िविनयम 41(2) : कठोर दंड लगाने की ᮧिᮓया :

िनयुिᲦ ᮧािधकारी उन अिभकथनᲂ के आधार पर िनि᳟त आरोप तय

करेगा िजन पर जांच की जानी ᮧ᭭तािवत है। इस तरह के आरोपᲂ के

साथ-साथ उन अिभकथनᲂ का िववरण, िजन पर वे आधािरत हᱹ,

कमᭅचारी को िलिखत ᱨप मᱶ सूिचत िकया जाएगᱶ और उसे अपने

बचाव मᱶ एक िलिखत बयान िजसमᱶ यह ᭭प᳥ हो िक वह मामले की

सुनवाई ᳞िᲦगत ᱧप से चाहता है िनिदᭅ᳥ िकए जा सकने वाले समय

के भीतर जांच अिधकारी को ᮧ᭭तुत करने को कहा जाएगा ।

िविनयम 41(2) : कठोर दंड लगाने की ᮧिᮓया :

संबंिधत ᮧभागा᭟यᭃ/ᭃेᮢीय िनदेशक, उन अिभकथनᲂ के आधार पर

आरोप ᮧाᱨप तैयार करᱶगे, िजस पर जांच की जानी ᮧ᭭तािवत है

और अनुमोदन के िलए अनुशासना᭜मक ᮧािधकारी को ᮧ᭭तुत करᱶगे।

इस तरह के आरोपᲂ के साथ-साथ उन अिभकथनᲂ का िववरण, िजन

पर वे आधािरत हᱹ, कमᭅचारी को िलिखत ᱨप मᱶ सूिचत िकया जाएगᱶ

और उसे अपने बचाव मᱶ एक िलिखत बयान िजसमᱶ यह ᭭प᳥ हो िक

वह मामले की सुनवाई ᳞िᲦगत ᱧप से चाहता है िनिदᭅ᳥ िकए जा

सकने वाले समय के भीतर जांच अिधकारी को ᮧ᭭तुत करने को कहा

जाएगा ।

िविनयम 46(1)(III & IV) :अपील :

(iii) ᮧबंध िनदेशक को जहां आदेश महाᮧबंधक ᳇ारा पािरत िकया

गया हो ।

(iv) महाᮧबंधक को जहां आदेश उप िनदेशक (ᮧशासन) ᳇ारा आदेश

पािरत िकया गया हो ।

िविनयम 46(1)(III & IV) :अपील :

कमᭅचारी, िनयुिᲦ ᮧािधकारी को अपील करने का हकदार होगा

जहां आदेश उप ᮧबंध िनदेशक/िवᱫीय सलाहकार/कायᭅकारी

िनदेशक/मु᭎य िनदेशक/ िनदेशक/ ᭃेᮢीय िनदेशक ᳇ारा पािरत िकया

गया हो ।

उपयुᭅᲦ संशोधन िदनांक 30 अग᭭त, 2022 से ᮧभावी हᲂगे ।

Regulation 41(2) : Procedure for Imposing Major

Penalties :

The appointing authority shall frame definite charges on the

basis of the allegations on which the inquiry is proposed to

be held. Such charges together with a statement of the

allegations on which they are based shall be communicated

in writing to the employee and he shall be called upon to

submit within such time as may be specified to the enquiry

officer a written statement of his defence and also to state

whether he desires to be heard in person.

Regulation 41(2) : Procedure for Imposing Major

Penalties :

The concerned Divisional Head/Regional Director, shall

frame the draft charges on the basis of the allegations on

which the inquiry is proposed to be held and put up the

same to the disciplinary authority for approval. Such

charges together with a statement of the allegations on

which they are based shall be communicated in writing to

the employee and he shall be called upon to submit within

such time as may be specified to the enquiry officer a

written statement of his defence and also to state whether

he desires to be heard in person.

Regulation 46(1)(III & IV) :Appeals :

(iii) To the Managing Director where the order was one

passed by the General Manager.

(iv) To the General Manager where the order was one

passed by the Dy. Director (Admn).

Regulation 46(1)(III & IV) :Appeals :

An employee shall be entitled to prefer an appeal to the

appointing authority, where the order is passed by

DMD/FA/ED/CD/Director/Regional Director.

The above amendments shall be effective from 30.08.2022.
