने हेतु

᭭थानांतᳯरत ᳰकए जाने हᱹ और िजनके पास अपेिᭃत

अनुभव एवं िविहत अहᭅता हᱹ, पर भी िवचार ᳰकया

जाएगा। ऐसे ᳞िᲦयᲂ को उस ितिथ तक ᮧितिनयुिᲦ

पर रखा जाएगा िजस ितिथ को उ᭠हᱶ सशᳫ बल से

कायᭅमुᲦ ᳰकया जाना है, उसके प᳟ात् उ᭠हᱶ पुनᳶनयोजन

के आधार पर सेवा मᱶ बनाए रखा जा सकता है।

ᳯट᭡पण : कᱶᮤीय सरकार के एक ही अथवा ᳰकसी अ᭠य

संगठन/िवभाग मᱶ इस िनयुिᲦ से त᭜काल पहले धाᳯरत

अ᭠य संवगᭅ-बा᳭ पद मᱶ ᮧितिनयुिᲦ कᳱ अविध सिहत

ᮧितिनयुिᲦ कᳱ अविध साधारणत: तीन वषᭅ से अिधक

नहᱭ होगी। ᮧितिनयुिᲦ अथवा आमेलन ᳇ारा िनयुिᲦ

हेतु अिधकतम आयु-सीमा, आवेदन-पᮢᲂ कᳱ ᮧाि᳙ कᳱ

New Delhi, the 7th September, 2016

G.S.R. 180(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in

supersession of the Department of Social Welfare (Despatch Rider, Staff Car Driver and Senior Gestetner Operator)

Recruitment Rules, 1969, insofar as they relate to the post of Staff Car Driver, except as respects things done or omitted

to be done before such supersession, the President hereby makes the following rules regulating the method of

recruitment to the posts of Staff Car Driver (Ordinary Grade), Staff Car Driver Grade-II, and Staff Car Driver Grade-I in

the Department of Social Justice and Empowerment, Ministry of Social Justice and Empowerment, namely :-

Short title and commencement.—(1) These rules may be called the Ministry of Social Justice and

Empowerment, Department of Social Justice and Empowerment (Staff Car Driver Ordinary Grade, Staff Car Driver

Grade-II, and Staff Car Driver Grade-I) Group 'C' Posts Recruitment Rules, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

Number of posts, classification, Level in the Pay Matrix.—The number of the said posts, their

classification and Level in the Pay Matrix attached to the said post shall be as specified in columns (2) to (4) of the

Schedule annexed to these rules.

Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit,

qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

Disqualifications.—No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law

applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any

person from the operation of this rule.

Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so

to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to

any class or category of persons.

Saving.—Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions

required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen

and other special category of persons, in accordance with the orders issued by the Central Government from time to time

in this regard.

From amongst the regular Dispatch Rider (Group

'C') or Group ' C' employees in Level 1 in the Pay

Matrix in the Ministry of Social Justice and

Empowerment who possess valid Driving License

for Motor Cars on the basis of a Driving Test to

assess the competence to drive Motor Cars failing

which from officials holding the post of Dispatch

Rider on regular basis

or regular Group C

employees in Level 1 in the Pay Matrix in other

Ministries of the Central Government who fulfil the

necessary qualifications as mentioned in column (7).

Deputation or re-employment for Armed

Forces Personnel:

The Armed Forces Personnel due to retire or

who are to be transferred to reserve within a

period of one year and having the requisite

experience and qualifications prescribed shall also

be considered. Such persons would be given

deputation terms upto the date on which they are

due for release from the Armed Forces; thereafter

they may be continued on re-employment.

Note.- The period of deputation including the

period of deputation in another ex-cadre post held

immediately preceding this appointment in the same

or some other organization or Department of the

Central Government shall ordinarily not exceed

three years. The maximum age limit for

appointment by deputation or absorption shall be

'Not exceeding 56 years' as on the closing date of

receipt of applications
