सा.का.जन. 05.— रा् रपजत, संजवधान के ऄनछ छेद 309 के परन् तक ्ारा प्रदत श िजियों का प्रयोग करते हुए, और
पंजाब पजलस सेवा जनयम, 1959 को, जहां तक ईसका संबंध चंडीगढ संघ रा य क्षेत्र के जलए पजलस ईप-ऄधीक्षक के पद को
भरे जाने से हज, ईन बातों के जसवाय जजन्हें ऐसे ऄजधक्रमण से पहले दकया गया हज या करने का लोप दकया गया हज, गषह मंत्रालय
के ऄधीन चंडीगढ़ संघ रा य क्षेत्र के पजलस जवभाग में पजलस ईप-ऄधीक्षक के पद पर भती की पद्धजत का जवजनयमन करने के
जलए जनम नजलजखत जनयम बनाते हैं, ऄथागत्:-

1.
संजक्षप् त नाम और प्रारंभः -
(1)
आन जनयमों का संजक्षप्त नाम पजलस ईप-ऄधीक्षक, पजलस जवभाग, चंडीगढ़ संघ रा य क्षेत्र भती
जनयम, 2021 हज;
(2)
ये राजपत्र में प्रकािन की तारीख से प्रवषत श होंगे।
2.
पद की सं् या, वगीकरण और वेतनमानः- पद की सं् या, ईसका वगीकरण और ईससे संबंजधत वेतनमान
वह होगा जो आन जनयमों से ईपाबद्ध ऄनसूची के स्ट् तम भ (2) से स्ट् तम भ (4) में जवजनर्दद् ट हैं।

संवगग ऄथागत् पजलस ईप-ऄधीक्षक की ऄजधकषत सं्या 23 हो जाएगी जजसमें पजलस ईप-ऄधीक्षक
के जवद्यमान 14 पद और आंजडया ंरजवग बटाजलयन के 07 पद एवं 01 संवगग-बाह्य पद (जविेष
कायग ऄजधकारी –पजलस ईप-ऄधीक्षक –सतकगता) और 01 संवगग बाह्य पद (जडस्ट्रकट कमांडेट होम
गाडग) िाजमल हैं। ये 09 पद (07 आंजडया ंरजवग बटाजलयन+02 संवगग –बाह्य) आन जनयमों की
ऄजधसूचना की तारीख से पजलस ईप-ऄधीक्षक के ग्रेड में संवर्गगत हो जाएंगे;
(2)
संवगग प्राजधकारी कायगभार में जभन् नता के अधार पर, प्राजधकषत सं्या में ऐसा पंरवतगन कर सकता
हज जो वह समय-समय पर अवश् यक समझे।
3.
संवगग से ड्यूटी पदों का ऄपवजगनः- संवगग प्राजधकारी ्ारा संवगग से ग्रेड के दकसी भी ड्यूटी पद को
ऄपवर्गजत घोजषत दकया जा सकता हज यदद ऐसे पद को, तत् समय, जविेष या तकनीकी ऄहगता ऄथवा ऄनभव रखने
वाले व् यजियों की जनयजि से भरा जाना ऄपेजक्षत हज।
4.
भती की पद्धजत, अय सीमा ऄहगताएं अददः - ईक् त पद पर भती की पद्धजत, अय-सीमा, ऄहगताएं और
ईससे संबंजधत ऄन् य बातें वें होंगी जो पूवोि ऄनसूची के स्ट् तम भ (5) से स्ट् तम भ (13) में जवजनर्दद् ट हैं।
5.
जनरहगताः - वह व् यजि-
(क)
जजसने ऐसे व् यजि से जजसका पजत या जजसकी पत् नी जीजवत हज, से जववाह दकया हज या जववाह की
संजवदा की हज; या
(ख) जजसने ऄपने पजत या ऄपनी पत् नी के जीजवत रहते हुए दकसी व् यजि से जववाह दकया हज या जववाह
की संजवदा की हज, ईक् त पद पर जनयजि का पात्र नह होगा :
परन् त यदद केन् रीय सरकार का यह समाधान हो जाता हज दक ऐसा जववाह ऐसे व् यजि और जववाह के ऄन् य
पक्षकार को लागू स्ट् वीय जवजध के ऄधीन ऄनज्ञेय हज और ऐसा करने के जलए ऄन् य अधार हैं तो वह दकसी व् यजि को
आस जनयम के प्रवतगन से छूट दे सकेगी।
6.
अरंजभक ग न: - आन जनयमों के ईपबंधों में ऄंतर्गवष्ट दकसी बात के होते हुए भी ऐसे व्यजि जो पंजाब
पजलस सेवा जनयम, 1959 के ईपबंधों के ऄधीन चंडीगढ़ संघ रा य क्षेत्र में पजलस ईप-ऄधीक्षक (डीएसपी) का पद
धारण दकए हुए हैं आन जनयमों के ईपबंध के ऄनसार पजलस ईप-ऄधीक्षक के पदों पर जनयक् त दकया गया समझा
जाएगा। पंजाब पजलस सेवा जनयम, 1959 के ईपबंधों के ऄनसार चंडीगढ़ प्रिासन के ऄधीन जनयक् त दकए गए
चंडीगढ़ पजलस के पजलस ईप-ऄधीक्षक ्ारा की गइ जनयजमत सेवा की गणना आन जनयमों के प्रारंभ के समय येष्ठता
बनाए रखने के जलए की जाएगी।
7.
जिजथल करने की िजि: - जहां केन् रीय सरकार की यह राय हज दक ऐसा करना अवश् यक या समीचीन हज,
वहां वह ईसके जलए जो कारण हज लेखबध्द करके, संघ लोक सेवा अयोग से परामिग करके, आन जनयमों के दकसी
ईपबंध को, दकसी वगग या प्रवगग के व् यजियों की बाबत, अदेि ्ारा जिजथल कर सकेगी।
8.
व् यावषजत शः -
(1)
आन जनयमों की कोइ बात ऐसे अरक्षण, अय-सीमा में छूट और ऄन्य ंरयायतों पर प्रभाव नह
डालेगी जजसका केन्रीय सरकार ्ारा आस संबंध में समय-समय पर जारी दकए गए अदेिों के
ऄनसार ऄनसूजचत जाजतयों, ऄनसूजचत जनजाजतयों, भूतपूवग सजनकों और ऄन्य जविेष प्रवगग के
व्यजियों के जलए ईपबंध करना ऄपेजक्षत हज।

आन जनयमों की कोइ बात प्रोन् नजत कोटा की ंरजियों से बाहर ऄथागत् पजलस ईप-ऄधीक्षक के ग्रेड
में, ड्यूटी पदों के प प में, आंजडया ंरजवग बटाजलयन के स्ट् वीकषत पदों के ईपयोग के माध् यम से, पजलस
ईप-ऄधीक्षक के ग्रेड में प्रोन् नजतयों पर प्रभाव नह डालेगी। तथाजप, पजलस ईप-ऄधीक्षक, पजलस
जवभाग, चंडीगढ़ संघ रा य ् ेात्र भती जनयम, 2021 के प्रवषत होने के पश् चात, प्रोन् नजत कोटा से

ंटप् पण : जहां ऐसे कजनष्ठ व्यजियों के
संबंध में, जजन्होंने ऄपनी ऄहगक या
पात्रता सेवा पूरी कर ली हज, प्रोत्रजत के
जलए जवचार दकया जा रहा हो, वहां
ईनके येष्ठ व्यजियों के संबंध में भी
जवचार दकया जाएगा परंत यह तब जब
दक ईसके ्ारा की गइ ऐसी ऄहगक या
पात्रता सेवा, ऄपेजक्षत ऄहगक या सेवा के
अधे से ऄजधक से या दो वषग से, आनमें
से जो भी कम हो, कम न हो और
ईन्होंने ऄपने ऐसे कजनष्ठ व्यजियों
सजहत, जजन्होंने ऐसी ऄहगक या पात्रता
सेवा पहले ही पूरी कर ली हज, ऄगली
ईच्चतर श्रेणी में प्रोत्रजत के जलए ऄपनी
पंरवीक्षा की ऄवजध सफलतापूवगक पूरी
कर ली हो।
प्रजतजनयजि : केन् रीय सरकार या
रा य सरकारों या संघ रा य-क्षेत्रों के
ऐसे पजलस ऄजधकारी जो :-
(क) जो मूल संवगग या जवभाग में (वेतन
बैंड 3 में) वेतनमान 15,600-
39,100 प सजहत ग्रेड वेतन
5400 प या समतूल्य वेतनमान
वाले पदों में जनयजमत अधार पर
सदषि या समतल्य पदधारण दकए
हुए हैं; और
(ख) जजसके पास जवजध और अदेि और
ऄन्वेषण के क्षेत्र में तीन वषग का
ऄनभव हज।
ंटप् पण 1: पोषक प्रवगग के ऐसे
जवभागीय ऄजधकारी, जो
प्रोन् नजत की सीधी पंजि में
हैं, प्रजतजनयजि पर जनयजि
के जलए जवचार दकए जाने के
पात्र नह होंगे। आसी प्रकार,

संवगग में िाजमल दकया गया तथा ऐसे संवगग पदों की सं् या 14 हज। आसके ऄलावा, सक्षम प्राजधकारी ्ारा जवजभन् न ऄवसरों पर
पजलस ईप-ऄधीक्षक के ग्रेड में 01 संवगग- बाह्य पद (पजलस ईप-ऄधीक्षक – ओ.एस.डी. –सतकगता), 01 संवगग- बाह्य पद (जजला
कमांडेंट होमगाडग) और आंजडया ंरजवग बटाजलयन (अइअरबी) के 7 पद भी स्ट् वीकषत दकए गए थे। यह ऐसी ऄं तंरम व् यवस्ट् थाओ
को ध् यान में रखते हुए दकया गया था दक संवगग पदों से बाहर के ऐसे पदों का ईपयोग भी संघ रा य क्षेत्र प्रिासन ्ारा
सांजवजधक जनयमों में जबना दकसी संिोधन के पंजाब पजलस सेवा जनयम, 1959 के ऄधीन प्रोन् नजत अधार पर पदों को भरने के
जलए दकया गया था।

पजलस ईप-ऄधीक्षक के ग्रेड में संवगग पदों की कल स्ट् वीकषत सं् या, आस ऄजधसूचना के राजपत्र में प्रकािन की तारीख
से, 23 होगी, जजसा दक उपर बताया गया हज।

New Delhi, the 21st January, 2021
G.S.R. 05.— In exercise of powers conferred by the proviso to article 309 of the Constitution, and in
supersession of the Punjab Police Service Rules, 1959 in so far as they relate to filling up the post of Deputy
Superintendent of Police, for the union territory of Chandigarh except as respects things done or omitted to be done
before such supersession, the President hereby makes the following rules regulating the method of recruitment to the
post of Deputy Superintendent of Police in the Police Department, Union territory of Chandigarh under the Ministry of
Home Affairs, namely :–
1.
Short Title and Commencement. - (1) These rules may be called the Deputy Superintendent of Police, Police
Department, Union territory of Chandigarh Recruitment Rules, 2021. (2) They shall come into force from the date of
publication in the Official Gazette.
2.
Number of post, classification and scale of pay. - The number of post, its classification and scale of pay
attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
(1)
the authorised strength of the cadre, i.e. Deputy Superintendent of Police, shall be 23 which includes, existing
14 posts of Deputy Superintendent of Police, and 07 posts of India Reserve Battalion plus 01 ex-cadre post
(Officer on Special Duty - Deputy Superintendent of Police - Vigilance) plus 01 ex-cadre post (District
Commandant Home Guards). These 09 posts (07 India Reserve Battalion + 02 ex-cadre) will be en-cadred into
the grade of Deputy Superintendent of Police from the date of Notification of these rules;
(2)
the Cadre Authority may alter the authorised strength, as it may deem necessary from time to time, depending
on variation in the work load.
3.
Exclusion of duty posts from the cadre. - Any duty posts in the grade may be declared by the Cadre Authority
to be excluded from the cadre, if such post is required, for the time being, to be filled in by the appointment of persons
possessing special or technical qualification or experience.

4.
Method of recruitment, age-limit, qualifications etc.- The method of recruitment, age-limit, qualifications
and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.
5.
Disqualification. - No person,-
(a)
who has entered into or contracted a marriage with a person having a spouse living; or
(b)
who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for
appointment to the post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law
applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any
person from the operation of this rule.
6.
Initial Constitution. - Notwithstanding anything contained in the provisions of these rules, persons holding the
post of Deputy Superintendent of Police (DSP) in the Union territory of Chandigarh, under provisions of the Punjab
Police Service Rules, 1959 shall be deemed to have been appointed to the posts of Deputy Superintendent of Police in
accordance with the provision of these rules. The regular service rendered by the incumbent Deputy Superintendent of
Police in Chandigarh Police under Chandigarh Administration appointed in accordance with the provisions of the Punjab
Police Service Rules 1959, shall be counted in order to maintain seniority at the time of commencement of these rules.
7.
Power to Relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do, it
may, by order, for reasons to be recorded in writing, relax in consultation with the Union Public Service Commission,
any of the provisions of these rules with respect to any class or category of persons.
8. Savings. -
(1)
Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be
provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of
persons in accordance with the orders issued by the Central Government from time to time in this regard.
(2)
Nothing in these rules shall affect the promotions to the grade of Deputy Superintendent of Police, outside
the promotion quota vacancies i.e. by way of utilisation of the sanctioned posts of the India Reserve
Battalion, as duty posts, in the grade of Deputy Superintendent of Police. However, after coming into force
of the Deputy Superintendent of Police, Police Department, Union territory of Chandigarh Recruitment
Rules, 2021, all the posts outside the promotion quota, shall be restored to the prescribed quota,
immediately, after it is vacated by the promotee officer.

Note 3: The maximum age-limit for
appointment by deputation shall not be
exceeding fifty-six years as on the
closing date of receipt of applications.
Explanatory Note - The sanctioned posts of Deputy Superintendent of Police, sanctioned from time to time were
included in the cadre posts and the number of such cadre posts remains 14. In addition, 01 ex-cadre post (DSP-
OSD-Vigilance), 01 ex-cadre post (District Commandant Home Guards) and 07 posts of Indian Reserve Battalion
(IRB) were also sanctioned by the competent authority, in the grade of Deputy Superintendent of Police, on
different occasions. It was, by view of interim arrangements that such posts, outside the cadre posts, were also
utilized by the Union territory Administration for filling up on promotion basis, under the Punjab Police Service
Rules, 1959 without any amendment in the statutory rules.

The total sanctioned strength of the cadre posts, in the grade of the Deputy Superintendent of Police
shall be 23 from the date of publication of this notification in official Gazette, as explained above.
