सं. ए-12(11)1/2009-िच.-VI-(भाग-I-डी).—कमᭅचारी रा᭔य बीमा अिधिनयम, 1948 (1948 का 34) की धारा 97 की उप-धारा

(2) के खंड (xxi) तथा उप-धारा (2क) के साथ पिठत उ᭍ त धारा की उप-धारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ तथा धारा 17 की उप-धारा (3) का

ᮧयोग करते ᱟए तथा कमᭅचारी रा᭔य बीमा िनगम (िचिक᭜सा िशᭃण संकाय पद) भतᱮ िविनयम, 2015 के अिधᮓमण मᱶ, जहां तक िक वे

"सहायक आचायᭅ" के पद से संबंध रखते हᱹ, ऐसे अिधᮓमण से पहले की गई अथवा िकए जाने से िवलोिपत बातᲂ के अलावा, कमᭅचारी रा᭔य

बीमा िनगम कᱶᮤीय सरकार के अनुमोदन से एत᳇ारा कमᭅचारी रा᭔य बीमा िनगम के िचिक᭜सा महािव᳒ालयᲂ मᱶ सहायक आचायᭅ के पद की भतᱮ

को िविनयिमत करने हेतु िन᭥ निलिखत िविनयम बनाता है, नामत :—

संिᭃ᳙ नाम और ᮧार᭥भ : (1) ये िविनयम कमᭅचारी रा᭔य बीमा िनगम, "सहायक आचायᭅ भतᱮ िविनयम, 2022" कहे जाएंगे।

(2) ये शासकीय राजपᮢ मᱶ इनके ᮧकाशन की ितिथ से लागू हᲂगे।

पदᲂ की सं᭎या, वगᱮकरण और वेतन मैिᮝ᭍स मᱶ वेतन लेवल:—पद की सं᭎या, उनका वगᱮकरण और उनसे संब᳍ वेतन मैिᮝ᭍स मᱶ

लेवल इन िविनयमᲂ के साथ संल᭏ न उ᭍ त अनुसूची के कॉलम (2) से (4) मᱶ यथा िविनिदᭅ᭬ ट होगा।

भतᱮ की प᳍ित, आयु-सीमा, अहᭅताएं, आिद :—भतᱮ की प᳍ित, आयु-सीमा, अहᭅताएं और उ᭍ त पदᲂ से संबंिधत अ᭠य मामले उ᭍ त

अनुसूची के कॉलम (5) से (13) मᱶ यथा िविनिदᭅ᭬ ट हᲂगे।

चयन बोडᭅ का गठन:—(1) चयन बोडᭅ मᱶ िन᭥ निलिखत शािमल हᲂगे:—

(क) भारत सरकार के सिचव या अितिर᭍ त सिचव के समकᭃ ᮧाि᭭थित का अंशकािलक अ᭟यᭃ अथवा वह ᳞िᲦ िजसने

भारत सरकार के सिचव या अितिर᭍ त सिचव के समकᭃ पद धािरत िकया हो, िजसे सिचव, ᮰म एवं रोजगार मंᮢालय

या महािनदेशक, कमᭅचारी रा᭔य बीमा िनगम ᳇ारा, अ᭟यᭃ, कमᭅचारी रा᭔य बीमा िनगम के िविश᭬ ट पूवᭅ अनुमोदन से

िनयु᭍ त िकया जाएगा;

(ख) िजस िवषय या िवशेषीकृत ᭃेᮢ के संबंध मᱶ भतᱮ की जानी है, उससे जुड़े दो िचिक᭜सा िवशेष᭄ जो महािनदेशक,

कमᭅचारी रा᭔य बीमा िनगम ᳇ारा इस ᮧयोजनाथᭅ अनुरिᭃत िवशेष᭄ᲂ के पैनल से हो, अ᭟यᭃ, चयन बोडᭅ ᳇ारा चुने

जाएंगे; तथा

(ग)

िचिक᭜सा आयु᭍ त, कमᭅचारी रा᭔य बीमा िनगम नई िद᭨ली मᱶ िवभागीय िवशेष᭄ हᲂगे और अ᭠य रा᭔यᲂ या िशᭃण

सं᭭थाᲐ के मामले मᱶ, संबंिधत रा᭔य या िशᭃण सं᭭थाᲐ के संकाया᭟यᭃ िवभागीय िवशेष᭄ हᲂगे:

परंतु िक᭠हᱭ कारणᲂ से ये अिधकारी उपल᭣ध नहᱭ होते हᱹ तो महािनदेशक िकसी अ᭠य अिधकारी को िवभागीय

िवशेष᭄ के ᱨप मᱶ नािमत कर सकते हᱹ।

(2) अंशकािलक अ᭟यᭃ की पदाविध सामा᭠यत: चयन बोडᭅ के गठन की ितिथ से एक वषᭅ की होगी। हालांिक, उनकी अविध को

अ᭟यᭃ, कमᭅचारी रा᭔य बीमा िनगम के िविश᭬ ट पूवᭅ अनुमोदन से महािनदेशक ᳇ारा घटाया या बढ़ाया जा सकता है।

(3) उप-िविनयम (1) के खंड (ख) मᱶ संदिभᭅत अंशकािलक अ᭟यᭃ तथा िचिक᭜सा िवशेष᭄ उन दरᲂ पर याᮢा भᱫᲂ, बैठक शु᭨क

आिद के हकदार हᲂगे, जो कᱶᮤीय सरकार ᳇ारा िविहत दरᲂ को ᭟यान मᱶ रखते ᱟए समय-समय पर महािनदेशक ᳇ारा िनधाᭅिरत

की जाएंगी।

चयन की ᮧिᮓया एवं रीित:—अनुसूची मᱶ शािमल पदᲂ पर सीधी भतᱮ सामा᭠यत: चयन बोडᭅ ᳇ारा पाᮢ अ᭤यिथᭅयᲂ के साᭃा᭜कार के

आधार पर होगी :

परंतु चयन बोडᭅ ᳇ारा पाᮢ अ᭤यिथᭅयᲂ के साᭃा᭜कार के आधार पर भतᱮ की िविध से िभ᭠ न भतᱮ ᮧिᮓया अपनाना आव᭫यक हो जाता

है, तो अ᭟यᭃ, कमᭅचारी रा᭔य बीमा िनगम का िविश᭬ ट पूवᭅ अनुमोदन ᮧा᳙ करने के बाद महािनदेशक ᳇ारा उसे अपनाया जाएगा।

हालांिक, िव᭄ापन मᱶ एक बार भतᱮ की िविध अिधसूिचत हो जाती है, तो बाद मᱶ उसमᱶ कोई पिरवतᭅन नहᱭ िकया जाएगा।

साᭃा᭜कार के िलए आमंिᮢत िकए जाने वाले अ᭤यिथᭅयᲂ की सं᭎या का िनणᭅय अ᭟यᭃ, चयन बोडᭅ ᳇ारा िरिᲦयᲂ की सं᭎या एवं

िविहत अपेᭃाᲐ को पूणᭅ करने वाले अ᭤यिथᭅयᲂ की सं᭎या को ᭟यान मᱶ रखकर िकया जाएगा।

(2)

आयु, अहᭅता, अनुभव आिद िविहत अपेᭃाᲐ की पूितᭅ माᮢ अ᭤यथᱮ को साᭃा᭜कार हेतु बुलाने या िव᭄ािपत पद पर िकसी भी

दावे के िलए कोई अिधकार ᮧदान नहᱭ करती है।

(3)

आवेदनᲂ के संबंध मᱶ िव᭄ापन जारी करने तथा अ᭟यᭃ, चयन बोडᭅ को ᮧ᭭तुत करने हेतु आवेदनᲂ के ᮧᮓमण से संबंिधत सभी

कायᲄ को महािनदेशक, कमᭅचारी रा᭔य बीमा िनगम कायाᭅलय ᳇ारा िकया जाएगा।

चयन बोडᭅ को आव᭫यक सिचवीय सहयोग महािनदेशक, कमᭅचारी रा᭔य बीमा िनगम कायाᭅलय ᳇ारा ᮧदान िकया जाएगा।

िनरहᭅता- ऐसा कोई ᳞िᲦ:—

(क) िजसने ऐसे ᳞िᲦ से िववाह िकया है या िववाह करने का करार िकया है, िजसका िववािहती जीिवत है; अथवा

(ख) िजसने अपने िववािहती के जीिवत रहते ᱟए िकसी ᳞िᲦ से िववाह िकया है अथवा िववाह करने का करार िकया है,

उ᭍ त पद पर िनयुिᲦ का पाᮢ नहᱭ होगा:

पर᭠तु यिद महािनदेशक इस बात से संतु᭬ ट है िक ऐसा िववाह ऐसे ᳞िᲦ और िववाह के अ᭠य पᭃकार पर लागू ᭭वीय िविध के

अधीन अनु᭄ेय है और ऐसा करने के िलए अ᭠य आधार हᱹ, तो वे िकसी ᳞िᲦ पर इस िविनयम के ᮧवतᭅन से छूट दे सकᱶगे।

िशिथलता ᮧदᱫ करने की शिᲦ:—जहां कमᭅचारी रा᭔य बीमा िनगम के महािनदेशक की राय मᱶ ऐसा करना आव᭫यक अथवा

समीचीन है, तो वे त᭜संबंधी कारणᲂ को लेखब᳍ करके तथा के᭠ᮤ सरकार का पूवᭅ अनुमोदन ᮧा᳙ करने के प᳟ात् िकसी ᮰ेणी अथवा

वगᭅ के ᳞िᲦयᲂ के संबंध मᱶ इन िविनयमᲂ के िकसी भी उपबंध मᱶ आदेश ᳇ारा िशिथलता दे सकᱶगे।

᳞ावृिᱫ – इन िविनयमᲂ की कोई बात आरᭃण, आयु-सीमा मᱶ छूट और अ᭠य िरयायतᲂ पर ᮧभाव नहᱭ डालेगी, िजनका केᮤीय

सरकार ᳇ारा इस संबंध मᱶ समय-समय पर जारी िकए गए आदेशᲂ के अनुᱨप अनुसूिचत जाितयᲂ, अनुसूिचत जनजाितयᲂ, अ᭠य िपछड़े

वगᲄ, भूतपूवᭅ सैिनकᲂ तथा अ᭠य िवशेष वगᲄ के ᳞िᲦयᲂ के िलए ᮧदान करना अपेिᭃत है।

के आदेश ᳇ारा जारी िदशा िनदᱷशᲂ के अनुपालन मᱶ, शरीर रचना

िव᭄ान, शरीर िᮓया िव᭄ान और जीव रसायन िवभाग मᱶ

गैर-िचिक᭜सा िशᭃकᲂ/संकाय सं᭎या के ᮧितशत संबंधी ᮧावधान

लंिबत ᭠याियक मामलᲂ के पिरणाम और रा᳦ीय िचिक᭜सा आयोग के

आदेश के िदशािनदᱷशᲂ और समय-समय पर लागू संशोधनᲂ के

शताᭅधीन “िचिक᭜सा सं᭭थान मᱶ िशᭃकᲂ के िलए ᭠यूनतम यो᭏यता

िविनयम, 1998” के अनुसार जारी रहᱶगे।

िट᭡पणी 1:— संबंिधत िविश᭬ टता अथवा अितिविश᭬ टता समय-

समय पर संशोिधत “िचिक᭜सा सं᭭थान मᱶ िशᭃकᲂ के िलए ᭠यूनतम

यो᭏यता िविनयम, 2022” के अनुसार होगी।

िट᭡पणी 2:— अनुसूिचत जाित अथवा अनुसूिचत जनजाित से

संबंिधत अ᭤यिथᭅयᲂ के मामले मᱶ यिद चयन के िकसी चरण मᱶ चयन

बोडᭅ की यह राय होती है िक इन समुदायᲂ से अपेिᭃत अनुभव रखने

वाले अ᭤यिथᭅयᲂ के उनके िलए आरिᭃत िरिᲦयᲂ को भरने के िलए

पयाᭅ᳙ सं᭎या मᱶ उपल᭣ध न होने की आशंका है तो अनुभव संबंधी

अहᭅताएं चयन बोडᭅ के िववेकानुसार िशिथलनीय हᱹ।

िट᭡पणी 3:— अनुभव को वैध िशᭃण अनुभव अथवा िशᭃण पदᲂ के

ᱨप मᱶ रा᳦ीय िचिक᭜सा आयोग अथवा िचिक᭜सा ᮧणाली से संबंिधत

सांिविधक िनकाय ᳇ारा मा᭠यता दी जाएगी और इसका ᮧमाण पᮢ

सेवा अथवा सावᭅजिनक ᭃेᮢ के उपᮓमᲂ अथवा ᭭वायᱫ िनकाय

के अंतगᭅत अिधकारी:

(i) अनुᱨप पदधारी तथा कॉलम (7) के अंतगᭅत सीधी भतᱮ के

िलए समान अहᭅता और अनुभव धारक।

िट᭡पणी—1: ᮧितिनयुिᲦ की अविध कᱶᮤीय सरकार के उसी

अथवा िकसी अ᭠य संगठन मᱶ इस िनयुिᲦ से ठीक पहले धािरत

िकसी अ᭠य बाहय- संवगᭅ पद मᱶ ᮧितिनयुिᲦ अविध सिहत

सामा᭠यत: तीन वषᭅ से अिधक नही होगी।

िट᭡पणी—2: फीडर ᮰ेणी के िवभागीय अिधकारी जो पदो᭠ नित

की सीधी पंिᲦ मᱶ हᱹ, ᮧितिनयुिᲦ पर िनयुिᲦ के िवचाराथᭅ पाᮢ

नहᱭ हᲂगे। इसी ᮧकार, ᮧितिनयु᭍ त भी पदो᭠ नित ᳇ारा िनयुिᲦ

के िवचार हेतु पाᮢ नहᱭ हᲂगे।

No. A.12 (11)/1/2009-Med.-VI.-(Part-I-D)—In exercise of the powers conferred by sub section (1) of section 97 read

with clause (xxi) of sub-section (2) and sub-section (2A) of the said section and sub-section (3) of section 17 of the

Employees’ State Insurance Act, 1948 (34 of 1948) and in supersession of the Employees’ State insurance Corporation

(Medical Teaching Faculty posts) Recruitment Regulation , 2015 in so far as they relate to the post of Assistant Professor,

except as respect things done or omitted to be done before such supersession, the Employees’ State insurance Corporation

here by makes, with the approval of the Central Government, the following regulations for regulating the method of

recruitment for the post of Assistant Professor in the Medical colleges of Employees’ State Insurance Corporation, namely:—

Short title and commencement.—(1) These regulations may be called the Employees’ State Insurance Corporation,

Assistant Professor, Recruitment Regulations, 2022.

(2) They shall come into force on the date of their publication in the official Gazette.

Number of post, classification, pay level in the pay matrix.–The number of post, its classification, level in the pay

matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations.

Method of recruitment, age-limit, qualifications, etc.–The method of recruitment, age-limit, qualification and other

matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

Composition of Selection Board.–

(1) Selection Board shall consist of—

(a)

a part-time Chairman of the status equivalent to Secretary or Additional Secretary to the Government of

India or a person who had held the post equivalent to Secretary or Additional Secretary to the

Government of India, may be appointed by the secretary, Ministry of Labour and employment or the

Director General Employees’ State Insurance Corporation, with the specific prior approval of the

Chairman, Employees’ State Insurance Corporation;

(b)

two Medical experts from the discipline or specialised field for which recruitment is to be made, who

may be chosen by the Chairman, Selection Board from the panel of experts maintained for the purpose

by the Director General, Employees' State Insurance Corporation; and

(c)

the Medical Commissioner, Employees' State Insurance Corporation shall be the departmental expert in

New Delhi and in case of other States or teaching institutions the Dean of the respective State or

teaching institutions shall be departmental expert:

Provided, that the Director General can nominate some other officer as the departmental expert, in case

the said officers are not available due to some reasons.

(2) The term of office of the part-time Chairman shall ordinarily be one year from the date of constitution of the

Selection Board and his term may, however, be curtailed or extended by the Director General, with the

specific prior approval of the Chairman, Employees' State Insurance Corporation.

(3)

The part-time Chairman and the Medical experts referred to in clause (b) of sub-regulation (1) shall be entitled

to travelling allowances, sitting fees, etc., at such rates as may be fixed by the Director General from time to

time, keeping in view the rates prescribed by the Central Government.

Procedure and manner of selection. - Direct recruitment to the posts included in the Schedule shall ordinarily be

made on the basis of an interview of eligible candidates by the Selection Board:

Provided that in case, it becomes necessary to adopt a different mode of recruitment other than on the basis of

an interview of eligible candidates by the Selection Board, the Director General may adopt the same after obtaining

specific prior approval of the Chairman, Employees' State Insurance Corporation, and however, once a mode of

recruitment is notified in the advertisement, no change shall be made subsequently.

(1)

The number of candidates to be invited for interview shall be decided by the Chairman of the Selection Board,

keeping in view the number of vacancies and the number of applicants who satisfy the prescribed requirement.

(2)

Mere fulfillment of the prescribed requirement of age, qualification, experience, etc., shall not confer any right

on the applicant to be called for interview or to any claim over the post advertised.

(3)

All work relating to issue of advertisement in respect of applications and processing of applications for

submission to the Chairman, Selection Board shall be handled by the office of the Director General,

Employees’ State Insurance Corporation.

(4)

Necessary secretarial assistance shall be provided to the Selection Board by the office of the Director General,

Employees’ State Insurance Corporation.

Disqualification, — No person, —

(a)

Who has entered into or contracted a marriage with a person having a spouse living; or

(b)

Who, having a spouse living, has entered into or contracted a marriage with any person,

Shall be eligible for appointment to the said post:

Provided that the Director General may, if satisfied that such marriage is permissible under the personal law

applicable to such person and the other party to the marriage and that there are other grounds for so doing,

exempt any person from the operation of this regulation.

Power to relax.—Where the Director General of the Employees State Insurance Corporation is of the opinion that it

is necessary or expedient so to do, he may, by order, for reasons to be recorded in writing and after obtaining prior

approval of the Central Government, relax any of the provisions of these regulations with respect to any class or

category of persons.

Savings.—Nothing in these regulations shall affect reservation, relaxation of age-limit and other concessions

required to be provided for the Scheduled Castes, the Schedules Tribes, the Other Backward Classes, the Ex-

servicemen and other special categories of persons in accordance with the orders issued by the Central Government

from time to time, in this regard.

the “Teachers Eligibility Qualifications in Medical

Institutions Regulations, 2022” as amended from

time to time and at least three years teaching

In compliance of directions issued by MoHFW vide

release from the Armed Forces; thereafter they may be

continued on re-employment.
