थी; और
यत:, ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 78 के ऄनुसार, जनवााचन ल़ने वाले प्रत्येक ऄभ्यथी क ,
जनवााजचत ऄभ्यथी के जनवााचन की तारीख से 30 ददनों के भीतर जनवााचन व्यय के ऄृने लेखे की सही प्रजत संबजन्धत जिला

यत:, 4-सहारनृुर जवधान सभा जनवााचन क्षेे्र के ररटर्ननग ऄजधकारी द्वारा ईक्त जवधान सभा क्षेे्र से जनवााचन के
ृररणाम ददनांक 11 माचा, 2017 क घ जषत दकए गए थे और आस प्रकार, जनवााचन व्यय का लेखा दाजखल करने की ऄजन्तम
तारीख 10 ऄप्रैल, 2017 थी; और
यत:, जिला जनवााचन ऄजधकारी, सहारनृुर जिला, ईत्तर प्रदेि द्वारा प्रस्ट्तुत ददनांक 15 ऄप्रैल, 2017 की ररृ टा के
ऄनुसार, ईत्तर प्रदेि के 4-सहारनृुर जवधान सभा जनवााचन क्षेे्र से िन ऄजधकार ृाटी से जनवााचन ल़ने वाले ऄभ्यथी श्री
नौिाद ऄृने जनवााचन व्यय का सही लेखा जवजध द्वारा यथाृेजक्षेत रीजत से दाजखल करने में जवफल रहे हैं; और
यत:, जिला जनवााचन ऄजधकारी, की ईक्त ररृ टा के अधार ृर भारत जनवााचन अय ग द्वारा जनवााचनों का संचालन
जनयम, 1961 के जनयम 89 के ईृ जनयम (5) के ऄंतगात श्री नौिाद क ददनांक 11 जसतम्बर, 2017 क जनवााचन व्यय का
लेखा जनम्नजलजखत ्र ुरटयों के साथ दाजखल करने हेतु कारण बताओं न रटस नं. 76/ई.प्र.-जव.स./4/2017 िारी दकया गया था:-
(1) ददन-प्रजतददन के लेखा रजिस्ट्टर, र क़ रजिस्ट्टर, बैंक रजिस्ट्टर, सार जववरण क िाजमल करते हुए जनवााचन
व्यय रजिस्ट्टर दाजखल नहीं दकया गया है |
(2) िृथ ृ्र में जवजधवत रूृ से िृथ दाजखल नहीं की गइ |
(3) जनवााचन व्यय की मदों के सन्दभा में ऄृेजक्षेत वाईचर प्रस्ट्तुत नहीं दकए गए हैं |
(4) जनवााचन के जलए ऄलग से बैंक ऄकाईन्ट ख ला नहीं गया है |
(5) सभी व्यय (ो टे-म टे व्ययों क ो ़कर) बैंक खाते के माध्यम से नहीं दकए गए हैं; और
यत:, जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईृ जनयम (6) के ऄनुसार एवं ईृयुाक्त कारण बताओ
न रटस के द्वारा श्री नौिाद क जनदेि ददया गया था की वे आस न रटस के प्राप्त ह ने के 20 ददनों के भीतर लेखा दाजखल नहीं
करने के कारणों क स्ट्ृष्ट करते हुए जलजखत रूृ में ऄृना ऄभ्यावेदन जनवााचन अय ग के समक्षे प्रस्ट्तुत करें और साथ ही ईक्त
्र ुरटयों क दूर करते हुए ऄृना जनवााचन व्ययों का लेखा जिला जनवााचन ऄजधकारी, सहारनृुर के समक्षे प्रस्ट्तुत करें; और
यत:, जिला जनवााचन ऄजधकारी, सहारनृुर जिला, द्वारा भारत जनवााचन अय ग क प्रस्ट्तुत की गइ ृावती रसीद के
ऄनुसार, ईक्त न रटस श्री नौिाद क ददनांक 29 िुलाइ, 2019 क ईनके द्वारा नामांकन ृ्र में दिााये गये ृते ृर तामील
दकया गया था; और
यत:, जिला जनवााचन ऄजधकारी, सहारनृुर ने ददनांक 4 नवम्बर, 2019 की ऄृनी ऄनुृूरक ररृ टा में यह बताया है
दक श्री नौिाद द्वारा ऄभी तक क इ िवाब नहीं ददया गया है और मूल वाईचर सजहत हस्ट्ताक्षेररत जनवााचन व्यय के सही लेखे
का जववरण प्रस्ट्तुत नहीं दकया गया है; और
यतः, भारत जनवााचन अय ग द्वारा ऄभ्यथी श्री नौिाद क ऄंजतम ऄवसर प्रदान करते हुए ृ्र सं० 76/ई0प्र.-
जव.स./4/2017, ददनांक 22 नवम्बर, 2019 िारी दकया गया, ि जिला जनवााचन ऄजधकारी, सहारनृुर के माध्यम से ईन्हें
ददनांक 4 ददसम्बर, 2019 क प्राप्त हुअ; और
यत:, जिला जनवााचन ऄजधकारी, से प्राप्त ददनांक 27 फरवरी, 2020 तथा ददनांक 02 िुलाइ, 2020 की ररृ टा के
ऄनुसार श्री नौिाद द्वारा ईक्त कजमयों क सुधारते हुए न त क इ लेखा िमा दकया गया है न ही क इ ऄभ्यावेदन प्रस्ट्तुत
दकया गया है | आसके ऄजतररक्त, ईक्त न रटस/ृ्र जमलने के ईृरांत भी ऄभ्यथी द्वारा ईक्त जवफलता के जलए भारत जनवााचन
अय ग के समक्षे क इ कारण ऄथवा स्ट्ृष्टीकरण प्रस्ट्तुत नहीं दकया गया है; और

यत:, तथ्यों और ईृलब्ध दस्ट्तावेिों के अधार ृर, अय ग का यह समाधान ह गया है दक श्री नौिाद जवजहत प्रृ्र
में ऄृने जनवााचन व्यय का लेखा दाजखल करने में जवफल रहे हैं और ईनके ृास आस जवफलता के जलए क इ भी ईजचत कारण
ऄथवा औजचत्य नहीं है; और
यत:, ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 10क में ऄनुबंजधत दकया गया है दक :-
“यदद जनवााचन अय ग का समाधान ह िाता है दक क इ व्यजक्त –
(क) जनवााचन व्ययों का लेखा ईस समय के भीतर और ईस रीजत में िैसी आस ऄजधजनयम के द्वारा या ऄधीन ऄृेजक्षेत
है, दाजखल करने में जवफल रहा है; तथा
(ख) ईस जवफलता के जलए क इ ऄच्ोा कारण या औजचत्य नहीं है
त जनवााचन अय ग िासकीय रािृ्र में प्रकाजित अदेि द्वारा ईसक जनरर्हहत घ जषत करेगा और ऐसा व्यजक्त ईस
अदेि की तारीख से तीन वषा की कालावजध के जलए जनरर्हहत ह गा ।”;
ऄत:, ऄब ल क प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 10क के ऄनुसरण में भारत जनवााचन अय ग एतदद्वारा
घ षणा करता है दक श्री नौिाद, जनवासी ग्राम कुतुबृुर कुसानी, ृ स्ट्ट जतवाया, जिला सहारनृुर, ईत्तर प्रदेि, ि ईत्तर प्रदेि
जवधान सभा साधारण जनवााचन, 2017 में 4-सहारनृुर जवधान सभा जनवााचन क्षेे्र से जनवााचन ल़ने वाले ऄभ्यथी थे, आस
अदेि की तारीख से तीन वषा की ऄवजध के जलए संसद के दकसी भी सदन ऄथवा राज्य ऄथवा संघ राज्य-क्षेे्र की जवधान सभा
ऄथवा जवधान ृररषद का सदस्ट्य चुने िाने ऄथवा ह ने के जलए जनरर्हहत होंगे ।

ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 27th July, 2020
O. N. 62 .— WHEREAS, the General Election for 4-Saharanpur Assembly Constituency of Uttar Pradesh, 2017
was announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4th January, 2017; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to
lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from
the date of election of the returned candidate; and
WHEREAS, the result of the election for 4-Saharanpur Assembly Constituency was declared by the Returning
Officer on 11th March, 2017 and hence the last date for lodging the accounts of election expenses was 10th April, 2017;
and
WHEREAS, as per the report dated 15th April, 2017 submitted by the District Election Officer, Saharanpur
District, Uttar Pradesh, Sh. Naushad, a contesting candidate of Jan Adhikar Party from 4-Saharanpur Assembly
Constituency of Uttar Pradesh has failed to lodge accounts of his election expenses, in the manner prescribed under the
law; and
WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP-
LA/4/2017, dated 11th September, 2019 was issued under sub rule (5) of rule 89 of the Conduct of Election Rules, 1961
by the Election Commission of India to Sh. Naushad, for the following defects in accounts of his election expenses:-
(i) Election expenditure register comprising of day to day account register, cash register, bank register, abstract
statement has not been lodged.
(ii) Duly sworn in Affidavit has not been submitted by candidate.

(iii) Requisite vouchers in respect of items of election expenditure not submitted.
(iv) Separate Bank Account not opened for election.
(v) All Expenditure (Except petty expenditure) not routed through bank account; and
WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of rule 89 of the
Conduct of Election Rules, 1961, Sh. Naushad was directed to submit his representation in writing to the Commission
explaining the reason for the above said shortcomings in his accounts of election expenses and also to lodge the
accounts, after rectifying the above mentioned defects, with the District Election Officer, Saharanpur within 20 days
from the date of receipt of the notice; and
WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District
Election Officer, Saharanpur, the said notice was served to Sh. Naushad on 29th July, 2019 at the address provided by
the candidate in the nomination papers; and
WHEREAS, the District Election Officer, Saharanpur has submitted in his supplementary report, dated 4th
November, 2019 that Sh. Naushad, has not submitted any representation or a statement of correct account of his
election expenses duly signed, along with original vouchers etc. till that date; and
WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide
Commission’s letter No. 76/UP-LA/4/2017, dated 22nd November, 2019, which was served to him on 4th December,
2019 through the District Election Officer, Saharanpur; and
WHEREAS, as per the report, dated 27th February, 2020 and dated 02nd July, 2020 submitted by the District
Election Officer to the Commission, Sh. Naushad has neither rectified the above mentioned defects nor any
representation has been received from him. Further, no representation from the candidate has been received in the
Secretariat of the Election Commission of India, after delivery of the above mentioned notice/letter; and
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Naushad has failed
to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or justification for
the failure to do so; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-
“If the Election Commission is satisfied that a person-
(a)
Has failed to lodge an account of election expenses within the time and in the manner required by or under this
Act; and
(b)
Has no good reason or justification for the failure,
the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such
person shall be disqualified for a period of three years from the date of the order.”;
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election
Commission of India hereby declares Sh. Naushad, resident of Village Kutubpur Kusani, Post Tiwaya, District
Saharanpur, Uttar Pradesh and a contesting candidate from 4-Saharanpur Assembly Constituency of the State of Uttar
Pradesh in the General Elections to the State Legislative Assembly, 2017, to be disqualified for being chosen as and for
being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union
Territory for a period of three years from the date of this order.

और यत:, 30-लुंगलेइ ईत्तर (ऄ.ि.िा.) जवधान सभा जनवााचन क्षेे्र के ररटर्ननग ऄजधकारी द्वारा ईक्त जनवााचन का
ृररणाम 11.12.2018 क घ जषत कर दकया गया था। आस तरह, जनवााचन खचा का लेखा दिा करने की ऄंजतम जतजथ
10.01.2019 थी;
और यत:,जिला जनवााचन ऄजधकारी, जिला लुंगलेइ, जमज़ रम द्वारा प्रस्ट्तुत एवं मु्य जनवााचन ऄजधकारी, जमज़ रम
द्वारा ऄृने ृ्र सं. एच.11016/2/2019-मु.जन.ऄ. ददनांक 26.04.2019 के माध्यम से ऄग्रसाररत ररृ टा ददनांक
10.01.2019 के ऄनुसार, जमज़ रम की 30-लुंगलेइ ईत्तर (ऄ.ि.िा.) जवधान सभा जनवााचन क्षेे्र से जनवााचन ल़ने वाले
भारतीय िनता ृाटी के ऄभ्यथी, श्री रामददनिौवा जवजध द्वारा यथाृेजक्षेत रीजत से ऄृने जनवााचन खचा का क इ लेखा दिा
करने में जवफल रहे हैं;
और यत:,जनवााचन खचा नहीं प्रस्ट्तुत करने के जलए लुंगलेइ जिला, जमज़ रम के जिला जनवााचन ऄजधकारी और मु्य
जनवााचन ऄजधकारी, जमज़ रम की ररृ टों के अधार ृर जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईृ जनयम (5)
के तहत श्री रामददनिौवा क भारत जनवााचन अय ग द्वारा ददनांक 18.07.2019 क कारण बताओ न रटस िारी दकया गया
था;
और यत:, जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईृ जनयम (6) के तहत ईृयुाक्त कारण बताओ
न रटस ददनांक 18.07.2019 के ऄनुसार श्री रामददनिौवा क जनदेि ददया गया था दक वे जनवााचन खचा लेखा प्रस्ट्तुत न करने
का कारण स्ट्ृष्ट करते हुए ऄृना ऄभ्यावेदन जलजखत रूृ में प्रस्ट्तुत करें और साथ ही जनवााचन खचा का ऄृना लेखा दिा करें
/ऄृने लेखे की कजमयों का जनराकरण करें और ईसे न रटस प्राजप्त की तारीख से 20 ददनों के ऄन्दर संबंजधत जिला जनवााचन
ऄजधकारी क प्रस्ट्तुत करें;
और यत:,
ईक्त न रटस श्री रामददनिौवा द्वारा 06.08.2019 क प्राप्त दकया गया। ईनसे प्राप्त ृावती रसीद
मु्य जनवााचन ऄजधकारी, जमज़ रम द्वारा ऄृने ृ्र सं. एच.11016/2/2019-मु.जन.ऄ. ददनांक 09.03.2020 के माध्यम से
अय ग क प्रस्ट्तुत की गइ है;
और यत:, न रटस के प्रत्युत्तर में श्री रामददनिौवा ने ऄृना ऄभ्यावेदन ददनांक 19.08.2019, प्रस्ट्तुत दकया, जिसमें
ईन्होंने कहा दक व्यय समाृन के ददन ईनके व्यय एिेंट/टीम क सूजचत दकया गया था दक प्रेक्षेणों से ृहले लेखा दिााने के जलए
प्रस्ट्तुत न दकया िाए। आसके ऄलावा, ईन्हें कहा गया दक बाद में यह ईतना प्रभावी नहीं ह गा और आसजलए ईन्होंने जमिन
ृूरा कर जलया है, ऐसा समझ कर ऄृना लेखा कायाालय में बन्द कर ददया था। ईक्त के ृररप्रेक्ष्य में श्री रामददनिौवा ने
ऄनुर ध दकया दक ईनके व्यय टीम की गलजतयों और लाृरवाजहयों के जलए ईन्हें क्षेमा कर ददया िाए और ईन्हें जनरर्हहत
घ जषत न दकया िाए।
और यत:, ऄभ्यथी क एक ऄवसर प्रदान करने के जलए अय ग के ृ्र ददनांक 25.09.2019 एवं 23.12.2019 के
माध्यम से जिला जनवााचन ऄजधकारी, लुंगलेइ से ऄनुर ध दकया गया दक वे ऄभ्यथी श्री रामददनिौवा द्वारा प्रस्ट्तुत ऄभ्यावेदन
ृर ऄृना ऄजभमत दें। ईनसे यह भी कहा गया था दक ऄभ्यथी द्वारा न रटस प्राजप्त की प्रजत और ऄभ्यथी के जनवााचन खचे की
नइ संवीक्षेा एवं ृूरक ररृ टा प्रस्ट्तुत करें ।
और यत:,मु्य जनवााचन ऄजधकारी, जमज़ रम द्वारा ृ्र सं. एच.11016/2/2019–मु.जन.ऄजध. ददनांक
14.07.2020 के माध्यम से ऄग्रसाररत जिला जनवााचन ऄजधकारी, लुंगलेइ के ऄजभमत के ऄनुसार लेखा दिा न करने के
औजचत्य के जलए श्री रामददनिौवा द्वारा प्रस्ट्तुत तका की ृुजष्ट नहीं की िा सकती है और आसजलए ऄस्ट्वीकाया है। तत्कालीन
ररटर्ननग ऄजधकारी, 30-लुंगलेइ ईत्तर (ऄ.ि.िा.) जवधान सभा और सहायक व्यय प्रेक्षेक ने भी स्ट्ृष्ट रूृ में कहा है दक श्री
रामददनिौवा के ऄभ्यावेदन में ि दावा दकया गया है, ऐसा क इ भी जलजखत या मौजखक ऄनुदेि ईनके प्रजतजनजध क नहीं
ददया गया था। वस्ट्तुत:, श्री रामददनिौवा क 22.11.2018 क 48 घंटे के भीतर ऄद्यतन व्यय रजिस्ट्टर िमा करने का
न रटस ददया गया था। एक और न रटस 27.11.2018 क ददया गया था। जनवााचन व्यय रजिस्ट्टर िमा करने के ऄनुदेि के
साथ ृुन: तीसरा न रटस 07.01.2019 क ददया गया था। यह सभी सुस्ट्ृष्ट रूृ में दिााता है दक श्री रामददनिौवा ऄभ्यथी के
रूृ में ऄृने दाजयत्वों का जनवाहन करने में जवफल रहे हैं और आस तरह ईन्होंने जनवााचन व्यय संबंधी प्रावधानों का ईल्लंघन
दकया है।

और यत:,मु्य जनवााचन ऄजधकारी, जमज़ रम द्वारा ृ्र सं. एच.11016/2/2019–मु.जन.ऄजध. ददनांक
14.07.2020 के माध्यम से ऄग्रसाररत जिला जनवााचन ऄजधकारी, लुंगलेइ की नइ ृूरक ररृ टा ददनांक 14.07.2020 से ृता
चलता है दक श्री रामददनिौवा ने अय ग के ददनांक 18.07.2018 के कारण बताओ न रटस के िवाब में जनवााचन खचों का
ऄृना लेखा ऄभी तक नहीं प्रस्ट्तुत दकया है।
और यत:, अय ग का समाधान ह गया है दक श्री रामददनिौवा जनवााचन खचों का लेखा प्रस्ट्तुत करने में जवफल रहे
हैं और ईनके ऄभ्यावेदन ददनांक 19.08.2019 के माध्यम से ईनके द्वारा ददए गए कारण संत षिनक और न्यायसंगत नहीं हैं।
और यत:,ल क प्रजतजनजधत्व ऄजधजनयम1951 की धारा 10क में जवजनधााररत दकया गया है दक :--
यदद जनवााचन अय ग का समाधान ह िाता है दक क इ व् यजक्त –
(क)
जनवााचन व् ययों का लेखा ईस समय के भीतर और ईस रीजत में िैसी आस ऄजधजनयम के द्वारा या ऄधीन ऄृेजक्षेत
है, दाजखल करने में ऄसफल रहा है; तथा
(ख) ईस ऄसफलता के जलए क इ ऄच् ोा कारण या न् याय जचत् य नहीं रखता है, त जनवााचन अय ग िासकीय
रािृ्र में प्रकाजित अदेि द्वारा ईसक जनरर्हहत घ जषत करेगा और ऐसा व् यजक्त ईस अदेि की तारीख से तीन

ORDER
New Delhi, the 30th July, 2020
O. N. 63.—WHEREAS, the General Election to the Legislative Assembly of Mizoram, 2018 was announced
by the Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 06.10.2018. As per the schedule the
date of Counting was 11.12.2018;
AND WHEREAS, as per section 78 of the Representation of the People Act, 1951, every contesting candidate
has to lodge a true copy of his/her account of election expenses within 30 days with the District Election Officer, from
the date of election of the returned candidate;
AND WHEREAS, the result of the said election was declared by the Returning Officer of 30-Lunglei North
(ST) Assembly Constituency on 11.12.2018. As such the last date for lodging of account of election expenses was
10.01.2019;
AND WHEREAS, as per the report dated 10.01.2019 submitted by the District Election Officer, District
Lunglei, Mizoram, and forwarded by the Chief Electoral Officer vide his letter No. H.11016/2/2019-CEO dated 26-04-
2019, Shri Ramdinzauva, a contesting candidate of Bharatiya Janata Party from 30-Lunglei North (ST) Assembly
Constituency of Mizoram has failed to lodge any account of his election expenses as required by law;
AND WHEREAS, on the basis of the reports of the District Election Officer, Lunglei District, Mizoram and
the Chief Electoral Officer, Mizoram, a Show-Cause notice dated 18.07.2019 was issued by the Election Commission of
India under sub-rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Ramdinzauva for non submission of
Election expenses;
AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules,1961, through the above
said Show Cause Notice dated 18.07.2019, Shri Ramdinzauva was directed to submit his representation in writing to the
Commission explaining the reason for non submission of accounts and also to lodge his accounts of election

expenses/rectify the defects in his accounts and submit the same with the District Election Officer concerned within 20
days from the date of receipt of the notice;
AND WHEREAS, the said notice was received by Shri Ramdinzauva on 06.08.2019. Acknowledgement
receipt obtained from him, has been submitted to the Commission by Chief Electoral Officer, Mizoram vide his letter
No. H.11016/2/2019-CEO dated 09.03.2020;
AND WHEREAS, in response to the notice Shri Ramdinzauva submitted his representation dated 19.08.2019,
wherein he stated that on the expenditure closing day, his expenditure agent/team was informed not to submit the
accounts for showing before the observations. Further they were told that it would not be so effective later on and so
they closed their account in the office, thinking that they had completed the mission. In view of the same Shri
Ramdinzauva requested to forgive him for his expenditure team mistakes and negligence and not to declare him
disqualified.
AND WHEREAS, to provide an opportunity to the candidate, DEO, Lunglei vide Commission’s letter dated
25.09.2019 & 23.12.19 was requested to give his comments on the representation submitted by the candidate Shri
Ramdinzauva. He was further asked to send copy of receipt of notice by the candidate and fresh scrutiny and
supplementary report of election expenses by the candidate.
AND WHEREAS, as per the comments of the District Election Officer, Lunglei forwarded by the Chief
Electoral Officer, Mizoram vide letter No. H.11016/2/2019-CEO dated 14.07.2020 the arguments submitted by Shri
Ramdinzauva for justifying non lodging of accounts cannot be substantiated and therefore not acceptable. The then
Returning Officer, 30-Lunglei North (ST) Assembly Constituency and Assistant Expenditure Observer also clearly
stated that no such instructions as claimed by Shri Ramdinzauva in the representation were given, either in writing or
verbally to his representative. In fact, notice was served to Shri Ramdinzauva to submit updated expenditure register
within 48 hrs on 22.11.2018. Another notice was served on 27.11.2018. On 07.01.2019, third notice was again served
with the instruction to submit accounts of election expenses. All these clearly show that Shri Ramdinzauva persistently
failed to fulfil his obligations as a candidate and has thus violated provisions related to Election Expenditure.
AND WHEREAS, the fresh supplementary report dated 14.07.2020 of District Election Officer, Lunglei
forwarded by the Chief Electoral Officer, Mizoram vide letter No. H.11016/2/2019-CEO dated 14.07.2020, reveals that
Shri Ramdinzauva has not yet submitted his accounts of Election Expenses in response to Commission’s Show-Cause
Notice dated 18.07.2019.
AND WHEREAS, the Commission is satisfied that Shri Ramdinzauva has failed to lodge an account of
election expenses and the reasons given by him in his representation dated 19.08.2019 for the failure are not satisfactory
and justifiable.
AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-
“If the Election Commission is satisfied that a person-
(a)
has failed to lodge an account of election expenses within the time and in the manner required by or
under this Act, and
(b)
has no good reason or justification for the failure,
the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such
person shall be disqualified for a period of three years from the date of the order;
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election
Commission of India hereby declares Shri Ramdinzauva, resident of Chhipher, Lunglei Distt. Mizoram-796181, a
contesting candidate of Bharatiya Janata Party for the General Election to the Legislative Assembly, 2018, from 30-
Lunglei North (ST) Assembly Constituency of the State of Mizoram to be disqualified for being chosen as and for being
a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory
for a period of three years from the date of this order.
