सं. ईसीआई/प्रे.न ./23/2019 दिनांक 10 माचा, 2019 द्वारा की गई थी । त का ाक्रम के अनुसार, मतगणना की तारीख

23 मई, 2019 थी ।

और तः, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 78 के अनुसार, जनवााचन ल़ने वाले प्रत् ेक अभ् थी क ,

जनवााजचत अभ् थी के जनवााचन की तारीख से 30 दिनों के भीतर जनवााचन व्य के अृने लेखे की सत् प्रजतजलजृ जिला

जनवााचन अजिकारी क िाजखल करनी ि ती िै;

और तः, झारखण्ड राज् के संबंजित ररटर्निंग अजिकारी द्वारा 01-रािमिल (अ.ि.िा.) संसिी जनवााचन क्षेे्र

सजित उक्त जनवााचन के ृररणाम 23 मई, 2019 क घ जषत दकए गए थे । इस प्रकार जनवााचन व्य ों का लेखा िाजखल करने

की अंजतम तारीख 22 िून, 2019 थी;

और तः, जिला जनवााचन अजिकारी, सािेबगंि जिला, झारखण्ड द्वारा प्रस्ट्तुत और मु्‍ जनवााचन अजिकारी,

झारखण्ड, द्वारा दिनांक 5 िुलाई, 2019 के ृ्र सं. 01/जनवाा.-ईईएम-क .-23/2019/5197 द्वारा अग्रेजषत दिनांक 26 िून,

2019 की ररृ टा के अनुसार, श्री मंगल मरांडी, ि झारखण्ड के 01-रािमिल (अ.ि.िा.) संसिी जनवााचन क्षेे्र से जनवााचन

ल़ने वाले जनिाली अभ् थी िैं, जवजि द्वारा थाृेजक्षेत अृने जनवााचन व्य का क ई लेखा िाजखल करने में असफल रिे िैं;

और तः, जिला जनवााचन अजिकारी, सािेबगंि जिला, झारखण्ड और मु्‍ जनवााचन अजिकारी, झारखण्ड, की

ररृ टों के आिार ृर भारत जनवााचन आ ग द्वारा जनवााचनों का संचालन जन म, 1961 के जन म 89 के उृ जन म (5) के

तित जनवााचन व्य का लेखा िाजखल करने में असफल रिने ृर, श्री मंगल मरांडी क दिनांक 23 अगस्ट्त, 2019 क कारण

बताओ न रटस िारी दक ा ग ा था;

और तः, जनवााचनों का संचालन जन म, 1961 के जन म 89 के उृ जन म (6) के अनुसार, दिनांक 23 अगस्ट्त,

2019 के उृ ुाक्त कारण बताओ न रटस के िररए, श्री मंगल मरांडी क जनिेि दि ा ग ा था दक वे इस न रटस के प्राप्त ि ने के

20 दिनों के भीतर लेखे न प्रस्ट्तुत कर ृाने का कारण स्ट्ृष्ट करते हुए आ ग क जलजखत में अृना अभ् ावेिन प्रस्ट्तुत करें और

जनवााचन व्य का अृना लेखा िाजखल करें/अृने लेखे में ्र ुरट ों क सिी करें और उसे संबंजित जिला जनवााचन अजिकारी क

प्रस्ट्तुत करें;

और तः, उक्त न रटस श्री मंगल मरांडी क दिनांक 5 जसतंबर, 2019 क सौंृ दि ा ग ा था । ृावती रसीि, जिला

जनवााचन अजिकारी, सािेबगंि द्वारा दिनांक 10 िून, 2020 के अृने ृ्र सं.132/जनवाा. द्वारा आ ग क प्रस्ट्तुत कर िी

गई िै ।

और त:, जिला जनवााचन अजिकारी, सािेबगंि द्वारा प्रस्ट्तुत दिनांक 10 िून, 2020 के अृने ृ्र सं.132/जनवाा

द्वारा प्रस्ट्तुत की गई अनुृूरक ररृ टा में ि उल्लेख िै दक श्री मंगल मरांडी ने आि की तारीख तक क ई भी अभ् ावेिन अथवा

अृने जनवााचन व्य का लेखा प्रस्ट्तुत निीं दक ा िै । इसके अलावा, उन्िोंने भारत जनवााचन आ ग का सम् क न रटस जमलने

के बाि भी उक्त असफलता का न त क ई कारण बता ा िै और न िी क ई स्ट्ृष्टीकरण दि ा िै;

और त:, भारत जनवााचन आ ग का ि समािान ि ग ा िै दक श्री मंगल मरांडी जनवााचन व्य का लेखा िाजखल

करने में असफल रिे िैं और जवफलता के जलए उनके ृास क ई समुजचत कारण ा न् ा जचत् निीं िै;

और त:, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 10क में ि अनुबंजित दक ा ग ा िै दक:-

“ दि जनवााचन आ ग का ि समािान ि िाता िै दक क ई व्यजक्त-

(क) जनवााचन व्य ों का लेखा उस सम के भीतर और उस रीजत में िैसी इस अजिजन म के द्वारा ा अिीन

अृेजक्षेत िै, िाजखल करने में असफल रिा िै; तथा

(ख) उसके ृास उस असफलता के जलए क ई समुजचत कारण ा न् ा जचत् निीं िै,

त जनवााचन आ ग िासकी रािृ्र में प्रकाजित आिेि द्वारा उसक जनरर्िात घ जषत करेगा और ऐसा क ई भी

व्यजक्त उस आिेि की तारीख से तीन वषा की कालावजि के जलए जनरर्िात ि गा ।”

अब इसीजलए, ल क प्रजतजनजित्व अजिजन म,1951 की िारा 10क के अनुसरण में भारत जनवााचन आ ग एतद्द्वारा

झारखण्ड राज् के 01-रािमिल (अ.ि.िा.) संसिी जनवााचन क्षेे्र से ल कसभा के सािारण जनवााचन, 2019 में जनवााचन

ल़ने वाले जनिाली अभ् थी, श्री मंगल मरांडी, जनवासी गांव + डाक – बरमजस ा, थाना – बरिैट, जिला – सािेबगंि,

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the, 23rd September, 2020

O. N. 109.—WHEREAS, the General Election to Lok Sabha, 2019 was announced by Election

Commission of India vide Press Note No. ECI/PN/23/2019 dated 10^th March, 2019. As per the schedule, Date of

Counting was 23^rd May, 2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate

has to lodge a true copy of his/her account of election expenses within 30 days with the District Election Officer, from

the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

01-Rajmahal (ST) Parliamentary Constituency of the State of Jharkhand on 23^rd May, 2019. As such the last date for

lodging of account of election expenses was 22^nd June, 2019.

AND WHEREAS, as per the report dated 26^th June, 2019 submitted by the District Election Officer, Sahibganj

District, Jharkhand and forwarded by Chief Electoral Officer, Jharkhand vide letter No. 01/निर्वा०-EEM-को०-

23/2019/5197 dated 5^th July, 2019, Shri Mangal Marandi, an Independent contesting candidate from 01-Rajmahal

(ST) Parliamentary Constituency of Jharkhand, has failed to lodge any account of his election expenses as required by

law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Sahibganj District, Jharkhand

and the Chief Electoral Officer, Jharkhand, a Show Cause notice dated 23^rdAugust, 2019 was issued by Election

Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Mangal Marandi

for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 23^rd August, 2019, Shri Mangal Marandi was directed to submit his representation in

writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of

election expenses/rectify the defects in his accounts and submit the same to the District Election Officer concerned

within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was delivered to Shri Mangal Marandi on 5^th September, 2019.

Acknowledgment receipt has been submitted to the Commission by District Election Officer, Sahibganj vide his letter

No. 132/जनवाा dated 10^th June, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Sahibganj vide his letter

No. 132/निर्वा dated 10^th June, 2020, it has been stated that Shri Mangal Marandi, has not submitted any representation

or his account of election expenses, till date. Further, he has furnished neither any reason nor explanation for the said

failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Shri Mangal Marandi has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person:

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act, and

(b) Has no good reason or justification for the failure,

The Election Commission shall, by order published in the official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from date of the order.”

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission of India hereby declares Shri Mangal Marandi, resident of Village + Post – Baramasia, PS – Barhait,

District – Sahibganj, Jharkhand and the contesting Independent candidate for the General Election to Lok Sabha, 2019

from 01-Rajmahal (ST) Parliamentary Constituency of the state of Jharkhand to be disqualified for being chosen as and

for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or

Union Territory for a period of three years from the date of this order.

जनवााचन आ ग का ि समािान ि ग ा िै दक उक् त असफलता के जलए उनके ृास क ई उृ ुक् त ा न् ा जचत कारण निीं

िै;

अत:, अब, उक् त अजिजन म की िारा 10क के अनुसरण में, भारत जनवााचन आ ग नीचे की सारणी के स्ट् तंभ 4 में

जवजनर्िा्‍ ट व् जक्त ों क संसि के दकसी सिन ा दकसी राज् ा संघ राज् -क्षेे्र की जविान सभा अथवा जविान ृररषि ा

O. N. 110.—Whereas, the Election Commission of India is satisfied that each of the contesting candidate

specified in column 4 of the Table below at the General Election to the Lok Sabha, 2019, from the State of Karnataka,

specified in column 2 and held from the Parliamentary Constituency specified in column 3 against his/her name has failed

to lodge the account of his/her election expenses as shown in column 5 of the said Table as required by the

Representation of the People Act, 1951 and the Rules made thereunder;

And whereas, the said candidates have furnished neither any reason nor explanation for the said failure even after

due notice by the Election Commission or after considering the representation made by them, if any, the Election
