आ. अ. 34.—यतः, भारत जनवााचन आय ग द्वारा दिनांक 10 माचा, 2019 के प्रेस न ट सं. ईसीआई/ृीएन/23/2019 के तित

तेलंगाना के 06-मेडक संसिीय जनवााचन क्षेे्र के जलए सािारण जनवााचन, 2019 की घ षणा की गई थी; और

यत:, ल क प्रजतजनजित्व अजिजनयम, 1951 की िारा 78 के अनुसार, जनवााचन ल़ने वाले प्रत्येक अभ्यथी क , जनवााजचत

अभ्यथी के जनवााचन की तारीख से 30 दिनों के भीतर अृने जनवााचन व्यय के लेखे की सिी प्रजत संद्ध जिला जनवााचन अजिकारी क

प्रस्ट्तुत करनी ि ती िै; और

यतः, 06-मेडक संसिीय जनवााचन क्षेे्र के जलए जनवााचन के ृररणाम ररटर्निंग ऑदिसर द्वारा दिनांक 23 मई, 2019 क घ जषत

दकए गए थे और इस प्रकार जनवााचन व्यय के लेखों क िाजखल करने की अजन्तम तारीख 23 िून, 2019 थी; और

यतः, जिला जनवााचन अजिकारी, मेडक जिला, तेलंगाना द्वारा प्रस्ट्तुत दिनांक 25 िून, 2019 की ररृ टा के अनुसार श्री मािव

रेड्डी गरी िनमंथा रेड्डी, ि तेलंगाना ल क सभा के 06-मेडक संसिीय जनवााचन क्षेे्र से जिव सेना ृाटी के जनवााचन ल़ने वाले अभ्यथी िैं,

जवजि द्वारा यथाृेजक्षेत रीजत से अृने जनवााचन व्यय का क ई भी लेखा िाजखल करने में जविल रिे िैं; और

यतः, जिला जनवााचन अजिकारी की उक्त ररृ टा के आिार ृर, भारत जनवााचन आय ग द्वारा जनवााचनों का संचालन जनयम,

1961 के जनयम 89 के उृ-जनयम (5) के अंतगात श्री मािव रेड्डी गरी िनमंथा रेड्डी क अृने जनवााचन व्यय के लेखे प्रस्ट्तुत निीं करने के

जलए दिनांक 6 िुलाई, 2020 क कारण दताओ न रटस सं. 76/टीईएल-एचृी/एसओयू3/2019 िारी दकया गया था; और

यत:, उृयुाक् त कारण दताओ न रटस के िररए और जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के उृ-जनयम (6) के

अनुसार, श्री मािव रेड्डी गरी िनमंथा रेड्डी क अृना अभ् यावेिन, जिसमें लेखा प्रस्ट् तुत न दकए िाने संदंिी कारणों क स्ट् ृष् ट दकया गया ि ,

आय ग क जलजखत रूृ में प्रस्ट् तुत करने और यि न रटस के प्राप् त ि ने के 20 दिनों के अंिर जिला जनवााचन अजिकारी, मेडक क अृने

जनवााचन व्यय का लेखा प्रस्ट् तुत करने का जनिेि दिया गया थाऔ और

यत:, जिला जनवााचन अजिकारी, मेडक ने दताया िै दक श्री मािव रेड्डी गरी िनमंथा रेड्डी क उक् त न रटस दिनांक 18 अगस्ट्त,

2020 क तामील दकया गया था; और

यत:, जिला जनवााचन अजिकारी, मेडक ने दिनांक 6 मई, 2021 की अृनी अनुृूरक ररृ टा में यि दताया दक श्री मािव रेड्डी

गरी िनमंथा रेड्डी ने अृने जनवााचन व्यय का क ई भी अभ्यावेिन अथवा मूल वाउचरों आदि के साथ जवजिवत रूृ से िस्ट्ताक्षेररत अृने

जनवााचन व्यय का सिी लेखा जववरण प्रस्ट्तुत निीं दकया िै। इसके अजतररक् त, उक्त न रटस जमलने के उृरांत भी उन् िोंने जवजि के अंतगात

यथा-जवजित लेखे प्रस्ट्तुत करने में अृनी जविलता के जलए भारत जनवााचन आय ग क न त क ई कारण दताया िै और न िी क ई

स्ट् ृष् टीकरण दिया िैऔ और

यत:, ल क प्रजतजनजित् व अजिजनयम, 1951 की िारा 10क में यि जवजित िै दक:

‘‘यदि जनवााचन आय ग का समािान ि िाता िै दक क ई व् यजक्त—

(क)

इस अजिजनयम के द्वारा अथवा इसके अिीन अृेजक्षेत समय के भीतर और रीजत में जनवााचन व् यय लेखा िाजखल करने

में जविल रिा िैऔ और

(ख)

उसके ृास इस जविलता का क ई उजचत कारण अथवा औजचत् य निीं िै

त , जनवााचन आय ग, सरकारी रािृ्र में आिेि प्रकाजित करके उसे जनरिा घ जषत करेगा और ऐसा क ई भी व् यजक्त इस आिेि की तारीख

से तीन वषा की अवजि के जलए जनरिा रिेगाऔ

यत:, तथ्यों और उृलब्ि ररकाडों के आिार ृर आय ग का यि समािान ि गया िै दक श्री मािव रेड्डी गरी िनमंथा रेड्डी अृने

जनवााचन व् यय के लेखों क िाजखल करने में जविल रिे िैं और उनके ृास ऐसा करने में जविल रिने के जलए क ई भी उजचत कारण अथवा

औजचत् य निीं िै; और

अत:, अद ल क प्रजतजनजित् व अजिजनयम, 1951 की िारा 10क के अनुसरण में भारत जनवााचन आय ग एतद्द्वारा घ षणा करता

िै दक ल क सभा के सािारण जनवााचन, 2019 में तेलंगाना राज्य के 06-मेडक संसिीय जनवााचन क्षेे्र से जनवााचन ल़ने वाले अभ् यथी

श्री मािव रेड्डी गरी िनमंथा रेड्डी, जनवासी- मकान नं. 2-32, कांगल गांव, थ गुटा मंडल, सीिीृेट जिला, तेलंगाना, इस आिेि की तारीख

से तीन वषा की अवजि के जलए संसि के दकसी भी सिन अथवा राज् य अथवा संघ राज् य क्षेे्र की जविान सभा अथवा जविान ृररषि का

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 10th June, 2021

O. N. 34.—WHEREAS, the General Election for 06-Medak Parliamentary Constituency of Telangana 2019, was

announced by the Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to

lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from

the date of election of the returned candidate; and

WHEREAS, the result of the election for 06-Medak Parliamentary Constituency was declared by the Returning

Officer on 23rd May, 2019 and hence the last date for lodging the accounts of Election Expenses was 23rd June, 2019;

and

WHEREAS, as per the report dated 25th June, 2019 submitted by the District Election Officer, Medak District,

Telangana, Shri Madhava Reddy Gari Hanmantha Reddy, a contesting candidate of Shiv Sena Party from 06-Medak

Parliamentary Constituency of Lok Sabha 2019 from Telangana has failed to lodge any account of his Election

Expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/TEL-

HP/SOU3/2019, dated 06th July, 2020 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961

by the Election Commission of India to Shri Madhava Reddy Gari Hanmantha Reddy, for not lodging of accounts of his

Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Shri Madhava Reddy Gari Hanmantha Reddy was directed to submit his representation in writing

to the Commission explaining the reason for not lodging the account and also to lodge his account of Election Expenses

with the District Election Officer, Medak within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Medak, has reported that the said notice was served to Shri Madhava

Reddy Gari Hanmantha Reddy on 18th August, 2020; and

WHEREAS, the District Election Officer, Medak in his supplementary report, dated 6th May, 2021 reported that

Shri Madhava Reddy Gari Hanmantha Reddy, has not submitted any representation or a statement of correct account of

his election expenses, duly signed along with original vouchers etc. Further, after receipt of the said notice, he has

neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as

prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :—

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses, within the time and in the manner required by or under this

Act; and

(b)

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.”

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Madhava Reddy

Gari Hanmantha Reddy has failed to lodge his accounts of election expenses and has no good reason or justification for

the failure to do so; and

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission of India hereby declares Shri Madhava Reddy Gari Hanmantha Reddy, resident of H. No. 2-32, Kangal

village, Thoguta Mandal, Siddipet District. and a contesting candidate from 06-Medak Parliamentary Constituency of

the State of Telangana in the General Election to Lok Sabha 2019, to be disqualified for being chosen as and for being a

member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory

for a period of three years from the date of this order.

करने में जविल रिे िैं; और

1961 के जनयम 89 के उृ-जनयम (5) के अंतगात श्री दालाराम नाइक ृ ररका क अृने जनवााचन व्यय के लेखे प्रस्ट्तुत निीं करने के जलए

दिनांक 6 िुलाई, 2020 क कारण दताओ न रटस सं. 76/टीईएल-एचृी/2019/06 िारी दकया गया था; और

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/TEL-

HP/2019/06 dated 6th July, 2020 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by

the Election Commission of India to Shri Balaram Naik Porika, for not lodging of any accounts of his Election

Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Shri Balaram Naik Porika was directed to submit his representation in writing to the Commission

explaining the reason for not lodging the account and also to lodge his account of election expenses with the District

Election Officer, Mahabubabad within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Mahabubabad, has reported that the said notice was served to

Shri Balaram Naik Porika on 16th December, 2020; and

WHEREAS, the District Election Officer, Mahabubabad in his supplementary report, dated 1st May, 2021

reported that Shri Balaram Naik Porika, has not submitted any representation or a statement of correct account of his

O.N. 36.—WHEREAS, the General Election for16-Mahabubabad (ST) Lok Sabha, 2019, was announced by the

Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to

lodge a true copy of his accounts of election expenses within 30 days with the concerned District Election Officer, from

the date of election of the returned candidate; and

WHEREAS, the result of the election for16-Mahabubabad (ST) Lok Sabha, 2019 was declared by the Returning

Officer on 23rd May,2019 and hence the last date for lodging the accounts of Election Expenses was 23rd June, 2019;

and

WHEREAS, as per the report dated 25th June, 2019 submitted by the District Election Officer, Mahabubabad

District, Telangana, Shri Kalluri. Venkateswara Rao, a contesting candidate of Communist Party of India from

16-Mahabubabad (ST), Parliamentary Constituency of Lok Sabha 2019 from Telangana has failed to lodge any account

of his Election Expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, a Show-Cause notice No. 76/TEL-

HP/2019/06 dated 6th July, 2020 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by

the Election Commission of India to Shri Kalluri. Venkateswara Rao, for not lodging of account of his Election

Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Shri Kalluri. Venkateswara Rao was directed to submit his representation in writing to the

Commission explaining the reason for not lodging the account and also to lodge his account of election expenses with

the District Election Officer, Mahabubabad within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Mahabubabad, has reported that the said notice was served to

Shri Kalluri. Venkateswara Rao on 9th October, 2020; and

WHEREAS, the District Election Officer, Mahabubabad in his supplementary report, dated 1st May, 2021

reported that Shri Kalluri. Venkateswara Rao, has not submitted any representation or a statement of correct account of

his election expenses, duly signed along with original vouchers etc. Further, after receipt of the said notice, he has

neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the accounts as

prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under

this Act; and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order.”

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri Kalluri

Venkateswara Rao has failed to lodge his accounts of election expenses and has no good reason or justification for the

failure to do so; and

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission of India hereby declares Shri Kalluri. Venkateswara Rao, H.No. 1-32, Gannavaram Village, Charla

Mandal, Bhadradri Kothagudem District – 507133 Telangana and a contesting candidate from 16-Mahabubabad (ST)

Parliamentary Constituency of the State of Telangana in the General Election to the Lok Sabha-2019, to be disqualified
