घ षणा प्रेस न ट सं्‍ ा ईसीआई/प्रे.न ./66/2018 दिनांक 06.10.2018 के िररए क गई थी। का ाक्रम के अनुसार,

मतगणना क तारीख 11.12.2018 थी।

और त:, ल क प्रजतजनजित्व अजिजन म, 1951 क िारा 78 के अनुसार, जनवााचन ल़ने वाले प्रत् ेक अयर थक क ,

जनवााजचत अयर थक के जनवााचन क तारीख से 30 दिनों के भीतर जनवााचन व्य के अपने लेखे क सिी प्रजत जिला जनवााचन

अजिकारी क िाजखल करनी ि ती िै;

और तः, संबंजित ररटर्निंग अजिकारी द्वारा 76-चुरिट जविान सभा जनवााचन क्षेे्र के पररणाम 11.12.2018 क

घ जषत दकए गए थे। इस प्रकार, जनवााचन व्य के लेखा िाजखल करने क अजन्तम तारीख 10.01.2019 थी।

क प्रस्ट्तुत ररप टा के अनुसार श्री जववेक क ल, मध् प्रिेि के 76-चुरिट जविान सभा जनवााचन क्षेे्र से जनवााचन ल़ने वाले

बहुिन समाि पाटक के अयर थक, अपने जनवााचन व् का क ई भी लेखा िाजखल करने में असफल रिे ।

और तः, जिला जनवााचन अजिकारी, सीिी जिला, मध् प्रिेि और मु्‍ जनवााचन अजिकारी, मध् प्रिेि क

ररप टो के आिार पर भारत जनवााचन आ ग द्वारा जनवााचनों का संचालन जन म, 1961 के जन म 89 के उप जन म (5) के

अंतगात जनवााचन व्य लेखा प्रस्ट्तुत निीं करने के जलए श्री जववेक क ल क कारण बताओ न रटस दिनांक 01.08.2019 िारी

दक ा ग ा था;

और त:, जनवााचनों का संचालन जन म, 1961 के जन म 89 के उप-जन म (6) के अनुसार, दिनांक 01.08.2019

के उप ुाक् त कारण बताओ न रटस के िररए श्री जववेक क ल क जनिेि दि ा ग ा था दक वे इस न रटस के प्राप् त ि ने के 20

दिनों के अंिर आ ग में लेखे न प्रस्ट् तुत कर पाने के कारणों क स्ट् प्‍ ट करते हुए जलजखत रूप में अपना अयर ावेिन प्रस्ट् तुत करें

और साथ िी, पूणा जनवााचन व् का लेखा संबंजित जिला जनवााचन अजिकारी क प्रस्ट् तुत करें;

और त:, उक् त न रटस श्री जववेक क ल द्वारा 17.10.2019 क प्राप् त दक ा था। अयर थक से प्राप् त पावती रसीि

जिला जनवााचन अजिकारी, सीिी के दिनांक 23.10.2019 के प्र सं्‍ ा 2134/जनवाा/2019 द्वारा आ ग क प्रस्ट् तुत कर िी

गई िै;

और त:, जिला जनवााचन अजिकारी, सीिी द्वारा अपने दिनांक 13.08.2020 के प्र सं. 312/जनवाा0/2020 के

तित प्रस्ट् तुत क गई अनुपूरक ररप टा में ि बता ा ग ा िै दक श्री जववेक क ल ने आि क तारीख तक न त क ई भी

अयर ावेिन और न िी मूल वाउचरों आदि के साथ जवजिवत रूप से िस्ट् ताक्षेररत अपने जनवााचन व् के सिी लेखे का जववरण

प्रस्ट् तुत दक ा िै। इसके अजतररक् त, उन् िोंने भारत जनवााचन आ ग का सय क् न रटस जमलने के उपरांत भी उक् त असफलता के

जलए न त क ई कारण बता ा िै और न िी क ई स्ट् प्‍ टीकरण दि ा िै;

और त:, आ ग का ि समािान ि ग ा िै दक श्री जववेक क ल, जनवााचन व्य ों का लेखा िाजखल करने में

असफल रिे िैं और उनके पास इस असफलता के जलए क ई भी उजचत कारण अथवा न् ा जचत् निीं िै;

और त:, ल क प्रजतजनजित् व अजिजन म, 1951 क िारा 10क में अनुबंजित दक ा ग ा िै दक:-

‘‘ दि जनवााचन आ ग का समािान ि िाता िै दक क ई व् जि-

(क) जनवााचन व् ों का लेखा उस सम के भीतर और उस रीजत में िैसी इस अजिजन म के द्वारा ा अिीन अपेजक्षेत िै,

िाजखल करने में असफल रिा िै; तथा

(ख) उस असफलता के जलए क ई अच् ोा कारण ा न् ा जचत् निीं रखता िै, त जनवााचन आ ग िासक रािप्र में

प्रकाजित आिेि द्वारा उसक जनरर्िात घ जषत करेगा और ऐसा व् जि उस आिेि क तारीख से तीन वषा क

कालावजि के जलए जनरर्िात ि गा;

अत:, अब ल क प्रजतजनजित् व अजिजन म, 1951 क िारा 10क के अनुसरण में भारत जनवााचन आ ग एतद्द्वारा मध्

प्रिेि राज् क जविान सभा के सािारण जनवााचन, 2018 के 76-चुरिट जविान सभा जनवााचन क्षेे्र से जनवााचन ल़ने वाले

बहुिन समाि पाटक के अयर थक, श्री जववेक क ल, जनवासी ग्राम बारी, प स्ट्ट बयिनी, तिसील ग पि बनास, जिला सीिी,

मध् प्रिेि क संसि के दकसी भी सिन अथवा राज् अथवा संघ राज् क्षेे्र क जविानसभा अथवा जविान पररषि् के जलए

सिस्ट् चुने िाने अथवा ि ने के जलए इस आिेि क तारीख से तीन वषा क अवजि के जलए जनरर्िात घ जषत करता िै।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 5th January, 2021

O.N. 5.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer,

from the date of election of returned candidate;

AND WHEREAS, the result of 76-Churhat Assembly Constituency was declared by the Returning Officer

concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 15.01.2019 submitted by the District Election Officer, Sidhi District,

Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/Four/

Elec.Expenditure Account/16-Sidhi /2019/886 dated 19.01.2019, Shri Vivek Kol, Bahujan Samaj Party contesting

candidate from 76-Churhat Assembly Constituency of Madhya Pradesh, failed to lodge any account of his election

expenses as required by law.

AND WHEREAS, on the basis of the report of the District Election Officer, Sidhi District, Madhya Pradesh, a

Show Cause notice dated 01.08.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of

the Conduct of Elections Rules, 1961 to Shri Vivek Kol for non submission of accounts of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 01.08.2019, Shri Vivek Kol was directed to submit his representation in writing to the

Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of election

expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Vivek Kol on 17.10.2019. Acknowledgment receipt

obtained from the candidate have been submitted to the Commission by District Election Officer, vide his letter

No. 2134/Election/2019 dated 23.10.2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Sidhi vide his letter

No. 312/Election/2020 dated 13.08.2020 it has been stated that Shri Vivek Kol has not submitted any representation or

a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further,

he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the

Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Vivek Kol has failed to lodge an account of election

expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Vivek Kol resident of Village Bari, Post Bamhani, Tehsil-Gopad,

Banas Distt. Sidhi, Madhya Pradesh, the contesting candidate of Bahujan Samaj Party for the General Election to the

Legislative Assembly of Madhya Pradesh, 2018 from 76-Churhat Assembly Constituency to be disqualified for being

chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of

a State or Union Territory for a period of three years from the date of this order.

16.01.2019 क प्रस्ट्तुत ररप टा के अनुसार श्री द्वारका प्रसाि अजिरवार, मध् प्रिेि के 44-ितारा (अ.िा) जविान सभा

जनवााचन क्षेे्र से जनवााचन ल़ने वाले बहुिन समाि पाटक के अयर थक, अपने जनवााचन व् का क ई भी लेखा िाजखल करने में

असफल रिे ।

और तः, जिला जनवााचन अजिकारी, टीकमगढ़ जिला, मध् प्रिेि और मु्‍ जनवााचन अजिकारी, मध् प्रिेि क

अंतगात जनवााचन व्य प्रस्ट्तुत निीं करने के जलए श्री द्वारका प्रसाि अजिरवार क कारण बताओ न रटस दिनांक 31.07.2019

क िारी दक ा ग ा था;

और त:, जनवााचनों का संचालन जन म, 1961 के जन म 89 के उप-जन म (6) के अनुसार, दिनांक 31.07.2019

के उप ुाक् त कारण बताओ न रटस के िररए श्री द्वारका प्रसाि अजिरवार क जनिेि दि ा ग ा था दक वे इस न रटस के प्राप् त

ि ने के 20 दिनों के अंिर आ ग में लेखे न प्रस्ट् तुत कर पाने के कारणों क स्ट् प्‍ ट करते हुए जलजखत रूप में अपना अयर ावेिन

प्रस्ट् तुत करें और साथ िी, पूणा जनवााचन व् का लेखा संबंजित जिला जनवााचन अजिकारी क प्रस्ट् तुत करें;

और त:, उक् त न रटस श्री द्वारका प्रसाि अजिरवार क प्ी द्वारा 24.08.2019 क प्राप् त दक ा था । अयर थक से

न रटस/10-टीकमगढ़/15851, दिनांक 12.09.2020 द्वारा अग्रेजषत जिला जनवााचन अजिकारी, टीकमगढ़ के दिनांक

31.08.2019 के प्र सं्‍ ा 25/सामा॰ जनवाा।/2019/1566 द्वारा आ ग क प्रस्ट् तुत कर िी गई थी;

और त:, जिला जनवााचन अजिकारी, टीकमगढ़ द्वारा अपने दिनांक 17.07.2020 के प्र सं. 25/सामा0

जनवाा0/व्य /2020/255 के तित प्रस्ट् तुत क गई अनुपूरक ररप टा में ि बता ा ग ा िै दक श्री द्वारका प्रसाि अजिरवार ने आि

क तारीख तक न त क ई भी अयर ावेिन और न िी मूल वाउचरों आदि के साथ जवजिवत रूप से िस्ट् ताक्षेररत अपने जनवााचन

AND WHEREAS, as per the report dated 16.01.2019 submitted by the District Election Officer, Tikamgarh

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec.Expenditure Account/10-Tikamgarh /2019/882 dated 19.01.2019, Shri Dwarika Prasad Ahirwar, Bahujan Samaj

Party contesting candidate from 44-Jatara (SC) Assembly Constituency of Madhya Pradesh, failed to lodge any account

of his election expenses as required by law.

AND WHEREAS, on the basis of the report of the District Election Officer, Tikamgarh District, Madhya

Pradesh, a Show Cause notice dated 31.07.2019 was issued by the Election Commission of India under Sub Rule (5) of

Rule 89 of the Conduct of Election Rules, 1961 to Shri Dwarika Prasad Ahirwar for non submission of accounts of

Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 31.07.2019, Shri Dwarika Prasad Ahirwar was directed to submit his representation in

writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete

accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the

notice;

AND WHEREAS, the said notice was received by wife of Shri Dwarika Prasad Ahirwar on 24.08.2019.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election

Officer, vide his letter No. 25/Gen. Elec./2019/1566 dated 31.08.2019 and the same was forwarded by the office of

Chief Electoral Officer, Madhya Pradesh vide letter No.10 A/4/L.A.-2018/Elec. Expenditure Notice/10-

Tikamgarh/15851 dated 12.09.2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Tikamgarh vide his

letter No. 25/Gen. Elec./2020/255 dated 17.07.2020 it has been stated that Shri Dwarika Prasad Ahirwar has not

vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt

of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Dwarika Prasad Ahirwar has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

Council of a State or Union Territory for a period of three years from the date of this order.
