MULTI COMMODITY EXCHANGE CLEARING
CORPORATION LIMITED
Securities and Exchange Board of India (SEBI), in exercise
of its powers under Section 9 of the Securities Contracts
(Regulation) Act, 1956, vide its letter no. SEBI/HO/CDMRD/
DEA/OW/P/2018/015324/1 dated May 25, 2018 approved
the following amendments in the Bye-laws of Multi
Commodity Exchange Clearing Corporation Limited
(MCXCCL). The amendments to the Bye-laws of MCXCCL
shall be effective from the date of grant of recognition to
MCXCCL by SEBI.
AMENDMENTS IN THE BYE-LAWS OF MCXCCL
1.
In Bye-law 8.2.4 of the MCXCCL Bye-laws, in clause
(a) of second proviso, for the word “Clearing House”
wherever they occur, the word “Clearing Corporation”
shall be substituted.
2.
In Bye-law 8.2.4 of the MCXCCL Bye-laws, for clause
(b) of second proviso, the following clause shall be
substituted, namely:-
“b. the nature of the guarantee by the Clearing
Corporation is strictly financial, that is, in case of buyer
default or seller default, the Clearing Corporation shall
guarantee financial compensation to make good any
monetary loss to non-defaulting party.”

In Bye-law 8.5.2 of the MCXCCL Bye-laws, after the
words “and accordingly the rights and liabilities, of
buying Clearing Member to the Selling Clearing
Member” the following words and symbols shall be
inserted, namely :-
“However, the responsibility of Clearing Corporation
under novation shall be for guarantee of funds pay-out
till marking of delivery and for guarantee of financial
compensation (to make good losses of non-defaulting
party) in case of default (in goods or funds pay-in)
after marking of delivery. In case of disputes pertaining
to quality or quantity / any damages arising after the
delivery shall be addressed through the complaint
redressal mechanism, including arbitration mechanism
of the Clearing Corporation and can be settled in terms
of financial compensation”.
