S.O. 874.—Whereas by notification of the Government of India in the Ministry of Coal number

S.O. 1795, dated the 13^th December, 2018 under sub-section (1) of section 4 of the Coal Bearing Areas

(Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) and published

in the Gazette of India, Part II, Section 3, Sub-section (ii), dated the December 16 – December 22, 2018

(weekly), the Central Government gave notice of its intention to prospect for coal in land measuring 2773.639

thereto.

Now, therefore, in exercise of the powers conferred by section 7 of the said Act, the Central

Government hereby specifies a further period of one year commencing from the 13^th December, 2020, as the

period within which the Central Government gives notice of its intention to acquire the said land or any rights in

or over the said land specified in the Schedule appended hereto.

S.O. 875.—Whereas by the notification of the Government of India in the Ministry of Coal number

S.O. 2667, dated the 20^th November, 2017, issued under sub-section (1) of section 7 of the Coal Bearing Areas

(Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) and published in

the Gazette of India, Part II, Section 3, Sub-section (ii), dated the 25^th November, 2017, the Central Government

gave notice of its intention to acquire 37.619 hectares (approximately) or 92.96 acres (approximately) land and

all rights in or over such lands specified in the schedule appended to that notification;

And whereas, the competent authority in pursuance of section 8 of the said Act has made his report to

the Central Government;

And whereas, the Central Government after considering the aforesaid report and after consulting the

Government of Madhya Pradesh, is satisfied that the lands measuring 37.619 hectares (approximately) or 92.96

acres (approximately) as all rights in or over such lands as described in schedule appended hereto, should be

acquired;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 9 of the said Act, the

Central Government hereby declares that the land measuring 37.619 hectares (approximately) or 92.96 acres

(approximately) and all rights in or over such lands as described in Schedule are hereby acquired.

On successive dates, when the parties turned up the workman and opposite party No. 02/contractor

come forward with a agreement for settlement of dispute and prayed this Tribunal to disposed of the reference in

light of the settlement arrived between them. The copy of the agreement for settlement was furnished to the

learned counsel for the opposite party No. 01, who did not make any objection.

In the agreement for settlement, it has been stated that the respondent no. 02 entered into an agreement

with respondent no. 01 for cleaning of train coaches and accordingly, the workman joined the services of

respondent no. 02, which were later terminated by the respondent no. 02. It has been stated in the agreement,

filed before this Tribunal that the contract of respondent no. 02 with respondent no. 01 had expired and

presently the workman is working with new contractor and also that no dues are left against respondent No. 02;

hence no grievances are left to him and the reference order may be disposed of accordingly.

In view of the terms of the agreement of settlement, filed before this Tribunal, which is made part of

this award, the grievances of the workman stands resolved; and no relief is required to be given to the workman

concerned.

post of Messenger on 03.11.1981 and was paid accordingly. The workman has submitted that he worked with

the bank continuously upto 1997; and when he moved a representation for his regularization, the management of

the bank terminated his services w.e.f. 31.12.1997 without any notice or notice pay in lieu thereof or any

retrenchment compensation in violation to the provisions contained in Section 25 F of the Industrial Disputes

Act, 1947; and accordingly, has prayed that his termination be declared illegal and he be reinstated with

consequential benefits including full back wages.

The management of the Bank has filed its written statement; wherein it has submitted that the workman

had never been employed by the Bank as daily wager on the post of Messenger, therefore, there was no

relationship of employee and employer between the workman and the Bank. The management has submitted

that since the workman had never been in employment of the Bank, therefore, there arises no question of

termination of his services in violation of any of the provisions of the I.D. Act. Accordingly, the management

has prayed that the claim of the workman be rejected being devoid of any merit.

The workman has filed its rejoinder; wherein it has reiterated the averments already made in the

statement of claim.

The parties filed documents in support of their respective case. After filing of the parties’ documents,

the workman was called upon to adduced oral evidence; whereupon the workman filed his oral evidence in

shape of affidavit, paper No. W-19; but the workman never turn up for his cross-examination, leading to closure

of his opportunity for getting himself cross-examined vide order dated 15.11.2017; thereafter, the management

was asked to lead its evidence in support of its pleadings; but the management denied to adduce any oral

evidence in wake of non-cross-examination of the workman. Accordingly next date was fixed for arguments.

When the workman did not turn on several dates, ex-parte arguments of the management had been heard.

Heard learned authorized representative of the management at length and perused entire material

placed on file and scanned each and every document available therein.

It is well settled that if a party challenges the legality of order, the burden lies upon it to prove illegality

of the order and if no evidence is produced by the party, invoking jurisdiction of the court, must fail. In the

present case burden was on the workman to set out the grounds to challenge the validity of the action of the

management in terminating his services.

It was the case of the workman that he was appointed by the opposite party and after having worked

continuously for more than 16 years his services have been terminated orally without any notice or notice pay in

lieu thereof or any retrenchment compensation in violation to the provisions contained in Section 25 F of the

Industrial Disputes Act, 1947. Since the management has denied the claim of the workman out rightly,

therefore, in the event of its denial, the burden was on the workman to prove its pleadings that he had been

employed by the management of the Bank and also that he worked continuously for 240 days in twelve calendar

months preceding the date of his alleged termination. Hence it was for the workman to lead evidence,

documentary as well as oral, to show that the alleged injustice was being done to the workman.

In 2008 (118) FLR 1164 M/s. Uptron Powertronics Employees’ Union, Ghaziabad through its

Secretary vs. Presiding Officer, Labour Court (II), Ghaziabad & others, Hon’ble High Court relied upon the

law settled by the Apex Court in 1979 (39) FLR 70 (SC) Sanker Chakravarti vs. Britannia Biscuit Co. Ltd.,

1979 (39) FLR 70 (SC) V.K. Raj Industries v. Labour Court and others, 1984 (49) FLR 38 Airtech Private

Limited v. State of U.P. and others and 1996 (74) FLR 2004 (Alld.) Meritech India Ltd. v. State of U.P. and

others; wherein it was observed by the Apex Court:

“that in absence of any evidence led by or on behalf of the workman the reference is bound to be

answered by the Court against the workman. In such a situation it is not necessary for the

employers to lead any evidence at all. The obligation to lead evidence to establish an allegation

made by a party is on the party making the allegation. The test would be, who would fail if no

evidence is led.”

In the present case the workman has not turned up to substantiate its case by way of filing any oral

evidence. Mere pleadings are no substitute for proof. It was obligatory on the part of workman to come

forward with the case that the workman was actually appointed by the opposite party and his services have been

terminated orally without any notice or notice pay in lieu thereof or any retrenchment compensation in violation

to the provisions contained in Section 25 F of the Industrial Disputes Act, 1947; but the workman’s union has

failed to forward any substantive evidence in support of its claim, as he did not turn up for his cross-examination

before this Tribunal, in spite of ample opportunity being provided to him. There is no reliable material for

recording findings that the alleged injustice was done to the workman or the action of the management of the

Bank was unjustified and illegal.

Accordingly, the reference is adjudicated against the workman; and as such, I come to the conclusion

that the workman, Jeevan Prasad Gupta is not entitled to any of the relief(s) claimed by him.

“Whether the action of the management of Food Corporation of India is erroneous and with

malafide intention in effecting transfer orders given by a very higher authority in respect of 112

number (4+4 no. of gangs) of un-skilled manual workmen from FSD Chanpatia to FSD,

Muzaffarpur and vice-versa? If so, what remedy can be given to workmen under transfer?”

2. After receipt of the reference, both parties were noticed but the workman/union didn’t appear before the

Tribunal. However the management has appeared in this case, but subsequently both of them left appearing

before the Tribunal. Thereafter again regd. notice was issued to workman/union which returned without service.

Now the Case is pending since 18/02/2013 and workman/union is not appearing before Tribunal. so, it is felt

that workman/union has lost its interest in this matter. Hence No Dispute Award is passed. Communicate.

called the Act), has referred the following Industrial dispute for adjudication to this Tribunal:-

“Whether the action of management of BBMB in not accepting the demand of Sh. Sarwan Singh

S/o Shri Jawahar Lal for deeming/considering him in continuous service upto age of

superannuation and resultantly entitled for consequential benefits is legal, just and valid? If not,

to what relief the workman concerned is entitled to and from which date?

On the receipt of the above reference, notices are sent to the workman Sarwan Singh vide letters dated

11.09.2019 and 15.05.2020 which are received back with the report about the death of the workman which is

received at the back of both the notices which are on record.

Perusal of file reveals that none turned up on behalf of the LRs of the deceased-workman Sarwan

Singh for a long time which indicates that legal LRs of the deceased-workman Sarwan Singh are not interested

in contesting the case as such, reference stands abetted, resulting the case of no evidence.

Since the workman is dead and his legal LRs are not interested in contesting the case so as to prove the

cause against the managements/respondents, as such, this Tribunal is left with no choice, except to pass a ‘No

Dispute/Claim Award’. It is also clarified that passing of the no claim award/no dispute award would not bar the

LRs of the deceased-workman Sarwan Singh from approaching the Appropriate Government/this Tribunal for

adjudication of this case on merits or filing any fresh claim. Let copy of this award be sent to the Appropriate

Government as required under Section 17 of the Act for publication.

received. The reference is made to this Tribunal under Section -10 of I.D.Act, 1947 as per Notification

No. L-41012/36/2015-IR(B-1) The dispute under reference relates to:

“Whether the action of the management of Divisional Railway Manager, West Central Railway,

Jabalpur in terminating the services of Shri Grijesh Prasad, Ex-casual Labour S/o Dhanraj Prasad

w.e.f. 21-8-1982 is legal and justified?if not , what relief the workman is entitled to? .”

1. After registering the case on the basis of reference, notices were sent to the parties.

2. The workman side never appeared and did not file any statement of claim whereas the Management side filed

its statement of defence along with two documents.

3. The workman side never appeared during the hearing inspite of notice, hence the case was ordered to be

proceeded ex-parte against the workman vide order dated 13-8-2019.

4. Mr. A.K. Shashi, learned counsel for the Management has submitted his arguments on behalf of

Management.

5. None was present for the workman.

6. I have gone through the record.

7. The reference is the point for determination in the case in hand.

8. It is the case of the Management that the workman was never engaged as casual labour from 20-5-1980 to

20-8-1982 for 240 days as claimed by workman during conciliation proceedings. It has also been pleaded that

vide notification dated 30-8-2000 applications were invited from Ex-Casuals and certain documents were

required from them in support of their claim. Notices were issued to the present workman also. He never

appeared in response to the notice nor he filed any documents with respect of his claim. The Management

witness Dharmendra Weekey has supported the case of Management in his affidavit which is uncontroverted.

9. In the light of the above facts and circumstances stated above there is nothing on record to hold the claim of

workman proved as the workman has miserably failed to discharge his burden in this case, moreover the alleged

dismissal is of August-1982, hence highly delayed for which there is no justification. Hence holding the claim

of the workman not proved the reference deserves to be answered against the workman.

10. On the basis of the above discussion, following award is passed:-

The action of the management of Divisional Railway Manager, West Central Railway,

Jabalpur in terminating the services of Shri Grijesh Prasad, Ex-casual Labour S/o Dhanraj

Prasad w.e.f. 21-8-1982 is held justified in law and fact.

The workman is held entitled to no relief.

Let the copies of the award be sent to the Government of India, Ministry of Labour & Employment as

per rules.

The Central Government, Ministry of Labour & Employment vide its Order No. L-12012/28/2017-IR

(B.I) dtd. 26.10.2017 referred the following Industrial Dispute to this Tribunal for adjudication.

The schedule mentioned in that order is:

“Whether the action of the Management of State Bank of India, Zonal Office, Madurai in dismissing

Sri A. Jeyakumar, an Ex-Messenger / Peon from service w.e.f. 26.08.2013 is legal and justified? If not,

to what relief the workman is entitled to?”

On receipt of the above reference from the appropriate Government registered as ID No. 99/2017 and

notices were issued to both the parties for their appearance fixing the case to 02.01.2018. Since then, the case is

dragged for such a long period till 27.01.2020 intervening almost 7 adjournments in the year 2018, 8

adjournments in the year 2019 and then finally it was posted to 27.01.2020 for appearance. It appears even if for

the interest of justice the Tribunal suo-moto afforded sufficient opportunities to the Petitioner, there was no

progress in the proceeding. It appears even if sufficient opportunities were made available to the Petitioner, he

did not turn up on the dates posted for appearance and also failed to file his Claim Statement. Thus, it is held

that the Petitioner as referred in the reference is not interested to proceed with his Claim raised in the dispute.

The non-cooperation and default in appearance of the Petitioner constrained the Tribunal not to repost the

proceeding to any other date for the same purpose.

In view of the discussion held in preceding paragraphs, it deems there exists no dispute for adjudication

as referred by the Appropriate Government.

In the result the reference is answered against the petitioner.

An Award is passed accordingly.

1. After registering the case on the basis of reference, notices were sent to the parties.

2. The workman never appeared in any of the cases inspite of notice. They did not file any statement of

claim nor did they file any evidence documentary or oral. The case was ordered to be proceeded

ex-parte against the workman.

3. The Management has filed written statement of defense wherein it has been pleaded that firstly the

workman are not in the category of workman as defined under section 2(s) of the Industrial Disputes

Act, 1947, secondly they were all appointed on contractual basis in Out bond Sales Team for selling

the policies of the Management on terms and conditions laid down in the appointment contract. A

policy decision was taken by the Management to close the Scheme vide its resolution of the Board of

Director’s in its meeting dated 7-3-2013. Secondly the workman were given 90 days notice and their

services were dispensed with. Accordingly, the Management has prayed that the reference be

answered against the workman in all these cases.

4. The Management has filed affidavit of its witness in all the cases separately reiterating its pleadings.

5. Since all these cases are mainly on same fact and evidence as well as the pleadings also the same,

hence they are being disposed by a common award.

6. I Have heard the arguments of learned counsel for Management Shri Arun Patel and none appeared

for the workman.

7. The references are the point for determination in these cases in hand.

8. The burden to prove their case lies on the workman in which they have miserably failed. On the other

hand, the Management has successfully proved its pleadings on which it is established that the

disengagement of the applicant’s/workman is not unjustified in law and fact. Accordingly they are

held entitled to no relief.

9. The references are answered accordingly. A copy of Award be kept in all the case files.

10. On the basis of the above discussion, following award is passed:-

The action of the management IDBI Intech Ltd in terminating the services of Shri Avinash

Budholiya, Shri Dheeraj Singh Pawar, Shri Liyakat Qureshi, Ms. Archana Rathore,

Shri Yogesh Jain, Shri Hamood Riyaz Hashmi and Shri Shazi Shakil Hashmi is held to be

just and proper.

They are is held entitled to no relief.

11. Let the copies of the award be sent to the Government of India, Ministry of Labour & Employment as

per rules.
