38.—यत:, भारत िनवाचन आयोग का यह समाधान हो गया है क नीचे क सारणी के तंभ 2 म िविन द! ट केरल रा# य

से लोकसभा के साधारण िनवाचन, 2014 म अपने नाम के सामने तंभ 3 म िविन द! ट िनवाचन &े' से, तंभ 4 म िविन द! ट िनवाचन

लड़ने वाला )* येक अ+ यथ-, लोक )ितिनिध* व अिधिनयम, 1951 तथा त.ीन बनाए गए िनयम1 के अंतगत यथाअपेि&त उ3 त सारणी के

तंभ 5 म यथाद4शत अपने िनवाचन 6 यय का लेखा दािखल करने म असफल रहा/रही है।

और यत:, उ3 त अ+ य4थय1 ने िनवाचन आयोग :ारा स; यक नो<टस दए जाने के बावजूद उ3 त असफलता के िलए न तो कोई

कारण और न ही कोई प! टीकरण दया है या उनके :ारा दए गए अ+ यावेदन, यद कोई हो, पर िवचार करने के उपरांत िनवाचन

आयोग का यह समाधान हो गया है क उ3 त असफलता के िलए उनके पास कोई उपयु3 त या A यायोिचत कारण नहB है।

अत:, अब, उ3 त अिधिनयम क धारा 10क के अनुसरण म, िनवाचन आयोग नीचे क सारणी के तंभ 4 म िविन द! ट 6 यिFय1

को संसद के कसी सदन या कसी रा# य/संघ रा# य-&े' क िवधान सभा अथवा िवधान प<रषद् के िलए सद य चुने जाने और होने के िलए,

इस आदेश क तारीख से तीन वष क अविध के िलए िनर4हत घोिषत करता है:-

ORDER

New Delhi, the 26th July, 2018

O.N. 38.—Whereas, the Election Commission of India is satisfied that each of the contesting candidate

specified in column 4 of the Table below at the General Election to the Lok Sabha, 2014 from the State of Kerala

specified in column 2 and held from the Parliamentary Constituency specified in column 3 against his/her name has

failed to lodge the account of his/her election expenses as shown in column 5 of the said Table as required by the

Representation of the People Act, 1951 and the Rules made thereunder.

And whereas, the said candidates have furnished neither any reason nor explanation for the said failure

even after due notice by the Election Commission or after considering the representation made by them, if any, the

Election Commission is satisfied that they have no good reason or justification for the said failure.
