का.नन.आ. 49.—राष्ट्रपनि, संनिधान के अनुच्छेि 309 के परंिुक द्वारा प्रित्त शनियों का प्रयोग करिे हुए रक्षा

मंत्रालय, लेखाकार (समूह 'ख' पि) भिी ननयम, 2013 का संशोधन करने के नलए ननम्ननलनखि ननयम बनािे हैं अर्ााि् :—

1.

संनक्षप्त नाम और प्रारम्भ :—

(1)

इन ननयमों का संनक्षप्त नाम रक्षा मंत्रालय, लेखाकार (समूह 'ख' पि) भिी (संशोधन) ननयम,

2017 है ।

(2)

ये राजपत्र में प्रकाशन की िारीख को प्रिृत्त होंगे ।

2.

रक्षा मंत्रालय, लेखाकार (समूह 'ख' पि) भिी ननयम, 2013 के ननयम 2 में, "िेिन बैंड िर्ा ग्रेड िेिन या

िेिनमान" िोनों स्र्ानों पर जहां ये शब्ि आिे हैं "िेिन मैट्रिक्स में स्िर" शब्ि रखे जाएंगे ।

(क) स्िंभ (4) में,

(i)

शीर्ाक के स्र्ान पर "िेिन मैट्रिक्स में स्िर" शीर्ाक रखा जाएगा;

(ii)

प्रनिनियों के स्र्ान पर ‘‘िेिन मैट्रिक्स में स्िर 6 35400 – 112400 रुपए” प्रनिनियां रखी

जाएंगी;

‘‘नजन्होंने मूल काडर या निभाग में िेिन मैट्रिक्स में स्िर – 5, 29200-92300 रुपए या

समिुल्य में ननयनमि आधार पर ननयुनि के पश्चाि, उस श्रेणी में न्यूनिम छह िर्ा सेिा

की है, या

(iii)

नजन्होंने मूल काडर या निभाग में िेिन मैट्रिक्स में स्िर - 4 , 25500-81100 रुपए या

समिुल्य में ननयनमि आधार पर ननयुनि के पश्चाि, उस श्रेणी में 10 िर्ा सेिा की है;

ट्रिप्पण 2 के अधीन निद्यमान प्रनिनियों के स्र्ान पर ननम्ननलनखि प्रनिनियां रखी जाएंगी; अर्ााि :—

‘‘ट्रिप्पण-2 – प्रनिननयुनि के आधार पर ननयुनि के प्रयोजन के नलए दकसी अनधकारी द्वारा 01 जनिरी, 2016 से

पहले (उस िारीख से नजससे साििें केन्रीय िेिन आयोग की नसफाट्ररशों पर आधाट्ररि पुनरीनक्षि िेिन संरचना का

निस्िार दकया गया है), ननयनमि आधार पर की गई सेिा को नसिाय उस िशा के जहां एक से अनधक पूिा पुनरीनक्षि

िेिनमान का एक श्रेणी में निलय कर दिया गया है और िहां यह लाभ केिल उस पि (उन पिों) पर निस्िाट्ररि होगा

नजसके नलए िेिनमान नबना दकसी उन्नयन का साधारण प्रनिस्र्ापन ग्रेड है, िेिन आयोग की नसफाट्ररशों पर

आधाट्ररि निस्िाट्ररि ित्सस्र्ानी िेिन मैट्रिक्स में स्िर में की गई सेिा समझी जाएगी ।"

MINISTRY OF DEFENCE

New Delhi, the 16th June, 2017

S.R.O. 49.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President

hereby makes the following rules to amend the Ministry of Defence Accountant (Group B post) Recruitment Rules,

2013, namely:—

1. Short title and commencement.—(1)These rules may be called the Ministry of Defence Accountant (Group

B post) Amendment Recruitment Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Defence Accountant (Group ‘B’ post) Recruitment Rules, 2013, in rule 2, for the words

“pay band and grade pay or pay scale” and “scale pay” the words “level in the pay matrix” shall be

substituted.

3. In the Schedule to the Ministry of Defence, Accountant, (Group B post) Recruitment Rules, 2013,—

(a) in column (4),— (i) for the heading, the heading “Level in the pay matrix” shall be substituted;

(ii) for the entries, the entries “Level 6 in pay matrix Rs 35400 - Rs 112400” shall be substituted;

(b) in column (11),—

(i) in item (a), for sub-items (ii) and (iii), the following entries shall be substituted namely:—

(ii) “minimum six years service in the grade rendered after appointment thereto on regular basis in

the Level 5 in Pay Matrix of Rs 29200 – Rs 92300 or equivalent in the parent cadre or department,

or

(iii) ten years service in the grade rendered after appointment thereto on regular basis in the Level 4

in Pay Matrix of Rs 25500-Rs 81100 or equivalent in the parent cadre or department; and”

(c) for the existing entries under the Note-2, the following entries shall be substituted, namely:—

‘‘Note : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an

officer prior to the 1^st January, 2016 (the date from which the revised pay structure based on the Seventh

Central Pay Commission recommendation has been extended) shall be deemed to be service rendered in the

corresponding level in the pay matrix extended based on the recommendations of the Pay Commission except

where there has been merger of more than one pre-revised scale of pay and where this benefit will extend only

for the post(s) for which pay scale is the normal replacement grade without any upgradation.”

ििरक्षक संगठन (समूह ’क’ पि) िकननकी अनधकारी भिी ननयम, 2007 िर्ा ििरक्षक संगठन समूह ’ख’ और समूह ’ग’

िकननकी पयािेक्षण पि भिी ननयम, 2008 को उन बािों के नसिाए अनधक्ांि करिे हुए नजन्हें ऐसे अनधक्मण से पहले दकया

गया है या करने का लोप दकया गया है, रक्षा मंत्रालय के अधीन ििरक्षक संगठन में िकननकी अनधकारी , फोरमैन और

चाजामैन के पिों पर भिी की पद्धनि का निननयमन करने के नलए ननम्ननलनखि ननयम बनािे हैं , अर्ााि् : —

1. संनक्षप्त नाम और प्रारंभ.—(1) इन ननयमों का संनक्षप्त नाम ििरक्षक संगठन (समूह ’क’ और ‘ख’) िकनीकी पयािेक्षण संिगा

भिी ननयम 2017 है।

(2) ये राजपत्र में उनके प्रकाशन की िारीख को प्रिृत्त होंगे ।

2. लागू होना.—ये ननयम इन ननयमों से उपािद्ध अनुसूची के स्िंभ (i) में निननर्िाि पिों पर लागू होंगे।

3. पि-संख्या, िगीकरण, और िेिन मैट्रिक्स में स्िर.—पिों की संख्या, उसका िगीकरण और िेिन मैट्रिक्स में स्िर िह होगा

जो इन ननयमों से उपाबद्ध अनुसूची के स्िंभ (2) से स्िंभ (4) में निननर्िाि हैं ।

4. भिी की पद्धनि, आयु सीमा और अहािाएं आदि.—भिी की पद्धनि, आयु सीमा, अहािाएं और उससे संबंनधि अन्य बािें िे

होंगी जो उि अनुसूची के स्िंभ (5) से (13) में निननर्िाि हैं ।

5. ननरहािा.— िह व्यनि—

(क) नजसने ऐसे व्यनि से नजसका पनि या नजसकी पत्नी जीनिि हैं, नििाह दकया है या नििाह की संनििा की है; या

(ख) नजसने अपने पनि या अपनी पत्नी के जीनिि रहिे हुए दकसी व्यनि से नििाह दकया है या नििाह की संनििा की

उि पि पर ननयुनि का पात्र नहीं होगा :

परन्िु यदि केन्रीय सरकार का यह समाधान हो जािा है दक ऐसा नििाह उस व्यनि और नििाह के अन्य पक्षकार

को लागू स्िीय निनध के अधीन अनुज्ञेय है और ऐसा करने के नलए अन्य आधार हैं िो िह दकसी व्यनि को इस ननयम के प्रििान

से छूि िे सकेगी ।

6. नशनर्ल करने की शनि.—जहां केन्रीय सरकार की यह राय है दक ऐसा करना आिश्यक या समीचीन है, िहां िह उसके

नलए जो कारण हैं, उन्हें लेखबद्ध करके, िर्ा संघ लोक सेिा आयोग से परामशा करके इन ननयमों के दकसी उपबंध को दकसी

िगा या प्रिगा के व्यनियों की बाबि, आिेश द्वारा नशनर्ल कर सकेगी ।

7. व्यािृनत्त.—इन ननयमों की कोई बाि, ऐसे आरक्षण, आयु-सीमा में छूि और अन्य ट्ररयायिों पर प्रभाि नहीं डालेगी, नजनका

केन्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी दकए गए आिेशों के अनुसार अनुसूनचि जानियों, अनुसूनचि

जनजानियों, अन्य नपछडें िगों, भूिपूिा सैननकों और अन्य निशेर् प्रिगा के व्यनियों के नलए उपबंध करना अपेनक्षि है ।

प्रोन्ननि : — स्िर-7, 44900 रु. से 142400 रु. में ऐसा फोरमैन िकनीकी नजसने श्रेणी में िीन िर्ा ननयनमि सेिा की हो ।

ट्रिप्पण : जहां ऐसे कननष्ठ व् यनियों के संबंध में, नजन्होंने अपनी अहाक या पात्रिा सेिा पूरी कर ली है, प्रोन्ननि के नलए निचार

दकया जा रहा हो, िहां उनके ज्येष्ठ व् यनियों के संबंध में भी निचार दकया जाएगा परंिु यह िब जब दक उसके द्वारा की गई

ऐसी अहाक या पात्रिा सेिा, अपेनक्षि अहाक या पात्रिा सेिा के आधे से अनधक से या िो िर्ा से, इनमें से जो भी कम हो, कम न

हो और उन्होंने अपने ऐसे कननष्ठ व् यनियों सनहि, नजन्होंने ऐसी अहाक या पात्रिा सेिा पहले ही पूरी कर ली है, अगली

उच्चिर श्रेणी में प्रोन्ननि के नलए अपनी पट्ररिीक्षा की अिनध सफलिापूिाक पूरी कर ली हो ।

प्रनिननयुनि : —केन्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्रों या पनब्लक सेक्िरों उपक्म या मान्यिा प्राप्त अनुसंधान

संस्र्ान या निश्वनिद्यालयों या अधा सरकारी या कानूनी या स्िायत्त संगठन के अधीन ऐसे अनधकारी —

(क)

(i)

मूल संिगा / निभाग में ननयनमि आधार पर सिृश पि धारण कर रहे हों ; या

(ii)

मूल संिगा या निभाग में स्िर-8, 47600 रु. से 151100 रु. या समिुल्य में ननयनमि आधार पर

इसकी ननयुनि के पश्चाि िो िर्ा ननयनमि सेिा की हो; या

(iii) मूल संिगा या निभाग में स्िर-7, 44900 रु. से 142400 रु. या समिुल्य में ननयनमि आधार पर

इसकी ननयुनि के पश्चाि िीन िर्ा ननयनमि सेिा की हो; या

(ख)

ननम्ननलनखि शैक्षनणक अहािाएं रखिे हों :—

(i)

दकसी मान्यिा प्राप्त निश्वनिद्यालय या संस्र्ा से यांनत्रकी या निद्युि या सामुदरक या िूरसंचार या

औद्यौनगक इंजीननयरी या उत्सपािन इंजीननयरी या िास्िुकला में नडप्लोमा रखिा हो;

(ii)

पोि मरम्मि या इलेनक्िक में साधारण इंजीननयरी और / या इलेक्िाननक या समुरी व्यापार में

िीन िर्ा अनुभि रखिा हो ।

भूिपूिा सैननक : प्रनिननयुनि या पुनः ननयोजन--

सेना, नौ सेना या िायु सेना की समुनचि िकनीकी शाखा में मास्िर चीफ पेिी आफीसर की पंनि धारण करने िाले

ऐसे सशस्त्र बल कार्माकों के, नजनके पास उपयुाि उपिर्शाि के अनुसार रखिे हों और जो एक िर्ा की अिनध के भीिर

सेिाननिृि होने िाले हैं या ट्ररजिा में स्र्ांिट्ररि दकए जाने िाले हैं, के संबंध में भी निचार दकया जाएगा । ऐसे व्यनि को उस

िारीख िक प्रनिननयुनि के ननबंधनों पर रखा जाएगा ित्सपश्चाि् पुनर्नायोजन पर बने रहने दिया जा सकिा है ; ित्सपश्चाि िह

पुनर्नायोजन पर बने रहने दिया जा सकिा है ।

पोर्क प्रिगा के ऐसे निभागीय अनधकारी, जो प्रोन्ननि की सीधी पंनि में है, प्रनिननयुनि/आमेलन पर ननयुनि के नलए

निचार दकए जाने के पात्र नहीं होंगे । इसी प्रकार प्रनिननयुि व्यनि प्रोन्ननि द्वारा ननयुनि के नलए निचार दकए जाने के पात्र

नहीं होंगे ।

इलेक्िाननक इंनजननयरी में नडप्लोमा या समिुल्य ।

(ii)

पोि मरम्मि या साधारण इंजीननयरी और / या इलेनक्िक या इलेनक्िकल या समुरी व्यापार के क्षेत्र

में िो िर्ा का अनुभि ।

ट्रिप्पण : पोर्क प्रिगा के ऐसे निभागीय अनधकारी, जो प्रोन्ननि की सीधी पंनि में है, प्रनिननयुनि पर ननयुनि के नलए निचार

दकए जाने के पात्र नहीं होंगे । इसी प्रकार प्रनिननयुि व्यनि प्रोन्ननि द्वारा ननयुनि के नलए निचार दकए जाने के पात्र नहीं

होंगे ।

(प्रनिननयुनि (आई एस िी सी) की अिनध, नजसके अंिगाि केन्रीय सरकार के उसी या दकसी अन्य संगठन या निभाग

supersession of the Coast Guard Organization (Group ‘A’ Post) Technical Officer Recruitment Rules, 2007 and Coast

Guard Organization Group “B” and Group “C” Technical Supervisory Posts Recruitment Rules, 2008, except as

respects things done or omitted to be done before such supersession, the President hereby makes the following rules

regulating the method of recruitment to the post of Technical Officer, Foreman (Technical) and Chargeman in Coast

Guard Organization under the Ministry of Defence namely:-

1.

Short title and commencement.—(1) These rules may be called as Coast Guard Organization (Group “A”

and Group “B” posts) Technical Supervisory Cadre Recruitment Rules, 2017.

They shall come into force on the date of their publication in the Official Gazette.

2.

Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these

rules.

3.

Number of posts, classification and the Level in the pay matrix.—The number of the said posts, their

classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule

annexed to these rules.

4.

Method of recruitment, age-limit, and qualification, etc.—The method of recruitment, age limit,

qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the Schedule.

5.

Disqualification.—No person,-

(a)

Who has entered into or contracted a marriage with a person having a spouse living, or

(b) Who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law

applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any

person from the operation of this rule.

6.

Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it

may, by order and for reasons to be recorded in writing, in consultation with the Union Public Service Commission,

relax any of the provisions of these rules with respect to any class or category of persons.

7.

Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required

to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-Servicemen and other

special categories of persons in accordance with the orders issued by the Central Government from time to time in this

regard.

Rules, 2016 and corrigendum issued vide S.R.O. 34, dated 10 Jun 2016, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Department of Defence

Production, Directorate General of Aeronautical Quality Assurance, Staff Car Driver(Special Grade) Group ‘B’ post

Recruitment (Amendment) Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

In the Ministry of Defence, Department of Defence Production, Directorate General of Aeronautical Quality

Assurance, Staff Car Driver (Special Grade) Group ‘B’ posts Recruitment Rules, 2016,-

(1) in rule 2, for the words “pay band and grade pay or pay scale” occurring at both the places, the words

“the level in the pay matrix” shall be substituted;

(2) in the Schedule,-

(a) in column (4),

का.नन.आ. 52. —राष्ट्रपनि, संनिधान के अनुच्छेि 309 के परन्िुक द्वारा प्रित्त शनियों का प्रयोग करिे हुए, रक्षा

मंत्रालय, सशस्त्र बल मुख्यालय और अंिर सेिा संगठन, स्िाफ कार ड्राइिर, समूह 'ग' पि भिी ननयम, 2005 को, जहां िक

उनका संबंध स्िाफ कार ड्राइिर निशेर् श्रेणी के पि से है, उन बािों के नसिाय अनधक्ांि करिे हुए नजन्हें ऐसे अनधक्मण से

पहले दकया गया है या करने का लोप दकया गया है, रक्षा मंत्रालय, रक्षा मंत्रालय के एकीकृि मुख्यालय (सेना, नौसेना,

िायुसेना), रक्षा स्िाफ मुख्यालय और अंिर सेिा संगठन में स्िाफ कार ड्राइिर (निशेर् श्रेणी) के पि पर भिी की पद्धनि का

निननयमन करने के नलए ननम्ननलनखि ननयम बनािे हैं, अर्ााि्:-

संनक्षप्त नाम और प्रारंभ.—(1) इन ननयमों का संनक्षप्त नाम रक्षा मंत्रालय, रक्षा मंत्रालय के एकीकृि मुख्यालय (सेना,

नौसेना, िायुसेना), रक्षा स्िाफ मुख्यालय और अंिर सेिा संगठन, स्िाफ कार ड्राइिर (निशेर् श्रेणी) भिी ननयम, 2017 है।

(2) ये राजपत्र में उनके प्रकाशन की िारीख को प्रिृत्त होंगे।

पि-संख्या, िगीकरण और िेिन मैट्रिक्स में स्िर.—पि की संख्या, उसका िगीकरण और िेिन मैट्रिक्स में स्िर िह

होगा, जो इन ननयमों से उपाबद्ध अनुसूची के स्िंभ (2) से (4) में निननर्िाि हैं।

3.

भिी की पद्धनि, आयु-सीमा, अहािाएं आदि.—उि पि पर भिी की पद्धनि, आयु-सीमा, अहािाएं और उससे संबंनधि

अन्य बािें िे होंगी जो उि अनुसूची के स्िंभ (5) से (13) में निननर्िाि हैं।

4.

ननरहािा – िह व्यनि .—

क)

नजसने ऐसे व्यनि से नजसका पनि या नजसकी पत्नी जीनिि हैं, नििाह दकया है; या

ख)

नजसने अपने पनि या अपनी पत्नी के जीनिि रहिे हुए दकसी व्यनि से नििाह दकया है,

उि पि पर ननयुनि का पात्र नहीं होगा :

परन्िु यदि केन्रीय सरकार का यह समाधान हो जािा है दक ऐसा नििाह उस व्यनि और नििाह के अन्य पक्षकार को

लागू स्िीय निनध के अधीन अनुज्ञेय है और ऐसा करने के नलए अन्य आधार हैं िो िह दकसी व्यनि को इस ननयम के प्रििान से

छूि िे सकेगी।

5.

नशनर्ल करने की शनि.—जहां केन्रीय सरकार की यह राय है दक ऐसा करना आिश्यक या समीचीन है, िहां िह

उसके नलए जो कारण हैं, उन्हें लेखबद्ध करके, इन ननयमों के दकसी उपबंध को दकसी िगा या प्रिगा के व्यनियों की बाबि,

आिेश द्वारा नशनर्ल कर सकेगी।

6.

व्यािृनत्त .—इन ननयमों की कोई बाि, ऐसे आरक्षण, आयु-सीमा में छूि और अन्य ट्ररयायिों पर प्रभाि नहीं डालेगी,

नजनका केन्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी दकए गए आिेशों के अनुसार अनुसूनचि जानियों, अनुसूनचि

जनजानियों, भूिपूिा सैननकों और अन्य निशेर् प्रिगा के व्यनियों के नलए उपबंध करना अपेनक्षि है।
