(Land and Revenue Department), Darbhanga House, Ranchi- 834029 (Jharkhand) or at the office of the General

Manager, Central Coalfields Limited, Magadh Sanghamitra Area, Districts - Chatra and Latehar (Jharkhand) or

at the office of the Deputy Commissioner, Districts Chatra and Latehar (Jharkhand) or at the office of the

General Manager (Exploration Division), RI-III, Central Mine Planning and Design Institute Limited,

Gondwana Palace, Kanke Road, Ranchi (Jharkhand) or at the office of the Coal Controller, 1, Council House

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 4 of the Coal Bearing

Areas (Acquisition and Development) Act, 1957 (20 of 1957), (hereinafter referred to as the said Act) the

Central Government hereby gives notice of its intention to prospect for coal in land described in the aforesaid

Schedule ;

Any person interested in the land described in the above mentioned Schedule may -

(i) object to the acquisition of the whole or any part of the land or of any rights in or over the said

land; or

(ii)

claim compensation under section 6 of the said Act for any damage caused or likely to be caused

by any action taken under sub-section (3) of section 4 thereof; or

(iii) claim compensation under sub-section (1) of section 13 of the said Act in respect of prospecting

license ceasing to have effect or under sub-section (4) of section 13 of the said Act for mining

lease ceasing to have effect and deliver all maps, charts and other documents relating to the

aforesaid land to show the expenditure incurred in respect of items specified in clauses (i) to (iv)

of sub-section (1) of section 13 of the said Act,

to the office of the General Manager, Central Coalfields Limited, Magadh Sanghamitra Area, Districts - Chatra

and Latehar (Jharkhand) or General Manager, Central Coalfields Limited, Land and Revenue Department,

अतः, अब, केन्री सरकार, उक्त अजिजन म की िारा 11 की उृिारा (1) द्वारा प्रित्त िजक्त ों का प्र ोग

अविाररत सभी प्रजतकर, ब् ाि, नुकसाजन ों, इ्‍ ादि और वजसी िी मिों की बाबत् सभी संिा

करेगी ;

(2) सरकारी कंृनी द्वारा िता (1) के अिीन, संिे रकमों का अविारण करने के प्र ोिनों के जलए उक्त

अजिजन म की िारा 14 के अिीन एक अजिकरण का ग न दक ा िाएगा त ा ऐसे दकसी

अजिकरण और उक्त अजिकरण की सिा ता करने के जलए जन ुक्त व्यजक्त ों के संबंि में उृगत सभी

S.O. 501.—Whereas on the publication of the notification of the Government of India in the Ministry

of Coal, number S.O. 345, dated the 25^th May, 2021, published in the Gazette of India, Part II, Section 3, Sub-

section (ii), dated the 29^th May,2021, issued under sub-section (1) of section 9 of the Coal Bearing Areas

(Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), the lands and

the all rights in or over the land described in the Schedule appended to the said notification (hereinafter referred

to as the said lands) vested absolutely in the Central Government free from all encumbrances under sub-section

(1) of section 10 of the said Act ;

And whereas, the Central Government is satisfied that the Rajasthan Rajya Vidyut Utpadan Nigam

Limited, Vidyut Bhawan, Janpath, Jyoti Nagar, Jaipur (Rajasthan) (hereinafter referred to as the Government

company) is willing to comply with such terms and conditions as the Central Government thinks fit to impose in

this behalf ;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 11 of the said Act, the

Central Government hereby directs that the said lands measuring 1760.000 hectares (approximately) or

4348.960 acres (approximately) and all rights in or over the said lands so vested shall with effect from the

29^th May, 2021 instead of continuing to so vest in the Central Government, shall vest in the Government

company, subject to the following terms and conditions, namely:-

(1) The Government company shall make all payments in respect of compensation, interest, damages

and the like, as determined under the provisions of the said Act and other relevant law;

(2) A Tribunal shall be constituted under section 14 of the said Act, for the purpose of determining

the amounts payable by the Government company under condition (1) and all expenditure

incurred in connection with any such Tribunal and persons appointed to assist the Tribunal shall

be borne by the Government company and similarly, all expenditure incurred in respect of all

legal proceedings like appeals, etc. for or in connection with the rights, in or over the said lands,

so vested, shall also be borne by the Government company;

(3) The Government company shall indemnify the Central Government and its officials against any

other expenditure that may be necessary in connection with any proceedings by or against the

Central Government or its officials regarding the rights in or over the said lands so vested;

(4) The Government company shall have no power to transfer the aforesaid rights in the said lands so

vested to any other person without the prior approval of the Central Government; and

(5) The Government company shall abide by such directions and conditions as may be given or

imposed by the Central Government for particular areas of the said lands, as and when

necessary.

S.O. 502.—Whereas by the notification of the Government of India in the Ministry of Coal, number

S.O. 1074, dated the 18^th December, 2020, issued under sub-section (1) of section 7 of the Coal Bearing Areas

(Acquisition and Development) Act, 1957 (20 of 1957), (hereinafter referred to as the said Act), published in

the Gazette of India, Part II, Section 3, Sub-section (ii), dated the 19^th December 2020, the Central Government

gave notice of its intention to acquire the lands measuring 174.44 hectares (approximately) or 431.04 acres

(approximately) and surface rights over such lands specified in the Schedule appended to that notification;

And whereas, the competent authority in pursuance of section 8 of the said Act has made his report to the

Central Government;

And whereas, the Central Government after considering the aforesaid report and after consulting the

Government of Jharkhand is satisfied that the lands measuring 174.44 hectares (approximately) or 431.04 acres

(approximately) and any lands or surface rights over such lands as described in Schedule appended hereto

should be acquired;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 9 of the said Act, the

Central Government hereby declares that the land measuring 174.44 hectares (approximately) or 431.04 acres

(approximately) and surface rights in or over such lands as described in Schedule are hereby acquired.

Central Government vide Notification No.L-12012/69/2014-IR(B-I) Dated 11.12.2014, under clause

(d) of Sub-Section (1) and Sub-Section (2A) of Section 10 of the Industrial Disputes Act, 1947 (hereinafter

called the Act), has referred the following Industrial Dispute for adjudication to this Tribunal:-

“Whether the action of the management of serve Haryana Gramin Bank (formerly known as

Gurgaon Gramin Bank), Gurgaon in terminating the services of Sh. Suresh S/o Shri Om

Prakash w.e.f. 5.12.2013 is valid, just and legal? If not to what relief the concerned workman is

entitled to and from which date?”

Notices were issued to the claimant and respondent to make their presence. Workman made his

presence in person along with his counsel Shri. Arun Batra. It appears that inadvertently claimant and his

counsel could not file the claim statement due to other reference of co-workers by the Government of

India/Bharat Sarkar/Ministry of Labour/Shram Mantralya, while management has filed its written statement on

the assumption that workman has filed claim statement but zimini the assumption that workman has filed

claim statement but zimini order makes it clear that workman has not filed any claim statement so far.

During the pendency of the reference from the year 2016-2020 workman remained absent for long

time forcing the learned counsel of other workman Shri. A.R Kumar Batra to make statement that he is

withdrawing his authority as workman counsel from the case on 24.10.2019. Even in spite the statement of the

workman counsel withdrawing from the case Tribunal gave further Opportunity to workman for taking

participation the proceeding of the Tribunal but he did not turn-up forcing the Tribunal to close the evidence

of the workman making it a case of no evidence.

Perusal of file reveals that concerned workman is not turning for the paravi of the case for long time

and case is pending for the evidence of the workman for last more than two years. It is pertinent to mention that

it is not possible for Tribunal to proceed with the case in the absence of the workmen as well as statement of

the workmen-counsel regarding the withdrawal of his authority as a workmen-counsel.

In view of the above facts and statement made by the learned counsel of the workmen, this Tribunal

is left with no choice, except to pass a ‘No Dispute/Claim Award’. Since there is no adjudication of claim

petition or case on merits as such, it would not preclude the workmen from seeking fresh reference in

accordance with Law.

Let this award be sent to the appropriate Government, as required under Section 17 of the Industrial

Disputes Act, 1947 for publication.
