का.िन.आ. 16.—रा᳦पित, संिवधान के अनु᭒छेद 309 के पर᭠तुक ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए और रᭃा मंᮢालय,

पᳯरवार िनयोजन संगठन (सहायक) भतᱮ िनयम, 1969 को, उन बातᲂ के िसवाय अिधᮓांत करते ᱟए, िज᭠हᱶ ऐसे अिधᮓमण से पूवᭅ ᳰकया

गया है या करने का लोप ᳰकया गया है, रᭃा मंᮢालय के अधीन पᳯरवार क᭨याण संगठन मᱶ सहायक (पᳯरवार क᭨याण) के पद पर भतᱮ कᳱ

प᳍ित का िविनयमन करने के िलये िन᳜िलिखत िनयम बनाते हᱹ, अथाᭅत् :-

1. संिᭃ᳙ नाम और ᮧारंभ.—(1) इन िनयमᲂ का संिᭃ᳙ नाम रᭃा मंᮢालय, पᳯरवार क᭨याण संगठन, सहायक (पᳯरवार क᭨याण), समूह

‘ग’ पद भतᱮ िनयम, 2017 है I

(2) ये राजपᮢ मᱶ उनके ᮧकाशन कᳱ तारीख को ᮧवृत हᲂगे I

2. पदᲂ कᳱ सं᭎या, वगᱮकरण और वेतन मैᳯᮝ᭍स मᱶ ᭭तर.—पदᲂ कᳱ सं᭎या, उसका वगᱮकरण और वेतन मैᳯᮝ᭍स मᱶ वेतन ᭭तर, जो इन

िनयमᲂ से उपाब᳍ अनुसूची के ᭭तंभ-(2) से ᭭तंभ-(4) मᱶ िविन᳸द᳥ हᱹ I

3. भतᱮ कᳱ प᳍ित, आयु-सीमा, अहᭅताएं आᳰद.—उᲦ पद पर भतᱮ कᳱ प᳍ित, आयु-सीमा, अहᭅताएं और उस पद से संबंिधत अ᭠य बातᱶ वे

हᲂगी जो उᲦ अनुसूची के ᭭तंभ-(5) से ᭭तंभ-(13) मᱶ िविन᳸द᳥ हᱹ I

4. िनरहᭅता.—वह ᳞िᲦ-

(क) िजसने ऐसे ᳞िᲦ से िजसका पित या िजसकᳱ प᳀ी जीिवत है, िववाह ᳰकया है; या

(ख) िजसने अपने पित या अपनी प᳀ी के जीिवत रहते ᱟए ᳰकसी ᳞िᲦ से िववाह ᳰकया है,

उᲦ पद पर िनयुिᲦ का पाᮢ नहᱭ होगा:

पर᭠तु यᳰद के᭠ᮤीय सरकार का यह समाधान हो जाता है ᳰक ऐसा िववाह, ऐसे ᳞िᲦ और िववाह के अ᭠य पᭃकार को लागू

᭭वीय िविध के अधीन अनु᭄ेय है और ऐसा करने के िलये अ᭠य आधार है तो वह ᳰकसी ᳞िᲦ को इस िनयम के ᮧवतᭅन से छूट दे सकेगी I

5. िशिथल करने कᳱ शिᲦ.—जहां के᭠ᮤीय सरकार कᳱ यह राय है ᳰक ऐसा करना आव᭫यक या समीचीन है, वहां वह उसके िलये जो कारण

हᱹ उ᭠हᱶ लेखब᳍ करके और इन िनयमᲂ के ᳰकसी उपबंध को ᳰकसी वगᭅ या ᮧवगᭅ के ᳞िᲦयᲂ कᳱ बाबत, आदेश ᳇ारा िशिथल कर सकेगी I

6. O;ko`fÙk.—इन िनयमᲂ कᳱ कोई बात, ऐसे आरᭃण, आयु-सीमा मᱶ छूट और अ᭠य ᳯरयायतᲂ पर ᮧभाव नहᱭ डालेगी, िजनका के᭠ᮤीय

सरकार ᳇ारा इस संबंध मᱶ समय-समय पर िनकाले गए आदेशᲂ के अनुसार अनुसूिचत जाितयᲂ, अनुसूिचत जनजाितयᲂ, अ᭠य िपछड़े वगᲄ,

भूतपूवᭅ सैिनकᲂ तथा अ᭠य िवशेष ᮧवगᭅ के ᳞िᲦयᲂ के िलये उपबंध करना अपेिᭃत है I

S.R.O. 16.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in

supersession of the Ministry of Defence, Family Planning Organization, (Attendants) Recruitment Rules, 1969, except

as respects things done or omitted to be done before such supersession, the President hereby makes the following rules,

regulating the method of recruitment to the post of Attendant (Family Welfare) in the Family Welfare Organization

under Ministry of Defence, namely:-

Short title and Commencement. - (1) These rules may be called the Ministry of Defence, Family Welfare

Organization Attendant (Family Welfare) Group ‘C’ post Recruitment Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

Number of post, classification and the level in the pay matrix. - The number of post, its classification and the

level in the pay matrix attached to the said post shall be as specified in columns (2) to (4) of the schedule annexed to

these rules.

Method of recruitment, age-limit, qualifications etc. – The method of recruitment, age-limit, qualifications

and other matters relating to the said post, shall be as specified in columns (5) to (13) of the aforesaid schedule.

Disqualification. – No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law

applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any

person from the operation of this rule.

Power to relax. – Where the Central Government is of the opinion that it is necessary or expedient to do so it

may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any

class or category of persons.

Saving. – Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required

to be provided for the Scheduled Castes, the Scheduled Tribes, ex-Serviceman and other special categories of persons in

accordance with the orders issued by the Central Government from time to time in this regard.
