के अिार ृर भारत जनवााचन अय ग ्ारा जनवााचनों का संचालन जनयम 1961 के जनयम 89 के ईृ जनयम (5) के ऄंतगात

जनवााचन व्यय प्रस्ट्तुत निीं करने के जलए िीजृका सुमन क कार िताओ न रटस सं. 76/ईत्तरप्रिेि-जव.स./

2022/सी.इ.एम.एस.-III, दिनांक 13.12.2022 जारी दकया गया ा; रर

यतः, जनवााचनों का संचालन जनयम 1961 के जनयम 89 के ईृ-जनयम (6) के ऄनुसार, दिनांक 13.12.2022 के

ईृयुाक्त कार िताओ न रटस के जररए िीजृका सुमन क जनिेि दिया गया ा दक वे आस न रटस के प्राप्त ि ने के 20 दिनों

के ऄंिर लेखा न प्रस्ट्तुत कर ृाने के कार ों क स्ट्ृट क करते ए ए जलजखत प ृ में ऄृना ऄभ्यावेिन प्रस्ट्तुत करें रर सा िी,

जव.स.सा.जन./2022 के जररए अय ग क सूचना िी गइ की ईक्त न रटस ऄभ्य ी ्ारा दिनांक 08.01.2023 क प्राप्त

दकया गया ा; रर,

यतः, जजला जनवााचन ऄजिकारी, िरि इ ्ारा दिनांक 28.02.2023 के ृ्र सं्‍या 89/जन.व्यय.लेखा/

जव.स.सा.जन./2022 के जररए प्रस्ट्तुत की गइ ऄनुृूरक संवीक्षेा ररृ टा में यि िताया गया िै दक िीजृका सुमन ने न त

क इ भी ऄभ्यावेिन रर न िी ऄृने जनवााचन व्यय का लेखा िाजखल दकया िै। आसके ऄजतररक्त ईन्िोंने भारत जनवााचन

अय ग का सम्यक् न रटस जमलने के ईृरांत ईक्त जवफलता के जलए न त क इ कार िताया िै रर न िी क इ स्ट्ृट कीकर

दिया िै; रर,

यतः, अय ग का यि समािान ि गया िै दक िीजृका सुमन जनवााचन खचों का लेखा िाजखल करने में जवफल रिे िैं

रर ईनके ृास आस जवफलता के जलए क इ भी ईजचतकार ऄ वा रजचत्य निीं िै; रर

यत:, ल क प्रजतजनजित्व ऄजिजनयम,1951 की िारा 10क में ऄनुिंजित दकया गया िै दक:-

"यदि जनवााचन अय ग का समािान ि जाता िै दक क इ व्यजक्त -

जनवााचन व्ययों का लेखा ईस समय के भीतर रर ईस रीजत में जैसी आस ऄजिजनयम के ्ारा या ऄिीन ऄृेजक्षेत िै,

िाजखल करने में ऄसफल रिा िै; त ा

ईस ऄसफलता के जलए क इ ऄच्छा कार या न्याय जचत्य निीं रखता िै, त जनवााचन अय ग िासकीय राजृ्र

में प्रकाजित अिेि ्ारा ईसक जनरर्हित घ जित करेगा रर ऐसा व्यजक्त ईस अिेि की तारीख से तीन विा की

कालावजि के जलए जनरर्हित ि गा;

ऄ वा संघ राज्य-क्षेे्र की जविान सभा ऄ वा जविान ृररिि् का सिस्ट्य चुने जाने ऄ वा ि ने के जलए जनरर्हित िै।

New Delhi, the 23rd March, 2023

O.N. 82.—WHEREAS, the General Election to 159-Bilgram Mallanwan Legislative Assembly of Uttar

Pradesh, 2022 was held vide Notification No. 68/61-2022 dated 27^th January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at

an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account

of his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 159-Bilgram Mallanwan Assembly Constituency

was declared by the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of

Election Expenses was 09^thApril, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Hardoi, Uttar Pradesh and

forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE-

LA/2022/Patra-01/2021, dated 27^th April, 2021, Deepika Suman, a contesting candidate of Uttar Pradesh from

159-Bilgram Mallanwan Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election

expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Hardoi, Uttar Pradesh and the Chief

Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 13.12.2022 was issued under

sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to

Deepika Suman for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 13.12.2022, Deepika Suman was directed to submit his representation in writing with

explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the

date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 08.01.2023. The acknowledgment receipt

has been submitted to the Commission by the District Election Officer, Hardoi, vide its letter

No. 89/नि.व्यय.लेखा/नि.स.सा.नि./2022; and,

WHEREAS, the District Election Officer, Hardoi in his Supplementary Report, vide its letter No.

89/नि.व्यय.लेखा/नि.स.सा.नि./2022 dated 28.02.2023 has reported that Deepika Suman has neither submitted any

representation nor any statement of account of election expenses. Further, after receipt of the due notice of the

Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Deepika Suman has failed to lodge the account of election

expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

ii.

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Deepika Suman resident of Village - Tejipur, Post – Mallanwan,

District- Hardoi a contesting candidate from 159-Bilgram Mallanwan Assembly Constituency of the State of Uttar

Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being

a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or

Union Territory for a period of three years from the date of this order.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

Kumar Verma for not lodging the account of Election Expenses; and,

O.N. 84.—WHEREAS, the General Election to 60- Garhmukteshwar Legislative Assembly of Uttar

Pradesh, 2022 was conducting Notification No. 28/61-2022 dated 14^th January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 60- Garhmukteshwar Assembly Constituency was

declared by the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of

Election Expenses was 09^thApril, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Hapur, Uttar Pradesh and forwarded

by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE-LA/2022/Patra-

01/2021, dated 27^th April, 2021, Shri Virendra Singh, a contesting candidate of Uttar Pradesh from

60- Garhmukteshwar Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses,

in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Hapur, Uttar Pradesh and the Chief

Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 18.11.2022 was issued under

sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to

Shri Virendra Singh for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 18.11.2022, Shri Virendra Singh was directed to submit his representation in writing

with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from

the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate’s brother Shri Dinesh Singh on 02.01.2023. The

acknowledgment receipt has been submitted to the Commission by the District Election Officer, Hapur, vide its letter

No. 58/29-28 (vsn2022).लेखा संवीक्षा रिपोर्ट-वव.स.सा.नि.-2022 dt. 01.02.2023; and,

WHEREAS, the District Election Officer, Hapur in his Supplementary Report, vide its letter 166/29-28

(vsn2022).लेखा संवीक्षा रिपोर्ट-वव.स.सा.नि.-2022 dt. 06.04.2023 has reported that Shri Virendra Singh has neither

submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice

of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Virendra Singh has failed to lodge the account of election

expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b)

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order”;

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Ajay Kashyap resident of Village- Biralsi, District-

Muzaffarnagar a contesting candidate from 12-Charthaval Assembly Constituency of the State of Uttar Pradesh in

the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member

of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 13-Purkaji(SC) Assembly Constituency was declared

by the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of Election

Expenses was 09^thApril, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Muzaffarnagar, Uttar Pradesh and

forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE-

LA/2022/Patra-01/2021, dated 27^th April, 2021, Shri Suneel Kumar, a contesting candidate of Uttar Pradesh from

13-Purkaji(SC) Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the

manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Muzaffarnagar, Uttar Pradesh and

the Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 21.10.2022 was

issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to

Shri Suneel Kumar for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 21.10.2022, Shri Suneel Kumar was directed to submit his representation in writing

with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from

the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 01.11.2022. The acknowledgment receipt has

been submitted to the Commission by the District Election Officer, Muzaffarnagar, vide its letter No. 1935/डी.ई.ओ.-

29- निवाटचि व्यय अिु./2022 dt. 26.12.2022; and,

WHEREAS, the District Election Officer, Muzaffarnagar in his Supplementary Report, vide its letter No.

1935(1)/डी.ई.ओ.-29- निवाटचि व्यय अिु./2022 dt. 26.12.2022 has reported that Shri Suneel Kumar has neither

submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice

of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Suneel Kumar has failed to lodge the account of election

expenses and has no good reason or justification for the failure,

O.N. 89.—WHEREAS, the General Election to 233- Baberu Legislative Assembly of Uttar Pradesh, 2022

was announced vide Notification No. 68/61-2022 dated 27^thJanuary, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 233- Baberu Assembly Constituency was declared by

the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of Election

Expenses was 09^thApril, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Banda, Uttar Pradesh and forwarded

by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/NirvachanVayy Cell/GE-LA/2022/Patra-

01/2021, dated 27^th April, 2021, Shri Jaypal, a contesting candidate of Uttar Pradesh from 233- Baberu Assembly

Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under

law; and,

WHEREAS, on the basis of the reports of the District Election Office,Banda,Uttar Pradeshand the Chief

Electoral Officer, Uttar Pradesh, a Show-Cause notice,76/UP-LA/2022/CEMS-III dated 11.11.2022 was issued under

sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Jaypal

for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 11.11.2022, Shri Jaypal was directed to submit his representation in writing with

explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the

date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 31.12.2022. The acknowledgment receipt has

been submitted to the Commission by the District Election Officer, Banda, vide its letter no. निवाटचि (वव.स.-नि.व्यय

लेखा)/2022 dt. 16.03.2023; and,

WHEREAS, the District Election Officer, Banda in his Supplementary Report, vide its letter No. निवाटचि

(वव.स.-नि.व्यय लेखा)/2022 dated 16.03.2023 has reported that Shri Jaypal has neither submitted any representation

nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission

of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Jaypal has failed to lodge the account of election expenses

and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

ii.

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Jaypal resident of Gram- Sersha, Po.- Sersha, Jila- Mathura, a

contesting candidate from 233- Baberu Assembly Constituency of the State of Uttar Pradesh in the General Election

to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the

Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three

years from the date of this order.

O.N. 92.—WHEREAS, the General Election to 23-Chandpur Legislative Assembly of Uttar Pradesh, 2022

was announced vide Notification No. 48/61-2022 dated 21^st January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 23-Chandpur Assembly Constituency was declared by

the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of Election

Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as

required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer, Bijnor, Uttar Pradesh and the Chief

Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 20.10.2022 was issued under

sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to

Shri Yasir Arafat for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 20.10.2022, Shri Yasir Arafat was directed to submit his representation in writing

with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from

the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 02.11.2022. The acknowledgment receipt has

been submitted to the Commission by the Deputy District Election Officer, Bijnor, vide its letter no. 1374/29-

WHEREAS, the District Election Officer, Bijnor in his Supplementary Report, vide its letter No. 295/29-

representation nor any statement of account of election expenses. Further, after receipt of the due notice of the

Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Yasir Arafat has failed to lodge the account of election

expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

O.N. 95.—WHEREAS, the General Election to 54-Muradnagar Legislative Assembly of Uttar Pradesh,

2022 was announce vide Notification No. 28/61-2022 dated 14^th January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 54-Muradnagar Assembly Constituency was declared

by the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of Election

Expenses was 09^thApril, 2022; and,

WHEREAS, as per the scrutiny report dated 12.04.2022 submitted by the District Election Officer,

Ghaziabad, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No.

287/Nirvachan Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27^th April, 2021, Shri Ayyuv Khan, a contesting

candidate of Uttar Pradesh from 54-Muradnagar Assembly Constituency of Uttar Pradesh, has failed to lodge

account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Ghaziabad, Uttar Pradesh and the

Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 20.10.2022 was issued

under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to

Shri Ayyuv Khan for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 20.10.2022, Shri Ayyuv Khan was directed to submit his representation in writing

with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from

the date of receipt of the notice; and,

WHEREAS, the said notice was received by Shri Suhel Khan the candidate on 22.12.2022. The

acknowledgment receipt has been submitted to the Commission by the Assistant District Election Officer,

Ghaziabad, vide its letter no. 101/29-वव.स.नि.-22/व्यय लेखा; and,

WHEREAS, the District Election Officer, Ghaziabad in his Supplementary Report, vide its letter No.

214/29-वव.स.नि.-22/व्यय लेखा dated 03.04.2023 has reported that Shri Ayyuv Khan has neither submitted any

representation nor any statement of account of election expenses. Further, after receipt of the due notice of the

Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Ayyuv Khan has failed to lodge the account of election

expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

ii.

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any

such person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Ayyuv Khan resident of 864, Adarsh Colony, Braj Vihar,

Muradnagar, Ghaziabad a contesting candidate from 54-Muradnagar Assembly Constituency of the State of Uttar

Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being

a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or

Union Territory for a period of three years from the date of this order.

concerned Returning Officer on 10^th March,2022. Hence, the last date for lodging the account of Election Expenses

Uttarpradesh and forwarded by the Joint Chief Electoral Officer, Uttarpradesh vide their letter No. 287/Nirvachan

Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27^th April, 2021, Shri Naresh a contesting candidate of Uttarpradesh

from 94-Bah Assembly Constituency of Uttarpradesh, has failed to lodge account of his election expenses, in the

manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer, Agra, Uttarpradesh and the Chief

Electoral Officer, Uttarpradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 19.12.2022 was issued under

sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Naresh

for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 19.12.2022, Shri Naresh was directed to submit his representation in writing with

explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the

date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 23.12.2022. The acknowledgment receipt has

been submitted to the Commission by the District Election Officer, Agra, vide its letter no. 2506/नि०का०; and,

WHEREAS, the District Election Officer, Agra in his Supplementary Report, vide its letter No. 2655/

नि०का० dated 17.03.2023 has reported that Shri Naresh has neither submitted any representation nor any statement of

account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has

furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Naresh has failed to lodge the account of election expenses

and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

ii.

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Naresh resident of Vill and Post – Naugawan, Bah, Agra a

contesting candidate from 94-Bah Assembly Constituency of the State of Uttarpradesh in the General Election to the

Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of either House of the

Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three

O.N. 99.—WHEREAS, the General Election to 88-Agra South Legislative Assembly of Uttarpradesh, 2022

was announced vide Notification No. 28/61-2022 dated 14^th January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 88-Agra South Assembly Constituency was declared by

WHEREAS, the said notice was received by the candidate on 02.01.2023. The acknowledgment receipt has

been submitted to the Commission by the District Election Officer, Agra, vide its letter no. 2506/नि०का०; and,

O.N. 102.—WHEREAS, the General Election to 392-Bhadohi Legislative Assembly of Uttarpradesh, 2022

was announced vide Notification No 99/61-2022 dated 10th February, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and

WHEREAS, the result of the said election along with 392-Bhadohi Assembly Constituency was declared by

the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of Election

Expenses was 09^thApril, 2022; and

WHEREAS, as per the report submitted by the District Election Officer, Bhadohi, Uttarpradesh and

forwarded by the Joint Chief Electoral Officer, Uttarpradesh vide their letter No. 287/Nirvachan Vayy Cell/GE-

LA/2022/Patra-01/2021, dated 27^th April, 2021, Shri Shyam Pal a contesting candidate of Uttarpradesh from 392-

Bhadohi Assembly Constituency of Uttarpradesh, has failed to lodge account of his election expenses, in the manner,

as required under law; and

WHEREAS, on the basis of the reports of the District Election Officer, Bhadohi, Uttarpradesh and the

Chief Electoral Officer, Uttarpradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 18.11.2022 was issued

under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri

Shyam Pal for not lodging the account of Election Expenses; and

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 18.11.2022, Shri Shyam Pal was directed to submit his representation in writing with

explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the

date of receipt of the notice; and

WHEREAS, the said notice was received by the candidate on 31.12.2022. The acknowledgment receipt has

been submitted to the Commission by the District Election Officer, Bhadohi, vide its letter no. 3097/Nirvachan-29-

37/2022, dated 24.01.2023;and

WHEREAS, the District Election Officer, Bhadohi, in his Supplementary Report, vide its letter

3170/Nirvachan-29-37/2022 dated 16.03.2023 has reported that Shri Shyam Pal has neither submitted any

representation nor any statement of account of election expenses. Further, after receipt of the due notice of the

Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and

WHEREAS, the Commission is satisfied that Shri Shyam Pal has failed to lodge the account of election

expenses and has no good reason or justification for the failure; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27^th April, 2021, Shri Rajendra Kumar, a contesting candidate of

Uttar Pradesh from 197- Tirwa Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election

expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Kannauj, Uttar Pradesh and the Chief

Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 29.11.2022 was issued under

sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to

Shri Rajendra Kumar for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 29.11.2022, Shri Rajendra Kumar was directed to submit his representation in

writing with explaining the reasons for not lodging the account and to lodge account of election expenses within

20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 05.01.2023. The acknowledgment receipt has

been submitted to the Commission by the District Election Officer, Kannauj, vide its letter no. 46/29- निवाट0

WHEREAS, the District Election Officer, Kannauj in his Supplementary Report, vide its letter 91/29-

निवाट0 (निवाटचि व्यय- वव० स०-2022)).लेखा संवीक्षा रिपोर्ट-वव.स.सा.नि.-2022 dt. 14.03.2023 has reported that

Shri Rajendra Kumar has neither submitted any representation nor any statement of account of election expenses.

Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor

explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Rajendra Kumar has failed to lodge the account of

election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

a) has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order”;

Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 29.11.2022 was issued under

sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri Ankit

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 29.11.2022, Shri Ankit Kumar Pal was directed to submit his representation in

writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20

days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 26.12.2022. The acknowledgment receipt has

been submitted to the Commission by the District Election Officer, Kannauj, vide its letter no. 46/29- निवाट0

(निवाटचि व्यय- वव० स०-2022).लेखा संवीक्षा रिपोर्ट-वव.स.सा.नि.-2022 dt. 31.01.2023; and,

WHEREAS, the District Election Officer, Kannauj in his Supplementary Report, vide its letter 91/29-

निवाट0 (निवाटचि व्यय- वव० स०-2022)).लेखा संवीक्षा रिपोर्ट-वव.स.सा.नि.-2022 dt. 14.03.2023 has reported that Shri Ankit

Kumar Pal has neither submitted any representation nor any statement of account of election expenses. Further, after

receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for

the said failure; and,

WHEREAS, the Commission is satisfied that Shri Ankit Kumar Pal has failed to lodge the account of

election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such

person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Ankit Kumar Pal resident of Gram- Chooki Mustafabad,Post-

Makrand Nagar, Janpad,Kannauj(U.P.)209726, a contesting candidate from 196- Chhibramau Assembly

Constituency of the State of Uttar Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified

for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the

Legislative Council of a State or Union Territory for a period of three years from the date of this order.

O.N. 108.—WHEREAS, the General Election to 196- Chhibramau Legislative Assembly of Uttar Pradesh,

2022 was conducting Notification No. 60/61-2022 dated 25^th January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 196- Chhibramau Assembly Constituency was

declared by the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of

Election Expenses was 09^thApril, 2022; and,

WHEREAS, as per the scrutiny report dt. 10.042022 submitted by the District Election Officer, Kannauj,

Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan

Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27^th April, 2021, Dr. Chandra Kant Yadav, a contesting candidate of

Uttar Pradesh from 196- Chhibramau Assembly Constituency of Uttar Pradesh, has failed to lodge account of his

election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Kannauj, Uttar Pradesh and the

Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 29.11.2022 was issued

under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to

Dr. Chandra Kant Yadav for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 29.11.2022, Dr. Chandra Kant Yadav was directed to submit his representation in

writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20

days from the date of receipt of the notice; and,

WHEREAS, the said notice was pasted at the address given by the candidate on 05.01.2023. The

acknowledgment receipt has been submitted to the Commission by the District Election Officer, Kannauj, vide its
