घ जषत दकए गए थे रर इस प्रकार जनवाानन व्य के लेखे िाजखल करने की अजन्तम तारीख 22 िचन, 2019 थी; रर
तः, जिला जनवाानन अजिकारी, कुरनचल जिला, आंध्र प्रिेि ्ारा प्रस्ट्तुत दिनांक 22 िचन, 2019 की ररृ टा के
अनुसार श्री/श्रीमती/कुमारी/सुश्री िेष्टािी सुिाकर, ि ल क सभा के सािार जनवाानन, 2019 में आंध्र प्रिेि के
17-नन्ि ाल संसिी जनवाानन क्षेे्र से जनवाानन ल़कने वालेअभ् थी िैं, जवजि ्ारा थाृेजक्षेत रीजत से अृने जनवाानन व्य
का लेखा िाजखल करने में जविल रिे िैं; रर
तः, जिला जनवाानन अजिकारी, कुरनचल की उक्त ररृ टा के आिार ृर, भारत जनवाानन आ ग ्ारा जनवााननों
का संनालन जन म, 1961 के जन म 89 के उृ-जन म (5) के अंतगात श्री/श्रीमती/कुमारी/सुश्री िेष्टािी सुिाकर क
जनवााननों का संनालन जन म, 1961 के जन म 86(2) रर 86(3) में थाजवजित अृने जनवाानन व्य के वाउनर प्रस्ट्तुत
निीं करने के जलए कार बताओ न रटस सं. 76/एृी-एनृी/17/2020/एसओ च,दिनांक 20 िरवरी, 2021 िारी दक ा
ग ा था; रर
त:,उृ ुाक् त कार बताओ न रटस के िररए रर जनवााननों का संनालन जन म, 1961 के जन म 89 के उृ-
जन म (6) के अंतगात, श्री/श्रीमती/कुमारी/सुश्री िेष्टािी सुिाकर क ि न रटस प्राप् त ि ने के 20 दिनों के अंिर अृना
अभ् ावेिन, जिसमें जनवाानन व्य के उनके लेखे में उृ ुाक्त कजम ों के कार स्ट् ृ् ट दकए गए िों, आ ग क जलजखत रूृ में
प्रस्ट् तुत करने रर जिला जनवाानन अजिकारी, कुरनचल क जनवााननों के संनालन जन म, 1961 के जन म 86(3) में
थाजवजित वाउनर जिनमें व्य की तारीख, व्य की प्रकषजत रर िनराजि, आिाता का नाम रर ृता, भुगतान की तारीख
आदि ििाा ा ग ा ि , प्रस्ट् तुत करने का जनिेि दि ा ग ा था; रर
त:,जिला जनवाानन अजिकारी, कुरनचल ने 23.06.2021 क बता ा िै दक श्री/श्रीमती/कुमारी/सुश्री िेष्टािी
सुिाकर क उक् त न रटस तामील निीं दक ा िा सका क् ोंदक उक्त अभ् थी क अृने नाम-जनिेिन ृ्र में उनके ्ारा दिए
गए ृते ृर जनवास करते हुए निीं ृा ा ग ा रर उनके ृ़क जस ों से ृचोताो करने ृर ि ृा ा ग ा िै दक अभ् थी विां
लगभग डेढ़ वषों से जनवास निीं कर रिे िैं। अतएव, आ ग का न रटस दिनांक 20.02.2021 उक्त ृते ृर नस्ट्ृा कर दि ा
ग ा; रर
तः,आ ग के ृ्र सं 76/एृी-एनृी/2020 दिनांक 27 िुलाई, 2021 के िररए उक्त न रटस दिनांक
20.02.2021 की एक प्रजत अभ् थी क उनके दिए गए ईमेल ृते [email protected]ृर भी
ईमेल की गई जिसके माध् म से उनक उृ ुाक्त ृ्र प्राप्त ि ने के 20 दिनों के भीतर रर िि से िि 16 अगस्ट्त, 2021 तक
न रटस का उत्तर िेने का जनिेि दि ा ग ा; रर
रर त:, जिला जनवाानन अजिकारी, कुरनचल ने अृनी अनुृचरक ररृ टा में ि बता ा िै दक
श्री/श्रीमती/कुमारी/सुश्री िेष्टािी सुिाकर ने आि की तारीख तक न त आ ग के न रटस दिनांक 20.02.2021 रर ृ्र
दिनांक 27.07.2021 के प्रत् ुत्तर में क ई अभ् ावेिन प्रस्ट्तुत दक ा िै, न िी अृेजक्षेत वाउनर प्रस्ट्तुत दक ा िै। इसके
अजतररक् त, इस संबंि में भारत जनवाानन आ ग सजनवाल क अभ् थी से क ई अभ् ावेिन प्राप्त निीं हुआ िै; रर
त:, ल क प्रजतजनजित् व अजिजन म, 1951 की िारा 10क में ि उृबंि िै दक:
‘‘ दि जनवाानन आ ग का समािान ि िाता िै दक क ई व् जक्त-
(क) इस अजिजन म के ्ारा अथवा इसके अिीन अृेजक्षेत सम के भीतररर रीजत में जनवाानन व् लेखा
िाजखल करने में जविल रिा िै; रर
(ख) उसके ृास इस जविलता का क ई उजनत कार अथवा रजनत् निीं िै
त , जनवाानन आ ग, सरकारी रािृ्र में आिेि प्रकाजित करके उसे जनरिा घ जषत करेगा रर ऐसा क ई भी
व् जक्त इस आिेि की तारीख से तीन वषा की अवजि के जलए जनरिा रिेगा”;
त:, तथ् ों रर उृलब्ि ररकाडों के आिार ृर आ ग का ि समािान ि ग ा िै दक श्री/श्रीमती/कुमारी/सुश्री
िेष्टािी सुिाकरजवजि के अिीन जवजित रीजत से अृने जनवाानन व्य के लेखे िाजखल करने में जविल रिे िैं रर उनके ृास
ऐसा करने में जविल रिने के जलए क ई भी उजनत कार अथवा रजनत् निीं िै; रर

अत:,अब ल क प्रजतजनजित् व अजिजन म, 1951 की िारा 10क के अनुसर में भारत जनवाानन आ ग एतद्द्वारा
घ ष ा करता िै दक ल क सभा के सािार जनवाानन, 2019 में आंध्र प्रिेि राज् के 17-नन्ि ाल संसिी जनवाानन क्षेे्र से
जनवाानन ल़कने वाले अभ् थी श्री/श्रीमती/कुमारी/सुश्री िेष्टािी सुिाकर, जनवासी - मकान नं. 28/1380ए,क लीमीृेटा,
नचनीृल्ली, नान्ि ाल, कुरनचल जिला, आंध्र प्रिेि,इस आिेि की तारीख से तीन वषा की अवजि के जलए संसि के दकसी भी
सिन अथवा राज् अथवा संघ राज् -क्षेे्र की जविान सभा अथवा जविान ृररषि का सिस्ट् नुने िाने अथवा ि ने के जलए
जनरिा िोंगे।

ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 8th July, 2022
O.N. 131.— WHEREAS, the General Election to the House of People for 17-Nandyal Parliamentary
Constituency of Andhra Pradesh, 2019 was announced by the Election Commission of India vide Press Note No.
ECI/PN/23/2019 dated 10th March, 2019; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has
to lodge a true copy of his account of election expenses kept by him or by his election agent u/s 77, within 30 days
with the concerned District Election Officer, from the date of election of the returned candidate; and
WHEREAS, the result of the election for 17-Nandyal Parliamentary Constituency was declared by the
Returning Officer on 23rd May, 2019 and hence the last date for lodging the account of Election Expenses was 22nd
June, 2019 ; and
WHEREAS, as per the report dated 22nd June, 2019 submitted by the District Election Officer, Kurnool
District, Andhra Pradesh, Shri/Smt./Km./Ms Jestadi Sudhakar, a contesting candidate from 17-Nandyal
Parliamentary Constituency of Andhra Pradesh in General Election to the House of People, 2019, has failed to lodge
account of election expenses, in the manner prescribed under law; and
WHEREAS, on the basis of the said report of the District Election Officer, Kurnool, a Show-Cause notice No.
76/AP-HP/17/2020/SOU 3, dated 20th February, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of
Elections Rules, 1961 by the Election Commission of India to Shri/Smt./Km./Ms Jestadi Sudhakar, for not
submitting the vouchers of election expenses as envisaged in Rule 86(2) and 86(3) of the Conduct of Election Rules,
1961; and
WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of
Elections Rules, 1961, Shri/Smt./Km./Ms Jestadi Sudhakar was directed to submit representation in writing to the
Commission within 20 days of receipt of the notice, explaining the reason for the above said shortcoming in his
account of election expenses and also to furnish to the District Election Officer, Kurnool, the vouchers indicating
therein the date of expenditure, nature and amount of expenditure, the name and address of the payee, date of payment
etc. as envisaged in 86(3) of the Conduct of Election Rules, 1961; and
WHEREAS, the District Election Officer, Kurnool has reported on 23.06.2021 that the said notice could not
be served to Shri/Smt./Km./Ms Jestadi Sudhakar, as the said candidate was not found residing at the address
provided by him in his nomination papers and on enquiry from his neighbors, it has been found that the candidate is
not residing there for one and half years. Therefore, the Commission’s notice dated 20.02.2021 was affixed at the said
address; and
WHEREAS, vide Commission’s letter No. 76/AP-HP/2020 dated 27th July, 2021, a copy of the said Notice
dated 20.02.2021 was also emailed to the candidate at his given mail id i.e. [email protected],
whereby he was directed to submit a reply to the Notice within 20 days from receipt of the aforesaid letter and latest
by 16th August, 2021; and
WHEREAS, the District Election Officer, Kurnool in his supplementary report dated 20.06.2022, has reported
that Shri/Smt./Km./Ms Jestadi Sudhakar has neither submitted any representation in response to Commission’s
Notice dated 20.02.2021 and letter dated 27.07.2021 nor requisite original vouchers till date. Further, no
representation from the candidate in this regard has been received in the Secretariat of the Election Commission of
India till date ; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-
“If the Election Commission is satisfied that a person-
i.
has failed to lodge an account of election expenses, within the time and in the manner required by or under
this Act, and
ii.
has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such
person shall be disqualified for a period of three years from the date of the order.”;
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Shri/Smt./Km./Ms
Jestadi Sudhakar has failed to lodge account of election expenses in prescribed manner under law and has no good
reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the
Election Commission of India hereby declares Shri/Smt./Km./Ms Jestadi Sudhakar, resident of H. No. 28/ 1380A,
Kolimipeta, Noonepalli, Nandyal, Kurnool District, Andhra Pradesh and a contesting candidate from
17- Nandyal Parliamentary Constituency of Andhra Pradesh in the General Election to the House of People, 2019 to
be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly
or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
