की घ षणा प्रेस न ट सं. ईसीआई/प्रे.न ./23/2019 दिनांक 10.03.2019 के िररए की गई थी। का ाक्रम के अनुसार मतगणना

की तारीख 23.05.2019 थी।

और तः, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 78 के तित, जनवााचन ल़ने वाले प्रत् ेक अभ् थी क ,

जनवााजचत अभ् थी के जनवााचन की तारीख से 30 दिनों के भीतर जनवााचन व्य के अृने लेखे की सिी प्रजत जिला जनवााचन

अजिकारी क िाजखल करनी ि ती िै;

और तः, 48-लेकंग (अ.ि.िा.) जविान सभा जनवााचन क्षेे्र के सजित संबंजित ररटर्निंग अजिकारी द्वारा उक्त

जनवााचन के ृररणाम 23.05.2019 क घ जषत दकए गए थे। इस प्रकार, जनवााचन व्य का क ई भी लेखा जवजि द्वारा

थाृेजक्षेत रीजत से िाजखल करने की अंजतम तारीख 22.06.2019 थी;

और तः, जिला जनवााचन अजिकारी, नमसाई जिला, अरुणाचल प्रिेि, द्वारा प्रस्ट्तुत और मु्‍ जनवााचन अजिकारी,

अरुणाचल प्रिेि द्वारा दिनांक 26.07.2019 के ृ्र सं.ईएन/ओृी(सीई)-30/2019/75के तित अग्रेजषत दिनांक

26.07.2019 की ररृ टा के अनुसार, श्री तकम ृलेंग, ि अरुणाचल प्रिेि के 48-लेकंग (अ.ि.िा.) जविान सभा जनवााचन

क्षेे्र से जनवााचन ल़ने वाले अभ् थी िैं, अृने जनवााचन व्य का क ई भी लेखा िाजखल करने में असफल रिे िैं;

और तः, जिला जनवााचन अजिकारी, नमसाई जिला, अरुणाचल प्रिेि और मु्‍ जनवााचन अजिकारी, अरुणाचल

प्रिेि की ररृ टों के आिार ृर भारत जनवााचन आ ग द्वारा जनवााचनों का संचालन जन म, 1961 के जन म 89 के उृ जन म

(5) के अिीन जनवााचन व्य का लेखा िाजखल करने में असफल ि ने ृर, श्री तकम ृलेंग क दिनांक 01.10.2019 क एक

कारण बताओ न रटस िारी दक ा ग ा था;

और तः, जनवााचनों का संचालन जन म, 1961 के जन म 89 के उृ जन म (6) के अनुसार, दिनांक 01.10.2019

के उृ ुाक्त कारण बताओ न रटस के िररए, श्री तकम ृलेंग क जनिेि दि ा ग ा था दक वे इस न रटस के प्राप्त ि ने के 20

दिनों के अंिर लेखे न प्रस्ट्तुत कर ृाने के कारणों क स्ट्ृष्ट करते हुए आ ग क जलजखत रूृ में अृना अभ् ावेिन प्रस्ट्तुत करें

और जनवााचन व्य का अृना लेखा िाजखल करें/अृने लेखे में ्र ुरट ों क सिी करें और उसे संबंजित जिला जनवााचन अजिकारी

क प्रस्ट्तुत करें;

और तः, उक्त न रटस श्री तकम ृलेंग द्वारा दिनांक 13.11.2019 क प्राप्त दक ा ग ा था। अभ् थी से प्राप्त ृावती

रसीि, मु्‍ जनवााचन अजिकारी, नमसाई जिला, अरुणाचल प्रिेि द्वारा दिनांक 27.11.2019 के अृने ृ्र

सं. एन/ईएलएन/िीई(ईईएम)-2/2018-19/4205 के द्वारा आ ग क प्रस्ट्तुत कर िी गई िै;

और त:, जिला जनवााचन अजिकारी, नमसाई जिला, द्वारा दिनांक 13.03.2020 के अृने ृ्र सं. एन/ईएलएन/

िीई-02/2016-19 के तित प्रस्ट्तुत और मु्‍ जनवााचन अजिकारी, अरुणाचल प्रिेि द्वारा दिनांक 16.03.2020 क अृने

ृ्र सं. ईएन/ओृी(सीई)30/2019 क अग्रेजषत की गई अनुृूरक ररृ टा में ि बता ा ग ा िै दक श्री तकम ृलेंग द्वारा लेखे

का क ई संत षिनक उत्तर प्रस्ट्तुत निीं दक ा ग ा िै। इसके अलावा, भारत जनवााचन आ ग का सम् क न रटस जमलने के बाि

भी उन्िोंने उक्त असफलता का न क ई कारण बता ा और न िी क ई स्ट्ृष्टीकरण दि ा िै;

और त:, भारत जनवााचन आ ग का ि समािान ि ग ा िै दक श्री तकम ृलेंग जनवााचन व्य का लेखा िाजखल

करने में असफल रिे िैं और असफलता के जलए उनके ृास क ई समुजचत कारण ा न् ा जचत् निीं िै;

और त:, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 10क के अंतगात ि अनुबंजित दक ा ग ा िै दक:-

" दि जनवााचन आ ग का समािान ि िाता िै दक क ई व्यजक्त-

(क) जनवााचन व्य ों का लेखा उस सम के भीतर और उस रीजत में िैसी इस अजिजन म के द्वारा ा अिीन

अृेजक्षेत िै, िाजखल करने में असफल रिा िै; तथा

(ख) उस असफलता के जलए क ई समुजचत कारण ा न् ा जचत् निीं िै,

त जनवााचन आ ग िासकी रािृ्र में प्रकाजित आिेि द्वारा उसक जनरर्िात घ जषत करेगा और ऐसा व्यजक्त उस

आिेि की तारीख से तीन वषा की कालावजि के जलए जनरर्िात ि गा;

अब इसीजलए, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 10क के अनुसरण में भारत जनवााचन आ ग एतद्द्वारा

नमसाई, अरुणाचल प्रिेि-792105 क संसि के दकसी भी सिन ा राज् ा संघ राज् क्षेे्र की जविानसभा अथवा जविान

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 7th August, 2020

O.N. 74 .—WHEREAS, the General Election to the Legislative Assembly 2019 in the state of Arunachal

Pradesh was announced by Election Commission of India vide Press Note No ECI/PN/23/2019 dated 10.03.2019. As per

the schedule, Date of Counting was 23.05.2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate

has to lodge a true copy of his/her account of election expenses within 30 days with the District Election Officer, from

the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

48-Lekang(ST) Assembly Constituency on 23.05.2019. As such the last date for lodging of account of election expenses

was 22.06.2019.

AND WHEREAS, as per the report dated 26.07.2019 submitted by the District Election Officer, Namsai

District, Arunachal Pradesh and forwarded by Chief Electoral Officer, Arunachal Pradesh vide letter No.EN/OP(CE)-

30/2019/75 dated 26.07.2019, Shri Takem Paleng, a contesting candidate from, 48-Lekang (ST) Assembly Constituency

of Arunachal Pradesh has failed to lodge any account of her election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Namsai District, Arunachal

Pradesh and the Chief Electoral Officer, Arunachal Pradesh , a Show Cause notice dated 01.10.2019 was issued by the

Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Takem

Paleng for non submission of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 01.10.2019, Shri Takem Paleng was directed to submit her representation in writing in

the Commission explaining the reason for non submission of accounts and also to lodge her accounts of election

expenses/rectify the defects in his accounts and submit the same to the District Election Officer concerned within 20 days

from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Takem Paleng on 13.11.2019. Acknowledgment

receipt obtained from the candidate, has been submitted to the Commission by District Election Officer, Namsai District,

Arunachal Pradesh vide his letter No.N/ELN/GE(EEM)-02/2018-19/4205 dated 27.11.2019 .

AND WHEREAS, in the supplementary report submitted by District Election Officer, Namsai District vide his

letter No. N/ELN/GE-02/2016-19 dated 13.03.2020 and forwarded by Chief Electoral Officer, Arunachal Pradesh vide

letter No. EN/OP(CE)30/2019 dated 16.03.2020 has stated that no satisfactory reply of account has been submitted by

Shri Takem Paleng , Further, he has neither furnished any reason nor explanation for the said failure even after receipt of

the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Shri Takem Paleng has failed to lodge an account of election

expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the. time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure,

the Election Commission shall by order published in the official Gazette, declare his to be disqualified and any such

person shall be disqualified for a period of three years from date of the order;

NOW THEREFORE , in pursuance of Section 10 A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Takem Paleng a resident of Village Silatoo Khamti, PO/PS

Mahadevpur, District: Namsai Arunachal Pradesh-792105 and the contesting candidate for the General Election to the

Legislative Assembly 2019 in the state of Arunachal Pradesh from 48-Lekang(ST) Assembly Constituency of the state

of Arunachal Pradesh to be disqualified for being chosen as and for being a member of either House of Parliament or

the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date

of this order.

सािारण जनवााचन, 2017 की घ षणा प्रेस न ट सं्‍ ा ईसीआई/प्रे.न ./1/2017 दिनांक 4 िनवरी, 2017 के िररए की गई

थी; और

त:, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 78 के अनुसार, जनवााचन ल़ने वाले प्रत् ेक अभ् थी क ,

जनवााजचत अभ् थी के जनवााचन की तारीख से 30 दिनों के भीतर जनवााचन व्य के अृने लेखे की सिी प्रजत संबजन्ित जिला

त:, जिला जनवााचन अजिकारी, िाथरस जिला, उत्तर प्रिेि द्वारा प्रस्ट्तुत दिनांक 12 अप्रैल, 2017 की ररृ टा के

अनुसार, उत्तर प्रिेि के 79-सािाबाि जविान सभा जनवााचन क्षेे्र से जनवााचन ल़ने वाले अभ् थी श्री तेन्र ससंि अृने

जनवााचन व्य का सिी लेखा जवजि द्वारा थाृेजक्षेत रीजत से िाजखल करने में जवफल रिे िैं; और

त:, जिला जनवााचन अजिकारी, की उक्त ररृ टा के आिार ृर भारत जनवााचन आ ग द्वारा जनवााचनों का संचालन

जन म, 1961 के जन म 89 के उृ जन म (5) के अंतगात श्री तेन्र ससंि क दिनांक 18 अक्तूबर, 2018 क जनवााचन व्य का

लेखा जनम्नजलजखत ्र ुरट ों के साथ िाजखल करने िेतु कारण बताओं न रटस नं. 76/उ.प्र.-जव.स./79/भा.जन.आ./

न रटस/टेरी./उ.अनु.-III-उ.प्र./2017 िारी दक ा ग ा था:-

(2) बैंक स्ट्टेटमेन्ट प्रस्ट्तुत निीं दक ा ग ा िै; और

त:, जनवााचनों का संचालन जन म, 1961 के जन म 89 के उृ जन म (6) के अनुसार एवं उृ ुाक्त कारण बताओं

न रटस के द्वारा श्री तेन्र ससंि क जनिेि दि ा ग ा था की वे इस न रटस के प्राप्त ि ने के 20 दिनों के भीतर लेखा िाजखल

निीं करने के कारणों क स्ट्ृष्ट करते हुए जलजखत रूृ में अृना अभ् ावेिन जनवााचन आ ग के समक्षे प्रस्ट्तुत करें और साथ िी

त:, जिला जनवााचन अजिकारी, िाथरस जिला, द्वारा भारत जनवााचन आ ग क प्रस्ट्तुत की गई ृावती रसीि के

अनुसार, उक्त न रटस श्री तेन्र ससंि क दिनांक 19 नवम्बर, 2018 क उनके द्वारा नामांकन ृ्र में ििाा े ग े ृते ृर

तामील दक ा ग ा था; और

त:, जिला जनवााचन अजिकारी, िाथरस ने दिनांक 07 अगस्ट्त, 2019 की अृनी अनुृूरक ररृ टा में ि बता ा िै

तः, भारत जनवााचन आ ग द्वारा अभ् थी श्री तेन्र ससंि क अंजतम अवसर प्रिान करते हुए ृ्र सं. 76/उ.प्र.-

जव.स./79/भा.जन.आ./ृ्र /टेरी./उ.अनु.-III-उ.प्र./2017, दिनांक 1 अक्तूबर, 2019 िारी दक ा ग ा, ि जिला जनवााचन

अजिकारी, िाथरस के माध् म से उनकी ृत्नी श्रीमती ृा ल दिनांक 18 माचा, 2020 क प्राप्त हुआ; और

त:, जिला जनवााचन अजिकारी, से प्राप्त दिनांक 07 अगस्ट्त, 2020 की ररृ टा के अनुसार श्री तेन्र ससंि द्वारा उक्त

कजम ों क सुिारते हुए न त क ई लेखा िमा दक ा ग ा िै न िी क ई अभ् ावेिन प्रस्ट्तुत दक ा ग ा िै | इसके अजतररक्त,

उक्त न रटस/ृ्र जमलने के उृरांत भी अभ् थी द्वारा उक्त जवफलता के जलए भारत जनवााचन आ ग के समक्षे क ई कारण

अथवा स्ट्ृष्टीकरण प्रस्ट्तुत निीं दक ा ग ा िै; और

त:, तथ् ों और उृलब्ि िस्ट्तावेिों के आिार ृर, आ ग का ि समािान ि ग ा िै दक श्री तेन्र ससंि जवजित

प्रृ्र में अृने जनवााचन व्य का लेखा िाजखल करने में जवफल रिे िैं और उनके ृास इस जवफलता के जलए क ई भी उजचत

कारण अथवा औजचत् निीं िै; और

त:, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 10क में अनुबंजित दक ा ग ा िै दक :-

“ दि जनवााचन आ ग का समािान ि िाता िै दक क ई व्यजक्त –

(क) जनवााचन व्य ों का लेखा उस सम के भीतर और उस रीजत में िैसी इस अजिजन म के द्वारा ा अिीन अृेजक्षेत

िै, िाजखल करने में जवफल रिा िै; तथा

(ख) उस जवफलता के जलए क ई अच्ोा कारण ा औजचत् निीं िै

आिेि की तारीख से तीन वषा की कालावजि के जलए जनरर्िात ि गा ।”;

अत:, अब ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 10क के अनुसरण में भारत जनवााचन आ ग एतिद्वारा

घ षणा करता िै दक श्री तेन्र ससंि, जनवासी ग्राम व ृ स्ट्ट बद्वावारी मुरसान, िाथरस, उत्तर प्रिेि, ि उत्तर प्रिेि जविान

सभा सािारण जनवााचन, 2017 में 79-सािाबाि जविान सभा जनवााचन क्षेे्र से जनवााचन ल़ने वाले अभ् थी थे, इस आिेि

की तारीख से तीन वषा की अवजि के जलए संसि के दकसी भी सिन अथवा राज् अथवा संघ राज् -क्षेे्र की जविान सभा अथवा

जविान ृररषि का सिस्ट् चुने िाने अथवा ि ने के जलए जनरर्िात िोंगे ।

O. N. 75.—WHEREAS, the General Election for 79-Sadabad Assembly Constituency of Uttar Pradesh, 2017

was announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4^th January, 2017; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to

lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from

the date of election of the returned candidate; and

WHEREAS, the result of the election for 79-Sadabad Assembly Constituency was declared by the Returning

Officer on 11^th March, 2017 and hence the last date for lodging the accounts of election expenses was 10^th April, 2017;

and

WHEREAS, as per the report dated 12^th April, 2017 submitted by the District Election Officer, Hathras District,

Uttar Pradesh, Sh. Yatendra Singh, a contesting candidate from 79-Sadabad Assembly Constituency of Uttar Pradesh

has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP-

LA/79/ECI/Notice/TERR/NS-III-UP/2017, dated 18^th October, 2018 was issued under sub rule (5) of rule 89 of the

Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Yatendra Singh, for the following defects

in accounts of his election expenses:-

(i)

Bill vouchers have not been presented in respect of items of election expenditure.

(ii) Bank Statement has not been submitted; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of rule 89 of the

Conduct of Election Rules, 1961, Sh. Yatendra Singh was directed to submit his representation in writing to the

Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to

lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Hathras within 20

days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District

Election Officer, Hathras, the said notice was served to Sh. Yatendra Singh on 19^th November, 2018 at the address

provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Hathras has submitted in his supplementary report, dated 7^th August,

2019 that Sh. Yatendra Singh, has not submitted any representation or a statement of correct account of his election

expenses duly signed, along with original vouchers etc. till that date; and

WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide

Commission’s letter No. 76/UP-LA/79/ECI/LET/TERR/NS-III-UP/2017, dated 1^st October, 2019, which was served to

his wife Smt. Paayal on 18^th March, 2020 through the District Election Officer, Hathras; and

WHEREAS, as per the report, dated 7^th August, 2020 submitted by the District Election Officer to the

Commission, Sh. Yatendra Singh has neither rectified the above mentioned defects nor any representation has been

received from him. Further, no representation from the candidate has been received in the Secretariat of the Election

Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Yatendra Singh

has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or

justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

“If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under this

Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.”;

O.N. 76 .—WHEREAS, the General Election for 78-Hathras (SC) Assembly Constituency of Uttar Pradesh,

2017 was announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4^th January, 2017;

and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to

lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from

the date of election of the returned candidate; and

WHEREAS, the result of the election for 78-Hathras (SC) Assembly Constituency was declared by the

Returning Officer on 11^th March, 2017 and hence the last date for lodging the accounts of election expenses was

10^th April, 2017; and

WHEREAS, as per the report dated 12^th April, 2017 submitted by the District Election Officer, Hathras District,

Uttar Pradesh, Sh. Vijendra Singh, a contesting candidate from 78-Hathras (SC) Assembly Constituency of Uttar

Pradesh has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP-

LA/78/ECI/Notice/TERR/NS-III-UP/2017, dated 18^th October, 2018 was issued under sub rule (5) of rule 89 of the

Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Vijendra Singh, for the following defects

in accounts of his election expenses:-

(iii) Bill vouchers have not been presented in respect of items of election expenditure; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of rule 89 of the

Conduct of Election Rules, 1961, Sh. Vijendra Singh was directed to submit his representation in writing to the

Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to

lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Hathras within 20

days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District

Election Officer, Hathras, the said notice was served to Sh. Vijendra Singh on 6^th November, 2018 at the address

provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Hathras has submitted in his supplementary report, dated

18^th December, 2019 that Sh. Vijendra Singh, has not submitted any representation or a statement of correct account of

his election expenses duly signed, along with original vouchers etc. till that date; and

WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide

Commission’s letter No. 76/UP-LA/78/ECI/LET/TERR/NS-III-UP/2017, dated 2^nd July, 2020, which was served to him

on 10^th July, 2020 through the District Election Officer, Hathras; and

WHEREAS, as per the report, dated 7^th August, 2020 submitted by the District Election Officer to the

Commission, Sh. Vijendra Singh has neither rectified the above mentioned defects nor any representation has been

received from him. Further, no representation from the candidate has been received in the Secretariat of the Election

Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Vijendra Singh

has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or

justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

“If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under

this Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.”;

O.N. 78.—WHEREAS, the General Election for 79-Sadabad Assembly Constituency of Uttar Pradesh, 2017 was

announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4^th January, 2017; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to

lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from

the date of election of the returned candidate; and

WHEREAS, the result of the election for 79-Sadabad Assembly Constituency was declared by the Returning

Officer on 11^th March, 2017 and hence the last date for lodging the accounts of election expenses was 10^th April, 2017;

and

WHEREAS, as per the report dated 12^th April, 2017 submitted by the District Election Officer, Hathras District,

Uttar Pradesh, Sh. Subhash Chandra, a contesting candidate from 79-Sadabad Assembly Constituency of Uttar Pradesh

has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP-

LA/79/ECI/Notice/TERR/NS-III-UP/2017, dated 18^th October, 2018 was issued under sub rule (5) of rule 89 of the

Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Subhash Chandra, for the following

defects in accounts of his election expenses:-

(i)

Bill vouchers have not been presented in respect of items of election expenditure.

(ii) Bank Statement has not been submitted; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of rule 89 of the

Conduct of Election Rules, 1961, Sh. Subhash Chandra was directed to submit his representation in writing to the

Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to

lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Hathras within

20 days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District

Election Officer, Hathras, the said notice was served to Sh. Bachchu Singh F/o Sh. Subhash Chandra on 27^th November,

2018 at the address provided by the candidate in the nomination papers; and

WHEREAS, the District Election Officer, Hathras has submitted in his supplementary report, dated 7^th August,

2019 that Sh. Subhash Chandra, has not submitted any representation or a statement of correct account of his election

expenses duly signed, along with original vouchers etc. till that date; and

WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide

Commission’s letter No. 76/UP-LA/79/ECI/LET/TERR/NS-III-UP/2017, dated 1^st October, 2019, which was served to

him on 18^th March, 2020 through the District Election Officer, Hathras; and

WHEREAS, as per the report, dated 7^th August, 2020 submitted by the District Election Officer to the

Commission, Sh. Subhash Chandra has neither rectified the above mentioned defects nor any representation has been

received from him. Further, no representation from the candidate has been received in the Secretariat of the Election

Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Subhash Chandra

has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or

justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

“If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under

this Act; and

(b) Has no good reason or justification for the failure,

person shall be disqualified for a period of three years from the date of the order.”;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission of India hereby declares Sh. Subhash Chandra, resident of Patakhas, Post Patakhas, District Hathras,

Uttar Pradesh and a contesting candidate from 79-Sadabad Assembly Constituency of the State of Uttar Pradesh in the

General Elections to the State Legislative Assembly, 2017, to be disqualified for being chosen as and for being a

member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory

for a period of three years from the date of this order.

received from him. Further, no representation from the candidate has been received in the Secretariat of the Election

घ षणा प्रेस न ट सं्‍ ा ईसीआई/प्रे.न ./23/2019 दिनांक 10 माचा, 2019 के िररए की गई थी । का ाक्रम के अनुसार,

मतगणना की तारीख 23 मई, 2019 थी ।

और तः, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 78 के अनुसार, जनवााचन ल़ने वाले प्रत् ेक अभ् थी क ,

अजिकारी क िाजखल करनी ि ती िै;

और तः,05-जबलासृुर ल क सभा जनवााचन क्षेे्र सजित संबंजित ररटर्निंग अजिकारी द्वारा उक्त जनवााचन के

ृररणाम 23 मई, 2019 क घ जषत दकए गए थे । इस प्रकार, जनवााचन व्य के लेखे िाजखल करने की अजन्तम तारीख

22 िून, 2019 थी;

और तः, जिला जनवााचन अजिकारी, जबलासृुर जिला, ोत्तीसगढ़ द्वारा प्रस्ट्तुत और मु्‍ जनवााचन अजिकारी,

ोत्तीसगढ़ द्वारा अृने दिनांक 26 िून, 2019 के ृ्र सं. 21/चार/ल .स.चु./EEM/2019/6169 के िररए अग्रेजषत दिनांक

24 िून, 2019 की ररृ टा के अनुसार श्री ि रीलाल अनंत, ि ोत्तीसगढ़ के 05-जबलासृुर ल क सभा जनवााचन क्षेे्र से

जनवााचन ल़ने वाले जनिाली अभ् थी िैं, जवजि द्वारा थाृेजक्षेत रीजत से अृने जनवााचन व्य का क ई भी लेखा िाजखल करने

में जवफल रिे िैं ।

और तः, जिला जनवााचन अजिकारी, जबलासृुर जिला, ोत्तीसगढ़ और मु्‍ जनवााचन अजिकारी, ोत्तीसगढ़ की

ररृ टों के आिार ृर भारत जनवााचन आ ग द्वारा जनवााचनों का संचालन जन म 1961 के जन म 89 के उृ जन म (5) के

अंतगात जनवााचन व्य प्रस्ट्तुत निीं करने के जलए श्री ि रीलाल अनंत क कारण बताओ न रटस दिनांक 14 अगस्ट्त, 2019

िारी दक ा ग ा था;

और तः, जनवााचनों का संचालन जन म 1961 के जन म 89 के उृ-जन म (6) के अनुसार, दिनांक 14 अगस्ट्त,

2019 के उृ ुाक्त कारण बताओ न रटस के िररए श्री ि रीलाल अनंत क जनिेि दि ा ग ा था दक वे इस न रटस के प्राप्त ि ने

के 20 दिनों के अंिर लेखे न प्रस्ट्तुत कर ृाने के कारणों क स्ट्ृष्ट करते हुए जलजखत रूृ में अृना अभ् ावेिन प्रस्ट्तुत करें और

साथ िी, जनवााचन व्य का अृना लेखा िाजखल करें;

और तः, उक्त न रटस श्री ि रीलाल अनंत द्वारा 4 जसतम्बर, 2019 क प्राप्त दक ा था । अभ् थी से प्राप्त ृावती

रसीि जिला जनवााचन अजिकारी, जबलासृुर द्वारा अृने दिनांक 25 जसतम्बर, 2019 के ृ्र सं्‍ ा जन.ृ./ल .स.जन./व्य

लेखा/2019/4137 के िररए आ ग क प्रस्ट्तुत कर िी गई िै;

और तः, जिला जनवााचन अजिकारी, जबलासृुर द्वारा अृने दिनांक 12 माचा, 2019 के ृ्र सं्‍ ा

जन.ृ./ल .स.जन.-19/व्य लेखा/2020/4640 के िररए प्रस्ट्तुत की गई अनुृूरक ररृ टा में ि बता ा ग ा िै दक श्री ि रीलाल

अनंत ने आि की तारीख तक न त क ई भी अभ् ावेिन और न िी अृने जनवााचन व्य का लेखा िाजखल दक ा िै । इसके

अजतररक्त उन्िोंने भारत जनवााचन आ ग का सम् क न रटस जमलने के उृरांत भी उक्त जवफलता के जलए न त क ई कारण

बता ा िै और न िी क ई स्ट्ृष्टीकरण दि ा िै;

और तः, आ ग का ि समािान ि ग ा िै दक श्री ि रीलाल अनंत जनवााचन खचों का लेखा िाजखल करने में

जवफल रिे िैं और उनके ृास इस जवफलता के जलए क ई भी उजचत कारण अथवा औजचत् निीं िै,

और त:, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 10क में अनुबंजित दक ा ग ा िै दक :-

िाजखल करने में असफल रिा िै; तथा

िाउकाृा, ल रमी, ोत्तीसगढ़, इस आिेि की तारीख से तीन वषा की अवजि के जलए संसि के दकसी भी सिन अथवा राज्

अथवा संघ राज् -क्षेे्र की जविान सभा अथवा जविान ृररषि का सिस्ट् चुने िाने अथवा ि ने के जलए जनरर्िात िै ।

O.N. 81.—WHEREAS, the General Election to Lok Sabha of Chhattisgarh, 2019 was announced by Election

Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019. As per the schedule, Date of

Counting was 23rd May, 2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate

has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the

date of election returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

05-Bilaspur Parliamentary Constituency on 23rd May, 2019. As such the last date for lodging of account of election

expenses was 22nd June, 2019.

AND WHEREAS, as per the report dated 24th June, 2019 submitted by the District Election Officer, Bilaspur

05-Bilaspur Parliamentary Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as

required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Bilaspur District, Chhattisgarh

and the Chief Electoral Officer, Chhattisgarh, a Show Cause notice dated 14th August, 2019 was issued by Election

Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Horilal Anant for

non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 14th August, 2019, Shri Horilal Anant was directed to submit his representation in

writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of

election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within

20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Horilal Anant on 4th September, 2019.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election

Officer, Bilaspur vide his letter No. जन.ृ./ल .स.जन./व्य लेखा/2019/4137 dated 25th September, 2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Bilaspur vide his letter

No. जन.ृ./ल .स.जन.-19/व्य लेखा/2020/4640 dated 12th March, 2020 has stated that Shri Horilal Anant, has not

submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till date.

Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the

Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Shri Horilal Anant has failed to lodge an account of election

expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

"If the Election Commission is satisfied that a person:

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act, and

(b) Has no good reason or justification for the failure the Election Commission shall by order published in the

official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from date of the under;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission of India hereby declares Shri Horilal Anant, resident of Village Chakla, Post Office Daukapa, Lormi,

Chhattisgarh and the contesting Independent candidate for General Election to Lok Sabha of Chhattisgarh, 2019 from

05-Bilaspur Parliamentary Constituency of the state of Chhattisgarh to be disqualified for being chosen as and for being

a member of either House of Parliament or the Legislative Parliamentary or legislative Council of a State or Union

Territory for a period of three years from the date of this order.

AND WHEREAS, on the basis of the reports of the District Election Officer, Korea District, Chhattisgarh and

the Chief Electoral Officer, Chhattisgarh, a Show Cause notice dated 8th August, 2019 was issued by Election

Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Krishna Kant

Nagvanshi for non-submission of Election expenses;
