क्षेे्र से सािारण जनवााचन, 2017 की घ षणा प्रेस न ट सं्‍ ा ईसीआई/प्रे.न ./1/2017 दिनांक 4 िनवरी, 2017 के िररए

की गई थी; और

त:, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 78 के अनुसार, जनवााचन ल़ने वाले प्रत् ेक अभ् थी क ,

जनवााजचत अभ् थी के जनवााचन की तारीख से 30 दिनों के भीतर जनवााचन व्य के अपने लेखे की सिी प्रजत संबजन्ित जिला

जनवााचन अजिकारी क िाजखल करनी ि ती िै;

त:, 80-जसकन्िरा राऊ जविान सभा जनवााचन क्षेे्र के ररटर्निंग अजिकारी द्वारा उक्त जविान सभा क्षेे्र से जनवााचन

के पररणाम दिनांक 11 माचा, 2017 क घ जषत दकए गए थे और इस प्रकार, जनवााचन व्य का लेखा िाजखल करने की

अजन्तम तारीख 10 अप्रैल, 2017 थी; और

त:, जिला जनवााचन अजिकारी, िाथरस जिला, उत्तर प्रिेि द्वारा प्रस्ट्तुत दिनांक 12 अप्रैल, 2017 की ररप टा के

अनुसार, उत्तर प्रिेि के 80-जसकन्िरा राऊ जविान सभा जनवााचन क्षेे्र से जनवााचन ल़ने वाले अभ् थी श्री श्रीचन्र अपने

जनवााचन व्य का सिी लेखा जवजि द्वारा थापेजक्षेत रीजत से िाजखल करने में जवफल रिे िैं; और

त:, जिला जनवााचन अजिकारी, की उक्त ररप टा के आिार पर भारत जनवााचन आ ग द्वारा जनवााचनों का संचालन

जन म, 1961 के जन म 89 के उप जन म (5) के अंतगात श्री श्रीचन्र क दिनांक 18 अक्तूबर, 2018 क जनवााचन व्य का

लेखा जनम्नजलजखत ्र ुरट ों के साथ िाजखल करने िेतु कारण बताओं न रटस नं. 76/उ.प्र.-जव.स./80/भा.जन.आ./

न रटस/टेरी./उ.अनु.-III-उ.प्र./2017 िारी दक ा ग ा था:-

(1) जनवााचन व्य की मिों के सन्िभा में जबल वाउचर प्रस्ट्तुत निीं दक े ग े िैं ।

(2) बैंक स्ट्टेटमेन्ट प्रस्ट्तुत निीं दक ा ग ा िै; और

त:, जनवााचनों का संचालन जन म, 1961 के जन म 89 के उप जन म (6) के अनुसार एवं उप ुाक्त कारण बताओ

न रटस के द्वारा श्री श्रीचन्र क जनिेि दि ा ग ा था दक वे इस न रटस के प्राप्त ि ने के 20 दिनों के भीतर लेखा िाजखल निीं

करने के कारणों क स्ट्पष्ट करते हुए जलजखत रूप में अपना अभ् ावेिन जनवााचन आ ग के समक्षे प्रस्ट्तुत करें और साथ िी उक्त

्र ुरट ों क िूर करते हुए अपना जनवााचन व्य ों का लेखा जिला जनवााचन अजिकारी, िाथरस के समक्षे प्रस्ट्तुत करें; और

त:, जिला जनवााचन अजिकारी, िाथरस जिला, द्वारा भारत जनवााचन आ ग क प्रस्ट्तुत की गई पावती रसीि के

अनुसार, उक्त न रटस श्री श्रीचन्र क दिनांक 29 दिसम्बर, 2019 क तामील दक ा ग ा था; और

त:, जिला जनवााचन अजिकारी, िाथरस ने दिनांक 7 अगस्ट्त, 2020 की अपनी अनुपूरक ररप टा में ि बता ा िै

दक श्री श्रीचन्र द्वारा अभी तक क ई िवाब निीं दि ा ग ा िै और मूल वाउचर सजित िस्ट्ताक्षेररत जनवााचन व्य के सिी लेखे

का जववरण प्रस्ट्तुत निीं दक ा ग ा िै; और

तः, भारत जनवााचन आ ग द्वारा अभ् थी श्री श्रीचन्र क अंजतम अवसर प्रिान करते हुए प्र सं० 76/उ.प्र.-

जव.स./80/भा.जन.आ./प्र /टेरी./उ.अनु.-III-उ.प्र./2017, दिनांक 18 अगस्ट्त, 2020 िारी दक ा ग ा, ि जिला जनवााचन

अजिकारी, िाथरस के माध् म से उनकी पत्नी दकरन िेवी क दिनांक 4 जसतम्बर, 2020 क श्री श्रीचन्र द्वारा नामांकन प्र में

ििाा े ग े पते पर तामीला दक ा ग ा था; और

त:, जिला जनवााचन अजिकारी, से प्राप्त दिनांक 18 दिसम्बर, 2020 की ररप टा के अनुसार श्री श्रीचन्र द्वारा उक्त

कजम ों क सुिारते हुए न त क ई लेखा िमा दक ा ग ा िै न िी क ई अभ् ावेिन प्रस्ट्तुत दक ा ग ा िै | इसके अजतररक्त,

उक्त न रटस/प्र जमलने के उपरांत भी अभ् थी द्वारा उक्त जवफलता के जलए भारत जनवााचन आ ग के समक्षे क ई कारण

अथवा स्ट्पष्टीकरण प्रस्ट्तुत निीं दक ा ग ा िै; और

त:, तथ् ों और उपलब्ि िस्ट्तावेिों के आिार पर, आ ग का ि समािान ि ग ा िै दक श्री श्रीचन्र जवजित प्रप्र

में अपने जनवााचन व्य का लेखा िाजखल करने में जवफल रिे िैं और उनके पास इस जवफलता के जलए क ई भी उजचत कारण

अथवा औजचत् निीं िै; और

त:, ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 10क में अनुबंजित दक ा ग ा िै दक :-

“ दि जनवााचन आ ग का समािान ि िाता िै दक क ई व्यजक्त –

(क) जनवााचन व्य ों का लेखा उस सम के भीतर और उस रीजत में िैसी इस अजिजन म के द्वारा ा अिीन अपेजक्षेत

िै, िाजखल करने में जवफल रिा िै; तथा

(ख) उस जवफलता के जलए क ई अच्ोा कारण ा औजचत् निीं िै,

त जनवााचन आ ग िासकी रािप्र में प्रकाजित आिेि द्वारा उसक जनरहििात घ जषत करेगा और ासा व्यजक्त उस आिेि की

तारीख से तीन वषा की कालावजि के जलए जनरहििात ि गा ।”;

अत:, अब ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 10क के अनुसरण में भारत जनवााचन आ ग एतिद्वारा

घ षणा करता िै दक श्री श्रीचन्र, जनवासी ग्राम हुसैनपुर, तिसील जसकन्िराराऊ, जिला िाथरस, उत्तर प्रिेि, ि उत्तर प्रिेि

जविान सभा सािारण जनवााचन, 2017 में 80-जसकन्िरा राऊ जविान सभा जनवााचन क्षेे्र से जनवााचन ल़ने वाले अभ् थी थे,

इस आिेि की तारीख से तीन वषा की अवजि के जलए संसि के दकसी भी सिन अथवा राज् अथवा संघ राज् -क्षेे्र की जविान

सभा अथवा जविान पररषि का सिस्ट् चुने िाने अथवा ि ने के जलए जनरहििात िोंगे ।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 7th January, 2021

O. N. 01 .—WHEREAS, the General Election for 80-Sikandra Rao Assembly Constituency of Uttar Pradesh,

2017 was announced by the Election Commission of India vide Press Note No. ECI/PN/1/2017 dated 4^th January, 2017;

and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to

lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from

the date of election of the returned candidate; and

WHEREAS, the result of the election for 80-Sikandra Rao Assembly Constituency was declared by the

Returning Officer on 11^th March, 2017 and hence the last date for lodging the accounts of election expenses was

10^th April, 2017; and

WHEREAS, as per the report dated 12^th April, 2017 submitted by the District Election Officer, Hathras District,

Uttar Pradesh, Sh. Shrichandra, a contesting candidate from 80-Sikandra Rao Assembly Constituency of Uttar Pradesh

has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP-

LA/80/ECI/Notice/TERR/NS-III-UP/2017, dated 18^th October, 2018 was issued under sub rule (5) of Rule 89 of the

Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Shrichandra, for the following defects in

accounts of his election expenses:-

(i)

Bill vouchers were not presented in respect of items of election expenditure.

(ii) Bank Statement was not submitted; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of Rule 89 of the

Conduct of Election Rules, 1961, Sh. Shrichandra was directed to submit his representation in writing to the

Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to

lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Hathras within 20

days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District

Election Officer, Hathras, the said notice was served on Sh. Shrichandra on 29^th December, 2019; and

WHEREAS, the District Election Officer, Hathras has submitted in his supplementary report, dated 7^th August,

2020 that Sh. Shrichandra, has not submitted any representation or a statement of correct account of his election

expenses duly signed, along with original vouchers etc. till that date; and

WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide

Commission’s letter No. 76/UP-LA/80/ECI/LET/TERR/NS-III-UP/2017, dated 18^th August, 2020, which was served on

his wife Kiran Devi on 4^th September, 2020 through the District Election Officer, Hathras at the address provided by the

candidate in the nomination papers; and

WHEREAS, as per the report, dated 18^th December, 2020 submitted by the District Election Officer to the

Commission, Sh. Shrichandra has neither rectified the above mentioned defects nor any representation has been

received from him. Further, no representation from the candidate has been received in the Secretariat of the Election

Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Shrichandra has

failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason or

justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

“If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under

this Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.”;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission of India hereby declares Sh. Shrichandra, resident of Village- Husainpur, Tehsil Sikandra Rao, District

Hathras, Uttar Pradesh and a contesting candidate from 80-Sikandra Rao Assembly Constituency of the State of Uttar

Pradesh in the General Elections to the State Legislative Assembly, 2017, to be disqualified for being chosen as and for

being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union

Territory for a period of three years from the date of this order.

अतः, अब ल क प्रजतजनजित्व अजिजन म, 1951 की िारा 10-क के अनुसरण में, भारत जनवााचन आ ग,

अि जलजखत सारणी के स्ट्तंभ (4) में जवजनर्िाष्ट व्यजक्त ों क इस आिेि की तारीख से तीन वषा की अवजि के जलए संसि के

दकसी भी सिन ा राज् की जविानसभा अथवा जविान पररषि के जलए सिस्ट् के रूप में चुने िाने ा सिस्ट् ि ने के जलए

WHEREAS, the result of the election for 80-Sikandra Rao Assembly Constituency was declared by the

Returning Officer on 11^th March, 2017 and hence the last date for lodging the accounts of election expenses was

10^th April, 2017; and

WHEREAS, as per the report dated 12^th April, 2017 submitted by the District Election Officer, Hathras District,

Uttar Pradesh, Sh. Raj Shekhar Sengar, a contesting candidate from 80-Sikandra Rao Assembly Constituency of Uttar

Pradesh has failed to lodge accounts of his election expenses, in the manner prescribed under the law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/UP-

LA/80/ECI/Notice/TERR/NS-III-UP/2017, dated 18^th October, 2018 was issued under sub rule (5) of Rule 89 of the

Conduct of Election Rules, 1961 by the Election Commission of India to Sh. Raj Shekhar Sengar, for the following

defects in accounts of his election expenses:-

(i)

Bill vouchers were not presented in respect of items of election expenditure.

(ii) Bank Statement was not submitted; and

WHEREAS, through the above said Show Cause Notice and as required under sub rule (6) of Rule 89 of the

Conduct of Election Rules, 1961, Sh. Raj Shekhar Sengar was directed to submit his representation in writing to the

Commission explaining the reason for the above said shortcomings in his accounts of election expenses and also to

lodge the accounts, after rectifying the above mentioned defects, with the District Election Officer, Hathras within 20

days from the date of receipt of the notice; and

WHEREAS, as per the acknowledgement receipt made available to the Election Commission by the District

Election Officer, Hathras, the said notice was served on Sh. Raj Shekhar Sengar on 29^th December, 2018; and

WHEREAS, the District Election Officer, Hathras has submitted in his supplementary report, dated 7^th August,

2020 that Sh. Raj Shekhar Sengar, has not submitted any representation or a statement of correct account of his

election expenses duly signed, along with original vouchers etc. till that date; and

WHEREAS, the candidate was given last opportunity to rectify the defects found in his accounts, vide

Commission’s letter No. 76/UP-LA/80/ECI/LET/TERR/NS-III-UP/2017, dated 18^th August, 2020, which was served on

him on 31^st October, 2020 through the District Election Officer, Hathras; and

WHEREAS, as per the report, dated 18^th December, 2020 submitted by the District Election Officer to the

Commission, Sh. Raj Shekhar Sengar has neither rectified the above mentioned defects nor any representation has

been received from him. Further, no representation from the candidate has been received in the Secretariat of the

Election Commission of India, after delivery of the above mentioned notice/letter; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Raj Shekhar

Sengar has failed to lodge his accounts of election expenses in the manner prescribed under law and has no good reason

or justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

“If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by or under

this Act; and

(b) Has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.”;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission of India hereby declares Sh. Raj Shekhar Sengar, resident of Village- Hansgari, Post Hasona

Jagmohanpur, District Aligarh, Uttar Pradesh and a contesting candidate from 80-Sikandra Rao Assembly Constituency

of the State of Uttar Pradesh in the General Elections to the State Legislative Assembly, 2017, to be disqualified for

being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative

Council of a State or Union Territory for a period of three years from the date of this order.
