आ.अ. 33.—यतः, श्री रामबिािुर उत्तर प्रिेि जविान सभा के सािारण जनवााचन, 2017, जिसका ृररणाम
11.03.2017 क घ जित दकया गया था, के िौरान 182-सरेनी जविान सभा जनवााचन क्षेे्र से जनवााचन ल़ने वाले अभ्यथी
थे; और
यत:, ल क प्रजतजनजित्व अजिजनयम, 1951 की िारा 78 के अनुसार, जनवााचन ल़ने वाले प्रत्येक अभ्यथी क ,
जनवााजचत अभ्यथी के जनवााचन (की तारीख) से 30 दिनों के भीतर अृने जनवााचन व्ययों के लेखे प्रस्ट्तुत करना अृेजक्षेत ि ता िै
अथाात, इस मामले में लेखे प्रस्ट्तुत करने की अंजतम जतजथ 10.04.2017 थी; और

यत:, जिला जनवााचन अजिकारी, रायबरेली की ररृ र्ा के अनुसार, श्री. रामबिािुर समय ृर अृने लेखे ििा करने में
जवफल रिे थे, जिसके जलए उन्िें 27.04.2018 का दिनांदकत कारण बताओ न रर्स दिनांक 12.05.2018 क तामील दकया
दकया गया था, जिसमें अन्य बातों के साथ-साथ किा गया था दक न रर्स प्राप्त ि ने के 20 दिनों के भीतर लेखे ििा करने में
जवफल रिने ृर, वि ल क प्रजतजनजित्व अजिजनयम, 1951 की िारा 10क के तित अय ग्य घ जित दकए िाने के जलए
उत्तरिायी िोंगे; और
यत: श्री रामबिािुर ने 22.05.2018 क अृने जनवााचन व्यय का लेखा प्रस्ट्तुत दकया, लेदकन जिला जनवााचन
अजिकारी, रायबरेली के दिनांक 07.08.2018 की ररृ र्ा के अनुसार श्री बिािुर ने चुनाव प्रचार के िौरान अृने द्वारा दकए
गए खचा के संबंि में सभी अृेजक्षेत वाउचर िमा निीं दकए थे; और
यत:, आय ग का दिनांक 16.01.2019 का ृ्र उन्िें 09.09.2019 क तामील कराया गया था, जिसमें उनके लेखे की
कजमयों का उल्लेख दकया गया था और उक्त ृ्र प्राप्त ि ने के 20 दिनों के भीतर इन कजमयों क ठीक करने के जलए किा गया
था, जिसमें जवफल रिने ृर वे ल क प्रजतजनजित्व अजिजनयम की िारा 10क के तित अय ग्य घ जित दकए िाने के जलए
उत्तरिायी िोंगे; और
यत:, आय ग के सांजवजिक प्राविानों और जनिेिों का ृालन करने में जवफल रिने के कारण, ल क प्रजतजनजित्व
अजिजनयम, 1951 की िारा 10क के तित आय ग के आिेि दिनांक 07.01.2020 के द्वारा श्री रामबिािुर क संसि के दकसी
भी सिन अथवा राज् य अथवा संघ राज् य क्षेे्र की जविान सभा अथवा जविान ृररिि का सिस्ट् य चुने िाने अथवा ि ने के जलए
जनरर्िात दकया गया था; और
यत:, आय ग क श्री रामबिािुर से दिनांक 18.02.2021 का एक ृ्र प्राप्त हुआ था जिसमें किा गया था दक उन्िोंने
अृने चुनाव एिेंर् के माध्यम से सभी अृेजक्षेत वाउचरों के साथ लेखे ििा दकए थे, लेदकन कुो कारणों से उसे अय ग्य घ जित
कर दिया गया िै। उनके द्वारा अृनी ओर से हुई दकसी भी गलती के जलए माफी भी मांगी गई थी; और
यत: श्री रामबिािुर क आय ग के दिनांक 01.03.2021 के ृ्र द्वारा ृिले अृने लेखे की ्र ुरर्यों क ठीक करने और
(दफर) ल क प्रजतजनजित्व अजिजनयम, 1951 की िारा 11 के तित एक िृथृ्र , जिसमें सांजवजिक प्राविानों का अनुृालन
करने में जवफलता का कारण बताया गया ि , सजित एक अृील िायर करने के जलए किा गया था; और
यत: जिला जनवााचन अजिकारी, रायबरेली से प्राप्त दिनांक 10.03.2021 की ररृ र्ा के अनुसार, श्री रामबिािुर द्वारा
सभी अृेजक्षेत वाउचरों क प्रस्ट्तुत करके अृने लेखे की ्र ुरर्यों क ठीक दकया गया तथा चूक के जलए जनम्नजलजखत
औजचत्य/कारण के साथ अृेजक्षेत िृथृ्र भी प्रस्ट्तुत दकया गया:-
(क)
अनिाने में, कुो वाउचर िस्ट्तावेिों में रि गए थे जिनक उनके द्वारा समय ृर प्रस्ट्तुत निीं दकया िा सका
था।
(ख)
आवेिक ्र ुरर्यों से अनिान रिा और उसने अृने लेखे में िानबूझकर क ई गलती निीं की िै; और
यत: मामले में सभी तथ्यों और आवेिक द्वारा दकए गए प्रस्ट्तुजतकरण ृर जवचार करके श्री चन्र भूिण कुमार,
उृजनवााचन आयुक्त एवं अृीलीय प्राजिकारी ने इस मामले में श्री रामबिािुर क दिनांक 07.04.2021 क अृराह्न 2.30
बिे गूगल मीर् के माध्यम से जनिी सुनवाई का अवसर प्रिान दकया; और
यत:, श्री रामबिािुर ने दिनांक 07.04.2021 क जनिी सुनवाई में अन्य बातों के साथ साथ सभी बाउचरों क प्रस्ट्तुत
करने में अृनी जवफलता क स्ट्वीकार दकया और यि भी बताया दक कुो वाउचरों के प्रस्ट्तुत न कर ृाने समेत लेखे में ि भी
कजमयां रि गईं थीं उन्िें ठीक कर जलया गया िै। उन्िोंने बताया दक गलजतयां उनकी अनजभज्ञता के कारण हुई थीं। श्री
रामबिािुर ने उक्त जवफलता के जलए मौजखक रूृ से माफी भी मांगी और अृीलीय प्राजिकारी क आश्वासन दिया दक भजवष्य

में ऐसी गलजतयां ि बारा निीं िोंगी। इसके अलावा, अृील िायर करने में जवलंब के प्रश्न ृर उन्िोंने बताया दक उन्िें अृनी
जनरािता के बारे में (ृिली बार) जिला जनवााचन अजिकारी रायबरेली के कायाालय से दिसंबर, 2020 में ृता चला; और
यतः, उृलब्ि कराये गए तत्व यि सुझाते िैं दक अभ्यथी द्वारा दिनांक 22.05.2018 क अृने जनवााचन व्यय के लेखे
िमा दकये गए, िांलादक वे अृूणा थे । अभ्यथी द्वारा बताया गया दक ि भी कजमयााँ रि गयी थी वे अब सुिार ली गई िैं,
जिसकी ृुजि जिला जनवााचन अजिकारी, रायबरेली द्वारा उनकी दिनांक 10.03.2021 की ररृ र्ा में की गयी िै; और
अत:, अब उृलब्ि सभी भौजतक तथ्यों और श्री रामबिािुर द्वारा उनकी जनिी सुनवाई के िौरान प्रस्ट्तुत मौजखक
कथनों के मद्देनिर अृीलीय प्राजिकारी ने दिनांक 07.01.2020 के आय ग के आिेि के द्वारा उन ृर अजिर जृत जनरािता क
दिनांक 10.05.2021 से रद्द करने का जनणाय जलया िै।
यि आिेि सक्षेम प्राजिकारी के अनुम िन से िारी दकया गया िै।

ORDER
New Delhi, the 19th May, 2021
O.N. 33.—WHEREAS, Sh. Rambahadur was a contesting candidate from 182-Sareni AC during the
General Elections to the Legislative Assembly of Uttar Pradesh, 2017, result of which was declared on
11.03.2017; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, each contesting candidate
is required to lodge her/his accounts of election expenses within 30 days of election of returned candidate. In
this case, last date of filing accounts was 10.04.2017; and
WHEREAS, as per report of District Election Officer, Raebareli, Sh. Rambahadur had failed to lodge
his accounts in time for which a show-cause notice, dated 27.04.2018 was served on him on 12.05.2018,
stating inter-alia therein that on failure of lodging the accounts within 20 days of receipt of notice, he shall be
liable to be disqualified under Section 10A of the Representation of the People Act, 1951.
WHEREAS, Sh. Rambahadur had submitted his accounts of election expenses on 22.05.2018 but as
per report, dated 07.08.2018 of District Election Officer, Rae Bareli, Sh. Bahadur did not submit all the
requisite vouchers in respect of expenses incurred by him during the election campaigning.
WHEREAS, Commission’s letter dated 16.01.2019 was served on him on 09.09.2019, stating therein
the defect in his accounts and asking him to rectify the same within 20 days of receipt of the letter, failing
which he shall be liable to be disqualified under Section 10A of the Representation of the People Act, 1951.
WHEREAS, due to failure to comply with the statutory provisions and directions of the Commission,
Sh. Rambahadur was disqualified under Section 10A of the Representation of the People Act, 1951 for being
a Member or for being chosen a Member of Legislative Assembly, Legislative Council of any State/UT and
of Parliament of Union of India, vide Commission’s Order, dated 07.01.2020.
WHEREAS, a letter, dated 18.02.2021 was received in the Commission from Sh. Rambahadur stating
therein that he had lodged the accounts with all the requisite vouchers though his election agent but due to
some reasons he has been disqualified. He also apologised for any lapse on his part.

WHEREAS, Sh. Rambahadur was asked vide Commission’s letter, dated 01.03.2021 to first rectify
the errors in his accounts and to file an appeal under Section 11 of the Representation of the People Act, 1951
along with an affidavit stating therein the reasons for his failure to comply with statutory provisions.
WHEREAS, as per report, dated 10.03.2021 received from DEO, Raebareli, Sh. Rambahadur has
rectified the defects of his accounts by submitting all the requisite vouchers and that he has also submitted the
requisite affidavit with following justifications/reasons, for the lapse:-
(a) Inadvertently, a few vouchers were left in the documents which could not be submitted by him, in
time.
(b) The defects remained unknown to applicant and the he has not made a deliberate error in his
accounts.
WHEREAS, considering all the facts in the matter and submission made by the appellant, Shri
Chandra Bhushan Kumar, Deputy Election Commissioner & the Appellate Authority in the matter afforded
the opportunity of personal hearing to Sh. Rambahadur through Google meet at 2:30 pm on 07.04.2021.
WHEREAS, Sh. Rambahadur in the personal hearing on 07.04.2021 inter-alia accepted the failure to
submit all the vouchers and further submitted that whatever errors remained in the accounts including non-
submission of some vouchers have now been rectified. He has submitted that the errors occurred were due to
his ignorance. Shri Rambahadur had also verbally tendered his apology for the said failure and assured the
Appellate Authority not to repeat such mistake in future. Further, on the query of delay in filing the appeal he
has submitted that he got to know about his disqualification only in December, 2020 through the office of
District Election Officer, Raebareli.
WHEREAS, the material made available suggests that the candidate did submit his accounts on
22.05.2018, however, it was incomplete. Now, he has submitted that whatever errors remained in the
submission has now been rectified, which has been confirmed by the District Election Officer, Raebareli vide
its report, dated 10.03.2021.
NOW THEREFORE, in view of all the available material facts and oral submissions made by Sh.
Rambahadur during his personal hearing, the Appellate Authority has decided to revoke the disqualification
imposed upon him vide Commission’s Order, dated 07.01.2020, w.e.f. 10.05.2021.
This issues with the approval of the Competent Authority.
