Control and Inspection) Act, 1963 (22 of 1963) read with sub-rule (2) of rule 12 of the Export (Quality Control
and Inspection) Rules, 1964, the Central Government hereby recognises M/s Mitra S. K. Private Limited,
Holding No. 22/107, Ward No.- 9, P.O. Khanjanchak, Haldia, Dist. Purba Medinipur, Pin-721602, West
Bengal, (hereinafter referred to as the said agency), as an agency for a period of three years with effect from the
date of publication of this notification in the Official Gazette, for the inspection of Minerals & Ores, Group-I,
namely Iron Ore, Ferromanganese including Ferromanganese slag and Group–II, namely, Chrome Ore including
Chrome Concentrate as specified in the Schedule annexed to the notification of the Government of India in the
Ministry of Commerce, published in the official Gazette vide number S.O.3975 dated 20th December,
1965 and S.O.3978 dated 20th December, 1965 respectively, prior to export of the said Minerals and Ores at
Haldia port, Kolkata port and Sagar port,, subject to the following conditions, namely: -

(i) the said agency shall give adequate facilities to the officers nominated by the Export Inspection
Council in this behalf to carry out the inspection specified under rule 4 of the Export of Minerals
and Ores – Group I (Inspection) Rules, 1965 and Export of Minerals and Ores – Group II
(Inspection) Rules, 1965, and;
(ii) the said agency, in performance of their function as specified in this notification shall be bound
by such directions, as the Director (Inspection and Quality Control), Export Inspection
Council may give, in writing from time to time.

from the date of publication of this notification in the Official Gazette, for the inspection of Minerals & Ores,
Group- I, namely–Iron Ore and Bauxite, as specified in the Schedule annexed to the notification of the
Government of India in the Ministry of Commerce, published in the Official Gazette vide number S.O.3975
dated 20th December, 1965 prior to export of the said Minerals and Ores at Goa Port subject to the following
conditions, namely: -

कोयला मंत्रालय की अजधसूचना सं्यांक का.आ. 800, तारीख 14 जसतम्बर, 2022, जो भारत के राजृत्र, भाग II,
खण्ड 3, उृ-खण्ड (ii), तारीख 17 जसतम्बर, 2022 में प्रकाजित की गई थी, उि अजधसूचना से (जजसे इसमें इसके
ृश्चात उि भूजम किा गया िज) संलग्न अनुसूची में वर्तणत भूजम और ऐसी भूजम में या उस ृर के सभी अजधकार, उि

अतिः, अब, केन्रीय सरकार, उि अजधजनयम की धारा 11 की उृधारा (1) द्वारा प्रदत िजियों का प्रयोग
करते हुए, यि जनदेि देती िज दक 9.624 िेक्टेयर (लगभग) अथवा 23.780 एकड़ (लगभग) माृ वाली उि भूजम
और इस प्रकार जनजित उि भूजम में या उस ृर के सभी अजधकार तारीख 17 जसतम्बर, 2022 से केन्रीय सरकार में
इस प्रकार जनजित बने रिने के बजाए, जनम्नजलजखत जनबन्धनों और ितों के अधीन रिते हुए सरकारी कंृनी में जनजित
िो जाएंगे, अथाजत:-
(1)
सरकारी कंृनी, उि अजधजनयम के उृबंधों के अधीन और अन्य सुसंगत जवजधयों के अधीन यथा अवधाररत
प्रजतकर, ब्याज, नुकसाजनयों, इत्यादद, और वजसी िी मदों की बाबत सभी संदाय करेगी;
(2)
संदेय रकमों का अवधारण करने के प्रयोजनों के जलए उि अजधजनयम की धारा 14 के अधीन एक अजधकरण
का ग न दकया जाएगा, सरकारी कंृनी द्वारा ितज (1) के अधीन और ऐसे दकसी अजधकरण और उि
अजधकरण की सिायता करने के जलए जनयुि व्यजियों के संबंध में उृगत सभी व्यय, उि सरकारी कंृनी
द्वारा विन दकए जाएंगे और इसी प्रकार जनजित उि भूजम में या उस ृर के अजधकारों के जलए या उनके
संबंध में अृील, आदद सभी जवजधक कायजवाजियों की बाबत उृगत, सभी व्यय भी, सरकारी कंृनी द्वारा
विन दकए जाएंगे;

सरकारी कंृनी, केन्रीय सरकार या उसके ृदधाररयों की, ऐसे दकसी अन्य व्यय के संबंध में क्षजतृूर्तत करेगी
जो इस प्रकार जनजित उि भूजम में या उस ृर के अजधकारों के बारे में केन्रीय सरकार या उसके ृदधाररयों
द्वारा या उनके जवरुद्ध दकन्िी कायजवाजियों के संबंध में आवश्यक िो;
(4)
सरकारी कंृनी के ृास उि भूजम में इस प्रकार जनजित अजधकारों को केन्रीय सरकार के ृूवज अनुमोदन के
जबना, दकसी अन्य व्यजि को अंतररत करने की िजि निीं िोगी; और
(5)
सरकारी कंृनी, ऐसे जनदेिों और ितों का ृालन करेगी, जो केन्रीय सरकार द्वारा जब कभी आवश्यक िो,
उि भूजम के जवजिष्ट क्षेत्रों के जलए ददये जाएं या अजधरोजृत दकए जाएं।

NOTIFICATION
New Delhi, the 22nd November, 2022
S.O. 1215.—Whereas, on the publication of the notification of the Government of India in the Ministry
of Coal, number S.O. 800, dated 14th September, 2022, published in the Gazette of India, Part II, Section 3,
Sub-section (ii) dated the 17th September, 2022, issued under Sub- section (1) of section 9 of the Coal Bearing
Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), the land
and all rights in or over the lands described in the Schedule appended to the said notification (hereinafter
referred to as the said land) vested absolutely in the Central Government free from all encumbrances under sub-
section (1) of section 10 of the said Act;
And, whereas, the Central Government is satisfied that the Mahanadi Coalfields Limited, P.O. Jagruti
Vihar, Burla, District Sambalpur-768020, Odisha (hereinafter referred to as the Government Company) is
willing to comply with such terms and conditions as the Central Government thinks fit to impose in this behalf;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 11 of the said Act, the
Central Government hereby directs that the said lands measuring 9.624 hectares (approximately) or 23.780 acres
(approximately) and all rights in or over the said lands so vested, shall with effect from 17th September, 2022
instead of continuing to so vest in the Central Government, shall vest in the Government Company, subject to
the following terms and conditions, namely :-
(1) the Government Company shall make all payments in respect of compensation, interest, damages, etc.,
and the like, as determined under the provisions of the said Act and other relevant laws;
(2) a Tribunal shall be constituted under section 14 of the said Act, for the purpose of determining the amounts
payable by the Government Company under conditions (1) and all expenditure incurred in connection with
any such Tribunal and persons appointed to assist the Tribunal shall be borne by the Government Company
and similarly, all expenditure incurred in respect of all legal proceedings like appeals, etc., for or in
connection with the rights, in or over the said lands, so vested, shall also be borne by the Government
Company;
(3) the Government Company shall indemnify the Central Government and its officials against any other
expenditure that may be necessary in connection with any proceedings by or against the Central
Government or its officials regarding the rights in or over the said lands so vested;
(4) the Government Company shall have no power to transfer the aforesaid rights in the said lands so vested
to any other persons without the prior approval of the Central Government; and
(5) the Government Company shall abide by such directions and conditions as may be given or imposed by the
Central Government for particular areas of the said lands, as and when necessary.
