स्ट् ृ्‍ टीकरण.- इस िारा के अिीन ि आृजत् त निीं मानी िाएगी, दक कोई व् जक् त दकसी भूजम में को ला उत् ृािन के जलए

स्ट् व ं नन संदक्र ाएं करना चािता िज और ऐसी संदक्र ाएं केन् द्री सरकार ा दकसी अन् व् जक् त द्वारा निीं की िानी

चाजिए।

उृिारा (1) के अिीन प्रत् ेक आृजत् त सक्षम प्राजिकारी को जलज त प ृ में की िाएगी और सक्षम

प्राजिकारी, आृजत् तकताड को व्यजक्तक प ृ से ा जवजि व् वसा ी द्वारा सुनवाई का अवसर प्रिान करेगा और ऐसी सभी

आृजत् त ों को सुनने के ृश् चात् और ऐसी अजतररक् त िांच, दि कोई िो, करने के ृश् चात् िो वि आवश् क समझता िज, वि

ा तो िारा 7 की उृिारा (1) के अिीन अजिसूजचत भूजम के ा ऐसी भूजम में ा उस ृर के अजिकारों के संबंि में एक

ृर अृनी जसफाररिों और उसके द्वारा की गई का डवािी के अजभले सजित केन् द्री सरकार को उसके जवजनश् च के जलए

िेगा।

New Delhi, the 16th August, 2022

S.O. 765.—Whereas, by the notification of the Government of India in the Ministry of Coal number

S.O. 935, dated the 31^st December, 2021, issued under sub-section (1) of section 4 of the Coal Bearing Areas

(Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), published in the

Gazette of India, Part II, Section 3, Sub-section (ii), dated the 1^stJanuary, 2022, the Central Government gave notice

of its intention to prospect for coal in land measuring 223.80 hectares (approximately) or 553.022 acres

(approximately) in the locality specified in the Schedule annexed to the that notification;

And, whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands

prescribed in the Schedule appended to this notification;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the

Central Government hereby gives notice of its intention to acquire the land measuring 187.96 hectares

(approximately) or 464.45 acres (approximately) and all rights in or over the said lands described in the Schedule

appended hereto;

Note 1: The plan bearing number C-I(E)/III/JJNR/0622/987, dated the 22^nd June, 2022 of the area covered by this

notification may be inspected at the office of the Collector, District Yavatmal (Maharashtra) or at the office

of the Coal Controller, 1, Council House Street, Kolkata - 700 001 or at the office of the General Manager,

Western Coalfields Limited (Revenue Department), Coal Estate, Civil Lines, Nagpur – 440 001

(Maharashtra).

Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows:-

“8. Objections to acquisition.- (1)Any person interested in any land in respect of which a notification under

section 7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of

the whole or any part of the land or of any rights in or over such land.

Explanation. - It shall not be an objection within the meaning of this section for any person to say that he himself

desires to undertake mining operations in the land for the production of coal and that such operations should not be

undertaken by the Central Government or by any other person.

(2)

Every objection under sub-section (1) shall be made to the competent authority in writing, and the

competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner

and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either

make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over

such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the

Central Government, containing his recommendations on the objections, together with the record of proceedings held

by him, for the decision of that Government.

(3)

For the purpose of this section, a person shall be deemed to be interested in land who would be

entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this

Act.”

Note 3: The Coal Controller, 1, Council House Street, Kolkata - 700 001 has been appointed by the Central

Government as the competent authority under section 3 of the said Act, vide notification number S.O. 2519,

dated the 27^th May, 1983, published in the Gazette of India, Part II, section 3, sub-section (ii), dated the

11^th June, 1983.

II, ंड 3, उृ ंड (ii), तारी 20 िून, 2022 में प्रकाजित भारत सरकार के को ला मंत्राल की अजिसूचना का. आ.

सं्‍ ांक 2814(अ), तारी 20 िून, 2022 के प्रकािन ृर उक् त अजिसूचना से संलग् न अनुसूची में वर्णिंत भूजम और ऐसी

भूजम, (जिसे इसमें इसके ृश् चात् उक् त भूजम किा ग ा िज), में के सभी अजिकार, उक् त अजिजन म की िारा 10 की उृिारा

(1) के अिीन, सभी जवल् लंगमों से मुक् त िोकर, आत् ंजतक प ृ में केन् द्री सरकार में जनजित िो गए े;

और, केन् द्री सरकार का ि समािान िो ग ा िज, दक वेस्ट् टनड कोलफील् ्स जलजमटेड, नागृुर, मिाराष्ट्र (जिसे

इसमें इसके ृश् चात् सरकारी कंृनी किा ग ा िज), ऐसे जनबंिनों और ितों का, िो केन् द्री सरकार इस जनजमत्त अजिरोजृत

करना उजचत समझे, अनुृालन करने के जलए रिामंि िज;

अत: अब, केन्द्री सरकार, उक्त अजिजन म की िारा 11 की उृिारा (1) द्वारा प्रित् त िक् जत ों का प्र ोग करते

हुए, ि जनिेि िेती िज, दक इस प्रकार जनजित भूजम 227.16 िेक् टर (लगभग) ा 561.31 एकड़ (लगभग) माृ वाली

उक् त भूजम में ा उस ृर के सभी अजिकार तारी 20 िून, 2022 से केन् द्री सरकार में इस प्रकार जनजित बने रिने के

बिाए, जनम्प नजलज त जनबंिनों और ितों के अिीन रिते हुए, सरकारी कंृनी में जनजित िो िाऐंगे, अ ाडत : -

(1)

सरकारी कंृनी, उक् त अजिजन म के उृबंिों के अिीन ा अविाररत प्रजतकर, ब् ाि, नुकसाजन ों और वजसी िी

मिो की बाबत् दकए गए संिा ों की केन् द्री सरकार को प्रजतृूर्तड करेगी;

(2)

उक् त अजिजन म की िारा 14 के अिीन एक अजिकरण का ग न दक ा िाएगा जिसमें ितड (1) के अिीन

सरकारी कंृनी द्वारा संिे रकमों का अविारण करने के प्र ोिनों के जलए और दकसी ऐसे अजिकरण और उक्त

अजिकरण की सिा ता करने के जलए जन ुक् त व् जक् त ों के संबंि में उृगत सभी व् , उक्त सरकारी कंृनी द्वारा

विन दकए िाएंगे और इस प्रकार जनजित उक् त भूजम में ा उस ृर के अजिकारों के जलए ा उनके संबंि में

अृीलों आदि िजसी सभी जवजिक का डवाजि ों की बाबत् उृगत, सभी व् भी, सरकारी कंृनी द्वारा विन दकए

िाएंगे;

सरकारी कंृनी, केन् द्री सरकार ा उसके ृििारर ों की, ऐसे दकसी अन् व् के संबंि में क्षजतृूर्तड करेगी, िो

इस प्रकार जनजित उक् त भूजम में ा उस ृर के अजिकारों के बारे में, केन् द्री सरकार ा उसके ृििारर ों द्वारा ा

उनके जवप द्ध दकन् िीं का डवाजि ों के संबंि में आवश् क िो ;

(4)

सरकारी कंृनी को केन् द्री सरकार के ृूवड अनुमोिन के जबना उक् त भूजम और उसके ऊृर के जनजित अजिकारों

को दकसी अन् व् जक् त को अंतररत करने की िजक् त निीं िोगी ; और

(5)

उक् त कंृनी, ऐसे जनिेिों और ितों का ृालन करेगी, िो केन् द्री सरकार द्वारा, िब कभी आवश् क िो, उक् त

भूजम के जवजि्‍ ट क्षेत्रों के जलए दिए िाएं ा अजिरोजृत दकए िाएं ।

S.O. 766.—Whereas, on the publication of the notification of the Government of India in the Ministry of

Coal, number S.O. 2814 (E), dated the 20^th June, 2022, published in the Gazette of India, Extraordinary, Part II,

Section 3, Sub-section (ii), dated the 20^th June, 2022, issued under sub-section (1) of section 9 of the Coal Bearing

Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), the land and all

rights in or over the lands described in the Schedule appended to the said notification (hereinafter referred to as the

said land) vested absolutely in the Central Government free from all encumbrances under sub-section (1) of section 10

of the said Act ;

And, whereas, the Central Government is satisfied that the Western Coalfields Limited, District Nagpur,

Maharashtra (hereinafter referred to as the Government Company) is willing to comply with such terms and

conditions as the Central Government thinks fit to impose in this behalf ;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 11 of the said Act, the

Central Government hereby directs that the said lands measuring 227.16 hectares (approximately) or 561.31 acres

(approximately) with all rights in or over the said lands so vested, shall with effect from 20^th June, 2022 instead of

continuing to so vest in the Central Government, shall vest in the Government company, subject to the following

terms and conditions, namely:-

(1)

The Government company shall make all payments in respect of compensation, interest, damages and the like,

as determined under the provisions of the said Act and other relevant laws;

(2)

A Tribunal shall be constituted under section 14 of the said Act, for the purpose of determining the amounts

payable by the Government company under condition (1) and all expenditure incurred in connection with any

such Tribunal and persons appointed to assist the Tribunal shall be borne by the Government company and

similarly, all expenditure incurred in respect of all legal proceedings like appeals, etc. for or in connection with

the rights, in or over the said lands, so vested, shall also be borne by the Government company;

(3)

The Government company shall indemnify the Central Government and its officials against any other

expenditure that may be necessary in connection with any proceedings by or against the Central Government or

its officials regarding the rights in or over the said lands so vested;

(4)

The Government company shall have no power to transfer the aforesaid rights in the said lands so vested, to any

other persons without the prior approval of the Central Government ; and

(5)

The Government company shall abide by such directions and conditions as may be given or imposed by the

Central Government for particular areas of the said lands, as and when necessary.
