रर तः, ल क प्रजतजनजित्व अजिजन म, 1917 की िारा 78 के अनुसार, जनवाानन लडने वाले प्रत् ेक अभ् थी

ृरर ाम 11 दिसम्बर, 2018 क घ जषत दकए गए थे। इस प्रकार, जनवाानन व्य के लेखे िाजखल करने की अंजतम तारीख

10 िनवरी, 2019 थीः

रर तः, जिला जनवाानन अजिकारी, रा गढ़, ोत्तीसगढ़ ्ारा प्रस्ट्तुत रर मु्‍ जनवाानन अजिकारी, ोत्तीसगढ़

्ारा अृने दिनांक 29 िनवरी, 2019 के ृ्र सं. 21/नार/जव.स.नु./ई.ई.एम/2019/85 के िररए अग्रेजषत दिनांक

11 िनवरी, 2019 की ररृ टा के अनुसार श्री िेवानंि जनराला ि ोत्तीसगढ़ के 17-सारंगढ़ जविान सभा जनवाानन क्षेे्र से

जनवाानन लडने वाले भारती बहुिन कांग्रेस अभ् थी िैं, जवजि ्ारा थाृेजक्षेत रीजत से अृने जनवाानन व्य का क ई भी

लेखा िाजखल करने में जवफल रिे िै ।

रर तः, जिला जनवाानन अजिकारी, रा गढ़, ोत्तीसगढ़ रर मु्‍ जनवाानन अजिकारी, ोत्तीसगढ़ की ररृ टा के

दिार ृर जनवाानन द ग ्ारा जनवााननों का संनालन जन म 1961 के जन म 89 के उृ जन म (5) के अंतगात जनवाानन

व्य प्रस्ट्तुत निीं करने के जलए श्री िेवानंि जनराला क कार बताओ न रटस दिनांक 06 फरवरी, 2020 क िारी दक ा

रर तः, जनवााननों का संनालन जन म 1961 के जन म 89 के उृ-जन म (6) के अनुसार, दिनांक 06 फरवरी,

2020 के उृ ुक्त कार बताओ न रटस के िररए श्री िेवानंि जनराला क जनिेि दि ा ग ा था दक वे इस न रटस के प्राप्त

ि ने के 20 दिनों के अंिर लेखे न प्रस्ट्तुत कर ृाने के कार ों क स्ट्ृष्ट करते हुए जलजखत रूृ में अृना अभ् ावेिन प्रस्ट्तुत करें

150/जनवाा.ृ ा./2022 के िररए प्रस्ट्तुत की गई अनुृचरक ररृ टा में ि बता ा ग ा िै दक श्री िेवानंि जनराला ने दि की

तारीख तक न त क ई भी अभ् ावेिन रर न िी अृने जनवाानन व्य का लेखा िाजखल दक ा िै । इसके अजतररक्त उन्िोंने

जनवाानन द ग का सम् क न रटस जमलने के उृरांत भी उक्त जवफलता के जलए न त क ई कार बता ा िै रर न िी क ई

स्ट्ृष्टीकर दि ा िैः

रर तः, द ग का ि समािान ि ग ा िै दक श्री िेवानंि जनराला जनवाानन खनो का लेखा िाजखल करने में

जवफल रिे िैं रर उनके ृास इस जवफलता के जलए क ई भी उजनत कार अथवा रजनत् निी िै,

ORDER

New Delhi, the 26th April, 2022

O.N. 29.— WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced

by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6^thOctober, 2018. As per the schedule,

Date of Counting was 11^th December, 2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1917, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

17-Sarangarh Constituency on 11^th December, 2018. As such the last date for lodging of account of election expenses

was 10^th January, 2019.

AND WHEREAS, as per the report dated 11^th January, 2019 submitted by the District Election Officer,

Raigarh District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No.

21/नार/जव.स.नु./ई.ई.एम./2019/85, dated 29^thJanuary, 2019, Sh. Devanand Nirala, a contesting candidate of Bhartiya

Bahujan Congress from 17-Sarangarh Assembly Constituency of Chhattisgarh, has failed to lodge any account of

his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Raigarh District, Chhattisgarh

and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 06^th February, 2020 was issued by

Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to, Sh. Devanand

Nirala for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice, dated 06^th February, 2020, Sh. Devanand Nirala, was directed to submit his representation

in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of

election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned

within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by wife of Sh. Devanand Nirala, on 16^th February, 2020.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election

Officer, Raigarh vide his letter No. क्रमांक/498/कानचनग /2020 dated, 17^th February, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Raigarh vide his letter

No. 150/जनवाा./ृ ा./2022 dated, 24^th February, 2022 has stated that Sh. Devanand Nirala, has not submitted any

representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he

has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election

Commission of India as well;

AND WHEREAS, the Commission satisfied that Sh. Devanand Nirala, has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1917 stipulates that:-

"If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses within the time and in the manner required by law

or under this Act, and

(b)

has no good reason or justification for the failure,

Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from date of the order.”

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1917, the

Election Commission of India hereby declares Sh. Devanand Nirala, Vill-Singhanpur, P.O.-Pasid, Tehsil-

Sarangarh, Dist- Raigarh, Chhattisgarh and a contesting candidate of Bhartiya Bahujan Congress for General

Election to Legislative Assembly of Chhattisgarh, 2018 from 17-Sarangarh Constituency of the state of Chhattisgarh

to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative

Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this

order.

and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 06^th February, 2020 was issued by

O.N. 31.— WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced

by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6^thOctober, 2018. As per the schedule,

Date of Counting was 11^th December, 2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1917, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

17-Sarangarh Constituency on 11^th December, 2018. As such the last date for lodging of account of election expenses

was 10^th January, 2019.

AND WHEREAS, as per the report dated 11^th January, 2019 submitted by the District Election Officer,

Raigarh District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No.

21/चार/वि.स.चु./ई.ई.एम./2019/85, dated 29^thJanuary, 2019, Sh. Ravindra Kumar Ratre, a contesting candidate of

Sundar Samaj Party from 17-Sarangarh Assembly Constituency of Chhattisgarh, has failed to lodge any account of

his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Raigarh District, Chhattisgarh

and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 06^th February, 2020 was issued by

Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to, Sh. Ravindra

Kumar Ratre for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice, dated 06^th February, 2020, Sh. Ravindra Kumar Ratre, was directed to submit his

representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge

his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer

concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Ravindra Kumar Ratre, on 16^th February, 2020.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election

Officer, Raigarh vide his letter No. क्रमाांक/498/कानूनगो/2020 dated, 17^th February, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Raigarh vide his letter

No. 150/ननर्ाा./पर्ा./2022 dated, 24^th February, 2022 has stated that Sh. Ravindra Kumar Ratre, has not submitted

any representation or his account of election expenses, duly signed along with original vouchers etc. till date. Further,

he has furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the

Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Sh. Ravindra Kumar Ratre, has failed to lodge an

account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1917 stipulates that:-

"If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses within the time and in the manner required by law

or under this Act, and

(b)

has no good reason or justification for the failure,

Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from date of the order.”

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1917, the

Election Commission of India hereby declares Sh. Ravindra Kumar Ratre, Vill-Chhind, P.O.- Chhind, Tehsil-

Sarangarh, Dist- Raigarh, Chhattisgarh and a contesting candidate of Sundar Samaj Party for General Election

to Legislative Assembly of Chhattisgarh, 2018 from 17-Sarangarh Constituency of the state of Chhattisgarh to be

disqualified for being chosen as and for being a member of either House of Parliament or the Legislative

Parliamentary or legislative Council of a State or Union Territory for a period of three years from the date of this

order.

Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules,1961 to, Sh. Subhash Chouhan

for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice, dated 24^th June, 2021, Sh. Subhash Chouhan, was directed to submit his representation in

O.N. 34.— WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced

by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6^thOctober, 2018. As per the schedule,

Date of Counting was 11^th December, 2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1902, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

02-Manendragarh Constituency on 11^th December, 2018. As such the last date for lodging of account of election

expenses was 10^th January, 2019.

AND WHEREAS, as per the report dated 11^th January, 2019 submitted by the District Election Officer,

Korea, Baikunthpur, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No.

21/चार/वि.स.चु./ई.ई.एम./2019/85, dated 29^thJanuary, 2019, Sh. Deepak Kumar, an Independent contesting candidate

from 02-Manendragarh Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election

expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Korea Baikunthpur,

Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 28^th August, 2019 was issued

by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to, Sh.

Deepak Kumar for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice, dated 28th August, 2019, Sh. Deepak Kumar, was directed to submit his representation in

writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of

election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned

within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Deepak Kumar, on 10^thOctober, 2019.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election

Officer, Korea, Baikunthpur vide his letter No. 1044/सामान्र् ननर्ााचन/नोटिस/2019 dated, 14^thOctober, 2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Korea, Baikunthpur

vide his letter No. 265/सा.ननर्ाा./नोटिस/EEM/2022 dated, 24^th February, 2022 has stated that Sh. Deepak Kumar,

has not submitted any representation or his account of election expenses, duly signed along with original vouchers etc.

till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due

notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Sh. Deepak Kumar, has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1902 stipulates that:-

"If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses within the time and in the manner required by law

or under this Act, and

(b)

has no good reason or justification for the failure,

Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from date of the order.”

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1902, the

Election Commission of India hereby declares Sh. Deepak Kumar, Gelhapani, Chirmiri, Dist- Korea,

Chhattisgarh and an Independent contesting candidate for for General Election to Legislative Assembly of

Chhattisgarh, 2018 from 02-Manendragarh Constituency of the state of Chhattisgarh to be disqualified for being

chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or legislative

ORDER

New Delhi, the 27th April, 2022

O.N. 36.— WHEREAS, the General Election to Legislative Assembly of Chhattisgarh, 2018 was announced

by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6^thOctober, 2018. As per the schedule,

Date of Counting was 11^th December, 2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1902, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

02-Manendragarh Constituency on 11^th December, 2018. As such the last date for lodging of account of election

expenses was 10^th January, 2019.

AND WHEREAS, as per the report dated 11^th January, 2019 submitted by the District Election Officer,

Korea, Baikunthpur, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No.

21/चार/वि.स.चु./ई.ई.एम./2019/85, dated 29^thJanuary, 2019, Sh. Paratap Singh, a contesting candidate of Bhartiya

Panchayat Party from 02-Manendragarh Assembly Constituency of Chhattisgarh, has failed to lodge any account

of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Korea Baikunthpur,

Chhattisgarh and the Chief Electoral Officer, Chhattisgarh, a Show Cause Notice, dated 28^th August, 2019 was issued

by Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to,

Sh. Paratap Singh for non-submission of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice, dated 28th August, 2019, Sh. Paratap Singh, was directed to submit his representation in

writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of

election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned

within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Sh. Paratap Singh, on 09^thOctober, 2019.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election

Officer, Korea, Baikunthpur vide his letter No. 1044/सामान्र् ननर्ााचन/नोटिस/2019 dated, 14^thOctober, 2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Korea, Baikunthpur

vide his letter No. 265/सा.ननर्ाा./नोटिस/EEM/2022 dated, 24^th February, 2022 has stated that Sh. Paratap Singh, has

not submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till

date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due

notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Sh. Paratap Singh, has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1902 stipulates that:-

"If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses within the time and in the manner required by law

or under this Act, and

(b)

has no good reason or justification for the failure,

Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from date of the order.”

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1902, the

Election Commission of India hereby declares Sh. Paratap Singh, Vill+Post- Khadgawa, Tehsil- Khadgawa, Dist-

Korea, Chhattisgarh and a contesting candidate of Bhartiya Panchayat Party for General Election to Legislative

Assembly of Chhattisgarh, 2018 from 02-Manendragarh Constituency of the state of Chhattisgarh to be disqualified

for being chosen as and for being a member of either House of Parliament or the Legislative Parliamentary or

legislative Council of a State or Union Territory for a period of three years from the date of this order.
