की घ ष ा प्रेस न ट सं्‍या ईसीदई/प्रे.न ./66/2018 दिनांक 06.10.2018 के िररए की गई थी। कायाक्रम के अनुसार,

मतग ना की तारीख 11.12.2018 थी।

रर यत:, ल क प्रजतजनजित्व अजिजनयम, 1951 की िारा 78 के अनुसार, जनवाानन ल़कने वाले प्रत्येक अभ्यथी

क , जनवााजनत अभ्यथी के जनवाानन की तारीख से 30 दिनों के भीतर जनवाानन व्यय के अृने लेखे की सिी प्रजत जिला

घ जषत दकए गए थे। इस प्रकार, जनवाानन व्यय के लेखा िाजखल करने की अजन्तम तारीख 10.01.2019 थी।

रर यतः, मु्‍य जनवाानन अजिकारी, मध्य प्रिेि के दिनांक 19.01.2019 के ृ्र सं. 10-क/नार/जनवाा.व्यय

लेखा/6-जिवृुरी/2019/856 ्ारा अग्रेजषत जिला जनवाानन अजिकारी, जिवृुरी जिला, मध्य प्रिेि ्ारा दिनांक

15.01.2019 क प्रस्ट्तुत ररृ टा के अनुसार श्री MM सत्येन्र कुमार भागाव, मध्य प्रिेि के 27-क लारस जविान सभा

जनवाानन क्षेे्र से जनवाानन ल़कने वाले जिवसेना के अभ् यथी, अृने जनवाानन व्यय का क ई भी लेखा िाजखल करने में

असफल रिे ।

रर यतः, जिला जनवाानन अजिकारी, जिवृुरी जिला, मध्य प्रिेि की ररृ टा के दिार ृर भारत जनवाानन दय ग

्ारा जनवााननों का संनालन जनयम, 1961 के जनयम 89 के उृ जनयम (5) के अंतगात जनवाानन व्यय प्रस्ट्तुत निीं करने के

जलए श्री सत्येन्र कुमार भागाव क कार बताओ न रटस दिनांक 12/13.09.2019 क िारी दकया गया था;

रर यत:, जनवााननों का संनालन जनयम, 1961 के जनयम 89 के उृ-जनयम (6) के अनुसार, दिनांक

12/13.09.2019 के उृयुाक् त कार बताओ न रटस के िररए श्री सत्येन्र कुमार भागाव क जनिेि दिया गया था दक वे इस

न रटस के प्राप्त ि ने के 20 दिनों के अंिर दय ग में लेखे न प्रस्ट्तुत कर ृाने के कार ों क स्ट् ृ्‍ ट करते हुए जलजखत रूृ में

अृना अभ् यावेिन प्रस्ट्तुत करें रर साथ िी, ृच ा जनवाानन व्यय का लेखा संबंजित जिला जनवाानन अजिकारी क प्रस्ट्तुत करें;

रर यत:, उक्त न रटस उनके ्ारा 17.10.2019 क प्राप्त दकया गया था । अभ् यथी से प्राप्त ृावती रसीि जिला

जनवाानन अजिकारी, जिवृुरी ्ारा दिनांक 29.11.2019 के ृ्र सं्‍ या क्रमांक/सा.जनवाा./व्यय लेखा /2019/943 ्ारा

दय ग क प्रस्ट्तुत कर िी गई थी;

रर यत:, जिला जनवाानन अजिकारी, जिवृुरी ्ारा अृने दिनांक 22.02.2020 के ृ्र सं्‍ या

क्रमांक/सा.जनवाा./व्यय-लेखा /2020/42 के तित प्रस्ट्तुत की गई अनुृचरक ररृ टा में यि बताया गया िै दक श्री सत्येन्र कुमार

भागाव ने दि की तारीख तक न त क ई भी अभ् यावेिन रर न िी मचल वाउनरों ददि के साथ जवजिवत रूृ से िस्ट् ताक्षेररत

अृने जनवाानन व्यय के सिी लेखे का जववर प्रस्ट्तुत दकया िै। इसके अजतररक् त, उन्ि ने भारत जनवाानन दय ग का सम् यक्

न रटस जमलने के उृरांत भी उक् त असफलता के जलए न त क ई कार बताया िै रर न िी क ई स्ट् ृ्‍ टीकर दिया िै;

रर यत:, दय ग का यि समािान ि गया िै दक श्री सत्येन्र कुमार भागाव, जनवाानन व्यय का लेखा िाजखल

करने में असफल रिे िैं रर उनके ृास इस असफलता के जलए क ई भी उजनत कार अथवा न् याय जनत् य निीं िै;

रर यत:, ल क प्रजतजनजित् व अजिजनयम, 1951 की िारा 10क में अनुबंजित दकया गया िै दक:-

‘‘यदि जनवाानन दय ग का समािान ि िाता िै दक क ई व् यजक्त-

(क)

जनवाानन व् ययों का लेखा उस समय के भीतर रर उस रीजत में िैसी इस अजिजनयम के ्ारा या अिीन

अृेजक्षेत िै, िाजखल करने में असफल रिा िै; तथा

(ख)

उस असफलता के जलए क ई अच् ोा कार या न् याय जनत् य निीं रखता िै, त जनवाानन दय ग िासकीय

रािृ्र में प्रकाजित दिेि ्ारा उसक जनरर्िात घ जषत करेगा रर ासा व्यजक्त उस दिेि की तारीख से

तीन वषा की कालावजि के जलए जनरर्िात ि गा;

अत:, अब ल क प्रजतजनजित् व अजिजनयम, 1951 की िारा 10क के अनुसर में भारत जनवाानन दय ग एतद्द्वारा,

मध्य प्रिेि राज् य की जविान सभा के सािार जनवाानन, 2018 के 27-क लारस जविान सभा जनवाानन क्षेे्र से जनवाानन

ल़कने वाले जिवसेना के अभ् यथी, श्री सत्येन्र कुमार भागाव, जनवासी ग्राम भ़कौता तिसील क लारस जिला जिवृुरी

(म. प्र.) क संसि के दकसी भी सिन अथवा राज्य अथवा संघ राज्य क्षेे्र की जविानसभा अथवा जविान ृररषि् के जलए

सिस्ट्य नुने िाने अथवा ि ने के जलए इस दिेि की तारीख से तीन वषा की अवजि के जलए जनरर्िात घ जषत करता िै।

ORDER

New Delhi, the 4th May, 2022

O.N. 45.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 27- Kolaras Assembly Constituency was declared by the Returning Officer

concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 15.01.2019 submitted by the District Election Officer, Shivpuri

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter File No. 10-

A/Four/Elec. Expenditure Account/6- Shivpuri/2019/856 dated 19.01.2019, Shri Satyendra Kumar Bhargav,

contesting candidate of Shiv Sena from 27- Kolaras Assembly Constituency of Madhya Pradesh, failed to lodge any

account of his election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Shivpuri District, Madhya

Pradesh, a Show Cause notice dated 12/13.09.2019 was issued by the Election Commission of India under Sub Rule

(5) of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Satyendra Kumar Bhargav for non submission of

accounts of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 12/13.09.2019 to Shri Satyendra Kumar Bhargav was directed to submit his

representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge

his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of

receipt of the notice;

AND WHEREAS, said notice was received by him on 17.10.2019. Acknowledgment receipt obtained from

the candidate has been submitted to the Commission by District Election Officer, Shivpuri vide his letter

No./Gen.Elec./Expenditure account/2019/943 dated 29.11.2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Shivpuri vide his

letter No./Gen.Elec./Expenditure-account/2020/42 dated 22.02.2020 it has been stated that Shri Satyendra Kumar

Bhargav has not submitted any representation or a statement of correct account of his election expenses, duly signed

along with original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said

failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Satyendra Kumar Bhargav has failed to lodge an

account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period

of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Satyendra Kumar Bhargav, resident of Village Bhadota,

Tehsil Kolaras, Distt - Shivpuri (M.P.), the contesting Candidate of Shiv Sena for the General Election to the

Legislative Assembly of Madhya Pradesh, 2018 from 27- Kolaras Assembly Constituency, to be disqualified for

being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative

Council of a State or Union Territory for a period of three years from the date of this order.

के प्राप्त ि ने के 20 दिनों के अंिर दय ग में लेखे न प्रस्ट्तुत कर ृाने के कार ों क स्ट् ृ्‍ ट करते हुए जलजखत रूृ में अृना

अभ् यावेिन प्रस्ट् तुत करें रर साथ िी, ृच ा जनवाानन व्यय का लेखा संबंजित जिला जनवाानन अजिकारी क प्रस्ट् तुत करें;

of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Mahendra Singh Yadav for non submission of accounts

of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 21.01.2021 to Mahendra Singh Yadav was directed to submit his representation in

writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete

रर यतः, जिला जनवाानन अजिकारी, रायसेन जिला, मध्य प्रिेि की ररृ टा के दिार ृर भारत जनवाानन दय ग

जलए श्री मुन्ना क कार बताओ न रटस दिनांक 13.08.2019 क िारी दकया गया था;

रर यत:, जनवााननों का संनालन जनयम, 1961 के जनयम 89 के उृ-जनयम (6) के अनुसार, दिनांक

13.08.2019 के उृयुाक् त कार बताओ न रटस के िररए श्री मुन्ना क जनिेि दिया गया था दक वे इस न रटस के प्राप्त ि ने

के 20 दिनों के अंिर दय ग में लेखे न प्रस्ट्तुत कर ृाने के कार ों क स्ट् ृ्‍ ट करते हुए जलजखत रूृ में अृना अभ् यावेिन

प्रस्ट्तुत करें रर साथ िी, ृच ा जनवाानन व्यय का लेखा संबंजित जिला जनवाानन अजिकारी क प्रस्ट्तुत करें; रर यत:, उक्त

थी;

रर यत:, जिला जनवाानन अजिकारी, रायसेन ्ारा अृने दिनांक 29.12.2020 के ृ्र सं्‍ या 1870/23-

भा.जनवाा./2020 के तित प्रस्ट्तुत की गई अनुृचरक ररृ टा में यि बताया गया िै दक श्री मुन्ना ने दि की तारीख तक न त

क ई भी अभ् यावेिन रर न िी मचल वाउनरों ददि के साथ जवजिवत रूृ से िस्ट् ताक्षेररत अृने जनवाानन व्यय के सिी लेखे

Pradesh, a Show Cause notice dated 13.08.2019 was issued by the Election Commission of India under Sub Rule (5)

of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Munna for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the

above said Show Cause Notice dated 13.08.2019 to Shri Munna was directed to submit his representation in writing

to the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 197-Gandhwani (ST) Assembly Constituency was declared by the

Returning Officer concerned on 11.12.2018. As such the last date for lodging of account of election expenses was

10.01.2019.

AND WHEREAS, as per the report dated 17.01.2019 submitted by the District Election Officer, Dhar

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec.Expenditure Account/45-Dhar/2019/912 dated 19.01.2019, Shri. Aadiwasi Arvind Muzalda, the contesting

candidate of Gondvana Gantantra Party from 197-Gandhwani (ST) Assembly Constituency of Madhya Pradesh,

failed to lodge any account of his election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Dhar District, Madhya Pradesh,

a Show Cause notice dated 07.08.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule

89 of the Conduct of Elections Rules, 1961 to Shri. Aadiwasi Arvind Muzalda for non submission of accounts of

Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 07.08.2019, Shri. Aadiwasi Arvind Muzalda was directed to submit his

representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge

his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of

receipt of the notice;

AND WHEREAS, the said notice was received by him on 04.07.2020. Acknowledgment receipt obtained

from the candidate have been submitted to the Commission by District Election Officer, Dhar vide his letter No.

1553/Election/2020 dated 24.09.2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Dhar vide his letter

No. 1553/Election/2020 dated 24.09.2020 it has been stated that Shri. Aadiwasi Arvind Muzalda has not submitted

any representation or a statement of correct account of his election expenses, duly signed along with original

vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after

receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri. Aadiwasi Arvind Muzalda has failed to lodge an

account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order;

AND WHEREAS, on the basis of the report of the District Election Officer, Singrauli District, Madhya

Pradesh, a Show Cause notice dated 01.08.2019 was issued by the Election Commission of India under Sub Rule (5)

of Rule 89 of the Conduct of Elections Rules, 1961 to Smt. Shikha Singh for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 01.08.2019, Smt. Shikha Singh was directed to submit his/her representation in

writing to the Commission explaining the reason for non submission of accounts and also to lodge his/her complete

AND WHEREAS, the said notice was received by her husband on 07.09.2019. Acknowledgment receipt

obtained from the candidate has been submitted to the Commission by District Election Officer, Singrauli vide his

letter No. 1835/Gen. Elec./2019 dated 17.09.2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Singrauli vide his

letter No. 417/Gen. Elec./2020 dated 06.11.2020, it has been stated that Smt. Shikha Singh has not submitted any

representation or a statement of correct account of her election expenses, duly signed along with original vouchers

etc. till date. Further, She has neither furnished any reason nor explanation for the said failure even after receipt of the

due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Smt. Shikha Singh has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period

of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Smt. Shikha Singh w/o Omprakash Shingh resident of Indira

Ward, Ganiyari, Thana-Waidhan, Dist- Singrauli (M.P.) the contesting Candidate of Samajwadi party for the

schedule, the Date of Counting of votes was 11.12.2018.

O.N. 56.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 67-Rampur Baghelan Assembly Constituency was declared by the

Returning Officer concerned on 11.12.2018. As such the last date for lodging of account of election expenses was

10.01.2019.

AND WHEREAS, as per the report dated 16.01.2019 submitted by the District Election Officer, Satna

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec.Expenditure Account/14-Satna/2019/876 dated 19.01.2019, Shri. Pankaj Singh, the contesting candidate of

Rashtriya Sanyukt Samaj Party from 67-Rampur Baghelan Assembly Constituency of Madhya Pradesh, failed to

lodge any account of his election expenses. AND WHEREAS, on the basis of the report of the District Election

Officer, Satna District, Madhya Pradesh, a Show Cause notice dated 03.07.2020 was issued by the Election

Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Shri. Pankaj Singh

for non submission of accounts of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 03.07.2020, Shri. Pankaj Singh was directed to submit his representation in writing

to the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of

election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by his Uncle on 17.07.2020. Acknowledgment receipt

obtained from the candidate have been submitted to the Commission by District Election Officer, Satna vide his letter

No. 610/E/15-25/Elec./Expenditure Account/2020 dated 02.09.2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Satna vide his letter

No. 610/E/15-25/Elec./Expenditure Account/2020 dated 02.09.2020 it has been stated that Shri. Pankaj Singh has

not submitted any representation or a statement of correct account of his election expenses, duly signed along with

original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even

after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri. Pankaj Singh has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law

or under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a

period of three years from the date of the order;

O.N. 59.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 80- Singrauli Assembly Constituency was declared by the Returning Officer

concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 15.01.2019 submitted by the District Election Officer, Singrauli

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter File No. 10-

A/Four/Elec.Expenditure Account/17- Singrauli /2019/872 dated 19.01.2019, Shri Ramlakhan Sharma, the

contesting Independent Candidate from 80- Singrauli Assembly Constituency of Madhya Pradesh, failed to lodge

any account of his election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Singrauli District, Madhya

Pradesh, a Show Cause notice dated 01.08.2019 was issued by the Election Commission of India under Sub Rule (5)

of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Ramlakhan Sharma for non submission of accounts of

Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 01.08.2019, Shri Ramlakhan Sharma was directed to submit his/her representation in

writing to the Commission explaining the reason for non submission of accounts and also to lodge his/her complete

accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the

notice;

AND WHEREAS, the said notice was received by him on 07.09.2019. Acknowledgment receipt obtained

from the candidate has been submitted to the Commission by District Election Officer, Singrauli vide his letter No.

1835/Gen. Elec./2019 dated 17.09.2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Singrauli vide his

letter No. 417/Gen. Elec./2020 dated 06.11.2020, it has been stated that Shri Ramlakhan Sharma has not

submitted any representation or a statement of correct account of his/her election expenses, duly signed along with

original vouchers etc. till date. Further, he/She has neither furnished any reason nor explanation for the said failure

even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Ramlakhan Sharma has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period

of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Ramlakhan Sharma, resident of Village PO-Kachani, PS-

Waidhan, Tehsil- Dist- Singrauli (M.P.) the contesting Independent Candidate for the General Election to the

O.N. 62.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 156-Budni Assembly Constituency was declared by the Returning Officer

concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 17.01.2019 submitted by the District Election Officer, Sehore

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec.Expenditure Account/35-Sehore/2019/924 dated 19.01.2019, Shri Prem Singh, Independent contesting

candidate from 156-Budni Assembly Constituency of Madhya Pradesh, failed to lodge any account of his election

expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Sehore District, Madhya

Pradesh, a Show Cause notice dated 25.03.2019 was issued by the Election Commission of India under Sub Rule (5)

of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Prem Singh for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 25.03.2019, Shri Prem Singh was directed to submit his representation in writing to

the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of

election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by him on 07.04.2019. Acknowledgment receipt obtained from the

candidate have been submitted to the Commission by District Election Officer, Sehore vide his letter No.

265/Elec./Leg.Ass.2018./2020 dated 26.09.2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Sehore vide his letter

No. 265/Elec./Leg.Ass.2018./2020 dated 26.09.2020 it has been stated that Shri Prem Singh has not submitted any

representation or a statement of correct account of his election expenses, duly signed along with original vouchers

etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the

due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Prem Singh has failed to lodge an account of election

expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Prem Singh, resident of Village and Post – Semari, Tehsil –

Rehti, District - Sehore, the contesting Independent candidate for the General Election to the Legislative Assembly

of Madhya Pradesh, 2018 from 156-Budni Assembly Constituency, to be disqualified for being chosen as and for

being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union

Territory for a period of three years from the date of this order.

Adhikar Party from 79-Chitrangi Assembly Constituency of Madhya Pradesh, failed to lodge any account of his

election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Singrauli District, Madhya

Pradesh, a Show Cause notice dated 01.08.2019 was issued by the Election Commission of India under Sub Rule (5)

of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Paras Kol for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the

due notice to the Election Commission of India as well;
