ऑफ इंxडया QलQमटेड से समय पूव2 `यावत2न पर ,ी आद`य कुमार जैन, आईआरएस (आईटDः 84029), आयकर आयु>त को

19.10.2007 (अपरा3न) म काय2 मु>त कर दया गया था। 20.10.2007 से 18.12.2007 को दो माह क[ छु€ी •यतीत करने के पnचात

,ी जैन ने बोड2 को 19.12.2007 (पूवा23न) को रपोट2 {कया। अगले हD दन vFkkZr~ 20.12.2007 को भारतीय राज0व सेवा से `यागपH

दया जो{क +नयुि>त ा;धकारD को संबो;धत नहDं {कया गया था और 0वयं से हD ‚यूटD से अनुपि0थत रहने लगे। उसके पnचात, ,ी जैन

ने रा()प+त को व;धवत ?प से संबो;धत करते हुए दनांक 05.06.2008 को एक उ;चत `यागपH दया। उनके `यागपH क[ जांच करने के

बाद उसी दन व`त मंHी, +नयुि>त ा;धकारD के अनुमोदन से उसे अ0वीकार कर दया गया। तदनुसार, +नयुि>त ा;धकारD के +नण2य को

बोड2 के पH दनांक 17.07.2009 के माeयम से सीसीआईटD (सीसीए), मुंबई के काया2लय को ेषत {कया गया और एक +त सीसीआईटD

(सीसीए), कोलकाता भी भेजी गई।

2. और जब{क, ,ी आद`य कुमार जैन ने त`पnचात सेवा से 0वैिcछक सेवा+नवृि`त ाlत करने के Qलए दनांक 24.09.2009

को नोटस दया। जांच पड़ताल के बाद यह पाया गया {क संगत +नयमT के अंतग2त 0वैिcछक सेवा+नवृि`त के Qलए पाH नहDं पाया गया।

तदनुसार, बोड2 के पH दनांक 06.11.2009 के माeयम से अ;धकारD को सू;चत {कया गया। तथाप, ,ी आद`य कुमार ने अपनी ‚यूटD

पुनः आरंभ नहDं क[।

3. और जब{क, ,ी आद`य कुमार जैन ने अeय, सीबीडीटD को 30.03.2015 को एक पH Qलखा िजसम उGहTने दावा {कया

{क एनपीसीआईएल _वारा उGह सं0वीकृ+त छु€ी क[ समािlत पर उGहTने बोड2 को 19.12.2007 को रपोट2 {कया था और उGह यथा +त;थ

तक अ+नवाय2 तीा पर रखा गया। तथाप, बोड2 को रपोट2 करने के पnचात उGह सीबीडीटD के काय2बल के ?प म Qलया गया >यT{क

रपोट2 करने के अगले हD दन अथा2त 20.12.2007 को उGहTने `याग पH दे दया।

4. और जब{क, ,ी आद`य कुमार जैन उनक[ अन;धकृत अनुपि0थ+त के दौरान +नnचय हD रलायंस रटेल QलQमटेड के भूसंपदा

•यवसाय म जुड़े रहे। उGहTने कंसLटसी भी शु? कर दD। ,ी जैन क[ आयकर ववरणी से उनक[ अन;धकृत अनुपि0थ+त क[ अव;ध के

दौरान +नजी •यवसाय से जुड़े होने क[ बात पता चलD है जो{क सीसीएस (आचरण) +नयमावलD, 1964 के +नयम 3 का उLलंघन है।

5. और जब{क, ,ी आद`य कुमार जैन, आईआरएस (84029) म यथा +त;थ तक अपनी ‚यूटD शु? नहDं क[ और 20.12.2007

से अथा2त 5 वष2 से अ;धक क[ लगातार अव;ध अपनी ‚यूटD से अना;धकृत ?प से अनुपि0थत रहे अतः दनांक 20.01.2017 का कारण

बताओ नोटस उGह जारD {कया गया िजसम उGह पH क[ ािlत के 15 दनT के भीतर जवाब देने के Qलए कहा गया {क ‚यूटD से 5 वष2

से अ;धक समय तक {क उनक[ अन;धकृत अनुपि0थ+त को भारत सरकार के सीसीएस (लDव) +नयमावलD, 1979 के +नयम 12 (2) के

अंतग2त, भारत सरकार क[ दनांक 29.03.2012 क[ अ;धसूचना के साथ पठत, सरकार क[ सेवा से `यागपH >यT न माना जाए। ,ी जैन

ने उनक[ अन;धकृत अनुपि0थ+त और इस अना;धकृत अनुपि0थ+त क[ अव;ध म +नजी फम2 से उनके जुड़ने पर जवाब नहDं दया है।

बिLक उGहTने 19.12.2007 को बोड2 को उनके रपोट2 करने पर जारD तैनाती आदेश क[ +त और दनांक 06.11.2009 के बोड2 म पH क[

xडलDवरD zयौरा दान करने का +नवेदन {कया।

6. अतः अब, डीओपीएंडटD क[ अ;धसूचना संjया 13026/2/2010-0थापना-(एल) दनांक 29.03.2012, िजसे सा. का. +न. संjया

261 (अ) के तहत दनांक 29.03.2012 को भारत के राजपH म काQशत {कया गया था, के साथ पठत सीसीएस (लDव) +नयमावलD,

1972 के +नयम 12(2) के तहत द`त शि>तयT का योग करते हुए भारत के रा()प+त, ,ी आद`य कुमार जैन, आईआरएस (आईटDः

84029) क[ 20.12.2007 से लगातार 5 वष2 से अ;धक क[ अव;ध ‚यूटD से अनुपि0थत रहने को उनक[ दनांक 20.12.2007 से सरकार

No. 03/2017[F. No. A-39012/1/2008-Ad.VI(A)(PART)]—Whereas, on pre-mature repatriation from the Nuclear

Power Corporation of India Ltd.(NPCIL) on the advice of CVC, Shri Aditya Kumar Jain, IRS(IT:84029), CIT was relieved

on 19.10.2007(AN). After availing 2 months leave from 20.10.2007 to 18.12.2007, Shri Jain reported to the Board on

19.12.2007(F.N.). On the very next day i.e. 20.12.2007, he tendered resignation from Indian Revenue Service which was

not addressed to the Appointing Authority, and started absenting himself from duty. Thereafter, Shri Jain submitted a proper

resignation letter dated 5.6.2008, duly addressed to the President of India. His resignation was examined and the same was

rejected with the approval of the Finance Minister, being the Appointing Authority. Accordingly, decision of Appointing

Authority was communicated to the office of CCIT(CCA),Mumbai with a copy to CCIT(CCA), Kolkata vide Board’s letter

dated 17.7.2009.

2. And Whereas, Shri Aditya Kumar Jain subsequently, tendered a notice dated 24.9.2009 for seeking Voluntary

Retirement from Service which was examined and found that Shri Jain was not eligible for seeking VRS under the relevant

rules. Accordingly, the officer was informed vide Board’s letter dated 6.11.2009. However, Shri Aditya Kumar Jain did not

resume duty.

3. And Whereas, Shri Aditya Kumar Jain wrote a letter to Chairman, CBDT on 30.3.2015 wherein he claimed that he

reported to the Board on 19.12.2007, on expiry of the leave sanctioned to him by NPCIL and he was treated as on

compulsory wait till date. However, he was never taken on the strength of the CBDT on reporting to the Board as he

tendered his resignation on the very next day of his reporting to the Board i.e. 20.12.2007.

4. And Whereas, Shri Aditya Kumar Jain admittedly associated in real estate business of Reliance Retails Ltd. during

the period of his unauthorized absence. He has also admitted to have started consultancy. Income Tax Returns of Shri Jain

also reveals his association with private business during the period of his unauthorized absence which is in violation of Rule

3 of CCS(Conduct) Rules, 1964.

5. And Whereas, Shri Aditya Kumar Jain, IRS(84029) has not resumed duty till date and remained unauthorized absent

from duty since 20.12.2007 i.e., a continuous period exceeding 5 years. Therefore, a show cause notice dated 20.01.2017

was served on him for seeking his reply within 15 days of its receipt as to why his unauthorized absence from duty exceeding

five years may not be treated as deemed resignation from the Government Service under Rule 12(2) of CCS(Leave) Rules,

1979, read with the G.O.I.’s Notification dated 29.03.2012. Shri Jain did not submit the reply to his unauthorized absence

and joining a private firm during the period of his unauthorized absence. Instead he has requested to provide a copy of his

posting order issued to him on his joining the Board on 19.12.2007 and delivery details of the Board’s letter dated

06.11.2009.

6. Now, therefore, in exercise of the powers conferred under Rule 12(2) of CCS(Leave) Rules, 1972 read with

DOP&T’s Notification No. 13026/2/2010-Estt.(L) dated 29.03.2012, published as GSR No. 261(E) in the Gazetted of India

dated 29.03.2012, the President of India is pleased to treat the unauthorized absence of Shri Aditya Kumar Jain, IRS

(IT:84029) from duty from 20.12.2007 for a continuous period of more than five years, as deemed resignation from the
