20) (जिसे इसमें इसके ृश् चात् उक् त अजिजनयम किा गया िै) की िारा 4 की उृ-िारा (1) के अिीन, भारत

सरकार में कोयला मंत्रालय द्वारा िारी की गई अजिसूचना सं्‍ यांक का. आ. 1137, तारीख 26 िून, 2019, िो

भारत के रािृत्र के भाग II, खण् ड 3, उृ-खण् ड (ii), तारीख 6 िुलाई, 2019 में प्रकाजित की गई ी, उस

अजिसूचना से उृाबद्ध अनुसूची में जवजनर्िजष् ट ृररक्षेत्र की भूजम में जिसका माृ 255.33 िेक् टर (लगभग) या

630.92 एकड़ (लगभग) िै, कोयले का ृूवेक्षण करने के अृने आिय की सूचना िी ी ;

और केन् रीय सरकार का यि समािान िो गया िै दक इस अजिसूचना से संलग् न अनुसूची में जवजित उक् त

भूजम के भाग में कोयला अजभप्राप् त िै ;

अत:, अब, केन् रीय सरकार उक् त अजिजनयम की िारा 7 की उृ-िारा (1) द्वारा प्रित् त िजक् तयों का प्रयोग

करते हुए, इससे संलग् न अनुसूची में वर्णिंत 255.33 िेक् टर (लगभग) या 630.92 एकड़ (लगभग) माृ वाली भूजम

में या उस ृर के सभी अजिकार का अिजन करने के अृने आिय की सूचना िेती िै;

रटप् ृण 1: इस अजिसूचना के अिीन आने वाले क्षेत्र के रेखांक सं्‍ यांक सी-I (ई)III/ एफआर/1220-966, तारीख

10 दिसम् बर, 2020 का जनररक्षण कलेक् टर, जिला नागृुर, मिाराष् र के कायाजलय में या कोयला जनयंत्रक, 1,

काउंजसल िाउस स्ट् रीट, कोलकाता- 700 001 के कायाजलय में या जवभागाध् यक्ष, वेस्ट् टनज कोलफील् ्स जलजमटेड,

(रािस्ट् व जवभाग), कोल इस्ट् टेट, जसजवल लाईन् स, नागृुर - 440 001 (मिाराष् र) के कायाजलय में दकया िा सकता िै ।

रटप् ृण 2 : उक् त अजिजनयम की उृिारा 8 के उृबंिों की ओर ध् यान आकषष् ट दकया िाता िै, जिसमें जनम् नजलजखत

उृबंि िै :-

अिजन की बाबि् आृजत् तयॉ.-- ‘‘8(1) कोई व् यजक् त िो दकसी भूजम में, जिसकी बाबत् िारा 7 के अिीन अजिसूचना

जनकाली गई िै, जितबद्ध िै, अजिसूचना के िारी दकए िाने से तीस दिन के भीतर सम् ृूणज भूजम या उसके दकसी भाग

या ऐसी भूजम में या उस ृर के दकन् िीं अजिकारों का अिजन दकए िाने के बारे में आृजत् त कर सकेगा ।

स्ट् ृष् टीकरण: इस िारा के अंतगजत यि आृजत् त निीं मानी िाएगी, दक कोई व् यजक् त दकसी भूजम में कोयला उत् ृािन के

जलए स्ट् वयं खनन संदियाएं करना चािता िै और ऐसी संदियाएं केन् रीय सरकार या दकसी अन् य व् यजक् त को निीं

करनी चाजिए ।

उृिारा (1) के अिीन प्रत् येक आृजत् त सक्षम अजिकारी को जलजखत प ृ में की िाएगी और सक्षम

अजिकारी, आृजत् तकताज को स्ट् वयं सुने िाने, जविी व् यवसायी द्वारा सुनवाई का अवसर िेगा और ऐसी सभी

आृजत् तयों को सुनने के ृश् चात् और ऐसी अजतररक् त िांच, यदि कोई िो, करने के ृश् चात् िो वि आवश् यक समझता

िै, वि या तो िारा 7 की उृिारा (1) के अिीन अजिसूजचत भूजम के या ऐसी भूजम में या उस ृर के अजिकारों के

संबंि में एक ररृोटज या ऐसी भूजम के जवजभन् न टुकड़ों या ऐसी भूजम में या उस ृर के अजिकारों के संबंि में

आृजत् तयों ृर अृनी जसफाररिों और उसके द्वारा की गई कायजवािी के अजभलेख सजित जवजभन् न ररृोटज केन् रीय

सरकार को उसके जवजनश् चय के जलए िेगा ।

इस िारा के प्रयोिनों के जलए वि व् यजक् त दकसी भूजम में जितबद्ध समझा िाएगा िो प्रजतकर में जित का

िावा करने का िकिार िो, यदि भूजम या दकसी ऐसी भूजम में या उस ृर के अजिकार इस अजिजनयम के अिीन

अर्िजत कर जलए िाते िैं ।

New Delhi, the 21st May, 2021

S.O. 342.—Whereas by the notification of the Government of India in the Ministry of Coal number

S. O. 1137, dated the 26^th June, 2019 issued under sub-section (1) of section 4 of the Coal Bearing Areas

(Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) and published in

the Gazette of India, Part II, Section 3, Sub-section (ii), dated the 6^th July, 2019, the Central Government gave

notice of its intention to prospect for coal in 255.33 hectares (approximately) or 630.92 acres (approximately) of

the land in the locality specified in the Schedule annexed to that notification ;

And whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands

prescribed in the Schedule appended hereto;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the

Central Government hereby gives notice of its intention to acquire all rights in or over the land measuring

255.33 hectares (approximately) or 630.92 acres (approximately) described in the Schedule appended hereto;

Note 1: The plan bearing number C-I(E)III/FR/1220-966, dated the 10^th December, 2020 of the area covered

by this notification may be inspected in the office of the Collector, District Nagpur (Maharashtra) or in the

office of the Coal Controller, 1, Council House Street, Kolkata - 700 001 or in the office of the Head of

Department (Land and Revenue), Western Coalfields Limited, Revenue Department, Coal Estate, Civil Lines,

Nagpur – 440 001 (Maharashtra).

Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows:-

Objections to acquisition.-- “8.(1) Any person interested in any land in respect of which a notification under

section 7 has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the

whole or any part of the land or of any rights in or over such land.

Explanation:-

It shall not be an objection within the meaning of this section for any person to say that he

himself desires to undertake mining operations in the land for the production of coal and that such operations

should not be undertaken by the Central Government or by any other person.

(2)

Every objection under sub-section (1) shall be made to the competent authority in writing and the

competent authority shall give the objector an opportunity of being heard either in person or by a legal

practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks

necessary, either make a report in respect of the land which has been notified under Sub-Section (1) of Section 7

or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights

in or over such land, to the Central Government, containing his recommendations on the objections, together

with the record of proceedings held by him, for the decision of that Government.

(3)

For the purpose of this section, a person shall be deemed to be interested in land who would be entitled

to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act.”

Note 3: The Coal Controller, 1, Council House Street, Kolkata - 700 001 has been appointed by the Central

Government as the competent authority under section 3 of the said Act, vide notification number S.O. 2519,

dated the 27^th May, 1983, published in Part- II, Section 3, Sub-section (ii) of the Gazette of India, dated the

11^th June, 1983.

Line starts from Point ‘E’ passes in North-East direction passes along outer boundary of land

अतः, अब, केन्रीय सरकार, उक्त अजिजनयम की िारा 11 की उृिारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग

करते हुए, यि जनिेि िेती िै दक इस प्रकार जनजित उक्त भूजम का माृ 714.8553 िेक्टेयर (लगभग) या

1766.4459 एकड़ (लगभग) उक्त भूजम में या उस ृर के सभी अजिकार तारीख 17 माचज, 2021 से केन्रीय सरकार

में इस प्रकार जनजित बने रिने के बिाए, जनम्नजलजखत जनबंिनों और ितों के अिीन रिते हुए, सरकारी कंृनी में

जनजित िो िाएंगे, अ ाजत् :-

(1)

सरकारी कंृनी, उक्त अजिजनयम के उृबंिों के अिीन और अन्य सुसंगत जवजियों के अिीन य ा अविाररत

सभी प्रजतकर, ब्याि, नुकसाजनयों, इत्यादि और वैसी िी मिों की बाबत् सभी संिाय करेगी ।

(2)

सरकारी कंृनी द्वारा ितज (1) के अिीन, संिेय रकमों का अविारण करने के प्रयोिनों के जलए उक्त

अजिजनयम की िारा 14 के अिीन एक अजिकरण का गठन दकया िाएगा त ा ऐसे दकसी अजिकरण

और उक्त अजिकरण की सिायता करने के जलए जनयुक्त व्यजक्तयों के संबंि में उृगत सभी व्यय, उक्त

सरकारी कंृनी द्वारा विन दकए िाएंगे और इसी प्रकार जनजित उक्त भूजम में या उस ृर के अजिकारों के

जलए या उनके संबंि में अृील, आदि जवजिक कायजवाजियों की बाबत उृगत, सभी व्यय भी सरकारी कंृनी

द्वारा विन दकए िाएंगे ।

(3)

सरकारी कंृनी, केन्रीय सरकार या उसके ृििाररयों की ऐसे दकसी अन्य व्यय के संबंि में क्षजतृूर्तज करेगी

िो इस प्रकार जनजित उक्त भूजम में या उस ृर के ृूवोक्त अजिकारों के बारे में केन्रीय सरकार या उसके

ृििाररयों द्वारा या उनके जवरुद्ध दकन्िीं कायजवाजियों के संबंि में आवश्यक िो ।

(4)

सरकारी कंृनी के ृास उक्त भूजम और उक्त भूजम में या उसके ऊृर इस प्रकार जनजित अजिकारों को केन्रीय

सरकार के ृूवज अनुमोिन के जबना, दकसी अन्य व्यजक्त को अंतररत करने की िजक्त निीं िोगी ।

सरकारी कंृनी, ऐसे जनिेिों और ितों का ृालन करेगी, िो केन्रीय सरकार द्वारा, िब कभी आवश्यक िो,

उक्त भूजम के जवजिष्ट क्षेत्रों के जलए दिये िाएं या अजिरोजृत दकए िाएं।

S.O. 343 .—Whereas on the publication of the notification of the Government of India in the Ministry

of Coal number S.O. 1233(E), dated the 16^th March, 2021 published in the Gazette of India, Part II, Section 3,

Sub-section (ii), dated the 17^th March, 2021 issued under sub-section (1) of section 9 of the Coal Bearing Areas

(Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), the lands and

the all rights in or over the land described in the Schedule appended to the said notification (hereinafter referred

to as the said lands) vested absolutely in the Central Government free from all encumbrances under sub-section

(1) of section 10 of the said Act ;

And whereas, the Central Government is satisfied that the Neyveli Uttar Pradesh Power Limited,

Uttar Pradesh (hereinafter referred to as the Government Company) is willing to comply with such terms and

conditions as the Central Government thinks fit to impose in this behalf ;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 11 of the said Act,

the Central Government hereby directs that the said lands measuring 714.8553 hectares (approximately) or

1766.4459 acres (approximately) and all rights in or over the said lands so vested shall with effect from

17^th March, 2021 instead of continuing to so vest in the Central Government, shall vest in the Government

company, subject to the following terms and conditions, namely:-

(1)

The Government Company shall make all payments in respect of compensation, interest, damages, etc.

and the like, as determined under the provisions of the said Act and other relevant law.

(2)

A Tribunal shall be constituted under section 14 of the said Act, for the purpose of determining the

amounts payable by the Government Company under condition (1) and all expenditure incurred in

connection with any such Tribunal and persons appointed to assist the Tribunal shall be borne by the

Government Company and similarly, all expenditure incurred in respect of all legal proceedings like

appeals, etc. for or in connection with the rights, in or over the said lands, so vested, shall also be

borne by the Government Company.

(3)

The Government Company shall indemnify the Central Government and its officials against any other

expenditure that may be necessary in connection with any proceedings by or against the Central

Government or its officials, regarding the rights in or over the said lands so vested.

(4)

The Government Company shall have no power to transfer the aforesaid rights in the said lands so

vested to any other person without the prior approval of the Central Government.

(5)

The Government Company shall abide by such directions and conditions as may be given or imposed

by the Central Government for particular areas of the said lands, as and when necessary.
