11.12.2018 क घ जषत दकए गए थे। इस प्रकार, जनवाानन व्यय के लेखा िाजखल करने क अजन्तम तारीख 10.01.2019

थी।

रर यतः, मु्‍य जनवाानन अजिकारी, मध्य प्रिेि के दिनांक 20.01.2019 के ृ्र सं. 10-क/नार/जनवाा.व्यय

लेखा/4-ग्वाजलयर/2019/943 ्ारा अग्रेजषत जिला जनवाानन अजिकारी, ग्वाजलयर जिला, मध्य प्रिेि ्ारा दिनांक

17.01.2019 क प्रस्ट्तुत ररृ टा के अनुसार श्री दिलीृ जमश्रा, मध्य प्रिेि के 17-ग्वाजलयर िजक्षे जविान सभा जनवाानन

क्षेे्र से जनवाानन ल़कने वाले दम दिमी ृाट के अयर यथ , अृने जनवाानन व् यय का क ई भी लेखा िाजखल करने में असलल

रिे ।

रर यतः, जिला जनवाानन अजिकारी, ग्वाजलयर जिला, मध्य प्रिेि क ररृ टा के दिार ृर भारत जनवाानन

दय ग ्ारा जनवााननों का संनालन जनयम, 1961 के जनयम 89 के उृ जनयम (5) के अंतगात जनवाानन व्यय प्रस्ट्तुत निीं

करने के जलए श्री दिलीृ जमश्रा क कार बताओ न रटस दिनांक 03.07.2019 क िारी दकया गया था;

रर यत:, जनवााननों का संनालन जनयम, 1961 के जनयम 89 के उृ-जनयम (6) के अनुसार, दिनांक

03.07.2019 के उृयुाक् त कार बताओ न रटस के िररए श्री दिलीृ जमश्रा क जनिेि दिया गया था दक वे इस न रटस के

प्राप् त ि ने के 20 दिनों के अंिर दय ग में लेखे न प्रस्ट् तुत कर ृाने के कार ों क स्ट् ृ्‍ ट करते हुए जलजखत रूृ में अृना

अयर यावेिन प्रस्ट् तुत करें रर साथ िी, ृू ा जनवाानन व् यय का लेखा संबंजित जिला जनवाानन अजिकारी क प्रस्ट् तुत करें;

रर यत:, उक् त न रटस उनके जृता ्ारा 17.08.2020 क प्राप् त दकया गया था । अयर यथ से प्राप् त ृावती रसीि

जिला जनवाानन अजिकारी, ग्वाजलयर ्ारा दिनांक 23.02.2021 के ृ्र सं्‍ या जनवाा/25-6/70/2018/2073 ्ारा दय ग

क प्रस्ट् तुत कर िी गई थी;

रर यत:, जिला जनवाानन अजिकारी, ग्वाजलयर ्ारा अृने दिनांक 23.02.2021 के ृ्र सं. जनवाा /25-

6/70/2018/2073 के तित प्रस्ट् तुत क गई अनुृूरक ररृ टा में यि बताया गया िै दक श्री दिलीृ जमश्रा ने दि क तारीख

तक न त क ई भी अयर यावेिन रर न िी मूल वाउनरों ददि के साथ जवजिवत रूृ से िस्ट् ताक्षेररत अृने जनवाानन व् यय के

सिी लेखे का जववर प्रस्ट् तुत दकया िै। इसके अजतररक् त, उन् िोंने भारत जनवाानन दय ग का सम् यक् न रटस जमलने के

उृरांत भी उक् त असललता के जलए न त क ई कार बताया िै रर न िी क ई स्ट् ृ्‍ टीकर दिया िै;

रर यत:, दय ग का यि समािान ि गया िै दक श्री दिलीृ जमश्रा, जनवाानन व्यय का लेखा िाजखल करने में

असलल रिे िैं रर उनके ृास इस असललता के जलए क ई भी उजनत कार अथवा न् याय जनत् य निीं िै;

रर यत:, ल क प्रजतजनजित् व अजिजनयम, 1951 क िारा 10क में अनुबंजित दकया गया िै दक:-

‘‘यदि जनवाानन दय ग का समािान ि िाता िै दक क ई व् यजि-

(क)

जनवाानन व् ययों का लेखा उस समय के भीतर रर उस रीजत में िैसी इस अजिजनयम के ्ारा या अिीन

अृेजक्षेत िै, िाजखल करने में असलल रिा िै; तथा

(ख)

उस असललता के जलए क ई अच् ोा कार या न् याय जनत् य निीं रखता िै, त जनवाानन दय ग िासक य

रािृ्र में प्रकाजित दिेि ्ारा उसक जनरर्िात घ जषत करेगा रर ऐसा व् यजि उस दिेि क तारीख

से तीन वषा क कालावजि के जलए जनरर्िात ि गा;

अत:, अब ल क प्रजतजनजित् व अजिजनयम, 1951 क िारा 10क के अनुसर में भारत जनवाानन दय ग एतद्द्वारा,

मध्य प्रिेि राज् य क जविान सभा के सािार जनवाानन, 2018 के 17-ग्वाजलयर िजक्षे जविान सभा जनवाानन क्षेे्र से

New Delhi, the 9th May, 2022

O.N. 64.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 17-Gwalior South Assembly Constituency was declared by the Returning

Officer concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 17.01.2019 submitted by the District Election Officer, Gwalior

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/Four/

Elec.Expenditure Account/4-Gwalior/2019/943 dated 20.01.2019, Shri Dileep Mishra, contesting candidate of Aam

Aadmi Party from 17-Gwalior South Assembly Constituency of Madhya Pradesh, failed to lodge any account of his

election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Gwalior District, Madhya

Pradesh, a Show Cause notice dated 03.07.2020 was issued by the Election Commission of India under Sub Rule (5)

of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Dileep Mishra for non submission of accounts of

Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 03.07.2019, Shri Dileep Mishra was directed to submit his representation in writing to

the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of

election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by his father on 17.08.2020. Acknowledgment receipt

obtained from the candidate has been submitted to the Commission by District Election Officer, Gwalior vide his

letter No. Elec./25-6/70/2018/2073 dated 23.02.2021.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Gwalior vide his letter

No. Elec./25-6/70/2018/2073 dated 23.02.2021 it has been stated that Shri Dileep Mishra has not submitted any

representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc.

till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due

notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Dileep Mishra has failed to lodge an account of election

expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Dileep Mishra, resident of 152, Shiv Colony, Dolybua Ka Pul,

Lashkar, Gwalior, MP the contesting candidate of Aam Aadmi Party for the General Election to the Legislative

Assembly of Madhya Pradesh, 2018 from 17-Gwalior South Assembly Constituency, to be disqualified for being

chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of

a State or Union Territory for a period of three years from the date of this order.

जनवाानन ल़कने वाले जनिालीय अयर यथ , अृने जनवाानन व् यय का क ई भी लेखा िाजखल करने में असलल रिे ।

रर यतः, जिला जनवाानन अजिकारी, सीि र जिला, मध्य प्रिेि क ररृ टा के दिार ृर भारत जनवाानन दय ग

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer,

from the date of election of returned candidate;

AND WHEREAS, the result of 158-Ichhawar Assembly Constituency was declared by the Returning

Officer concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 17.01.2019 submitted by the District Election Officer, Sehore

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec.Expenditure Account/35-Sehore/2019/924 dated 19.01.2019, Shri Naveen Jatav, Independent contesting

candidate from 158-Ichhawar Assembly Constituency of Madhya Pradesh, failed to lodge any account of his

election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Sehore District, Madhya Pradesh,

a Show Cause notice dated 07.08.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89

of the Conduct of Elections Rules, 1961 to Shri Naveen Jatav for non submission of accounts of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 07.08.2019, Shri Naveen Jatav was directed to submit his representation in writing to

the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of

election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by him on 18.09.2019. Acknowledgment receipt obtained

from the candidate has been submitted to the Commission by District Election Officer, Sehore vide his letter No.

265/Elec./L.A.2018/2020 dated 26.09.2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Sehore vide his letter

No. 265/Elec./L.A.2018/2020 dated 26.09.2020 it has been stated that Shri Naveen Jatav has not submitted any

representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc.

till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due

notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Naveen Jatav has failed to lodge an account of election

expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

has failed to lodge an account of election expenses within the time and in the manner required by law

O.N. 69.— WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election

Officer, from the date of election of returned candidate;

AND WHEREAS, the result of 21-Bhander (SC) Assembly Constituency was declared by the Returning

Officer concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 19.01.2019 submitted by the District Election Officer, Datia

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec.Expenditure Account/5-Datia/2019/949 dated 20.01.2019, Shri Ashok Dandotiya, contesting Independent

candidate from 21-Bhander (SC) Assembly Constituency of Madhya Pradesh, failed to lodge any account of his

election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Datia District, Madhya Pradesh,

a Show Cause notice dated 01.08.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89

of the Conduct of Elections Rules, 1961 to Shri Ashok Dandotiya for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 01.08.2019, Shri Ashok Dandotiya was directed to submit his representation in

writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete

accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the

notice; AND WHEREAS, the said notice was received by him on 16.08.2020. Acknowledgment receipt obtained

from the candidate have been submitted to the Commission by District Election Officer, Datia vide his letter

No. Q./Elec.Expenditure/2021/184 dated 10.06.2021.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Datia vide his letter

No. Q./Elec.Expenditure/2021/184 dated 10.06.2021 it has been stated that Shri Ashok Dandotiya has not

submitted any representation or a statement of correct account of his election expenses, duly signed along with

original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even

after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Ashok Dandotiya has failed to lodge an account of

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/ Four/

Elec.Expenditure Account/14-Satna/2019/876 dated 19.01.2019, Dr. Santosh Kumar Gupta, contesting candidate

of Gondvana Gantantra Party from 66-Amarpatan Assembly Constituency of Madhya Pradesh, failed to lodge any

account of his election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Satna District, Madhya Pradesh,

a Show Cause notice dated 03.07.2020 was issued by the Election Commission of India under Sub Rule (5) of Rule 89

of the Conduct of Elections Rules, 1961 to Dr. Santosh Kumar Gupta for non submission of accounts of Election

expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 03.07.2020, Dr. Santosh Kumar Gupta was directed to submit his representation in

writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete

accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the

notice;

AND WHEREAS, the said notice was received by him on 16.07.2020. Acknowledgment receipt obtained

from the candidate have been submitted to the Commission by District Election Officer, Satna vide his letter No.

610/E/15-25/Elec./ExpenditureAccount/2020 dated 02.09.2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Satna vide his letter

No. 610/E/15-25/Elec./ExpenditureAccount/2020 dated 02.09.2020 it has been stated that Dr. Santosh Kumar

Gupta has not submitted any representation or a statement of correct account of his election expenses, duly signed

along with original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said

failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Dr. Santosh Kumar Gupta has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses within the time and in the manner required by

law or under this Act; and

(b)

has no good reason or justification for the failure, the Election Commission shall by order published

in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a

period of three years from the date of the order;

ORDER

New Dehi, the 18th May, 2022

O.N. 75.—WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was

announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the

schedule, the Date of Counting of votes was 11.12.2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer,

from the date of election of returned candidate;

AND WHEREAS, the result of 98-Jabalpur Uttar Assembly Constituency was declared by the Returning

Officer concerned on 11.12.2018. As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 17.01.2019 submitted by the District Election Officer, Jabalpur

District, Madhya Pradesh and forwarded by Chief Electoral Officer, Madhya Pradesh vide letter No.10-A/Four/

Elec.Expenditure Account/22-Jabalpur/2019/929 dated 19.01.2019, Shri Shyam Krishna Tiwari (Kallu),

contesting Independent candidate from 98-Jabalpur Uttar Assembly Constituency of Madhya Pradesh, failed to

lodge any account of his election expenses.

AND WHEREAS, on the basis of the report of the District Election Officer, Jabalpur District,

Madhya Pradesh, a Show Cause notice dated 19.07.2019 was issued by the Election Commission of India under Sub

Rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Shyam Krishna Tiwari (Kallu) for non

submission of accounts of Election expenses;

AND WHEREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 19.07.2019, Shri Shyam Krishna Tiwari (Kallu) was directed to submit his

representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge

his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of

receipt of the notice;

AND WHEREAS, the said notice was received by him on 26.07.2019. Acknowledgment receipt obtained

from the candidate have been submitted to the Commission by District Election Officer, Jabalpur vide his letter No.

1584/Election/2019 dated 27.07.2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Jabalpur vide his letter

No. 422/Elec.Expenditure/2020 dated 13.08.2020 it has been stated that Shri Shyam Krishna Tiwari (Kallu) has not

submitted any representation or a statement of correct account of his election expenses, duly signed along with original

vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt

of the due notice to the Election Commission of India as well;

AND WHEREAS, Commission is satisfied that Shri Shyam Krishna Tiwari (Kallu) has failed to lodge an

account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Shyam Krishna Tiwari (Kallu), resident of 725, Shukrawari,

Bajariya, Hanumanal Ward, Jabalpur, MP, the contesting Independent candidate for the General Election to the

Legislative Assembly of Madhya Pradesh, 2018 from 98-Jabalpur Uttar Assembly Constituency, to be disqualified

for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative

Council of a State or Union Territory for a period of three years from the date of this order.
