अ. ऄ. 121.— यतः, भारत जनवााचन अय ग द्वारा मध्य प्रदेि राज् य क जवधान सभा के साधारण जनवााचन, 2018

क घ षणा प्रेस न ट सं्‍या इसीअइ/प्रे.न ./66/2018 ददनांक 06.10.2018 के िररए क गइ थी। कायाक्रम के ऄनुसार,

मतगणना क तारीख 11.12.2018 थी।

और यत:, ल क प्रजतजनजधत्व ऄजधजनयम, 1951 क धारा 78 के ऄनुसार, जनवााचन ल़ने वाले प्रत् येक ऄयरयथक क ,

जनवााजचत ऄयरयथक के जनवााचन क तारीख से 30 ददनों के भीतर जनवााचन व्यय के ऄृने लेखे क सही प्रजत जिला जनवााचन

ऄजधकारी क दाजखल करनी ह ती है;

और यतः, संबंजधत ररटर्ननग ऄजधकारी द्वारा 190-ब़वानी (ऄ.ि.िा) जवधान सभा जनवााचन क्षेे्र के ृररणाम

11.12.2018 क घ जषत दकए गए थे। आस प्रकार, जनवााचन व्यय के लेखा दाजखल करने क ऄजन्तम तारीख 10.01.2019

थी।

और यतः, मु्‍य जनवााचन ऄजधकारी, मध्य प्रदेि के ददनांक 29.01.2019 के ृ्र सं.10-क/चार/जनवाा.व्यय-

लेखा/42-ब़वानी/2019/1265 द्वारा ऄग्रेजषत जिला जनवााचन ऄजधकारी,ब़वानी जिला, मध्य प्रदेि द्वारा ददनांक

21.01.2019 क प्रस्ट्तुत ररृ टा के ऄनुसार श्री चन्दन, मध्य प्रदेि के 190-ब़वानी (ऄ.ि.िा.) जवधान सभा जनवााचन क्षेे्र

से जनवााचन ल़ने वाले अम अदमी ृाटक के ऄयर यथक, ऄृने जनवााचन व् यय का क इ भी लेखा दाजखल करने में ऄसलल रहे ।

और यतः, जिला जनवााचन ऄजधकारी, ब़वानी जिला, मध्य प्रदेि क ररृ टा ददनांक 25.01.2020 के अधार ृर

भारत जनवााचन अय ग द्वारा जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईृ जनयम (5) के ऄंतगात जनवााचन व्यय

लेखा प्रस्ट्तुत नहीं करने के जलए श्री चन्दन क कारण बताओ न रटस ददनांक 27.02.2020 िारी दकया गया था;

और यत:, जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईृ-जनयम (6) के ऄनुसार, ददनांक 27.02.2020

के ईृयुाक् त कारण बताओ न रटस के िररए श्री चन्दन क जनदेि ददया गया था दक वे आस न रटस के प्राप् त ह ने के 20 ददनों के

ऄंदर अय ग में लेखे न प्रस्ट् तुत कर ृाने के कारणों क स्ट् ृ्‍ ट करते ुएए जलजखत रूृ में ऄृना ऄयर यावेदन प्रस्ट् तुत करें और साथ

ही, ृूणा जनवााचन व् यय का लेखा संबंजधत जिला जनवााचन ऄजधकारी क प्रस्ट् तुत करें;

और यत:, ईक् त न रटस श्री चन्दन द्वारा 06.03.2020 क प्राप् त दकया था। ऄयर यथक से प्राप् त ृावती रसीद जिला

जनवााचन ऄजधकारी, ब़वानी द्वारा ददनांक 21.05.2020 के ृ्र सं्‍ या 331/जव.स. जनवााचन/व्यय-लेखा /2020 द्वारा

अय ग क प्रस्ट् तुत कर दी गइ है;

और यत:, जिला जनवााचन ऄजधकारी, ब़वानी द्वारा ऄृने ददनांक 21.05.2020 के ृ्र सं. 331/जव.स.

जनवााचन/व्यय- लेखा /2020 के तहत प्रस्ट् तुत क गइ ऄनुृूरक ररृ टा में यह बताया गया है दक श्री चन्दन ने अि क तारीख

तक न त क इ भी ऄयर यावेदन और न ही मूल वाईचरों अदद के साथ जवजधवत रूृ से हस्ट् ताक्षेररत ऄृने जनवााचन व् यय के सही

लेखे का जववरण प्रस्ट् तुत दकया है। आसके ऄजतररक् त, ईन् होंने भारत जनवााचन अय ग का सम् यक् न रटस जमलने के ईृरांत भी

ईक् त ऄसललता के जलए न त क इ कारण बताया है और न ही क इ स्ट् ृ्‍ टीकरण ददया है;

और यत:, अय ग का यह समाधान ह गया है दक श्री चन्दन, जनवााचन व्यय का लेखा दाजखल करने में ऄसलल रहे हैं

और ईनके ृास आस ऄसललता के जलए क इ भी ईजचत कारण ऄथवा न्याय जचत्य नहीं है;

और यत:, ल क प्रजतजनजधत् व ऄजधजनयम, 1951 क धारा 10क में ऄनुबंजधत दकया गया है दक:-

‘‘यदद जनवााचन अय ग का समाधान ह िाता है दक क इ व् यजि-

(क) जनवााचन व् ययों का लेखा ईस समय के भीतर और ईस रीजत में िैसी आस ऄजधजनयम के द्वारा या ऄधीन ऄृेजक्षेत है,

दाजखल करने में ऄसलल रहा है; तथा

(ख) ईस ऄसललता के जलए क इ ऄच् ोा कारण या न् याय जचत् य नहीं रखता है, त जनवााचन अय ग िासक य रािृ्र में

प्रकाजित अदेि द्वारा ईसक जनरर्हहत घ जषत करेगा और ऐसा व् यजि ईस अदेि क तारीख से तीन वषा क

कालावजध के जलए जनरर्हहत ह गा;

ऄत:, ऄब ल क प्रजतजनजधत् व ऄजधजनयम, 1951 क धारा 10क के ऄनुसरण में भारत जनवााचन अय ग एतद्द्वारा,

मध्य प्रदेि राज् य क जवधान सभा के साधारण जनवााचन, 2018 के 190-ब़वानी(ऄ.ि.िा) जवधान सभा जनवााचन क्षेे्र से

जनवााचन ल़ने वाले अम अदमी ृाटक के ऄयर यथक, श्री चन्दन , जनवासी 26, ग्राम जृो ़ी, ृ स्ट्ट सोंदुल, तह0 ब़वानी,

जिला ब़वानी, मध्य प्रदेि क संसद के दकसी भी सदन ऄथवा राज्य ऄथवा संघ राज्य क्षेे्र क जवधानसभा ऄथवा जवधान

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 3rd December, 2020

O. N. 121.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate

has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer, from the

date of election of returned candidate;

AND WHEREAS, the result of 190-Barwani (ST) Assembly Constituency was declared by the Returning

Officer concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 21.01.2019 submitted by the District Election Officer, Barwani

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec.Expenditure Account/42-Barwani /2019/1265 dated 29.01.2019, Shri Chandan, Aam Admi Party contesting

candidate from 190-Barwani (ST) Assembly Constituency of Madhya Pradesh, failed to lodge any account of his

election expenses as required by law.

AND WHEREAS, on the basis of the report dated 25.01.2020 of the District Election Officer, Barwani District,

Madhya Pradesh, a Show Cause notice dated 27.02.2020 was issued by the Election Commission of India under Sub

Rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Chandan for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 27.02.2020, Shri Chandan was directed to submit his representation in writing to the

Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of election

expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Chandan on 06.03.2020. Acknowledgment receipt

obtained from the candidate have been submitted to the Commission by District Election Officer, Barwani vide his letter

No. 331/L.A. Election/Expenditure-Account/2020/1566 dated 21.05.2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Barwani vide his letter

No. 331/L.A. Election/Expenditure-Account/2020 dated 21.05.2020 it has been stated that Shri Chandan has not

submitted any representation or a statement of correct account of his election expenses, duly signed along with original

vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt

of the due notice to the Election Commission of India as well;

AND WHEREAS,Commission is satisfied that Shri Chandan has failed to lodge an account of election

expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order;

NOW THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission of India hereby declares Shri Chandan, resident of 26, Gram Pichhodi, Post Soundul, Teh.- Barwani,

District-Barwani, Madhya Pradesh, the contesting candidate of Aam Admi Party for the General Election to the

Legislative Assembly of Madhya Pradesh, 2018 from 190-Barwani (ST) Assembly Constituency, to be disqualified for

being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative

Council of a State or Union Territory for a period of three years from the date of this order.
