22.—क सरकार रा संकम अिधिनयम, 1903 (1903 का 7) क! धारा 3, 6 एवं 7 %ारा &द' शि)य* का &योग

करते /ए यह िवचार करती है क भारतीय वायु सेना 4टेशन* और &ित7ापन* के सामी9य म भूिम के &योग और उपयोग पर &ितबंध

लगाना आव>यक एवं समयोिचत है, इसिलए एत?ारा यह घोिषत करती है क ऐसी भूिम को वृ* और वDय वन4पित से मु) रखा

जाएगा और िनदेश देती है कः-

(क)

भारतीय वायु सेना 4टेशन* और &ित7ापन* के बाहरी &कार के िशखर से 25 मीटर क! सीमाI के अDदर कसी भूिम पर कोई

वृ / वDय वन4पित नहK रोपी जाएगी जैसा क इस अिधसूचना के अनुबंध ‘क’ म दया गया है ।

(ख)

इस अिधसूचना के &योजनाथ संबंिधत भारतीय वायु सेना 4टेशन* अथवा &ित7ापन* के एयर अफसर कमांPडग अथवा कमांPडग

अफसर जैसा भी मामला हो, उन वृ* िजनको काटने / खुदाई करने / छंटाई करने क! आव>यकता है, के बारे म सभी संगत Sयौरे और

िविशU सूचनाएं रा संकम अिधिनयम, 1903 (1903 का 7) क! धारा 3, उप-धारा (2) म संदVभत उ) घोषणा क! वा4तिवकता के

सावजिनक नोXटस के कारण कलYटर को उपलSध कराएंगे ।

(ग)

कलYटर वृ* के मािलक क! जांच करगे और रा संकम अिधिनयम, 1903 क! धारा 12 के अनुसार अिधसूिचत ेZ म वृ* को

काटने अथवा उनक! खुदाई करने के कारण ितपूVत के [प म उिचत मुआवजा यद कोई है, उसे &दान करगे ।

यह अिधसूचना सरकारी राजपZ म उसके &काशन क! तारीख से &वृ' होगी ।

MINISTRY OF DEFENCE

New Delhi, the 31st March, 2017

S.R.O. 22.—In exercise of the powers conferred by Sections 3, 6 and 7 of the Works of Defence Act, 1903 (7 of

1903), the Central Government, being of the opinion that it is necessary and expedient to impose restrictions, upon the

use and enjoyment of land in the vicinity of the Indian Air Force Stations and Installations, hereby declares that such

land shall be kept free from trees and wild vegetation and directs that:-

(a)

No tree / wild vegetation shall be planted on any land within the limits of 25 meters from the crest of the outer

parapet of Indian Air Force Stations and Installations as given in the Annexure ’A’ to this notification.

(b)

For the purpose of this notification, the Air Officer Commanding or Commanding Officer of the concerned Indian

Air Force Stations or Installations, as the case may be, shall provide all the relevant details and give specific inputs

regarding trees that need to be cut / grub up / pruned to the Collector to cause public notice of the substance of the said

declaration referred to in section 3, sub-section (2) of the Works of Defence Act, 1903 (7 of 1903).

(c)

The Collector shall inquire regarding the owner of trees and award suitable compensation, if any, for the damages

cause towards cut down or grub up of the trees in the notified area in accordance with Section 12 of the Works of

Defence Act, 1903.

This notification shall come into force on the date of its publication in the Official Gazette.
