्ारा जनवााननों का संनालन जन म, 1961 के जन म 89 के उृ जन म (5) के अंतगात जनवाानन व्य प्रस्ट्तुत निीं करने के

जलए श्री अिुान लाल क कार बताओ न रटस दिनांक 13.08.2019 क िारी दक ा ग ा था;

रर त:, जनवााननों का संनालन जन म, 1961 के जन म 89 के उृ-जन म (6) के अनुसार, दिनांक

13.08.2019 के उृ ुाक् त कार बताओ न रटस के िररए श्री अिुान लाल क जनिेि दि ा ग ा था दक वे इस न रटस के

प्राप् त ि ने के 20 दिनों के अंिर द ग में लेखे न प्रस्ट् तुत कर ृाने के कार ों क स्ट् ृ्‍ ट करते ुएए जलजखत रूृ में अृना

New Delhi, the 28th March, 2022

O.N. 17.— WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 23-Karera Assembly Constituency was declared by the Returning Officer

concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 15.01.2019 submitted by the District Election Officer, Shivpuri

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec. Expenditure Account/6-Shivpuri/2019/856 dated 19.01.2019, Shri Arjuna Lal, Aam Aadmi Party,

contesting candidate from 23-Karera Assembly Constituency of Madhya Pradesh, failed to lodge any account of his

election expenses as required by law.

AND WHEREAS, on the basis of the report of the District Election Officer, Shivpuri District, Madhya

Pradesh, a Show Cause notice dated 13.08.2019 was issued by the Election Commission of India under Sub Rule (5)

of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Arjuna Lal for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the

above said Show Cause Notice dated 13.08.2019, Shri Arjuna Lal was directed to submit his representation in

writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete

accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the

notice;

AND WHEREAS, the said notice was received by Shri Arjuna Lal on 26.08.2019. Acknowledgment

receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Shivpuri

vide his letter No. Gen.Election/Expenditure /2020/198 dated 06.07.2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Shivpuri vide his

letter No. Gen.Election/2020/198 dated 06.07.2020 dated it has been stated that Shri Arjuna Lal has not submitted

any representation or a statement of correct account of his election expenses, duly signed along with original

vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after

receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Arjuna Lal has failed to lodge an account of election

expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period

of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Arjuna Lal, resident of 24, Ward No. 04 Rani Avanti Bai

Narwar, Tehsil-Narwar, District-Shivpuri the contesting candidate of Aam Admi Party for the General Election

to the Legislative Assembly of Madhya Pradesh, 2018 from 23-Karera Assembly Constituency, to be disqualified

for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative

Council of a State or Union Territory for a period of three years from the date of this order.

contesting candidate from 36-Khurai Assembly Constituency of Madhya Pradesh, failed to lodge any account of his

election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Sagar District, Madhya

Pradesh, a Show Cause notice dated 19.07.2019 was issued by the Election Commission of India under Sub Rule (5)

of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Anil Choubey (Annu Bhaiya)for non submission of

accounts of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the

above said Show Cause Notice dated 19.07.2019, Shri Anil Choubey (Annu Bhaiya) was directed to submit his

representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge

his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of

receipt of the notice;

O.N. 19.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 36-Khurai Assembly Constituency was declared by the Returning Officer

concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 16.01.2019 submitted by the District Election Officer, Sagar

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec.Expenditure Account/ 9-Sagar/2019/951 dated 20.01.2019, Shri Bhagwan Singh, Independent contesting

candidate from 36-Khurai Assembly Constituency of Madhya Pradesh, failed to lodge any account of his election

expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Sagar District, Madhya

Pradesh, a Show Cause notice dated 19.07.2019 was issued by the Election Commission of India under Sub Rule (5)

of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Bhagwan Singh for non submission of accounts of

Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said

Show Cause Notice dated 19.07.2019, Shri Bhagwan Singh was directed to submit his representation in writing to

the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of

election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Bhagwan Singh on 29.07.2019. Acknowledgment

receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Sagar vide

his letter No. Ass. Elec./2019/2082 dated 22.08.2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Sagar vide his letter

No. 266/Election/Elec.Obs./2020 dated 29.05.2020 it has been stated that Shri Bhagwan Singh has not submitted

any representation or a statement of correct account of his election expenses, duly signed along with original

vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after

receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Bhagwan Singh has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period

of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Bhagwan Singh, resident of Mahuna Gujar Tehsil Khurai

Rahatgarh Dist. Sagar, the contesting Independent candidate for the General Election to the Legislative Assembly

AND WHEREAS, on the basis of the report of the District Election Officer, Sagar District, Madhya

Pradesh, a Show Cause notice dated 19.07.2019 was issued by the Election Commission of India under Sub Rule (5)

of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Rajesh for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the

above said Show Cause Notice dated 19.07.2019, Shri Rajesh was directed to submit his representation in writing to

the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of

election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Rajesh on 28.07.2019. Acknowledgment receipt

obtained from the candidate have been submitted to the Commission by District Election Officer, Sagar vide his letter

No. Ass. Elec./2019/2082 dated 22.08.2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Sagar vide his letter

etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

Anarakshit Samaj Party contesting candidate from 63-Satna Assembly Constituency of Madhya Pradesh, failed to

lodge any account of his election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Satna District, Madhya Pradesh,

a Show Cause notice dated 31.07.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89

of the Conduct of Elections Rules, 1961 to Shri Shashank Singh for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 31.07.2019 to Shri Shashank Singh was directed to submit his representation in

writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete

accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the

notice;

And WHEREAS, the said notice was received by his brother on 03.10.2019. Acknowledgment receipt

obtained from the candidate has been submitted to the Commission by District Election Officer, Satna vide his letter

No. 610/E/15-25/Elec/Expenditure Account/2020 dated 02.09.2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Satna vide his letter

No. 610/E/15-25/Elec/Expenditure Account/2020 dated 02.09.2020 it has been stated that Shri Shashank Singh has

not submitted any representation or a statement of correct account of his election expenses, duly signed along with

original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even

after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Shashank Singh has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period

of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Shashank Singh, resident of Vill.Sonaura,Post – Belahta, Teh.-

Raghurajnagar, Distt.- Satna (m.p) the contesting Anarakshit Samaj Party candidate for the General Election to

the Legislative Assembly of Madhya Pradesh, 2018 from 63-Satna Assembly Constituency, to be disqualified for

being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative

Council of a State or Union Territory for a period of three years from the date of this order.

O.N. 26.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 63-Satna Assembly Constituency was declared by the Returning Officer

concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 16.01.2019 submitted by the District Election Officer, Satna

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter File No.

10-A/Four/Elec. Expenditure Account/14-Satna/2019/876 dated 19.01.2019, Shri Shyama Ahirwar (ShyamLal

Saket), Independent contesting candidate from 63-Satna Assembly Constituency of Madhya Pradesh, failed to

lodge any account of his election expenses as manner required by law.

AND WHEREAS, on the basis of the report of the District Election Officer, Satna District, Madhya Pradesh,

a Show Cause notice dated 31.07.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89

accounts of Election expenses;

तीन वषा की कालावजि के जलए जनरर्िात ि गा;

मध् प्रिेि राज् की जविान सभा के सािार जनवाानन, 2018 के 72-िेवतालाब जविान सभा जनवाानन क्षेे्र से जनवाानन

ल़कने वाले जनिाली अभ् थी, श्री गौरी िंकर साकेत, जनवासी 63 गांव लरििा ृ . लरििा ट ला बराि, वाडा सं. 04 थाना

लौर, ति. मऊगंि जि. रीवा मध् प्रिेि क संसि के दकसी भी सिन अथवा राज् अथवा संघ राज् क्षेे्र की जविानसभा

अथवा जविान ृररषि् के जलए सिस्ट् नुने िाने अथवा ि ने के जलए इस दिेि की तारीख से तीन वषा की अवजि के जलए

जनरर्िात घ जषत करता िै।

ORDER

New Delhi, the 28th March, 2022

O.N. 28.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 72-Deotalab Assembly Constituency was declared by the Returning Officer

concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 17.01.2019 submitted by the District Election Officer, Rewa

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec.Expenditure Account/15-Rewa/2019/931 dated 19.01.2019, Shri Gauri Shankar Saket, Independent

contesting candidate from 72-Deotalab Assembly Constituency of Madhya Pradesh, failed to lodge any account of

his election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Rewa District, Madhya Pradesh,

a Show Cause notice dated 12.09.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89

of the Conduct of Elections Rules, 1961 to Shri Gauri Shankar Saket for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 12.09.2019, Shri Gauri Shankar Saket was directed to submit his representation in

writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete

accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the

notice;

AND WHEREAS, the said notice was received by his son on 16.08.2020. Acknowledgment receipt obtained

from the candidate have been submitted to the Commission by District Election Officer, Rewa vide his letter No.

514/15/Election/ES/2020 dated 18.09.2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Rewa vide his letter

No. 539/15/Election/ES/2020 dated 28.09.2020 it has been stated that Shri Gauri Shankar Saket has not submitted

any representation or a statement of correct account of his election expenses, duly signed along with original

vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after

receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Gauri Shankar Saket has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period

of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Gauri Shankar Saket, resident of 63 Village-Pharahda, Post

Pharahda Tola Baraha Ward No 04 Thana Laur, Tehsil Mauganj District-Rewa, Madhya Pradesh, the

contesting Independent candidate for the General Election to the Legislative Assembly of Madhya Pradesh, 2018

from 72-Deotalab Assembly Constituency, to be disqualified for being chosen as and for being a member of either

House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of

three years from the date of this order.
