सिमित के कायᭅ

सिमित का कायᭅ संिवधान मᱶ राजभाषा संबंधी ᮧावधानᲂ, राजभाषा अिधिनयम व िनयम के उपबंधᲂ, कᱶᮤीय िहंदी सिमित के नीितगत

िनणᭅयᲂ, तथा राजभाषा िवभाग, गृह मंᮢालय ᳇ारा जारी िकए गए िनदेशᲂ और अनुदेशᲂ के अनुसार नीित आयोग और इसके संब᳍/अधीन᭭थ

कायाᭅलयᲂ के कामकाज की समीᭃा करना और िहंदी के ᮧगामी ᮧयोग को बढ़ाने के बारे मᱶ सलाह देना होगा।

कायᭅ अविध

सिमित का कायᭅकाल उसके गठन की तारीख से िन᭥ निलिखत शतᲄ के अधीन सामा᭠यतः 3 वषᭅ का होगा:—

जो संसद सद᭭य सिमित के सद᭭य हᱹ, वे संसद सद᭭य न रहने पर इस सिमित के सद᭭य नहᱭ हᲂगे।

सिमित के पदेन सद᭭य अपने पद पर कायᭅ करते रहने तक ही सिमित के सद᭭य रहᱶगे।

)

ग

(

सिमित के कायᭅकाल की अविध मᱶ यिद िकसी सद᭭य की मृ᭜यु हो जाने अथवा सिमित की सद᭭यता से ᭜याग-पᮢ देने के कारण,

िरᲦ ᱟए ᭭थान पर िकसी अ᭠य ᳞िᲦ को सिमित का सद᭭य नािमत िकया जाता है, तो वह सिमित के कायᭅकाल की शेष अविध

के िलए ही सद᭭य रहेगा।

एवं िनयमᲂ के अनुसार याᮢा भᱫा और दैिनक भᱫा िदया जाएगा।

सिमित का मु᭎यालय नई िद᭨ली मᱶ होगा और िहंदी सलाहकार सिमित की बैठक का आयोजन िद᭨ली ᭃेᮢ मᱶ ही िकया जाना

अपेिᭃत है।

आदेश

आदेश िदया जाता है िक इस संक᭨प की ᮧित सभी रा᭔य सरकारᲂ और संघ रा᭔य ᭃेᮢ ᮧशासनᲂ, भारत सरकार के सभी मंᮢालयᲂ

तथा िवभागᲂ, रा᭬ ᮝपित सिचवालय, ᮧधान मंᮢी कायाᭅलय, मंिᮢमंडल सिचवालय, संसदीय कायᭅ मंᮢालय, लोक सभा सिचवालय, रा᭔य सभा

सिचवालय, संसदीय राजभाषा सिमित, भारत के िनयंᮢक और महालेखा परीᭃक और नीित आयोग के वेतन एवं लेखा कायाᭅलय तथा सभी

िनयंᮢणाधीन संब᳍/अधीन᭭थ कायाᭅलयᲂ/᭭वायᱫ संगठनᲂ को भेजी जाए।

यह भी आदेश िदया जाता है िक इस संक᭨प को जनसाधारण की जानकारी के िलए भारत के राजपᮢ मᱶ ᮧकािशत िकया जाए।

नई िद᭨ली, िदनांक 24 मई 2022

सं. 10/4/2018-यू.3(ए)—कᱶᮤ सरकार को िव᭫ विव᳒ालय अनुदान आयोग (यूजीसी) अिधिनयम, 1956 की धारा 3 के तहत, िकसी

उ᭒ च िशᭃण सं᭭थान को यूजीसी की सलाह पर समवत िव᭫ विव᳒ालय घोिषत करने का अिधकार है।

2. और, कᱶᮤ सरकार ने, यूजीसी अिधिनयम, 1956 की धारा 3 ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, यूजीसी की सलाह पर,

िदनांक 21.01.2003 की अिधसूचना सं᭎या 9-1/2002-यू.3 के ᳇ारा डॉ. एमजीआर शैिᭃक और अनुसंधान सं᭭थान, मदुरावोयल, चै᭠ नई,

तिमलनाडु को िजसमᱶ (i) थाई मूगाि᭥बगई डᱶटल कॉलेज और अ᭭पताल, चै᭠ नई और (ii) डॉ एमजीआर इंजीिनयिरंग कॉलेज, मदुरावोयल, चै᭠ नई

शािमल हᱹ; तीन साल की अनंितम अविध के िलए समवत िव᭫ विव᳒ालय घोिषत िकया था। इसके प᳟ात, सरकार ᳇ारा यूजीसी की सलाह पर,

इसके समवत िव᭫ विव᳒ालय के दजᱷ की अविध को बढ़ा िदया गया था।

3. और, डॉ एमजीआर शैिᭃक और अनुसंधान सं᭭ थान, चे᭠ नई के रिज᭭ᮝार ने िदनांक 18.06.2018 को आवेदन िकया था िक

राजाराजे᭫ वरी मेिडकल कॉलेज एवं अ᭭ पताल (आरआरएमसीएच), बᱶगलुᱧ, कनाᭅटक को समवत िव᭫ विव᳒ालय के दायरे मᱶ लाया जाए। उ᭍ त

आवेदन यूजीसी (समवत िव᭫ विव᳒ालय सं᭭थान) िविनयम, 2016 के अनुसरण मᱶ जांच और सलाह के िलए यूजीसी को भेज िदया गया था।

4. और, कᱶᮤ सरकार ने यूजीसी अिधिनयम, 1956 की धारा 3 ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, यूजीसी की सलाह पर,

िदनांक 14.02.2019 की अिधसूचना सं᭎या 10/4/2018-यू3.ए के ᳇ारा राजाराजे᭫ वरी मेिडकल कॉलेज एवं अ᭭ पताल, बᱶगलुᱧ, कनाᭅटक को

एक घटक सं᭭थान के ᱨप मᱶ डॉ एमजीआर शैिᭃक और अनुसंधान सं᭭ थान (समवत िव᭫ विव᳒ालय), चै᭠ नई, तिमलनाडु के दायरे मᱶ शािमल

करने का अनुमोदन कर िदया था।

5. और, इस मंᮢालय की िदनांक 14.02.2019 की अिधसूचना की एक ᮧित कुलपित, राजीव गांधी ᭭वा᭭᭝य िव᭄ान िव᭫ विव᳒ालय,

बᱶगलुᱧ, कनाᭅटक को भी इस अनुरोध के साथ पृ᭬ ठांिकत की गई थी िक वे राजाराजे᭫ वरी मेिडकल कॉलेज एवं अ᭭ पताल, बᱶगलुᱧ को अपने

िव᭫ विव᳒ालय के दायरे से हटाने की िदशा मᱶ आव᭫यक कारᭅवाई करᱶ। चूंिक कनाᭅटक रा᭔य सरकार ने राजाराजे᭫ वरी मेिडकल कॉलेज एवं

अ᭭ पताल, बᱶगलुᱧ, कनाᭅटक को डॉ एमजीआर शैिᭃक और अनुसंधान सं᭭ थान (समवत िव᭫ विव᳒ालय), चे᭠ नई, तिमलनाडु के दायरे मᱶ शािमल

करने के ᮧ᭭ताव को इस आधार पर अ᭭ वीकार कर िदया था िक यह कनाᭅटक के छाᮢᲂ के िलए लाभᮧद नहᱭ होगा, अत: राजीव गांधी ᭭वा᭭᭝य

िव᭄ान िव᭫ विव᳒ालय, बᱶगलुᱧ ने राजाराजे᭫ वरी मेिडकल कॉलेज एवं अ᭭ पताल को अपने दायरे से बाहर करने से इंकार कर िदया था।

6. और, इससे ᭃु᭣ध होकर, राजाराजे᭫ वरी मेिडकल कॉलेज एवं अ᭭पताल चलाने वाले मूगाि᭥बगई चैिरटेबल एंड एजुकेशनल ᮝ᭭ट ने

माननीय उ᭒ च ᭠यायालय, कनाᭅटक के समᭃ िरट यािचका सं. 7482/2020 दायर की। साथ ही, कनाᭅटक सरकार ने भी िशᭃा मंᮢालय की

िदनांक 14.02.2019 की अिधसूचना को चुनौती देते ᱟए िरट यािचका सं. 9236/2020 दायर की। माननीय उ᭒ च ᭠यायालय, कनाᭅटक ने

िदनांक 03.11.2020 के आदेश ᳇ारा िरट यािचका सं. 7482/2020 को खािरज कर िदया और इस मंᮢालय की िदनांक 14.02.2019 की

अिधसूचना को र᳎ करते ᱟए कनाᭅटक रा᭔य सरकार ᳇ारा दायर िरट यािचका सं. 9236/2020 की अनुमित दी।

समᭃ ड᭣᭨यूए सं᭎या 549/2020 और 550/2020 दायर की। माननीय कनाᭅटक उ᭒ च ᭠यायालय की खंडपीठ ने िदनांक 30.11.2021 के िनणᭅय

के ᳇ारा उपरोᲦ िरट अपीलᲂ का िनपटारा िन᭥ नानुसार िकया:—

"अंत मᱶ मामले को यूजीसी तथा कᱶᮤ सरकार पर छोड़ा जाता है और उ᭠ हᱶ िनदेश िदया जाता है िक वे िविनयमᲂ के िविनयम 13.09 मᱶ

िनिहत अिधदेश का पालन करᱶ और इस आदेश की ᮧमािणत ᮧित ᮧा᳙ होने की तारीख से दो महीने की अविध के भीतर रा᭔य सरकार

के मत को ᭟यान मᱶ रखते ᱟए एक ᭭पीिकंग ऑडᭅर ᳇ारा अपीलकताᭅ सं᭎या 2 को अपीलकताᭅ सं᭎या 3 के दायरे मᱶ शािमल करने के

संबंध मᱶ िनणᭅय लᱶ।"

8. और, माननीय ᭠यायालय के िदनांक 30.11.2021 के आदेश के अनुसरण मᱶ, यूजीसी से कहा गया था िक वे यूजीसी (समवत

िव᭫ विव᳒ालय सं᭭थान) िविनयम, 2016 के खंड 13.09 के अनुसार कनाᭅटक रा᭔य सरकार के मत पर िवचार करᱶ और अपनी सलाह ᮧ᭭तुत

करᱶ। तदनुसार, यूजीसी ने िदनांक 10.03.2022 को ᱟई आयोग की 556वᱭ बैठक मᱶ इस मामले पर िवचार िकया िजसमᱶ िन᭥ निलिखत संक᭨ प

पािरत िकया गया: —

“आयोग ने राजा राजे᭫ वरी मेिडकल कॉलेज और अ᭭ पताल, बᱶगलुᱧ को डॉ एम.जी.आर शैिᭃक और अनुसंधान सं᭭थान (समवत

िव᭫ विव᳒ालय), चै᭠ नई (तिमलनाडु) के दायरे मᱶ लाने संबंधी कनाᭅटक सरकार के मत पर िवचार िकया और िशᭃा मंᮢालय को

िदनांक 14.02.2019 की अिधसूचना सं᭎या 10/4/2018-यू3 (ए) को वापस लेने की िसफािरश करने का िनणᭅय िलया।”

9. अत: अब, यूजीसी की सलाह को ᭟यान मᱶ रखते ᱟए, कᱶᮤ सरकार, यूजीसी अिधिनयम, 1956 की धारा 3 ᳇ारा ᮧदᱫ शिᲦयᲂ का

ᮧयोग करते ᱟए, एत᳏ारा, अपनी िदनांक 14.02.2019 की अिधसूचना सं᭎या 10/4/2018-यू3 (ए) को वापस लेती है, िजसके ᳇ारा

राजाराजे᭫ वरी मेिडकल कॉलेज और अ᭭ पताल, बᱶगलुᱧ, कनाᭅटक को डॉ एमजीआर शैिᭃक एवं अनुसंधान सं᭭ थान (समवत िव᭫ विव᳒ालय),

FUNCTION OF THE COMMITTEE

The function of the Committee will be to review the position and tender advice in regard to progressive use of Hindi

for official purpose in the NITI Aayog, it’s attached and subordinate offices etc. in accordance with the constitutional

provisions regarding Official Language, policy decisions of the Kendriya Hindi Samiti, Official Language Act & Rules and

instructions & directions issued by the Department of Official Language, Ministry of Home Affairs on the subject.

3.

TENURE.

The term of the Committee will be three years from the date of formation provided that:—

(a)

Members of Parliament who are the members of the Committee shall cease to be members as soon as they

cease to be Members of Parliament.

(b) Ex-officio Members of the Committee shall continue as Members as long as they hold the office by virtue of

which they are Members of the Committee.

(c)

If a vacancy arises, on the Committee due to resignation or death of a Member, the Member appointed in that

capacity shall hold the office for the residual term for rest duration.

(d) Tenure of the Committee can be extended or curtailed in the special circumstances.

4.

TRAVELLING AND OTHER ALLOWANCES

Non Official members of the Committee will be paid Travelling allowance and daily allowance for attending

meetings of the Committee at the rates prescribed as per O.M.No. II/20034/4/86-O.L. (A-2) dated 22nd January, 1987 of

Department of Official Language and in accordance with the prescribed rates and rules as amended from time to time by the

Government of India.

5.

GENERAL

Headquarter of the Committee will be at New Delhi and And the meeting of Hindi Salahkar Samiti is expected to be

organized in Delhi region only.

Ordered that a copy of the Resolution be communicated to all the State Governments and Union Territory

Administration, All Ministries/Departments of Government of India, President’s Secretariat, Prime Minister’s Office, Cabinet

No. 10/4/2018-U.3(A)—Whereas, the Central Government is empowered under Section 3 of the University Grants

Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an institution of higher learning as an institution

deemed-to-be-university.

2. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government,

vide Notification No. 9-1/2002-U.3 dated 21.01.2003, on the advice of UGC, had declared Dr. MGR Educational and

Research Institute, Maduravoyal, Chennai, Tamil Nadu consisting of (i) Thai Moogambigai Dental College and Hospital,

Chennai; and (ii) Dr. MGR Engineering College, Maduravoyal, Chennai, as an Institution deemed to be University, for the

provisional period of three years. Subsequently, the status of deemed to be University was extended by the Government, on

the advice of UGC.

3. And whereas, an application was submitted by Registrar, Dr. MGR Educational & Research Institute, Chennai on

18.06.2018 for inclusion of RajaRajeswari Medical College & Hospital (RRMCH), Bengaluru, Karnataka under the ambit of

the deemed to be University. The application was sent to UGC for examination and advice as per the UGC (Institutions

Deemed to be Universities) Regulations, 2016.

4. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government,

vide Notification No.10/4/2018-U3.A dated 14.02.2019, on the advice of the UGC, accorded its approval for inclusion of

RajaRajeswari Medical College & Hospital, Bengaluru, Karnataka under ambit of Dr. MGR Educational and Research

Institute (Deemed to be University), Chennai, Tamil Nadu as Constituent Institution.

5. And whereas, a copy of this Ministry’s Notification dated 14.02.2019 was also endorsed to the Vice-Chancellor,

Rajiv Gandhi University of Health Sciences, Bengaluru, Karnataka with request to take necessary action towards

disaffiliation of RajaRajeswari Medical College & Hospital, Bengaluru from its ambit. Since the State Government of

Karnataka rejected the proposal of the Dr. MGR Educational and Research Institute (Deemed to be University), Chennai,

Tamil Nadu for inclusion of RajaRajeswari Medical College & Hospital, Bengaluru, Karnataka under its ambit citing the

reason that it will not benefit the students of Karnataka, Rajiv Gandhi University of Health Science, Bengaluru denied

disaffiliating RajaRajeswari Medical College & Hospital from its ambit.

6. And whereas, aggrieved by this, Moogambigai Charitable and Educational Trust running Rajarajeswari Medical

College and Hospital filed W.P. No.7482 of 2020 in the Hon'ble High Court of Karnataka. At the same time, the Government

of Karnataka also filed W.P. No.9236/2020 challenging the ambit Notification dated 14.02.2019 of Ministry of Education.

The Hon'ble High Court of Karnataka vide order dated 03.11.2020 dismissed W.P. 7482/2020 and allowed W.P. 9236 of

2020 filed by the State Government of Karnataka quashing this Ministry’s Notification dated 14.02.2019.

7. And further whereas, Moogambigai Charitable and Educational Trust and Dr. M.G.R. Educational and Research

Institute Chennai filed W.A. No.549/2020 and 550/2020 in Hon'ble High Court of Karnataka challenging the order dated

03.11.2020 of Hon’ble Single Bench of Karnataka High Court. The Hon'ble Division Bench of Karnataka High Court vide

Judgement dated 30.11.2021 disposed of the above Writ Appeals holding the following:—

"In the result, the matter is remitted to the UGC as well as the Central Government with a direction to

comply with the mandate contained in Regulation 13.09 of the Regulations and to take a decision with regard

to inclusion of the Appellant no. 2 under the ambit of the Appellant no. 3 by a speaking order after taking into

account the views of the State Government within a period of two months from the date of receipt of the

certified copy of this order".

8. And whereas, pursuant to the Order dated 30.11.2021 of the Hon’ble Court, UGC was asked to consider the views

of State Government of Karnataka as per Clause 13.09 of the UGC (Institutions Deemed to be Universities) Regulations,

2016 and furnish its advice. Accordingly, UGC considered this matter in its 556^th Commission meeting held on 10.03.2022 in

which the following resolution was passed:—

“The Commission considered the views of the Government of Karnataka on the inclusion of Raja Rajeswari

Medical College and Hospital, Bengaluru under the ambit of dr. M.G.R. Educational and Research Institute

(Deemed to be University), Chennai (TN) and decided to recommend to the Ministry of Education for

withdrawal of the Notification No.10/4/2018-U3(A) dated 14.02.2019.”

9. Now, therefore, taking into consideration the advice of UGC, the Central Government, in exercise of the powers

conferred by Section 3 of the UGC Act, 1956, hereby withdraws its Notification No.10/4/2018-U3(A) dated 14.02.2019 vide

which RajaRajeswari Medical College & Hospital, Bengaluru, Karnataka was brought under the ambit of Dr. MGR

Educational and Research Institute (Deemed to be University), Chennai, Tamil Nadu.
