यह उपबंिधत है क िनवाचक! के ित#पण का िनवारण करने क दृि' से, ताक उ) अिधिनयम क धारा 62 के

अधीन वा,तिवक िनवाचक! का उनके मत देने के अिधकार को और अिधक भावी बनाया जा सके, मतदान के

समय िनवाचक! क पहचान सुिनि1त करने के साधन के #प म िनवाचक! के िलए िनवाचक फोटो पहचान प5 के

उपयोग हेतु िनयम! के 7ारा उपबंध कए जा सकते ह8; तथा

यतः, िनवाचक का रिज ीकरण िनयम, 1960 का िनयम 28 िनवाचन आयोग को, इस दृि से क

िनवाचक के ित!पण का िनवारण हो सके तथा मतदान के समय उनक' पहचान को सरल बनाया जा सके,

िनवाचक को रा*य क' लागत पर फोटोयु/ िनवाचक फोटो-पहचान प0 जारी करने के िलए िनदेश देने क' शि/

दान करता है; तथा

3. यतः, िनवाचन का संचालन िनयम, 1961 के िनयम 49 ज(3) और 49 ट(2) (ख) म; यह उपबंिधत है क जहां

कसी िनवाचन =े0 के िनवाचक को िनवाचक रिज ीकरण िनयम, 1960 के िनयम 28 के उ/ उपबंध के अधीन

िनवाचक फोटो पहचान-प0 दए गए ह?, वहां िनवाचक को मतदान के@A म; अपना िनवाचक फोटो पहचान-प0

दखाना होगा तथा उनक' ओर से उन िनवाचक फोटो पहचान प0 को नहC दखाए जाने या दखाने म; असमथ

होने पर उ@ह; मत डालने क' अनुमित देने से इ@कार कया जा सकता है; तथा

4. यतः, उ/ अिधिनयम और िनयम के उपयु/ उपबंध को िमलाकर एवं सामंजयपूण ढ़ंग से उनके अGययन से

यह प होता है क यHिप मत देने का अिधकार िनवाचक नामावली म; नाम के होने से ही होता है, यह िनवाचन

आयोग Jारा रा*य क' लागत पर, मतदान के समय उनक' पहचान सुिनिKत करने के साधन के !प म; दान

करवाए गए िनवाचक फोटो पहचान प0 के योग पर भी िनभर करता है, तथा दोन का एक साथ योग करना

होता है; तथा

5. यतः, भारत िनवाचन आयोग ने एक समयबM कायNम के अनुसार सभी िनवाचक को िनवाचक फोटो पहचान-

प0 (ईपीआईसी) जारी करने का िनदेश देते Pए 28 अगत, 1993 को एक आदेश जारी कया था; तथा

यतः, देश म; 99% िनवाचक से अिधक को िनवाचक फोटो पहचान प0 जारी कए जा चुके ह?; तथा

अतः, अब, सभी संबM कारक तथा िविधक एवं तRयाSमक िथितय को Gयान म; रखते Pए, िनवाचन

आयोग, एतTारा, यह िनदेश देता है क आगामी लोक सभा साधारण िनवाचन, 2019 तथा लोक सभा साधारण

िनवाचन के साथ होने वाले रा* य िवधान सभाU के साधारण िनवाचन एवं उप िनवाचन के िलए सभी िनवाचक

िज@ह; िनवाचक फोटो पहचान प0 जारी कए गए ह?, मतदान थल पर अपना मत डालने से पहले अपनी पहचान

सुिनिKत करने हेतु अपना िनवाचक फोटो पहचान प0 दखाएंगे। ऐसे िनवाचक जो अपना िनवाचक फोटो पहचान

प0 तुत नहC कर पाते ह?, उ@ह; अपनी पहचान थािपत करने के िलए िनXिलिखत वैकिYपक फोटो पहचान

दतावेज म; से कोई एक तुत करना होगाः-

(i)

पासपोट;

(ii) ाइ वंग लाइसेस,

(iii) राय / के सरकार के लोक उपम, पिलक िलिमटेड कपिनय ारा अपने कमचा#रय को जारी &कए गए फोटोयु*

सेवा पहचान-प+,

(iv) ब-क / डाकघर ारा जारी क/ गई फोटोयु* पासबुक,

(v) पैन काड,

(vi) एनपीआर के अंतगत आरजीआई ारा जारी &कए गए 4माट काड,

(vii) मनरेगा जॉब काड,

(viii) 6म मं+ालय क/ योजना के अतगत जारी 4वा47य बीमा 4माट काड,

(ix) फोटोयु* प8शन द4तावेज,

9. एिपक के संबंध म8, लेखन अशुि@, वतनी क/ अशुि@ इAया&द को नजरअंदाज कर देना चािहए बशतB िनवाचक क/ पहचान

ईपीआईसी से सुिनिCत क/ जा सके । य&द कोई िनवाचक फोटो पहचान प+ EदFशत करता है, जो &क &कसी अय सभा

िनवाचन-Hे+ के िनवाचक रिज4Iीकरण अिधकारी ारा जारी &कया गया है, ऐसे एिपक भी पहचान 4थािपत करने हेतु

4वीकृत &कए जाएंगे बशतB उस िनवाचक का नाम जहां वह मतदान करने आया है उस मतदान क8 से संबंिधत िनवाचक

नामावली म8 उपलध हो। य&द फोटोNाफ इAया&द के बेमेल होने के कारण िनवाचक क/ पहचान सुिनिCत करना संभव न हो

तब िनवाचक को उपयु* पैरा 8 म8 वFणत &कसी एक वैकिPपक फोटो द4तावेज को E4तुत करना होगा।

10. उ* पैरा 8 म8 &कसी बात के होते Tए भी, Eवासी िनवाचक जो अपने पासपोट म8 उिPलिखत िववरण के आधार पर

लोक EितिनिधAव अिधिनयम, 1950 क/ धारा 20क के अधीन िनवाचक नामाविलय म8 पंजीकृत ह-, को मतदान के म8

केवल उनके मूल पासपोट (तथा कोई अय पहचान द4तावेज नहZ) के आधार पर ही पहचाना जाएगा ।

ORDER

New Delhi, the 28^th February, 2019

No. 3/4/ID/2019/SDR/VOL.I.—1. Whereas, Section 61 of the Representation of the People Act,

1951 provides that with a view to preventing impersonation of electors, so as to make the right of genuine

electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act

for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of

polling; and

Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to

direct, with a view to preventing impersonation of electors and facilitating their identification at the time of

poll, the issue of Electors Photo Identity Card to electors bearing their photographs at State cost; and

Whereas, Rules 49H(3) and 49K (2) (b) of the Conduct of Elections Rules, 1961,stipulate that where

the electors of a constituency have been supplied with Electors Photo Identity Card under the said provisions

of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Electors Photo Identity

Card at the polling station and failure or refusal on their part to produce those Electors Photo Identity Card

may result in the denial of permission to vote; and

Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the

Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it

is also dependent upon the use of the Electors Photo Identity Card, where provided by the Election

Commission at State cost, as the means of establishing their identity at the time of polling and that both are to

be used together; and

Whereas, the Election Commission made an Order on the 28th August, 1993,directing the issue of

Electors Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

Whereas, Electors Photo Identity Cards have been issued to more than 99%electors in the country;

and

Now, therefore, after taking into account all relevant factors and the legal and factual position, the

Election Commission hereby directs that for the upcoming General Election to the House of the People, 2019

and General Elections and Bye-elections to State Legislative Assemblies to be held along with the General

Election to the House of the People, all electors who have been issued EPIC shall produce the EPIC for their

identification at the polling station before casting their votes. Those electors who are not able to produce the

EPIC shall produce one of the following alternative photo identity documents for establishing their identity: -

(i)

Passport,

(ii)

Driving License,

(iii)

Service Identity Cards with photograph issued to employees by Central/State Govt. IPSUs/Public

Limited Companies,

(iv)

Passbooks with photograph issued by Bank/Post Office,

(v)

PAN Card,

(vi)

Smart Card issued by RGI under NPR,

(vii)

MNREGA Job Card,

(viii) Health Insurance Smart Card issued under the scheme of Ministry of Labour,

(ix)

Pension document with photograph,

(x)

Official identity cards issued to MPs/MLAs/MLCs, and

(xi)

Aadhaar Card.

In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the identity of

the elector can be established by the EPIC. If an elector produces an EPIC which has been issued by the

Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for

identification provided the name of that elector finds place in the electoral roll pertaining to the polling

station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on

account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo

documents mentioned in para8 above.

Notwithstanding anything in Para 8 above, overseas electors who are registered in the electoral roll

under Section 20A of the Representation of the People Act, 1950,based on the particulars in their Passport,

shall be identified on the basis of their original passport only (and no other identity document) in the polling

station.
