के योगदान के पNरमाण क5 गणना करने के उtेu य के 2लए भू2म क5 लागत को पNरयोजना लागत म- नहं Cकया जाएगा। सामा? यत:

!m येक पNरयोजना के 2लए सहायता अनुदान 20 करोड़ dपए क5 अ धकतम सीमा के अv यधीन होगा ।

चमड़ा, व< ', इलेO ानक, आईट आद जैसी पNरयोजनाओं िज? ह- gे' Rव2श ट < क5मp के अंतगTत कवर Cकया जा सकता है,

और जो नयाTत से संबं धत नहं है, उन पNरयोजनाओं को टआईईएस के अंतगTत सहायता नहं द जाएगी।

सृिजत पNरसंपिm तयp को कायाT? वयन एज-2सयp Vवारा अपने < वयं के संसाधनp, लाभ भुगतान और !योग !भारp Vवारा अनुरwgत

तथा संचा2लत Cकया जाएगा।‘’ को न.नवत पढ़ा जाएगा :

सं. ओ-19018/7/2016/ओएनजी-I——कोल बेड 2मथेन (सीबीएम) सहत !ाकृतक गैस के वैकि पक |ोतp को Rवक2सत करने और

गैस अथTb यव< था का संवधTन करने के 2लए, सरकार ने कोल बेड 2मथेन (सीबीएम) के 2लए Rवपणन और मू य नधाTरण < वतं'ता देने और

!चालनाm मक मुtp को सरल और कारगर बनाने करने का नणTय 2लया है। भारत सरकार एतदVवारा सीबीएम गैस के शी{ मुiकरण के

2लए नीतगत ढांचे को न. नानुसार अ धसू चत करती है:-

Rवपणन और मू य नधाTरण < वतं'ता

1.1

सीबीएम ब् लाकp के संRवदाकारp को घरेलू बाजार म- आ. सT ल_थ मू य पर सीबीएम बेचने के 2लए Rवपणन और मू य

नधाTरण < वतं'ता देने का नणTय 2लया गया है। आ. सT ल_थ HबCFयp के 2लए बाजार मू य का पता लगाते

समय, संRवदाकार को सीबीएम क5 HबF5 के 2लए पूणTतया पारदश• और !त< पZ• !CFया इस उtेu य के साथ

सुनिu चत करनी है Cक Hबना Cकसी !तबंधाm मक वाBणिU यक पZतयp के, इस संRवदा के सभी पgकारp के लाभ के

2लए सवrmतम संभव मू य !ा] त Cकया जाए। संRवदाकार Vवारा एक Rव€ापन/नRवदा आमंतरण नोटस (एनआईट)/ई-

नRवदा को कम से कम एक < थानीय भाषा के दैनक समाचार प' म- और एक अं•ेजी भाषा के रा य दैनक

समाचार प' म- और अ? य उपयुO त इलैO ॉनक मीkडया म-, िजसम- अ? य बातp के साथ-साथ HबF5 के 2लए उपल‚ ध

सीबीएम क5 गुणवmता और मा'ा का उ लेख हो, b यापक @प से अ धसू चत कराया जाए। Fेता Vवारा न पादत Cकए

जाने वाले HबF5 करार क5 मु> य Rवशेषताओं के साथ-साथ मू यांकन मानदंड के 2लए इ< तेमाल क5 जाने वाल Rव< तृत

जानकार भी द जाएगी और इस !CFया म- सभी संभाRवत Fेताओं क5 अ धकतम भागीदार सुनिu चत करने के 2लए

कम से कम 15 दन का समय देना होगा। Fेताओं के साथ Cकए जाने वाले अंतम करार के संबंध म- जानकार

संRवदाकार क5/ऑपरेटर क5 वेबसाइट पर द जाएगी और डीजीएच/सरकार को भी सू चत Cकया जाएगा।

1.2

नए घरेलू !ाकृतक गैस मू य नधाTरण दशा-नद„श, 2014 के तहत पेो2लयम आयोजना Rवu लेषण !को ठ (पीपीएसी)

Vवारा अ धसू चत मू य से बाजार का खोजा गया मू य कम होने क5 ि< थत म-, राय ट और उm पादन < तर भुगतान

(पीएलपी),पीएलपी के आधार पर Cकया जाएगा।

1.3

इन दशा नद„शp क5 अ धसूचना पर, नए घरेलू गैस मू य नधाTरण दशा-नद„श, 2014 और इससे पहले समय-समय

पर घोRषत गैस उपयोग नीत सीबीएम गैस पर लागू नहं होगी।

1.4

‘सरकार का ह< सा’ नधाTNरत करने के 2लए ? यूनतम मू य के साथ-साथ Rवपणन और मू य नधाTरण < वतं'ता के

संबंध म- नए !ावधान उन ‚ लाकp पर भी लागू हpगे, जहां मू य नधाTरण सू'/आधार सरकार Vवारा पहले ह अनुमोदत

कर दया गया है। इस नीत के अनुसरण म- इससे पहले जार Cकए गए Cकसी भी आदेश को वापस 2लया गया समझा

जाएगा।

1.5

पैरा 1.1 म- यथा नधाTNरत !CFया अपनाने के बाद संRवदाकार Vवारा Cकसी Fेता का पता नहं लगा पाने क5 दशा

म-,संRवदाकार के Cकसी संबZ संRवदाकार को सीबीएम क5 HबF5 करने क5 अनुमत द गई है। संबZ संRवदाकार को

HबF5 Cकए जाने के कारणp और संबZ संRवदाकार के साथ Cकए गए अंतम करार से संबं धत सूचना को संRवदाकार

क5/ऑपरेटर क5 वेबसाइट पर दशाTया जाएगा और डीजीएच/सरकार को भी सू चत Cकया जाएगा।

संRवदाm मक मुtे

महानदेशक, हाइˆोकाबTन महानदेशालय (डीजी, डीजीएच) नोटस अव धयp, वाRषTक कायT कायTFम और बजटp म- होने

वाले Rवलंब को माफ करने के 2लए और राU य और के? i सरकार से 2मलने वाल < वीकृतयp के संबंध म- g. य Rवलंबp

को अनुमोदत करने के 2लए शिO त !दmत है। डीजी, डीजीएच ऐसे मामलp का नपटान नीचे द गई समय सीमाओं के

भीतर करेगा:-

2.1

अधूरे ? यूनतम कायT कायTFम (एमड‚ यूपी) क5 लागत का भुगतान करने के बाद परवत• चरण म- !वेश

अ? वेषण अव ध के पूवTवत• चरण के अधूरे कायTFम क5 लागत का भुगतान सरकार को करने के बाद अ? वेषण के दूसरे

चरण के एमड‚ यूपी को करने के 2लए संRवदाकार को अनुमत द गई है।

2.2

अगले चरण म- !वेश करने के 2लए या चरण I से चरण III म- चरण के Rव< तार के 2लए नोटस !< तुत करने म-

Rवलंब माफ करना।

डीजीएच अगले चरण म- !वेश करने के 2लए संRवदाकार Vवारा दजT Cकए जाने वाले कारणp के संबंध म- नोटस देने के

2लए 90 दन तक क5 अव ध माफ करने के 2लए शिO त !दmत है। तथाRप, ऐसी माफ5 को चरण के Rव< तार के @प म-

नहं समझा जाएगा।

2.3

वाRषTक कायT कायTFम और बजट को !< तुत करने म- Rवलंब माफ करना

डीजीएच वाRषTक कायT कायTFम और बजट क5 !< तुत के 2लए 90 दन क5 अव ध तक का Rवलंब, िजसके 2लए

संRवदाकार Vवारा कारण दजT कराए जाएंगे, माफ करने के 2लए शिO त !दत है। तथाRप ऐसे माफ5 को चरण के Rव< तार

के @प म- नहं समझा जाएगा।

2.4

भू2म अ ध•हण/अपNरहायT मुtp अथवा !चालक के नयं'ण से परे अ?य ऐसे Cकसी मामले के चलते Rवकास चरण म-

माफ5 यो‹य Rवलंब।

<पट Rवलंबp क5 पुिट होने के बाद भू2म अ ध•हण/अपNरहायT ि<थत अथवा !चालक के नयं'ण से परे ऐसे Cकसी

अ?य मामले के कारण Rवकास चरण म-, माफ5 यो‹य Rवलंबp को अनुमोदत करने के संबंध म- डीजीएच को, अनवुत•

चरणp को अलग रखते हुए, शिOत!दmत बनाया गया है।

2.5

?यूनतम कायT कायTFम म- कटौती

यद सरकार Vवारा Cकसी कारण के चलते संRवदागत gे' को कम Cकया जाता है, डीजीएच को संRवदागत gे' के

अनुपातक @प से ?यूनतम कायT कायTFम (एमड‚यूपी) को कम करने के 2लए शिOत!दmत बनाया गया है। यद

संRवदाकार संRवदागत gे' म- Cकसी !कार क5 कमी को <वीकार नहं करने का नणTय लेता है, तो संRवदाकार के 2लए

अधूरे कायT कायTFम (सीओयूड‚यूपी) क5 लागत का भुगतान Cकए Hबना संRवदा छोड़ने का Rवकप खुला होगा।

2.6

संRवदा क5 !भावी तारख

यद Cकसी ‚लॉक म- राUय सरकारp Vवारा पेो2लयम अ?वेषण लाइस-स (पीईएल) !दान Cकए जाने म- दो (2) वषq से

अ धक Rवलंब होता है और यद संRवदाकार सीबीएम ‚लॉक छोड़ने के Rवकप का चयन करता है, तो उसे अधूरे कायT

कायTFम (सीओयूड‚यूपी) क5 लागत का भुगतान Cकए Hबना संRवदा छोड़ने क5 इजाजत होगी।

2.7

CORRIGENDUM

No. 10/6/2016-SC—In the Department of Commerce, Ministry of Commerce & Industry’s Notification published in

Part-I, Section-1, of the Gazette of India Weekly (April 1- April 7, 2017) No. 13, dated the 27March, 2017, the following

corrections in paras 3, 6 and 8 have been made :—

“3. Scheme outlay: It is proposed to that the scheme would have a budgetary allocation of Rs. 600 Cr. with an

annual outlay of Rs. 200 Cr. per year. 5% of the grant approved used for appraisal, review and monitoring expenses”

shall be read as:

“6. Implementing agencies: Central Government Agencies, State Government Agencies, Export Promotion

implementing agencies with major stake holding and implemented under PPP model are also eligible.”

Policy Framework for Early Monetization of Coal Bed Methane(CBM)

No. O-19018/7/2016/ONG-I—To develop alternate sources of natural gas including Coal Bed Methane (CBM) and

promoting gas economy, Government has decided to provide marketing and pricing freedom for Coal Bed Methane (CBM),

and streamline the operational issues. The Government of India hereby notifies the Policy Framework for Early Monetization

of CBM Gas as hereunder:

Marketing and Pricing Freedom

1.1

It has been decided to provide marketing and pricing freedom to the Contractors of CBM blocks to sell the

CBM at Arm’s Length Price in the domestic market. While discovering the market price for Arms Length

Sales, the Contractor has to ensure a fully transparent and competitive process for sale of CBM with the

objective that the best possible price is realized, to the benefit of all parties to this Contract, without any

restrictive commercial practices. An advertisement / Notice Inviting Tender (NIT) / e- Tender should be

notified widely by the Contractor, in at least one local language daily newspaper and one English language

national daily newspaper and other suitable electronic media, mentioning inter-alia the quality and quantity

of CBM available for sale. Detailed information on the evaluation criteria to be used along with broad

salient features of sale agreement to be executed by the buyer shall also be made known and at least 15

days time is to be allowed to ensure maximum participation of all likely buyers in this process. The

information regarding the final agreement reached with the buyer shall be hosted on the Contractor’s /

Operator’s website and also communicated to DGH / Government.

1.2

In the event of market discovered price being less than the price notified by the Petroleum Planning

Analysis Cell (PPAC) under the New Domestic Natural Gas Pricing Guidelines, 2014, the royalty and

Production Level Payment (PLP) shall be paid on the basis of the latter.

1.3

On notification of these guidelines, the New Domestic Gas Pricing Guidelines, 2014 and the Gas

Utilization Policy announced earlier from time to time shall not be applicable to CBM gas.

1.4

These provisions regarding marketing and pricing freedom along with the minimum price for determining

the ‘Government take’ shall also be applicable to the blocks where pricing formula/basis has been approved

earlier by the Government. Any order issued earlier not in consonance with this policy will be treated as

withdrawn.

1.5

Sale of CBM to any Affiliate of the Contractor is permitted, in the event the Contractor cannot identify any

buyer following the procedure as stipulated in para 1.1. The information regarding the reasons for sales to

Affiliate and the final agreement reached with the Affiliate shall be hosted on the Contractor’s / Operator’s

website and also communicated to DGH/ Government.

Contractual Issues

Director General, Directorate General of Hydrocarbons (DG,DGH) is empowered for condoning the delays

in notice periods, annual work program and budgets and to approve the excusable delays regarding

clearances from State and Central Government. The DG, DGH will dispose such cases within the time-

limits below:

2.1

Entry into subsequent Phase, after paying cost of Unfinished Minimum Work Programme (MWP)

Contractor is allowed to carry out MWP of second phase of exploration after paying the cost of unfinished

work program of previous phase of exploration period to the Government.

2.2

Condoning delays in submission of notice for entering into next phase or for the Extension of Phase in

Phase-I to Phase-III

DGH is empowered to condone delays up to a period of 90 days for giving notice for entering into the next

phase, for reasons to be recorded by the Contractor. However, such condonation shall not be construed as

Extensions of Phase.

2.3

Condoning delays in submission of Annual Work Program and Budget

DGH is empowered to condone delays up to a period of 90 days for submission of Annual Work Program

& Budget from which reasons are to be recorded by the Contractor. However, such condonation shall not

be construed as extension of a phase.

2.4

Excusable delay in development phase due to land acquisition/force majeure issues or any other such

matter beyond the control of Operator

DGH is empowered to approve the excusable delays, without set off from subsequent Phases, in

development phase due to Land Acquisition/Force Majeure condition or any other such matter beyond the

control of Operator after confirming demonstrable delays.

2.5

Reduction in minimum work programme

DGH is empowered to reduce Minimum Work Programme (MWP) in proportion to the contract area if

contract area is reduced by Government for any reason. If the Contractor decides not to accept any

reduction in contract area, the Contractor would be permitted to exercise exit option from the contract

without payment of Cost of Unfinished Work Programme (COUWP).

2.6

Effective date of the contract

If delay in grant of Petroleum Exploration License (PEL) exceeds two (2) years from the State

Governments in any Block, the Contractor if exercises exit option from the CBM Block, will be permitted

to exit without paying cost of unfinished work program.

2.7

Non-grant or delayed permission of clearances by State Government and Central Government

In cases of inordinate delays in granting clearances i.e. beyond two (2) years in any block, the Contractor if

exercises is exit option, will be permitted to exit from the contract without paying Cost of Unfinished Work

Programme. DGH is empowered to review and examine such cases and approve exit option exercised by

the Contractor from the CBM Contract.

2.8

Calculation of Cost of Unfinished Work Program

For Calculation of Cost of Unfinished Work Program, a fixed amount of USD 0.25 Million per corehole

and USD 0.6 Million per test well as well as pilot well shall be considered as Cost of Unfinished Work

Program irrespective of depth and will be uniformly applicable for all CBM Blocks. In case of low

prospectivity observed in CBM block after drilling of core holes, then it is not required to drill test/pilot

wells in the block. In such cases, DGH is authorized to waive off the cost of test/pilot wells depending upon

technical requirement. ‘Other works’ and tests/studies as indicated in Article 5 of the Contract ‘as part of

MWP’ shall not be considered for calculation of cost of unfinished work program of Phase-I and Phase-II

as the value of ‘Other works’ has been factored in the computation of COUWP for Core hole and Test Well

and Pilot well.

2.9

Relaxation of Notice Period for submission as per CBM Contract

DGH is empowered to review and examine delays in submission of various notice periods in CBM

Contracts.

2.10

Extended Role for Empowered Committee of Secretaries (ECS) for resolution of operational issues in

implementation of CBM Contracts.

The role of ECS comprising of Secretary (Petroleum & Natural Gas), Finance Secretary, Secretary (Coal) and

Secretary (Law) is extended for approving the matters relating to CBM blocks as and when referred to ECS.

3.0

This Notification shall be effective immediately.

Administration, Lok Sabha Secretariat and the concerned Ministries and Department of the Government of India.
