सं. ओ-32011/4/2013-ओएनजी-I——सरकार ने 10 माचS, 2016 को हाइUोकाबSन अ? वेषण तथा लाइस-2संग नीत (हे प) को

अनुमोदन !दान Cकया और दनांक 30 माचS, 2016 के संक प Yवारा उसके Z यौरे !का2शत Cकए। इस नीत के अंतगSत, पारदश\ तरके से

ई-बोल के मा] यम से सतत आधार पर अ? वेषण Z लॉक !दान Cकए जाएंगे। यह नीत अ? वेषण एवं उ` पादन के पर. परागत साथ ह साथ

गैर पर. परागत हाईUोकाबSन संसाधनa के 2लए एकल लाइस-स !दान करती है। खुला रकबा लाइस-2संग नीत के अंतगSत अ? वेषण Z लॉक

तैयार करने के 2लए बोलदाता को, राज= व भागीदार मॉडल, !चालना` मक साथ ह साथ मू य नधाSरण एवं Qवपणन क5 आजाद का

1.1

नीत

(i)

भारत सरकार ने हाइ$ोकाब%न अ' वेषण तथा लाइससंग नीत (हे+ प) के एक भाग के @प म- 30 माचS, 2016 को खुला

रकबा लाइस-2संग नीत (ओएएलपी) शु@ क5 है।

(ii)

इस नीत के कायाS? वयन के 2लए पेो2लयम तथा !ाकृतक गैस मं&ालय के अंतगSत हाईUोकाबSन महानदेशालय नोडल

एज-सी होगा और नेशनल डाटा iरपोिज़टर (एनडीआई) म- उपलZ ध डाटा के आधार पर नवेशकa को उनक5 पसंद के Z लॉक,

= व!ेरणा से अ2भk यिl त क5 अ2भm च(ईओआई) के मा] यम से, संQवदांकन हेतु !दान करने म- सहयोग !दान करेगा।

(iii) यह द= तावेज ओएएलई क5 !चालन !CFया नधाSiरत करता है।

(iv) इe छुक नवेशक सब-सफp स डाटा का अ] ययन कर सक- , इसके 2लए डीजीएच म- एनडीआर सुQवधा !दान क5 गई है िजसे

भारत सरकार Yवारा अ धसू चत डाटा नीत के अनुसार उपयोग Cकया जा सकता है।

(v)

नवेशकa से !ाq त अ2भm च क5 अ2भk यिl त(ईओआई) का आंकलन धारा 2 म- नधाSiरत योr यता मानद* ड के अनुसार

Cकया जाएगा।

(vi) नवेशकa से !ाq त बोल(यa) का आकलन धारा 2 म- नधाSiरत योr यता मानद* ड के अनुसार तथा मू यांकन धारा 7 म-

नधाSiरत बोल मू यांकन मानद* ड (बीईसी) के अनुसार Cकया जाएगा।

(vii) डीजीएच, जब भी आवs यक समझेगा, ओएएलपी के अंतगSत नवेशकa Yवारा = व!ेरणा से Cकए गए आवेदनa म- संQवदांकन हेतु

दए गए Qवक पa के अलावा, डीजीएच Yवारा तैयार Cकए गए Z लॉl स अवाडS करने के Qव2भ? न चरणa क5 देख-रेख करेगा।

वग\करण तीन Iे&a म- Cकया गया है। सैl टर/एiरया के 2लए वग\करण तथा इससे संबं धत उपलZ ध डाटा एनडीआर पर देखा जा

सकता है। ईओआई को = वीकृत उसी Iे& के 2लए, िजसम- वह Z लॉक पड़ता है, लागू संQवदा टाइप के आधार पर द जाएगी।

(vi) कोई भी !वतSक या बोलदाता Cकसी एक Z लॉक के 2लए !चालक या गैर !चालक के @प म- केवल एक बोल जमा कर सकता है।

(vii) !त= पध\ बोल !CFया के मा] यम से चुने गए बोलदाता को !त= पध\ बोल से पहले दए गए मॉडल संQवदा के अनुसार

सरकार के साथ एक करार करना होगा।

(iii)

बोल के समय !वतSक और बोलदाता का सकारा` मक नेटवथS होना चाहए। तथाQप, तकनीक5 बोल खोलते समय

बोलदाता के भागीदाiरता हत(पीआई) के अनुपात म- उसके घटकa के नेटवथS का मू यांकन Cकया जाएगा। इस = तर पर

नेटवथS न. न2लBखत के बराबर या उससे अ धक होना चाहए:

(ii)

अ2भm च क5 अ2भk यिlत != तुत कर रहे पiरसंघ के मामले म-, वह पiरसंघ Cकसी पiरवतSन के बोल != तुत करने के 2लए

उ` तरदायी है। यद बोल के समय पiरसंघ म- गठन म- कोई पiरवतSन होता है तो !वतSक !ो` साहन रा2श नहं द जाएगी

और ऐसे पiरसंघ क5 भागीदाiरता बॉड जZ त कर 2लया जाएगा।

3.2

(i)

उसम- बताए नदेश€ के अनुसार इस द= तावेज के अनुबंध[2] म- बताए !प& पर ऑनलाइन != तुत क5 जाएगी।

(ii)

डीजीएच भुगतान गेटवे के मा] यम से अमेiरक5 डालर 1000/- [एक हजार ] न लौटाए जाने वाले आवेदन शु क का

भुगतान Cकया जाना है।

(iii)

अ2भk यिlत क5 अ2भm च != तुत iरपोटS क5 मूल !त (है प पोटSल पर सृिजत सफल अ2भk यिlत क5 अ2भm च != तुत),

भागीदाiरता बॉड और अ? य अपे•Iत द= तावेज, यद कोई हो, ऑनलाइन != तुत क5 त थ से 10 कैल-डर दनa के भीतर

ग) !ाq त हुई ईओआई को डीजीएच अंतम @प देगा और ईओआई जमा कराने के 2लए !`येक Qवंडो बंद होने के 30

दनa के भीतर !त= पध\ बोल लगाने के 2लए डीजीएच आंतiरक/भारत सरकार का अनुमोदन लेकर सूचना आमं&ण

!=ताव (एनआईओ) !का2शत करेगा।

घ) बोलदाताओं को नQवदाएं जमा करने के 2लए एनआईओ !का2शत करने क5 तारख से 60 दन क5 अव ध !दान

क5 जाएगी।

ड) डीजीएच पैरा 7.3 म- उलेBखत मापदंड के अनुसार बोल मूयांकन करेगा और बोल समापन त थ से 10 सqताह

के अंदर Zलॉक !दान करेगा।

च) Zलॉक !दान करने के उपरांत, बोल Qवजेता 45 दनa क5 अव ध के भीतर अनुबंध पर ह=ताIर करेगा।

(v) ईओआई को समय पर जमा कराना इeछुक पाट‰ क5 िज.मेदार होगी। अंतम त थ और समय के बाद डीजीएच Yवारा

!ाqत ईओआई को बाद के मूयांकन क5 अव ध या Qवंडो के 2लए = वीकार Cकया जाएगा।

(vi) डाक के दौरान या Cकसी अ?य देर के 2लए या अ?यथा नQवदा के नुकसान के 2लए डीजीएच उ` तरदायी नहं होगा।

3.3

Oलॉक तैयार करना

(i) मुl त रकबा लाइस-2संग मागS म-, Zलॉक क5 पहचान क5 =वतं&ता और अनुबंध के 2लए उ?ह- पेश करने क5 मांग करना

नवेशकa पर नभSर होगा। Zलॉक क5 पहचान न. नानुसार करनी चाहए

क) भारत के तलछट बे2सनa के अंदर भीतर आते हd, और

ख) पीईएल/पीएमएल से मुlत हa

ग) एनडीआर म- "नो-गो" के @प म- संकेतत Iे& म- शा2मल नहं हa

(ii) Zलॉक का नधाSरण करने के 2लए उपलZध Iे& को एनडीआर पर देखा जा सकता है।

(iii) हाइUोकाबSन के सभी !कार के Iे& के @प म- [10 'x 10'] (~ 336 वगS Cक.मी.) का Iे&फल पiरभाQषत Cकया गया है।

ईओआई जमा करने के 2लए बोलदाता को एक या एक से अ धक नकटवत\ Iे&a के @प म- एक Zलॉक को नधाSiरत

करना होगा। तथाQप,

क)

मौजूदा Zलाकa (जो पहले से ह पीईएल/पीएमएल के तहत हd) के नकटवत\ Iे&a म- (कॉमन सीमा म- साझी) के

मामले म-, मौजूदा ठेकेदार को एक या एक से अ धक से अ धक आकार के Iे&a [1 'x 1'] के 2लए ईओआई !=तुत

करने क5 अनुमत द जाएगी िजसका अ धकतम आकार 50 इकाइयां [1'x1'] हो।

ख) वह Iे& जहां Iे&a क5 अनुपलZधता के कारण 10'x10 आकार के Iे&a के गुणज म- Zलॉक नधाSiरत करना संभव

नहं है तो नवेशक को एक या एक से अ धक आकार [ 1 'x 1'] के Iे&a के 2लए ईओआई !=तुत करने क5

अनुमत होगी।

[1'x1 '] के एक Iे& के 2लए नेटवथS, एक (10'x10') आकार के सेlटर के 2लए अपे•Iत नेटवथS के अनुसार

यथानुपात Cकया जाएगा।

(iv) Qव2भ?न Zलॉकa के 2लए अलग-अलग आवेदन !=तुत करना आवsयक है।

(v) Zलॉक को नधाSiरत करने के 2लए न.न2लBखत शत• लागू होती हd:

क) डीजीएच अपने Qववेकानुसार उ चत मूयांकन के बाद उस Iे& को = वीकार करेगा िजसके 2लए ईओआई !=तुत क5

गई है अथवा उसम- उस Iे& को संशो धत/पiरवतSत करेगा।

ख) आवेदन के 2लए ?यूनतम और अ धकतम Iे& न.नानुसार होगा:

उ` तम अंतराS य पेो2लयम उYयोग पcत (जीआईपीआईपी) का भाग है।

3.4.

^ व ेरणा से Iहत को ZयSत करने से संबंFधत स.ांत

(i) ईओआई आवेदकa को बाद म- बोल लगाने (डीजीएच को =वीकायS बोल !=तुत करने के 2लए) के 2लए अनुगृहत Cकया

जाएगा। यद डीजीएच Yवारा अंतम @प देने के 2लए बोल लगाने के 2लए अंतम Iे& म- Qवचलन आवेदन Iे& का 50%

से अ धक है, तो इस !कार के अनुKह को छोड़ दया जाएगा और बोल लगाने क5 !CFया म- भाग नहं लेने क5 इe छा

क5 जानकार 2मलने के बाद भागीदार बांड iरलज कर दया जाएगा।

(ii) धारा 3.4 (i) म- उपरोlत पiरगBणत पiरमाण के अलावा, यद ईओआई !=तुत करने वाल पाट‰ बोल !CFया म- भाग

नहं लेती है तो ईओआई के साथ जमा सहभा गता बांड को जZत कर दया जाएगा ।

(iii) सहभा गता बॉ^ंड धारा 3.5 के अनुसार जार Cकया जाएगा।

(iv) िजस Gेणी म- Zलॉक का 50% से अ धक Iे& आता है, उसे इसी Z लॉक क5 Gेणी (अथाSत् जमीनी, उथला समुu , सीमावत\

!देश, गहरा समुu ) माना जाएगा। Zलॉक को अ` यंत गहरा समुu Zलॉक माना जाएगा, यद उसम- अ` यंत गहरा समुu

30% से अ धक है ।

3.5

^ व ेरणा ईओआई संघटन

(i)

ओएएल हेतु ओएएल हेतु = व !ेरणा से ईओआई म- न. न2लBखत शा2मल हaगे शा2मल हaगे:

मॉडल और संभावना के बारे म- एक सं•Iqत संकपना`मक iरपोटS उपलZ ध करायी जानी चाहए।

उपरोlत iरपोटS के 2लए !ाथ2मक डेटा ’ोत एनडीआर या भारत सरकार से पहले !ाqत Cकए गए डाटा हd।

डाटा ’ोत का !कटन होना चाहए और डाटा Qव धक @प से ईओआई !=तुत करने वाल पाट‰ के पास होना चाहए ।

पेो2लयम संचालन संQवदा के 2लए, आवेदक को सवpIणa के 2लए नधाSiरत •Iतज (2मल सेकंड) और कुओं

हेतु 150,000 अमरक5 डालर/सेlटर मूय का सहभा गता बांड != तुत करना होगा। जमीनी या उथला समुu Gेणी

के अंतगSत आने वाले Z लॉक के 2लए 1(एक) 2म2लयन अमरक5 डालर क5 सीमा और गहरे समुu एवं अ` यंत गहरे

डालर क5 सीमा और गहरे समुu एवं अ` यंत गहरे समुu Gेणी के 2लए 0.4 2म2लयन अमरक5 डालर लागू है।

ग) एक बोलदाता को 12 महने क5 अव ध के 2लए एक वैध अनुसू चत वाBणि…यक बdक से बdक गारंट के @प म- सभी

!कार के Zलॉकa के 2लए पीओसी के 2लए मूय 150,000 अमरक5 डालर/सेlटर मू य का बोल बांड जमा कराना

होगा। जमीनी या उथला समुu Gेणी के अंतगSत आने वाले Z लॉक के 2लए 1 2म2लयन अमरक5 डालर और गहरे

समुu एवं अ` यंत गहरे समुu Gेणी के 2लए 2 2म2लयन अमरक5 डालर क5 अ धकतम सीमा लागू है।

!ामथ2मक संQवदा के 2लए, बोलदाता को 12 माह क5 अव ध के 2लए एक अनुसू चत काम2शSयल बdक से बdक

गारंट के @प म- सभी Z लॉकa के 2लए 30,000 यूएसडी/सेl टर मू य के 2लए एक बोल बॉ^ंड != तुत करना होगा।

जमीनी या उथला समुu Gेणी के अंतगSत आने वाले Z लॉक के 2लए 0.2 2म2लयन अमरक5 डालर और गहरे समुu

एवं अ` यंत गहरे समुu Gेणी के 2लए 0.4 2म2लयन अमरक5 डालर क5 अ धकतम सीमा लागू है। यद !वतSक बोल

म- सफल नहं होता है Cक? तु योrयता मानदंड (तकनीक5 और Qव`तीय दोनa) को पूरा करता है, तो 3.4 (i) क5 शतS

पर !वतSक का सहभा गता बांड जार Cकया जाएगा ।

!वतSक को (या एक !ाथ2मक लाइस-स धारक जो पीओसी को माइKेट करना चाहता है) बोल लगाने के चरण

म- नQवदा शु क और नQवदा बांड जमा कराना अपे•Iत नहं होगा ।

ii)

बोलदाताओं को बोल लगाने के चरण म- डीजीएच के 2लए ऑनलाइन भुगतान हेतु यूएस [1,000 (एक हजार

डॉलर) का एक अ!तदेय नQवदा शुक जमा कराना होगा।

4.1

(i)

पेो2लयम !चालन संQवदा नवेशकताSओं को संदभाSनुसार अपे•Iत अ? वेषण !चालन, Qवकास !चालन अथवा उ` पादन

!चालन या ऐसे दो या अ धक !चालनa का मेल हो िजसम- नमाSण, सभी आवs यक सुQवधाओं का !चालन तथा रख-

रखाव, कूप वेधन अथवा बंद करना और पiर` यl तता, सुरIा, पयाSवरण संरIा, पiरवहन, भंडारण, }डलवर q वाइंट तक

पेो2लयम क5 ”बF5 अथवा Qव? यास, कायS= थल का नवीकरण तथा अ? य कोई अथवा सभी आकि= मक !चालन अथवा

यथा आवs यक कायSकलाप शा2मल हa, करने क5 अनुमत !दान करेगी।

(ii)

पेो2लयम !चालन संQवदा क5 शत• भारत सरकार Yवारा अनुमोदत राज= व शेयiरंग संQवदा के अनुसार हaगी ।

4.2

ाथमक सं?वदा

(i)

ऑनशोर/ऑफशोर Iे& म- उपलZ ध Iे&a म- अ? वेषण कायS करने हेतु इe छुक बोलदाता इस द= तावेज के अनुबंध (2) म-

नधाSiरत फॉमpट के अनुसार डीजीएच को !ाथ2मक संQवदा हेतु अ2भm च क5 अ2भk यिl त != तुत कर सकते हd।

(ii)

!ाथ2मक संQवदा के अंतगSत पIकारa को दए गए Z लॉक म- सभी !कार के हाइUोकाबSन के अ? वेषण कायS को (2) वष€

तक करने क5 अनुमत होगी साथ ह, इसम- (1) वषS हेतु Qव= तार अव ध का !ावधान भी होगा।

(iii)

!ाथ2मक कायS क5 समािq त के पs चात संQवदाकताS डीजीएच Yवारा अ धसू चत नीत के अनुसार इस !कार जुटाए गए

सम= त आंकड़े डीजीएच को स•पेगा ।

(iv)

!ाथ2मक संQवदा के !चालक को संQवदा अव ध (12 वषS) के दौरान एक”&त आंकड़a (अपiर कृत आंकड़े, भौतक समुu

QवŽान संबं धत आंकड़े तथा डीजीएच आंकड़े को छोड़कर) पर लाइस-स का एकमा& अ धकार होगा, बशतp भारत के पड़ोसी

देशa म- नग2मत क5 गई कंपनयa अथवा डीजीएच Yवारा समय-समय पर अ धसू चत देशa के 2लए इन आंकड़a के

लाइस-स के 2लए डीजीएच का पूवाSनुमोदन आवs यक होगा।

(v)

Cकसी Qवशेष Z लॉक के 2लए !ाथ2मक संQवदा के !चालक कायS !तबcताओं का कम से कम 80% पूरा कर लेने के

पs चात पेो2लयम !चालन संQवदा म- = थानांतरण करने क5 इe छा != तुत करने के पा& हaगे । इस Qवक प का !योग

करने के 2लए संQवदाकताS !ाथ2मक संQवदा के समाq त होने के कम से कम 90 दन पहले = थानांतरण करने क5 इe छा

डीजीएच को != तुत कर-गे । संQवदाकताS को Qवचाराधीन Z लॉक हेतु पेो2लयम !चालन संQवदा हेतु लागू तकनीक5 तथा

Qव` तीय मानदंडa (धारा (2) म- उि लBखत ) को पूरा करना होगा । पेो2लयम !चालन संQवदा म- = थानांतरण हेतु

!ो` साहन रा2शयां इस द= तावेज के धारा (8) म- नधाSiरत क5 गई हd।

ऐसे लाइस-स से संबं धत आय को नलंब लेखा (ए= Fौ एकाउंट) म- जमा कर दया जाएगा।

(vii) यद, !ाथ2मक लाइस-सी का !चालक पेो2लयम !चालन संQवदा म- = थानांतरण क5 बोल नहं जीत पाता है तो

बोलदाता(ओं) के !ाथ2मक आंकड़े के लाइस-स से !ाq त आमदनी संQवदाकताS को अंतiरत कर द जाएगी। तथाQप,

संQवदाकताS को बोल !ाq त हो जाने पर पiरसंघ के Cकसी भी सद= य को आंकड़े के ऐसे लाइस-स से !ाq त आय पर दावा

नहं होगा तथा आंकड़a को लाइस-सीकृत करने के सभी अ धकार त` काल !भाव से समाq त हो जाएंगे।

(viii) िजन नवेशकताSओं ने िजस Z लॉक के 2लए !ाथ2मक संQवदा क5 अव ध को पूरा कर 2लया है तथा अनुमत समय-सीमा के

भीतर पेो2लयम !चालन संQवदा म- = थानांतरण होने क5 इe छा !कट नहं क5 है, वे डीजीएच Yवारा Z लॉक को पेो2लयम

!चालन संQवदा हेतु खोलने पर बोल लगाने के 2लए बा] य नहं हaगे।

(ix)

Cकसी Z लॉक के 2लए !ाथ2मक संQवदा के !ारंभकताS को !ो` साहन रा2श इस द= तावेज के धारा (8) के अनुसार !दान क5

जाएगी।

(x)

!ाथ2मक लाइस-सी से आंकड़े खरदने वाले पIकार अपने !तबc कायS योजना के एवज म- अपने !तबc कायS के

कायSFम के 2लए भूकंपीय आंकड़a को नधाSiरत कर सकता है।

(xi)

!ाथ2मक लाइस-सी, अपने Qववेकानुसार तृतीय पI को गैर-एlसl लू2सव बहु-Kाहक सवp करने क5 अनुमत द-गे।

YFच क- अभZ यिS त का मू+ यांकन

5.1

मू+ यांकन अवFध

(i)

m च क5 अ2भk यिl त (ईओआई) हेतु आवेदनa का मू यांकन ‘ पहले आओ पहले पाओ’ आधार पर Cकया जाएगा। != ताQवत

Z लॉक/Iे& (िजसके 2लए डीजीएच Yवारा m च क5 अ2भk यिl त = वीकार क5 गई है) उस Qवशेष !कार क5 संQवदा हेतु m च

क5 अ2भk यिl त != तुत करने के 2लए उपलZ ध नहं हaगे, बशतp डीजीएच को समय-सीमा के भीतर आवs यक द= तावेज

!= तुत Cकए जा चुके हa। तथाQप, !ाथ2मक संQवदा हेतु != तुत अ2भm च क5 अ2भk यिl त पेो2लयम !चालन हेतु संQवदा

का = थान ल-गे, यद उसी Iे& के 2लए उसी != तुत समय-सीमा के भीतर != तुत Cकए गए हa।

(ii)

डीजीएच !ाq त अ2भm च क5 अ2भk यिl त को अंतम @प देगा तथा अ2भm च क5 अ2भk यिl त != तुत समय-सीमा समाq त

होने के 30 दन पs चात आंतiरक/भारत सरकार के अनुमोदन के अधीन !त= पधाS` मक बोल हेतु ऑफर आमं&ण प&

(एनआईओ) जार कर-गा । ओएएल !CFया पूर करने के 2लए एक संभाQवत समय-सीमा इस द= तावेज के अनुबंध-4 म-

द गई है ।

5.2

सामा' य शतm

(i)

!ाथ2मक संQवदा तथा/अथवा पेो2लयम !चालन संQवदा हेतु !ाq त अ2भm च क5 अ2भk यिl त(यa) िज? ह- डीजीएच ने = वीकार

Cकया हो, पर बोल !CFया म- Qवचार Cकया जाएगा। बशत• डीजीएच Yवारा अपने Qववेक के अनुसार Iे&a का ऐसा

समायोजन Cकया गया हो ।

5.3

YFच क- अभZ यिS त का मू+ यांकन

(i)

!ाथ2मक/पेो2लयम !चालन संQवदा हेतु अ2भm च क5 अ2भk यिl त का मू यांकन इस द= तावेज के धारा (2) म- वBणSत

तकनीक5 तथा Qव` तीय अहSताओं के 2लए Cकया जाएगा। तथाQप, आवेदक को बोल लगाते समय लागू Qव` तीय तथा

तकनीक5 अहSता मानदंड पूरे करने हaगे ।

(ii)

m च क5 अ2भk यिl त (ईओआई) != तुतकताS को ईओआई != तुत Cकए जा रहे Iे& क5 पहचान करते समय Cकए गए

!य` नa पर एक नयत उYयम iरपोटS भी != तुत करनी होगी। पेो2लयम !चालन संQवदा के मामले म- सम= त भौगो2लक

एवं भूभौतक5य (जी एंड जी) आंकड़े, पूवS कूप लॉग, यद कोई हd और संभाk यता के आंक2लत = तर पर iरपोटS != तुत

5.4

नयत उYयम iरपोटS क5 समीIा डीजीएच Yवारा क5 जाएगी और iरपोटS क5 सभी शत€ का पालन करने पर = वीकार

Cकया जाएगा ।

तकनीक5 एवं Qव` तीय दोनa योr यता मानदंड को पूरा करना

अ2भm च क5 अ2भk यिl त पहले आओ पहले पाओ आधार पर = वीकार क5 जाएगी तथा ऐसी Cकसी भी अ2भm च क5

अ2भk यिl त को = वीकार नहं Cकया जाएगा जो पहले ह != तुत क5 जा चुक5 अ2भm च क5 अ2भk यिl त को

ओवरलैप करती हो ।

“नो गो एiरया” के साथ पर= पर ओवरलैQपंग करने वाल अ2भm च क5 अ2भk यिl त को = वीकार नहं Cकया जाएगा।

(ii)

उपयुSl त शत€ को पूणS न करने वाल अ2भm च क5 अ2भk यिl त को अ= वीकार कर दया जाएगा ।

5.5

YFच क- अभZ यिS त के मू+ यांकन का पXरणाम

(i)

m च क5 अ2भk यिl त के मू यांकन के अंत म- डीजीएच ईसीएस अनुमोदन के आधार पर !ारंभकताS Yवारा != तुत ईओआई

= वीकार/नर= त करेगा ।

(ii)

m च क5 अ2भk यिl त के मू यांकन के पiरणाम को डीजीएच क5 वेबसाइट पर दशाSया जाएगा ।

(iii)

!ारंभकताS Yवारा बनाए गए नाम एवं अ? य != तुतयa को बोल !CFया के दौरान अ? य बोलदाताओं को बताया नहं

जाएगा ।

(iv)

धारा 3.4 के अनुपालन म- !यो… य Iे& के 50% से अ धक I& म- Qवचलन या उनके अ2भm च क5 अ2भk यिl त के

= वीकार न Cकए जाने के मामले म- !ारंभकताS को Qव धवत सू चत Cकया जाएगा। डीजीएच Yवारा अ2भm च क5

बोलD ^ तुत करना

!तयोगी बो2लयां !वतSक(कa) Yवारा = वत: नधाSiरत अ2भm च क5 अ2भk यिl त के != तुत करने के पs चात डीजीएच Yवारा

= वीकृत !` येक Z लॉक के 2लए मांगी जाएंगी जो बोलदाताओं Yवारा इस द= तावेज के धारा (3) म- नधाSiरत सभी आवs यक

योr यता मानदंडa को पूरा करने के अ] यधीन होगा ।

(i)

कंसो2शSयम Yवारा अ2भm च क5 अ2भk यिl त करने के ि= थत म- वह कंसो2शSयम पiरवतSन के ”बना बोल != तुत करने के

2लए उ` तरदायी होगा। बोल = तर पर कंसो2शSयम पiरवतSन के संयोजन क5 ि= थत म- !वतSक !ो` साहन को मंजूर नहं द

जाएगी तथा इस !कार के कंसो2शSयम के भागीदार बॉ? ड को जZ त कर 2लया जाएगा ।

(ii)

एनआईओ के !काशन क5 त थ से बोलदाताओं को बोल != तुत करने के 2लए 60 दनa क5 अव ध उपलZ ध कराई

जाएगी ।

7.2

मू+ यांकन अवFध

(i)

डीजीएच पैरा 7.3 म- उि लBखत मानदंड के अनुसार बोल मू यांकन पूरा करने के 2लए !यास करेगा तथा बोल समापन

क5 त थ से 45 दनa म- Z लॉक अवाडS करेगा।

(ii)

Z लॉक अवाडS करने के पs चात बोल Qवजेता को संQवदा पर ह= ताIर करने के 2लए 45 दनa क5 अव ध द जाएगी ।

7.3

होगी। बोल के समय पiरसंघ का संघटन बदले जाने क5 ि=थत म- !वतSक !ो` साहन नहं दया जाएगा। इसके अलावा

ऐसे पiरसंघ का भागीदार बॉ?ड ज़Z त कर 2लया जाएगा।

8.2

ाथमक सं?वदा के ^ थान पर पेोलयम चालन सं?वदा करने पर माइrेशन ोE साहन

एक Z लॉक Qवशेष के 2लए !ाथ2मक संQवदाकार कायS कायSFम संबंधी लगभग 80 !तशत !तबcताएं पूर करने पर !ाथ2मक

संQवदा के =थान पर पेो2लयम !चालन संQवदा करने का इरादा !=तुत करने के 2लए पा& हो जाता है। !ाथ2मक संQवदा के

=थान पर पेो2लयम !चालन संQवदा करने के इरादे को उस Zलॉक Qवशेष म- पेो2लयम !चालन संQवदा करने के 2लए @ च क5

अ2भk यिlत माना जाएगा।

एक Z लॉक के 2लए !ाथ2मक संQवदा के =थान पर पेो2लयम !चालन संQवदा करते समय !ाथ2मक संQवदा के संQवदाकार

Open Acreage Licensing Policy(OALP): Modalities for operationalization

Hydrocarbon Exploration & Licensing Policy(HELP)

No. O-32011/4/2013-ONG-I—Government had approved the Hydrocarbon Exploration & licensing Policy (HELP)

on 10.3.2016. Under this Policy, exploration blocks shall be awarded on continuous basis through e-bidding in a transparent

manner. This Policy provides a single license for exploration and production of conventional as well as non-conventional

hydrocarbon resources, option for the bidder to carve out the exploration blocks under Open Acreage Licensing Policy,

Revenue Sharing Model, operational as well as pricing and marketing freedom to the operator. The modalities for

operationalization of Open Acreage Licensing Policy (OALP) have been formulated to facilitate the investors in carving out

the exploration blocks of their choice which are given in the following paragraphs:

Background

1.1.

Policy

(i)

The Government of India introduced the Open Acreage Licensing Policy (OALP) as a part of the

Hydrocarbon Exploration and Licensing Policy (HELP) on March 30, 2016.

(ii)

Directorate General Hydrocarbon (DGH) under Ministry of Petroleum & Natural Gas (MoPNG) will be the

nodal agency for implementing the Policy and will facilitate investors in proposing, through a suo motu

Expression of Interest (EoI), blocks of their choice for contracting based on the data available in National Data

Repository (NDR).

(iii) This document sets out the process for operationalizing the OALP.

(iv) To enable interested investors to study the sub-surface data, the facility of NDR has been created in the DGH

which can be used as per the Data Policy notified by Govt. of India.

(v)

The Expression of Interest (EoI) received from investors will be assessed as per the Qualification Criteria set

out in Section [2].

(vi) The bid(s) received from investors will be assessed as per the Qualification Criteria set out in Section [2] and

will be evaluated as per the Evaluation Criteria as set out in Section [7].

(vii) The DGH will also administer, when deemed necessary, rounds of awards of blocks carved out by DGH, for

contracting in addition to the option available to investors to make suo motu applications under OALP.

1.2.

Options for investors

(i)

While filing suo motu EoI, the applicants can choose to seek one of the following types of contracts:

Petroleum Operations Contract- permits Exploration, Development and Production Operations in any

of the Onshore, Shallow-Water, Frontier, Deep-water and Ultra-deep water block for all type of

hydrocarbons for

•

a period of six [6] years with a provision for extension of one [1] year each in Initial and

Subsequent Exploration Phase for On-land and Shallow water blocks.

•

a period of six [6] years with a provision for up to two extensions of one [1] year each in Initial

and Subsequent Exploration Phase for Frontier, Deep water and Ultra Deep-water blocks.

Reconnaissance Contract- permits Exploration Operations¹ in any of the Onshore, Shallow-Water,

Frontier, Deep-water and Ultra-deep water block for all types of hydrocarbons for a period of two [2]

years with a provision for an extension of one [1] year.

(ii)

For the purpose of these contracts, DGH has classified the Sector/Area into three zones based on the quantum

of geological and geophysical data available. Classification for the Sector/Area and the available data for the

same can be viewed on NDR. EoI for a Block will be accepted based on type of contract applicable for that

zone in which the block is falling. Type of contract that are permitted for different zone is mentioned in the

table below:

(iii) For an area, preference amongst different type of Contracts (as mentioned in Section 4 ), if, submitted within

the same submission window as described in [Para 3.2(iv)] would be accorded in following order:

(iv) For the purpose of this document block has the meaning as defined in Para [3.3.(iii)]

(v)

For the purpose of this document, Investor(s) submitting suo motu EoI for Reconnaissance Contract/

Petroleum Operations Contract is/are hereinafter referred as “Originator(s)”.

(vi) Any Originator or Bidder can put in only one bid either as an operator or non-operator for one particular

block.

(vii) Bidder selected through competitive bidding process would enter into contract with the Government as per the

model contract provided before the competitive bidding. .

Qualification Criteria (QC)

2.1.

Applicability of Qualification Criteria

(i)

The applicant submitting suo motu EoI and/or bid must be a Company singly or in association with other

companies, through an unincorporated or incorporated venture.

(ii)

EoI and/or bid for Reconnaissance/ Petroleum Operations Contract will be assessed for Technical & Financial

Qualification Criteria for the respective Contract as mentioned below.

2.2.

Qualification Criteria for Petroleum Operations Contract

(i)

Technical and Financial Qualification criteria, as mentioned in the paragraphs below, is to be met by the

Operator at the EoI/competitive bidding stage for Petroleum Operations Contract.

2.2.1.

Technical Qualification Criteria

(ii)

“Operatorship Experience” means experience of the party, appointed in accordance with laws of the

respective country (ies), to conduct and execute Exploration and/or development and/or production

operations.

(iii) Operatorship Experience in respective category of block is required for which bidder is applying, subject to:

Operatorship experience in Deepwater/Ultra Deepwater block would be recognized as relevant for all

type of blocks.

Operatorship experience in Shallow water block would be recognized as relevant for Deepwater,

shallow water and on-land blocks

Operatorship experience in on-land block would be recognized as relevant for on-land and Shallow

water blocks

Operatorship experience in CBM block would be recognized as relevant for on-land blocks

(iv) Acreage Holding (Petroleum Exploration License) means those areas where the designated operator holds

Lease/License /Permit etc., for Exploration and/or Development and/or Production Operations in accordance

with the laws of respective countries.

2.2.2.

Financial Qualification Criteria

There will be a two stage qualification for assessment of Networth.

Bidder (individually or in consortium) needs to meet following Networth (refer Annexure-3 for format)

criteria in proportion to their Participating Interest (PI) for Petroleum Operations Contract for each bid.

Networth of the constituents of the bidder will be reassessed in proportion to their Participating Interest (PI) at

the time of technical bid opening. At this stage, Networth of the bidder should be equal to or more than the

Estimated expenditure for the Committed Work Programme

LD equivalent value of the Committed Work Programme

Any shortfall in Networth is allowed to be supported by an equivalent Bank Guarantee in favour of Government of

India from a scheduled commercial bank.

2.3.

Qualification Criteria for Reconnaissance Contract

(i)

Qualification criteria is to be met by the Originator and Bidder for Reconnaissance Contract, at the

EoI/competitive bidding stage.

(ii)

Both Originator and/or bidder for Reconnaissance must have one of the following experience :

1000 LKM of 2D seismic API experience, or

300 Sq. km. of 3D seismic, or

Drilling experience of at least 5 wells, or

Others surveys like CSEM, Gravity, Magnetic, MT etc. for at least 1000 Sq. km.

(iii) Originator and Bidder should have positive Networth at the time of bidding. However, Networth of the

constituents of the bidder will be reassessed in proportion to their Participating Interest (PI) at the time of

technical bid opening. At this stage, Networth of the bidder should be equal to or more than the higher of

Estimated expenditure for the Committed Work Programme

•

LD equivalent value of the Committed Work Programme

Any shortfall in Networth is allowed to be supported by an equivalent Bank Guarantee in favour of Government of

India from a scheduled commercial bank.

(iv) If, the contractor wishes to migrate from Reconnaissance Contract to Petroleum Operations Contract, he

would be required to meet both Technical as well as Financial Qualification Criteria as applicable for the

block.

Submission of EoI

3.1.

Obligation of the Originator

(i)

The company/consortium submitting an EoI must qualify technically and financially at the bidding stage

subject to 3.4(i). Participation bond will be forfeited, otherwise.

(ii)

In case of a consortium submitting EOI, the same consortium without any change is liable to submit the bid.

Originator incentive would not be granted in case composition of the consortium changes at the time of

bidding and the Participation Bond of such consortium would be forfeited.

3.2.

Submission of EoI

(i)

Suo motu EOI shall be submitted online, through HELP Portal, in the format specified in Annexure [2] of this

document along with scaned copy of the Participation Bond and, subject to the instructions therein.

(ii)

A non-refundable Application Fee of USD 1000/- [one thousand] is to be paid online through DGH payment

gateway.

(iii) Original copy of EOI Submission report (generated on the HELP Portal on successful submission of EOI),

Participation Bond and other requisite document if any, shall be submitted to DGH within [10] calendar days

from the date of online submission. The documents shall be delivered to:

(iv) Suo motu EoIs will be accepted throughout the year in two windows. The deadline for submission will be

observed as 23:59 hrs IST of the closing dates for respective window:

November 15^th of every year for submission in Window-1 of the respective year

May 15^th of every year for submission in Window-2 of the respective year

DGH will endeavor to finalize the EoIs received and publish Notice Inviting Offer (NIO) for

competitive bidding within 30 days of closure of each window for EoI submission subject to

internal/GoI approvals.

A period of 60 days will be provided to bidders to submit bids from the date of publishing the NIO.

DGH will endeavor to complete the bid evaluation as per criteria mentioned in para 7.3 and award the

block within 10 weeks from the bid closing date.

After the award of block, bid winner will sign the contract within a period of 45 days.

(v)

Timely submission of the EoI will be the responsibility of the interested party. EoI received by DGH after the

closing date and time, will be considered in the subsequent evaluation period or window.

(vi) DGH will not be responsible for the loss of tender or for any delay during the postal transit or otherwise.

3.3.

Carving out a block

(i)

In the Open Acreage Licensing route, the freedom of identification of block and seeking to have them offered

for contract will be with the investors. The block identified ought to

fall within the sedimentary basins of India, and

be free of PEL/ PML

not to fall in area indicated as “NO-GO” in NDR

(ii)

The area available for carving out the block can be viewed on the NDR.

(iii) An area of [10’ x 10’] (~336 sq.km) is defined as Sector for all types of hydrocarbons. For submitting EOI a

bidder has to carve out a Block (for EOI submission) as one or more than one contiguous Sector(s). However,

for the

areas adjoining (sharing the common boundary) existing Blocks (areas already under a PEL/PML), the

incumbent Contractor will be allowed to submit EOI for one or more than one contiguous areas of size

[1’ x 1’] with a maximum area of 50 units of size [1’x1’].

Areas where it is not possible to carve out a block in multiple of sectors of size 10’x10’ due to non-

availability of areas, the investor will be allowed to submit EOI for one or more than one contiguous

areas of size [1’ x 1’]

The Networth for an area of [1’x1’] will be pro-rated in proportion to the Networth requirement for one sector

of size (10’x10’).

(iv) Separate applications are required to be submitted for different blocks.

(v)

Following conditions apply for carving out a block:

DGH at its discretion will accept the area for which EOI has been submitted OR alter/modify the area

after due evaluation.

(vi) The category of block (viz. Onland, Shallow Water, Deep Water, Ultra Deep Water, Frontier and CBM) will

be guided by the DGH policy in vogue. The current guidelines pertaining to this subject are a part of Good

International Petroleum Industry Practices (GIPIP) notified by DGH.

3.4.

Principles behind expressing suo motu interest

(i)

EoI applicants will be obliged to participate (submit a bid acceptable to DGH) in the subsequent bidding. In

case the deviation in the area finalized by DGH to be put up for bidding is more than 50% of the Application

Area, then such obligation will be waived and Participation Bond will be released upon communication of its

intent not to participate in the bidding process.

(ii)

Participation Bond submitted along with the EoI will be forfeited if the EoI submitting party doesn’t

participate in the bidding process except in the circumstance enumerated above in Section 3.4 (i).

(iii) The Participation Bond would be released as per Section 3.5.

(iv) Category of the block (i.e. Onland, Shallow Water, Frontier, Deep Water,) would be considered as the

category in which more than 50% area of block falls in. Block would be considered Ultra Deep Water Block if

more than 30% of the Block falls in Ultra Deep Water.

3.5.

Composition of suo motu EoI

(i)

A suo motu EoI for OAL shall include the following:

Original signed Application Form;

Map showing the area of interest outlined on NDR grid;

3 years audited financial statements and Annual Reports;

Additional supporting information (for example, Article of Association and Memorandum, Certificate

of Incorporation/Registration, corporate structure, etc.) to be uploaded on HELP portal and sent

physically to DGH ;

Payment proof covering the application fee

Participation Bond in prescribed format by the prescribed date

Submit a report on due diligence undertaken while identifying the area for which EoI is being

submitted. The list of all Geological & Geophysical (G&G) data available with the company for the

proposed area such as basin data, earlier well logs, if any, and the report on assessed level of

prospectivity is to be submitted, in case of EoI for Petroleum Operations Contract. The due diligence

report shall include the following:

Details of Supporting Geoscientific Data

All relevant Maps describing top structure, thickness, reservoir Property parameter

Seismic attribute map depicting facies and structures

Seismic sections across all identified prospects

Comprehensive Evaluation Report

Due diligence report is not required to be submitted for the areas for which no data is available.

However, a brief conceptual report about the model and prospectivity should be provided.

Primary Data Sources for the above report has to be NDR or Data previously procured from GOI.

Data source must be disclosed and data should be in the legal possession of the EoI submitting Party

For Petroleum Operations Contract, applicant has to define Target Horizon (millisecond) for surveys to

be undertaken and Target Depth (meters) of wells to be drilled.

For Reconnaissance Contract, applicant has to define Target Horizon (millisecond) for surveys to be

undertaken and wells are to be drilled till basement.

DGH at its sole discretion reserves the right to alter the e Target horizon and Target Depth for the

respective block at the bidding stage.

3.6.

Application Fee & Participation Bond/Bid Bond

(i)

A suo motu EoI in prescribed formats will be accompanied with:

A non-refundable Application Fee of US$ [1,000 (One Thousand)] to be paid online to DGH.

An Originator (or a Reconnaissance Licensee intends to Migrate to PoC) will have to submit a

Participation Bond of value 150,000 USD/ sector for POC for all types of blocks in the form of Bank

Guarantee from a Scheduled Commercial Bank valid for a period of 18 Months. A cap of 1 (one)

million USD for block falling under Onland or Shallow water category and 2 million USD for blocks

falling under Deepwater or Ultra deep water category is applicable.

For Reconnaissance Contract, an Originator will have to submit a Participation Bond of value 30,000

USD/ sector for all types of blocks in the form of Bank Guarantee from a Scheduled Commercial Bank

valid for a period of 18 Months. A cap of 0.2 million USD for a block falling under Onland or Shallow

water category and 0.4 million USD for blocks falling under Deepwater or Ultra deep water category is

applicable.

A Bidder will have to submit a Bid Bond of value 150,000 USD/ sector for POC for all types of blocks

in the form of Bank Guarantee from a Scheduled Commercial Bank valid for a period of 12 Months. A

cap of 1 million USD for block falling under Onland or Shallow water category and 2 million USD for

blocks falling under Deepwater or Ultra deep water category is applicable.

For Reconnaissance Contract, a Bidder will have to submit a Bid Bond of value 30,000 USD/ sector for

all types of blocks in the form of Bank Guarantee from a Scheduled Commercial Bank valid for a period

of 12 Months. A cap of 0.2 million USD for a block falling under Onland or Shallow water category and

0.4 million USD for blocks falling under Deepwater or Ultra deep water category is applicable.

Participation Bond of Originator will be released, if he doesn’t win the bid but fulfils the Qualification

criteria (Both Technical and Financial) subject to 3.4(i).

(ii)

Originator(s) (or a Reconnaissance Licensee intends to Migrate to PoC) will not be required to submit the

Tender Fee and Bid Bond at the bidding stage.

(iii) Bidders will have to submit a non-refundable Tender Fee of US$ [1,000 (USD One thousand)] to be paid

online to DGH at the bidding stage.

Types of Contract

4.1.

Petroleum Operations Contract

(i)

Petroleum Operations Contract will allow investors to undertake, as the context may require, Exploration

Operations, Development Operations or Production Operations or any combination of two or more of such

operations, including construction, operation and maintenance of all necessary facilities, plugging and

abandonment of Wells, safety, environmental protection, transportation, storage, sale or disposition of

Petroleum to the Delivery Point, Site Restoration and any or all other incidental operations or activities as may

be necessary.

(ii)

Terms of Petroleum Operations Contract will be as per the Revenue Sharing Contract approved by

Government of India.

4.2.

Reconnaissance Contract

(i)

Bidders interested in carrying out Exploration Operations in areas available for exploration in the

onshore/offshore sector may submit EoI to DGH for Reconnaissance Contract in the format set out in

Annexure [2] of this document.

(ii)

Reconnaissance Contract will allow parties to carry out Exploration Operations in a given block for all types

of hydrocarbons for a period of [2] years with a provision for an extension up to one [1] year.

(iii) Post completion of reconnaissance activity contractor will submit all the data so gathered to DGH as per the

Data Policy notified by DGH.

(iv) Operator of the Reconnaissance shall have the exclusive right to license the Data (excluding Raw Data,

Physical Oceanographic Data and DGH Data) during the Contract Duration (12 years), provided that license

of such Data to companies incorporated in neighboring countries of India or countries as notified by DGH

from time to time will require prior permission of DGH.

(v)

Operators of the Reconnaissance Contract for a particular block, upon completion of at least 80% of the work

programme commitments, becomes eligible to submit an intent to migrate to Petroleum Operations Contract.

To exercise this option, the Contractor will submit an intent to migrate to DGH, at least 90 days prior to the

expiry of the Reconnaissance Contract. The contractor will have to meet Technical as well as Financial

Qualification Criteria as applicable (mentioned in Section [2]) for Petroleum Operations Contract for the

block under consideration. Incentives for migration to Petroleum Operation Contract is specified in Section

[8] of this document.

(vi) Upon receipt of the intent to migrate to Petroleum Operations Contract for the area for which it has

undertaken Reconnaissance, DGH shall have the right to license the Reconnaissance Data collected by the

operator for the Contract Area to all other bidders. The data will be licensed at price bid by the Contractor.

The proceeds of such license of data will be deposited in an escrow account.

(vii) In-case, the operator of the Reconnaissance Licensee does not win the bid for migration to Petroleum

Operations Contract, then the proceeds realized through license of Reconnaissance Data to bidder(s) will be

transferred to the Contractor. However, if the Contractor wins the bid, then none of the consortium member

shall have claim over the proceeds realized from such a license of data and all the rights to license the data

shall lapse with immediate effect.

(viii) Investors who have completed term of Reconnaissance Contract for that block, and have not submitted an

intent to migrate to Petroleum Operations Contract within permitted time, shall NOT be obliged to bid for

Petroleum Operations Contract if and when DGH puts out the block to bid.

(ix) Originator of Reconnaissance Contract for a block will be provided incentives as mentioned in Section [8] of

this document.

(x)

The parties procuring data from Reconnaissance Licensee shall be eligible to set off the seismic data against

their committed work program.

(xi) Reconnaissance Licensee may, at its discretion, allow any third party to undertake Non-Exclusive Multi-client

surveys.

Evaluation of EOI

5.1.

Evaluation Period

(i)

Applications for EoI will be evaluated on a first come first serve basis. The proposed block/area (for which

EoI has been accepted by DGH) shall be unavailable for further EoI of that particular type of contract subject

to submission of requisite documents to DGH within the timeline. However, EoI submitted for

Reconnaissance Contract would be superseded by EoI for Petroleum Operations Contract, if submitted for the

same area, during the same submission Window.

(ii)

DGH will endeavor to finalize the EoIs received and publish Notice Inviting Offer (NIO) for competitive

bidding after 30 days of closure of each window for EoI submission subject to internal/GoI approvals. A

tentative timeline to complete the OAL process is placed in the Annexure-4 of this document.

5.2.

General Conditions

(i)

EoI(s) received for Reconnaissance Contract and/or Petroleum Operations Contract, accepted by DGH, will be

considered to put for bidding subject to such adjustment of areas as DGH may carry out at its discretion.

5.3.

Evaluation of EoI

(i)

EoI for Reconnaissance/ Petroleum Operations Contract will be evaluated for Technical & Financial

Qualification Criteria as mentioned in section [2] of this document. However, an applicant has to meet

applicable Financial and Technical qualification criteria at the time of bidding.

(ii)

The EoI Submitter has to submit a report on due diligence undertaken while identifying the area for which EoI

is being submitted. The list of all Geological & Geophysical (G&G) data available with the company for the

proposed area such as basin data, earlier well logs, if any, and the report on assessed level of prospectivity is

to be submitted, in case of EoI for Petroleum Operations Contract. The due diligence report shall include the

following:

Details of Supporting Geoscientific Data

All relevant Maps describing top structure, thickness, reservoir Property parameter

Seismic attribute map depicting facies and structures

Seismic sections across all identified prospects

Comprehensive Evaluation Report

Due diligence report is not required to be submitted for the areas for which no data is available. However, a

brief conceptual report about the model and prospectivity should be provided.

(iii) Primary Data Sources for the above report has to be NDR or Data previously procured from GOI.

(iv) Data source must be disclosed and data should be in the legal possession of the EoI submitting Party.

5.4.

EoI Acceptance Criteria

(i)

EoIs will be accepted subject to the fulfillment of following conditions

Submission of all the components listed under the para Composition of suo motu EoI (Para 3.5 of this

document)

Due diligence report would be reviewed by DGH and accepted if the report adheres with all conditions.

Fulfillment of Qualification Criteria, Both Technical and Fiscal.

EoIs will be accepted on First Come First serve Basis and no EoI will be entertained having area

overlapping with the already submitted EoI.

EoIs overlapping with the “No Go Areas” will not be entertained.

(ii) The EoI not fulfilling above conditions shall be liable for rejection.

5.5.

Result of EOI Evaluation

(i)

At the end of evaluation, DGH will accept/reject the EoI submitted by the Originator based on ECS approval.

(ii)

The outcome of EoI will be published on the DGH website.

(iii) The name and other submissions made by the Originator shall not be disclosed to other bidders during the

bidding process.

(iv) The Originator will be duly informed in case their EoI is not accepted or deviation in area is more than 50% of

the Application Area pursuant to Section 3.4. In case of rejection of the EOI by DGH the Participation Bond

will be released. In case of deviation in area, the Participation Bond would be released as per Section 3.4.

(v)

If, EoI for the Reconnaissance Contract is superseded by Petroleum Operations Contract the party submitting

would be informed and their Participation Bond would be released.

Public announcement for Notice Inviting Offer

The DGH, under its Open Acreage Licensing Policy for exploration of oil and natural gas, shall announce bid

rounds for hydrocarbon blocks in India from eligible interested parties. DGH on behalf of the Government shall

invite bids from companies for (1). Reconnaissance Contract and (2). Petroleum Operations Contract and release

NIO..

Bid Evaluation Criteria (BEC)

7.1.

Bid submission

(i)

Competitive bids will be sought against each block accepted by DGH after Originator(s) submit suo motu

EoI(s), subject to bidders meeting all the necessary Qualification Criteria set out in Section [3] of this

document.

(ii)

In case of a consortium submitting EOI, the same consortium without any change is liable to submit the bid.

Originator incentive would not be granted in case composition of the consortium changes at the bidding stage

and the Participation Bond of such consortium would be forfeited.

(iii) A period of 60 days will be provided to bidders to submit bids from the date of publishing the NIO.

7.2.

Bid Evaluation Period

(i)

DGH will endeavor to complete the bid evaluation as per criteria mentioned in para 7.3 below and award the

block within 45 days from the bid closing date.

(ii)

After the award of block, bid winner will be given a period of 45 days to sign the contract.

8.1.

8.2.

Migration Incentive from Reconnaissance to Petroleum Operations Contract

Reconnaissance Contractor for a particular block, upon completion of at least 80% of the work programme

commitments, becomes eligible to submit an Intent to Migrate to Petroleum Operations Contract. Such Intent to

Migrate would be treated as Expression of Interest to undertake Petroleum Operations Contract in that particular

block.

While migrating from a Reconnaissance Contract for a block to Petroleum Operations Contract, “Migration

Incentive” in terms of “Originator Incentive” (as mentioned above) will be granted to the Operator (as

defined/nominated by the consortium) of the Reconnaissance Contract.

Only the Operator of the Reconnaissance Contract, as on date of submission of intent to migrate, shall be eligible for

Originator Incentive. No other party of the consortium would have any right either on Originator Incentive or

licensing of Reconnaissance Data.

This notification shall be effective immediately.
