3. भतK कL पM*त, आयु सीमा, अह8ताएं आद—भतK कL पM*त, आयु सीमा, अह8ताएं और उत पद से संबंCधत अ<य बात. वे ह;गी जो

उत अनुसूची के ]तभ (5) से (14) म. 7व*नद81ट कL जाएगी।

4. *नरह8ता—वह _यित

(क) िजसने ऐसे _यित से िजसका प*त या िजसकL प+नी जी7वत है 7ववाह Gकया है,

(ख) िजसने अपने प*त या अपनी प+नी के जी7वत रहते हुए Gकसी _यित से 7ववाह Gकया है, उत पद पर *नयुित का पा नहं

होगा।

बशत` Gक यह के<aय सरकार उस बात से संतु1ट हो Gक ऐसा 7ववाह उस _यित और 7ववाह के अ<य प5कार को लागू ]वीय 7वCध के

अधीन अनुbेय है और ऐसा करने के 3लए अ<य आधार है तो वह Gकसी _यित को इस *नयम के ?वत8न से छूट दे सकेगी।

5. 3शCथल करने कL शित—जहां डीटएनबीड'यूई ए9ड डी कL यह राय है Gक ऐसा करना आवdयक या समीचीन है, वहां वह उसके

3लए जो कारण हY उ<ह. लेखबM करके तथा म और रोजगार मं ालय के पूव8 अनुमोदन से इन *नयम; के Gकसी उपबंध को Gकसी वग8 या ?वग8 के

_यितय; के बारे म. आदेश >वारा 3शCथल कर सकेगी ।

6. _यावृि+त—इन *नयम; कL कोई बात, ऐसे आर5ण, आयु सीमा म. छूट और अ<य eरयायत; पर ?भाव नहं डालेगी, िजनका के<aय

सरकार >वारा इस संबंध म. समय-समय पर जार Gकए गए आदेश; के अनुसार अनुसूCचत जा*तय;, अनुसूCचत जनजा*तय;, अ<य 7पछड़े वगH,

भूतपूव8 सै*नक; और अ<य 7पछड़े ?वग8 के _यितय; के 3लए उपबंध करना अपेT5त है।

New Delhi, the 24th October 2016

No. A-12018/2/2016—ESA(WE)/(G.S.R.)—In exercise of the powers conferred by the proviso to Rule 13(iv) of the

Rules and Regulations of the Dattopant Thengadi National Board for Workers Education and Development, (DTNBWE&D),

except as respects things done or omitted to be done before such supersession, the Competent Authority of Ministry of

Labour & Employment, hereby makes the following Rules regulating the method of recruitment to the post of Lower

Division Clerk Group ‘C’ in DTNBWE&D, namely:-

Short title and commencement.- (i) These Rules may be called the Dattopant Thengadi National Board for

Workers Education and Development Lower Division Clerk (LDC) Group ‘C’ posts Recruitment Rules,

2016. (ii) These shall come into force on the date of their publication in the Official Gazette.

Number of post, classification and Pay Band and Grade Pay or Pay Scale - The number of post, its

classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns

2 to 4 of the Schedule annexed to these Rules.

Method of recruitment, age limit, qualifications etc. - The method of recruitment, age limit, qualifications

and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule.

Disqualification.- No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible

for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal

law applicable to such person and the other party to the marriage and that there are other grounds for so

doing, exempt any person from the operation of this rule.

Power to relax - Where the DTNBWE&D is of the opinion that it is necessary or expedient so to do, it may,

by order, and for reasons to be recorded in writing, and with the prior approval of the Ministry of Labour &

Employment, relax any of the provisions of these Rules with respect of any class or category of persons.

Saving - Nothing in these Rules shall affect reservations, relaxation of age limit and other concessions

required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special

categories of persons in accordance with the orders issued by the Central Government from time to time in

this regard.

Appointing Authority – The Director, DTNBWE&D is the Appointing Authority in relation to a post under

the DTNBWE&D as the authority empowered to make appointments as per Bylaws of the DTNBWE&D.
